1.
Section
26.7,
subsection
1,
paragraph
a,
Code

is
amended
to
read
as
follows:

time
,
and
place
,
and
manner
for
filing
sealed

Section
26.7,
Code
2022,
is
amended
by
adding
the

following
new
subsection:

SUBSECTION
.
1A.
The
notice
to
bidders
may
provide
that
7
bids
may
be
received
in
an
electronic
format
as
determined
by
8
the
governmental
entity.

Sec.
3.
Section
26.10,
subsection
1,
Code
2022,
is
amended
10
to
read
as
follows:

1.
The
date
and
time
that
each
bid
is
received
by
the
12
governmental
entity,
together
with
the
name
of
the
person
13
receiving
the
bid,
shall
be
recorded
on
the
envelope
containing
14
the
bid.
If
bids
are
received
in
an
electronic
format
as
15
provided
in
section
26.7,
the
governmental
entity
shall
16
electronically
record
the
date
and
time
each
bid
is
received.
17
All
bids
received
after
the
deadlines
for
submission
of
18
bids
as
stated
in
the
project
specifications
shall
not
be
19
considered
and
shall
be
returned
to
the
late
bidder
unopened.

The
governmental
entity
shall
open,
announce
the
amount
of
21
the
bids,
and
file
all
proposals
received,
at
the
time
and
22
place
specified
in
the
notice
to
bidders.
The
governmental
23
entity
may,
by
resolution,
award
the
contract
for
the
public
24
improvement
to
the
bidder
submitting
the
lowest
responsive,
25
responsible
bid,
determined
as
provided
in
section
26.9
,
or
26
the
governmental
entity
may
reject
all
bids
received,
fix
a
27
new
date
for
receiving
bids,
and
order
publication
of
a
new
28
notice
to
bidders.
The
governmental
entity
shall
retain
the
29
bid
security
furnished
by
the
successful
bidder
until
the
30
approved
contract
form
has
been
executed,
a
bond
has
been
filed
31
by
the
bidder
guaranteeing
the
performance
of
the
contract,
and
32
the
contract
and
bond
have
been
approved
by
the
governmental
33
entity.
The
provisions
of
chapter
573
,
where
applicable,
apply
34
to
contracts
awarded
under
this
chapter
.
