H.F. 2600 Section 1. Section 124.401, subsection 1, Code 2024, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . j. A person who causes the death of another 3 person or who causes serious bodily injury to another person as 4 described in paragraphs “g” and “h” may be charged criminally 5 in either the county where the controlled substance violation 6 occurred or in the county where the death or serious bodily 7 injury occurred. Notwithstanding section 803.3, subsection 8 1, if two prosecuting agencies are seeking to file criminal 9 charges, the agency in the county where the controlled 10 substance violation occurred shall have the primary right to 11 proceed with prosecution of the offender. 12 -1- HF 2600 (3) 90 as/js/md 1/ 1
