Section
1.
Section
400.8,
subsection
2,
Code
2024,
is
1
amended
to
read
as
follows:
2
2.
a.
The
commission
shall
establish
the
guidelines
for
3
conducting
the
examinations
under
subsection
1
of
this
section
.
4
The
commission
shall
hire
persons
with
expertise
to
prepare
5
and
administer
the
examinations
approved
by
the
commission.
6
It
may
also
hire
persons
with
expertise
to
consult
in
the
7
preparation
of
such
examinations
if
the
persons
so
hired
are
8
employed
to
aid
personnel
of
the
commission
in
assuring
that
9
a
fair
examination
is
conducted.
A
fair
examination
shall
10
explore
the
competence
of
the
applicant
in
the
particular
field
11
of
examination.

b.
An
applicant
who
has
successfully
completed
training
at
13
the
Iowa
law
enforcement
academy
or
another
training
facility
14
certified
by
the
director
of
the
Iowa
law
enforcement
academy
15
does
not
need
to
retake
a
civil
service
examination
upon
16
changing
employment
from
one
Iowa
law
enforcement
agency
to
17
another
Iowa
law
enforcement
agency,
or
upon
becoming
employed
18
by
more
than
one
Iowa
law
enforcement
agency
simultaneously,
if
19
the
applicant
has
previously
passed
a
civil
service
examination
20
when
the
applicant
was
initially
hired
as
a
certified
peace
21
officer
and
if,
without
a
break
of
not
more
than
one
hundred
22
eighty
days
from
prior
law
enforcement
service,
the
applicant
23
is
hired
by
another
Iowa
law
enforcement
agency.
However,
24
the
applicant
shall
complete
and
pass
the
applicable
physical
25
examination
provided
in
subsection
1
prior
to
beginning
the
new
26
employment.

Sec.
2.
NEW
SECTION
.
400.12A
Hiring
practices
——
suspension
28
——
reinstatement.
29
1.
A
city
council,
by
majority
vote,
may
suspend
the
30
practices
specified
in
subsection
2
that
are
generally
required
31
pursuant
to
this
chapter
for
the
hiring
of
an
employee
of
a
32
department
governed
by
civil
service.
A
suspension
shall
not
33
be
in
effect
for
more
than
one
year,
but
a
city
council
may
34
immediately
vote
to
implement
a
new
suspension
of
the
required
35

practices
upon
the
expiration
of
the
prior
suspension.
Upon
1
the
expiration
of
a
suspension,
hiring
practices
required
under
2
this
chapter
shall
be
immediately
reinstated
for
the
applicable
3
positions.
A
city
council,
by
majority
vote,
may
reinstate
4
hiring
practices
suspended
pursuant
to
this
section
prior
to
5
the
expiration
of
the
suspension.
A
subsequent
vote
to
suspend
6
required
hiring
practices,
even
if
the
vote
occurs
prior
to
7
the
original
expiration
date
of
the
prior
suspension,
shall
be
8
considered
a
vote
for
a
new
suspension.

2.
The
provisions
of
section
400.11,
subsection
1,
10
paragraph
“a”
may
be
suspended
as
provided
in
subsection
1.
11
3.
a.
This
section
does
not
relieve
an
employee
of
a
12
department
governed
by
civil
service
from
the
requirements
to
13
complete
all
examinations
and
tests
applicable
to
those
persons
14
for
positions
subject
to
the
provisions
of
this
chapter.
15
b.
This
section
shall
not
be
construed
to
preclude
an
16
employee
of
a
department
governed
by
civil
service
from
17
accessing
rights,
benefits,
or
privileges
provided
outside
of
18
this
chapter.
