S.F. 231 Section 1. Section 321.194, subsection 2, paragraph a, 1 unnumbered paragraph 1, Code 2021, is amended to read as 2 follows: 3 The driver’s license entitles the licensee, while having the 4 license in immediate possession, to operate a motor vehicle, 5 other than a commercial motor vehicle , a motor vehicle with 6 more than two axles, a motor vehicle towing another vehicle, or 7 as a chauffeur, during the times and for the purposes set forth 8 in this paragraph. 9 Sec. 2. Section 321.194, subsection 2, paragraph a, Code 10 2021, is amended by adding the following new subparagraph: 11 NEW SUBPARAGRAPH . (03) If the licensee resides on a farm 12 or is employed for compensation on a farm in this state, 13 the licensee may operate a motor vehicle during the hours 14 of 5:00 a.m. to 10:00 p.m. for the purpose of assisting the 15 person’s parents, guardians, or employers with farm work or in 16 connection with any farm job, employment, or other farm-related 17 work, including traveling to or from the location of the farm 18 work, provided the licensee operates the vehicle over the most 19 direct and accessible route between the point of origin and 20 the destination and the driving distance between the point of 21 origin and the destination is no more than fifty miles. 22 Sec. 3. Section 321.194, subsection 2, paragraph a, 23 subparagraph (3), Code 2021, is amended to read as follows: 24 (3) To a service station for the purpose of refueling, so 25 long as the service station is the station closest to the route 26 on which the licensee is traveling under subparagraph (1) , or 27 (2) , or (03) . 28 Sec. 4. Section 321.194, subsection 3, paragraph b, Code 29 2021, is amended to read as follows: 30 b. Upon receipt of a statement of necessity, the department 31 shall issue the driver’s license provided the applicant is 32 otherwise eligible for issuance of the license. The fact that 33 the applicant resides at a distance less than one mile from the 34 applicant’s school of enrollment is prima facie evidence of 35 -1- SF 231 (2) 89 th/ns/mb 1/ 2
S.F. 231 the nonexistence of necessity for the issuance of a license. 1 However, the distance between the applicant’s residence and 2 school of enrollment shall not be considered if the applicant 3 resides on a farm or is employed for compensation on a farm. 4 -2- SF 231 (2) 89 th/ns/mb 2/ 2
