Act
relating
to
online
learning
and
continuous
remote

and
allowing
certain
school
districts
or

accredited
nonpublic
schools
to
deliver
coursework
using
an

learning
platform
for

to
five
school
days
when

inclement
weather
or
other
unanticipated
circumstance
causes

schools
to
temporarily
close.

Section
1.
Section
279.10,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:
2
NEW
SUBSECTION
.
4.
a.
Except
as
otherwise
provided
in
3
this
subsection
or
in
accordance
with
a
proclamation
of
public
4
health
disaster
emergency
issued
by
the
governor
pursuant
to
5
section
29C.6,
a
school
district
or
accredited
nonpublic
school
6
shall
not
offer
online
learning
as
defined
in
section
256.2
7
or
continuous
remote
learning
unless
the
school
district
or
8
accredited
nonpublic
school
meets
the
requirements
of
section
9
256.7,
subsection
32,
or
section
256.11,
subsection
17,
as
10
appropriate.
11
b.
A
school
district
or
accredited
nonpublic
school
may,
12
for
up
to
five
school
days
when
inclement
weather
or
other
13
unanticipated
circumstance
causes
the
school
district
or
14
accredited
nonpublic
school
to
temporarily
close
school
during
15
the
regular
school
calendar,
deliver
the
regular
school
day
16
coursework
using
an
online
learning
platform
that
meets
the
17
requirements
of
section
256.7,
subsection
32,
or
section
18
256.11,
subsection
17,
as
appropriate.

c.
The
limitation
on
the
number
of
school
days
specified
in
20
paragraph
“b”
does
not
apply
to
a
school
district
that
provides
21
educational
instruction
and
course
content
primarily
over
the
22
internet
in
accordance
with
section
256.7,
subsection
32,
23
paragraph
“c”
,
Code
2016,
or
section
256.9,
subsection
55.
24
d.
Unless
otherwise
required
by
a
state
or
federal
law
25
related
to
students
with
disabilities,
or
in
accordance
with
26
a
proclamation
of
public
health
disaster
emergency
issued
by
27
the
governor
pursuant
to
section
29C.6,
this
subsection
shall
28
not
be
construed
to
require
a
school
district
or
accredited
29
nonpublic
school
to
offer
continuous
remote
learning,
to
30
maintain
a
program
of
continuous
remote
learning,
to
deliver
31
instruction
primarily
over
the
internet,
to
continue
delivering
32
instruction
primarily
over
the
internet,
or
to
become
or
remain
33
an
approved
provider
of
online
learning.
