H.F. 2310 Section 1. Section 716.8, subsection 5, Code 2024, is 1 amended to read as follows: 2 5. A person who commits a trespass while hunting deer , 3 other than hunting a farm deer as defined in section 170.1 or 4 preserve whitetail as defined in section 484C.1 , commits a 5 simple misdemeanor punishable as a scheduled violation under 6 section 805.8C, subsection 12 . A peace officer shall consider 7 arresting and may arrest the person under section 805.9, 8 subsection 3 , paragraph “c” , if the person refuses to leave 9 the property after receiving a citation or immediately returns 10 to the property after receiving a citation, or may arrest the 11 person as otherwise provided under law. The person shall also 12 be subject to civil penalties as provided in sections 481A.130 13 and 481A.131 . A deer Any wildlife taken by a person while 14 committing such a trespass shall be subject to seizure as 15 provided in section 481A.12 . 16 Sec. 2. Section 805.8C, subsection 12, Code 2024, is amended 17 to read as follows: 18 12. Trespassing violations. For trespasses punishable under 19 section 716.8, subsection 1 or 5 , the scheduled fine is two 20 hundred sixty five hundred dollars for a first violation, six 21 hundred forty-five one thousand dollars for a second violation, 22 and one thousand two hundred eighty-five five hundred dollars 23 for a third or subsequent violation. 24 -1- HF 2310 (2) 90 as/js/md 1/ 1
