S.F. 2368 DIVISION I 1 FUNDING FORMULA 2 Section 1. Section 256E.8, subsection 2, paragraph a, Code 3 2024, is amended to read as follows: 4 a. The charter school in which the student is enrolled shall 5 receive under paragraph “c” an amount equal to the sum of the 6 regular program state cost per pupil for the previous school 7 budget year plus the teacher leadership supplement state cost 8 per pupil , the professional development supplement state cost 9 per pupil, and the early intervention supplement state cost 10 per pupil for the previous fiscal budget year as provided in 11 section 257.9 plus any moneys received by that would be due to 12 the school district of residence for the student as a result 13 of the non-English speaking weighting under section 280.4, 14 subsection 3 , for the previous school budget year multiplied 15 by the state cost per pupil for the previous budget year. 16 If a student is an eligible pupil under section 261E.6 , the 17 charter school shall pay the tuition reimbursement amount to 18 an eligible postsecondary institution as provided in section 19 261E.7 . 20 Sec. 2. Section 282.18, subsection 5, paragraph b, 21 subparagraph (1), Code 2024, is amended to read as follows: 22 (1) The board of directors of the district of residence 23 shall pay to the receiving district the sum of the state cost 24 per pupil for the previous school budget year plus either 25 the teacher leadership supplement state cost per pupil , the 26 professional development supplement state cost per pupil, and 27 the early intervention supplement state cost per pupil for 28 the previous fiscal budget year as provided in section 257.9 29 or the teacher leadership supplement foundation aid for the 30 previous fiscal year as provided in section 284.13, subsection 31 1 , paragraph “d” , if both the district of residence and the 32 receiving district are receiving such supplements , plus any 33 moneys received that would be due to the school district of 34 residence for the pupil as a result of the non-English speaking 35 -1- SF 2368 (2) 90 jda/jh/mb 1/ 3
S.F. 2368 weighting under section 280.4, subsection 3 , for the previous 1 school budget year multiplied by the state cost per pupil for 2 the previous budget year. If the pupil participating in open 3 enrollment is also an eligible pupil under section 261E.6 , the 4 receiving district shall pay the tuition reimbursement amount 5 to an eligible postsecondary institution as provided in section 6 261E.7 . 7 DIVISION II 8 SCHOOL DISTRICT PROPERTY 9 Sec. 3. Section 278.1, subsection 1, paragraph b, Code 2024, 10 is amended to read as follows: 11 b. Except when restricted by section 297.24 or 297.25 , 12 direct the sale, lease, or other disposition of any schoolhouse 13 or school site or other property belonging to the corporation, 14 and the application to be made of the proceeds thereof. 15 However, nothing in this section shall not be construed 16 to prevent the sale, lease, exchange, gift, or grant and 17 acceptance of any interest in real or other property of the 18 corporation to the extent authorized in section 297.22 or 19 297.24 . 20 Sec. 4. NEW SECTION . 297.23 Publication of information 21 related to real property. 22 The board of directors of a school district shall publish 23 information related to all of the following on the school 24 district’s internet site: 25 1. The square footage of each school building owned by the 26 school district. 27 2. The enrollment capacity of each attendance center owned 28 by the school district. 29 3. How each school building owned by the school district is 30 currently utilized by the school district. 31 4. School buildings owned by the school district that are 32 vacant. 33 Sec. 5. NEW SECTION . 297.24 Sale of real property to other 34 educational institutions. 35 -2- SF 2368 (2) 90 jda/jh/mb 2/ 3
S.F. 2368 1. The board of directors of a school district shall not 1 enter into any agreement that prohibits the sale of real 2 property to an educational institution. 3 2. If the board of directors of a school district offers 4 to sell real property that contains a building or structure, 5 and an educational institution offers to purchase such real 6 property for a purchase price that represents the highest bid 7 the board of directors of the school district received for 8 the real property, then the board of directors of the school 9 district shall sell the real property to the educational 10 institution for such purchase price. 11 3. For purposes of this section, “educational institution” 12 means all of the following: 13 a. A school district. 14 b. A nonpublic school. 15 c. A charter school established pursuant to chapter 256E. 16 d. A charter school or innovation zone school established 17 pursuant to chapter 256F. 18 e. An institution of higher education under the control of 19 the state board of regents. 20 f. A community college established under chapter 260C. 21 g. The state training school established under chapter 233A. 22 h. An accredited private institution as defined in section 23 256.183. 24 Sec. 6. IMPLEMENTATION OF ACT.
