CHIROPRACTIC LOAN FUNDS. Notwithstanding section 4 261.72, the moneys deposited in the chiropractic loan revolving 5 fund created pursuant to section 261.72, for the fiscal year 6 beginning July 1, 2021, and ending June 30, 2022, may be used 7 for purposes of the chiropractic loan forgiveness program 8 established in section 261.73. 9 Sec. 4. WORK-STUDY APPROPRIATION. Notwithstanding section 10 261.85, for the fiscal year beginning July 1, 2021, and ending 11 June 30, 2022, the amount appropriated from the general fund 12 of the state to the college student aid commission for the 13 work-study program under section 261.85 shall be zero. 14 Sec. 5. TRANSFERS TO FUTURE READY IOWA SKILLED WORKFORCE 15 LAST-DOLLAR SCHOLARSHIP FUND. 16 1. Notwithstanding section 261.132, subsection 5, there is 17 transferred from the future ready Iowa skilled workforce grant 18 fund created pursuant to section 261.132, subsection 5, to the 19 future ready Iowa skilled workforce last-dollar scholarship 20 fund created pursuant to section 261.131, subsection 5, any 21 moneys remaining unencumbered and unobligated on the effective 22 date of this Act. 23 2. From the moneys appropriated from the Iowa skilled worker 24 and job creation fund created in section 8.75 to the college 25 student aid commission for the fiscal year beginning July 1, 26 2020, and ending June 30, 2021, for purposes of providing 27 skilled workforce shortage tuition grants, in accordance with 28 section 261.130, pursuant to 2020 Iowa Acts, chapter 1019, 29 section 7, $400,000 is transferred to the future ready Iowa 30 skilled workforce last-dollar scholarship fund created pursuant 31 to section 261.131. 32 DEPARTMENT OF EDUCATION 33 Sec. 6. From the moneys deposited in the school ready children 8 grants account for the fiscal year beginning July 1, 2021, and 9 ending June 30, 2022, not more than $265,950 is allocated for 10 the early childhood Iowa office and other technical assistance 11 activities. Moneys allocated under this lettered paragraph 12 may be used by the early childhood Iowa state board for the 13 purpose of skills development and support for ongoing training 14 of staff. However, except as otherwise provided in this 15 subsection, moneys shall not be used for additional staff or 16 for the reimbursement of staff. 17 b. Of the amount appropriated in this subsection for 18 deposit in the school ready children grants account of the 19 early childhood Iowa fund, $2,318,018 shall be used for efforts 20 to improve the quality of early care, health, and education 21 programs. Moneys allocated pursuant to this paragraph may be 22 used for additional staff and for the reimbursement of staff. 23 The early childhood Iowa state board may reserve a portion 24 of the allocation, not to exceed $88,650, for the technical 25 assistance expenses of the early childhood Iowa state office, 26 including the reimbursement of staff, and shall distribute 27 the remainder to early childhood Iowa areas for local quality 28 improvement efforts through a methodology identified by the 29 early childhood Iowa state board to make the most productive 30 use of the funding, which may include use of the distribution 31 formula, grants, or other means. 32 c. Of the amount appropriated in this subsection for 33 deposit in the school ready children grants account of 34 the early childhood Iowa fund, $825,030 shall be used for 35 -6- HF 868 (2) 89 kh/tm/md 6/ 37
H.F. 868 support of professional development and training activities 1 for persons working in early care, health, and education by 2 the early childhood Iowa state board in collaboration with 3 the professional development component groups maintained by 4 the early childhood Iowa stakeholders alliance pursuant to 5 section 256I.12, subsection 7, paragraph “b”, and the early 6 childhood Iowa area boards. Expenditures shall be limited to 7 professional development and training activities agreed upon by 8 the parties participating in the collaboration. 9 9. BIRTH TO AGE THREE SERVICES 10 a. For expansion of the federal Individuals with 11 Disabilities Education Improvement Act of 2004, Pub. L. The moneys appropriated in this subsection shall be 25 used for implementation and expansion of early head start 26 pilot projects addressing the comprehensive cognitive, social, 27 emotional, and developmental needs of children from birth to 28 age three, including prenatal support for qualified families. 29 The projects shall promote healthy prenatal outcomes and 30 healthy family functioning, and strengthen the development of 31 infants and toddlers in low-income families. Priority shall be 32 given to those organizations that have previously qualified for 33 and received state funding to administer an early head start 34 project. 35 -7- HF 868 (2) 89 kh/tm/md 7/ 37

EARLY WARNING SYSTEM FOR LITERACY 4 For purposes of purchasing a statewide license for an early 5 warning assessment and administering the early warning system 6 for literacy established in accordance with section 279.68 and 7 rules adopted in accordance with section 256.7, subsection 31: 8 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,915,000 9 The department shall administer and distribute to school 10 districts and accredited nonpublic schools the early warning 11 assessment system that allows teachers to screen and monitor 12 student literacy skills from prekindergarten through grade 13 six. The department may charge school districts and accredited 14 nonpublic schools a fee for the system not to exceed the actual 15 costs to purchase a statewide license for the early warning 16 assessment minus the moneys received by the department under 17 this subsection. The fee shall be determined by dividing the 18 actual remaining costs to purchase the statewide license for 19 the school year by the number of pupils assessed under the 20 system in the current fiscal year. School districts may use 21 moneys received pursuant to section 257.10, subsection 11, and 22 moneys received for purposes of implementing section 279.68, 23 subsection 2, to pay the early warning assessment system fee. 24 21. IOWA READING RESEARCH CENTER 25 a. For purposes of the Iowa reading research center in 26 order to implement, in collaboration with the area education 27 agencies, the provisions of section 256.9, subsection 49, 28 paragraph “c”: 29 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,550,176 30 b. From moneys appropriated in this subsection, not more 31 than $250,000 shall be used for collaborations with the state 32 board of education relating to the approval of practitioner 33 preparation programs pursuant to section 256.7, subsection 3, 34 paragraph “c”, and with the board of educational examiners for 35 -10- HF 868 (2) 89 kh/tm/md 10/ 37

Notwithstanding section 8.33, moneys received by the 8 department pursuant to this subsection that remain unencumbered 9 or unobligated at the close of the fiscal year shall not revert 10 but shall remain available for expenditure for the purposes 11 specified in this subsection for the following fiscal year. 12 22. Section 261.87, subsection 1, paragraph d, 3 subparagraphs (1), (2), (3), and (4), Code 2021, are amended 4 to read as follows: 5 (1) Is the child or stepchild of a peace officer, as 6 defined in section 97A.1 , who was killed in the line of duty 7 as determined by the board of trustees of the Iowa department 8 of public safety peace officers’ retirement, accident, and 9 disability system in accordance with section 97A.6, subsection 10 16 . 11 (2) Is the child or stepchild of a police officer or a fire 12 fighter, as each is defined in section 411.1 , who was killed in 13 the line of duty as determined by the statewide fire and police 14 retirement system in accordance with section 411.6, subsection 15 15 . 16 (3) Is the child or stepchild of a sheriff or deputy sheriff 17 as each is defined in section 97B.49C , who was killed in 18 the line of duty as determined by the Iowa public employees’ 19 retirement system in accordance with section 97B.52, subsection 20 2 . 21 (4) Is the child or stepchild of a fire fighter or police 22 officer included under section 97B.49B , who was killed in 23 the line of duty as determined by the Iowa public employees’ 24 retirement system in accordance with section 97B.52, subsection 25 2 . 26 Sec. 15. Section 261.87, subsection 1, paragraph d, Code 27 2021, is amended by adding the following new subparagraph: 28 NEW SUBPARAGRAPH . (5) Is the child or stepchild of an 29 employee of the Iowa department of corrections, or of a 30 judicial district department of correctional services, who was 31 killed in the line of duty. 32 Sec. 16. Section 261.87, subsection 1, Code 2021, is amended 33 by adding the following new paragraph: 34 NEW PARAGRAPH . i. “Stepchild” means the same as defined in 35 -22- HF 868 (2) 89 kh/tm/md 22/ 37
H.F. 868 section 450.l. 1 Sec. 17. Section 261.132, Code 2021, is amended by adding 2 the following new subsection: 3 NEW SUBSECTION . 6. New awards prohibited. For the fiscal 4 year beginning July 1, 2021, and each succeeding fiscal year, 5 the commission shall not award a future ready Iowa skilled 6 workforce grant to any new applicant, but may award a future 7 ready Iowa skilled workforce grant to an applicant who received 8 a grant awarded under the program in the fiscal year beginning 9 July 1, 2020, and who continues to meet the eligibility 10 requirements of this section. 11 Sec. 18. Section 284.13, subsection 1, paragraphs a, b, c, 12 e, f, and g, Code 2021, are amended to read as follows: 13 a. For the fiscal year beginning July 1, 2019 2021 , and 14 ending June 30, 2020 2022 , to the department, the amount of 15 five hundred eight thousand two hundred fifty dollars for the 16 issuance of national board certification awards in accordance 17 with section 256.44 . Of the amount allocated under this 18 paragraph, not less than eighty-five thousand dollars shall 19 be used to administer the ambassador to education position in 20 accordance with section 256.45 . 21 b. For the fiscal year beginning July 1, 2019 2021 , and 22 ending June 30, 2020 2022 , up to seven hundred twenty-eight 23 thousand two hundred sixteen dollars to the department for 24 purposes of implementing the professional development program 25 requirements of section 284.6 , assistance in developing model 26 evidence for teacher quality committees established pursuant to 27 section 284.4, subsection 1 , paragraph “b” , and the evaluator 28 training program in section 284.10 . A portion of the funds 29 allocated to the department for purposes of this paragraph may 30 be used by the department for administrative purposes and for 31 not more than four full-time equivalent positions. 32 c. For the fiscal year beginning July 1, 2019 2021 , 33 and ending June 30, 2020 2022 , an amount up to one million 34 seventy-seven thousand eight hundred ten dollars to the 35 -23- HF 868 (2) 89 kh/tm/md 23/ 37
H.F. 868 department for the establishment of teacher development 1 academies in accordance with section 284.6, subsection 10 . A 2 portion of the funds allocated to the department for purposes 3 of this paragraph may be used for administrative purposes. 4 e. For the fiscal year beginning July 1, 2019 2021 , and 5 ending June 30, 2020 2022 , to the department an amount up to 6 twenty-five thousand dollars for purposes of the fine arts 7 beginning teacher mentoring program established under section 8 256.34 . 9 f. For the fiscal year beginning July 1, 2019 2021 , and 10 ending June 30, 2020 2022 , to the department an amount up 11 to six hundred twenty-six thousand one hundred ninety-one 12 dollars shall be used by the department for a delivery system, 13 in collaboration with area education agencies, to assist in 14 implementing the career paths and leadership roles considered 15 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 16 not limited to planning grants to school districts and area 17 education agencies, technical assistance for the department, 18 technical assistance for districts and area education agencies, 19 training and staff development, and the contracting of external 20 expertise and services. In using moneys allocated for purposes 21 of this paragraph, the department shall give priority to school 22 districts with certified enrollments of fewer than six hundred 23 students. A portion of the moneys allocated annually to the 24 department for purposes of this paragraph may be used by the 25 department for administrative purposes and for not more than 26 five full-time equivalent positions. 27 g. For the fiscal year beginning July 1, 2020 2022 , and 28 for each subsequent fiscal year, to the department, ten 29 million dollars for purposes of implementing the supplemental 30 assistance for high-need schools provisions of section 284.11 . 31 Annually, of the moneys allocated to the department for 32 purposes of this paragraph, up to one hundred thousand dollars 33 may be used by the department for administrative purposes and 34 for not more than one full-time equivalent position. 35 -24- HF 868 (2) 89 kh/tm/md 24/ 37
H.F. 868 Sec. 19. INTERIM STUDY COMMITTEE —— REGENTS UNIVERSITIES. 1 1. The legislative council is requested to establish an 2 interim study committee to examine the administrative costs, 3 staffing levels, and allocation of staff at the institutions of 4 higher learning governed by the state board of regents, as well 5 as the graduation and student retention rates for each academic 6 program at each such institution of higher learning. 7 2. The interim study committee shall submit a report, 8 including findings and recommendations, to the general assembly 9 by December 15, 2021, for the 2022 legislative session. 10 Sec. 20. EFFECTIVE DATES. The following, being deemed of 11 immediate importance, take effect upon enactment: 12 1. The section of this division of this Act transferring 13 moneys to the future ready Iowa skilled workforce last-dollar 14 scholarship fund established pursuant to section 261.131. 15 2. The section of this division of this Act amending 2019 16 Iowa Acts, chapter 135, section 5, subsection 27, as amended by 17 2020 Iowa Acts, chapter 1121, section 76, subsection 27. 18 Sec. 21. RETROACTIVE APPLICABILITY. The following apply 19 retroactively to July 1, 2020: 20 1. The section of this division of this Act enacting section 21 261.87, subsection 1, paragraph “d”, subparagraph (5). 22 2. The section of this division of this Act enacting section 23 261.87, subsection 1, paragraph “i” . 24 3. The section of this division of this Act transferring 25 moneys to the future ready Iowa skilled workforce last-dollar 26 scholarship fund established pursuant to section 261.131. 27 DIVISION II 28 WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS FY 2021-2022 29 Sec. 22. The department shall establish an 28 application process and criteria to award grants pursuant to 29 this subparagraph to community colleges. The criteria shall be 30 based on need for instruction in English as a second language 31 in the region served by each community college as determined by 32 factors including data from the latest federal decennial census 33 and outreach efforts to determine regional needs. 34 (4) From the moneys appropriated in this lettered paragraph 35 -26- HF 868 (2) 89 kh/tm/md 26/ 37
H.F. 868 “b”, $210,000 shall be transferred to the department of human 1 services for purposes of administering a program to provide 2 access to international resources to Iowans and new Iowans 3 to provide economic and leadership development resulting in 4 Iowa being a more inclusive and welcoming place to live, work, 5 and raise a family. The program shall provide supplemental 6 support services for international refugees to improve 7 learning, English literacy, life skills, cultural competencies, 8 and integration in a county with a population over 350,000 9 as determined by the 2010 federal decennial census. The 10 department of human services shall utilize a request for 11 proposals process to identify the entity best qualified to 12 implement the program. 13 c. For support costs associated with administering a 8 workforce preparation outcome reporting system for the purpose 9 of collecting and reporting data relating to the educational 10 and employment outcomes of workforce preparation programs 11 receiving moneys pursuant to this subsection: 12 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 13 3. Notwithstanding section 8.33, moneys appropriated 14 in this section of this division of this Act that remain 15 unencumbered or unobligated at the close of the fiscal year 16 shall not revert but shall remain available for expenditure 17 for the purposes designated until the close of the succeeding 18 fiscal year. 19 DIVISION III 20 ACCOUNTABILITY AND ADMINISTRATIVE MEASURES —— FEES 21 Sec. 23. Section 256.9, Code 2021, is amended by adding the 22 following new subsection: 23 NEW SUBSECTION . 63. Develop and make available on the 24 department’s internet site general guidance for parents, 25 guardians, and community members who have concerns about school 26 districts or their governing boards. 27 Sec. 24. Section 256.11, subsections 10 and 11, Code 2021, 28 are amended by striking the subsections and inserting in lieu 29 thereof the following: 30 10. The state board shall establish, and the department 31 shall use, for the school year commencing July 1, 2021, and 32 each succeeding school year, an accreditation, monitoring, 33 and enforcement process for school districts and nonpublic 34 schools seeking accreditation pursuant to this subsection and 35 -28- HF 868 (2) 89 kh/tm/md 28/ 37
H.F. 868 subsections 11 and 12. The process established shall include 1 all of the following requirements: 2 a. Phase I monitoring. 3 (1) Phase I monitoring shall consist of annual monitoring by 4 the department of all accredited schools and school districts 5 for compliance with state and federal school laws, regulations, 6 and rules adopted by the state board under chapter 17A, 7 including but not limited to the following: 8 (a) Accreditation standards adopted by the state board as 9 provided in this section. 10 (b) Fiscal compliance. 11 (c) Federal education laws including but not limited to the 12 federal Elementary and Secondary Education Act of 1965, and the 13 federal Individuals with Disabilities Education Act, 20 U.S.C. 14 §1400 et seq., as amended. 15 (d) The federal Civil Rights Act of 1964 and chapter 216. 16 (e) All other requirements of this title applicable to 17 accredited schools and school districts. 18 (2) Phase I monitoring may include but shall not be limited 19 to the following: 20 (a) One or more desk audits requiring submission of 21 information to the department in a manner and on forms 22 prescribed by the department. 23 (b) One or more remote or on-site visits to schools or 24 school districts to address accreditation issues identified in 25 a desk audit. Such a visit may be conducted by an individual 26 departmental consultant or may be a comprehensive site visit 27 by a team of departmental consultants and other subject-matter 28 professionals. 29 (c) A review of district finances by department staff or a 30 neutral third party. 31 (d) A review of local school board policies and procedures 32 by department staff or a neutral third party. 33 (3) The department shall provide a public report annually of 34 findings of noncompliance and required corrective actions for 35 -29- HF 868 (2) 89 kh/tm/md 29/ 37
H.F. 868 each accredited school and school district. The purpose of the 1 phase I process is to bring schools and school districts into 2 minimum compliance with federal and state laws, regulations, 3 and rules and no citation or corrective action may be designed 4 to require more than minimum compliance. 5 (4) The department shall provide a written report 6 annually to the state board of any monitoring review resulting 7 in multiple or substantial findings of noncompliance or 8 noncompliance findings that remain uncorrected for more 9 than thirty days past the deadline set by the department for 10 correction. 11 (5) The department shall eliminate duplicative reporting 12 on the part of schools and school districts for phase I 13 monitoring, and is prohibited from collecting information not 14 specifically permitted by federal or state law, regulation, or 15 rule. 16 (6) Enforcement actions under phase I monitoring are 17 limited to actions permitted pursuant to paragraph “c” , 18 subparagraphs (2) and (3). Violations of federal legal 19 requirements shall follow the procedures and limitations of the 20 governing statute. 21 b. Phase II monitoring. 22 (1) Phase II monitoring shall take place when any of the 23 following conditions are present: 24 (a) When either the annual monitoring or the biennial 25 on-site visit of phase I indicates that an accredited school or 26 school district is deficient and fails to be in compliance with 27 accreditation standards. 28 (b) In response to a petition filed with the director 29 requesting such an accreditation committee visitation that is 30 signed by eligible electors residing in the school district 31 equal in number to at least twenty percent of the registered 32 voters of the school district. 33 (c) In response to a petition filed with the director 34 requesting such an accreditation committee visitation that is 35 -30- HF 868 (2) 89 kh/tm/md 30/ 37
H.F. 868 signed by twenty percent or more of the parents or guardians 1 who have children enrolled in the school or school district. 2 (d) At the direction of the state board. 3 (e) The school budget review committee submits to the 4 department a recommendation for a fiscal review pursuant to 5 section 257.31, subsection 18. 6 (2) Phase II monitoring shall consist of a full desk audit 7 of all monitoring requirements and an on-site visit to the 8 school or school district for the purpose of determining the 9 extent of noncompliance, the reason for lack of correction, if 10 applicable, and a recommendation for corrective action to the 11 director and the state board. 12 (3) Phase II monitoring requires the use of an accreditation 13 committee appointed by the director. The accreditation 14 committee shall be made up primarily of department staff but 15 may request the assistance of third-party specialists at the 16 discretion of the director. An accreditation committee visit 17 to a nonpublic school requires membership on the committee 18 from nonpublic school instructional or administrative staff or 19 board members. A member of a committee shall not have a direct 20 interest in the school district or nonpublic school being 21 visited. 22 (4) After visiting the school district or nonpublic 23 school, the accreditation committee shall, within thirty 24 days, determine whether the accreditation standards have been 25 met and shall make a report to the director, together with a 26 recommendation on what enforcement actions, if any, should be 27 recommended to the state board. 28 c. Enforcement. 29 (1) The department shall enforce the laws, regulations, 30 and rules applicable to school districts and nonpublic schools 31 consistent with the process outlined in this subsection. The 32 department shall coordinate its enforcement of chapter 216 with 33 the Iowa state civil rights commission to reduce duplication 34 of efforts. 35 -31- HF 868 (2) 89 kh/tm/md 31/ 37
H.F. 868 (2) If, after having an opportunity to correct, if 1 permitted, a school district is found to be in noncompliance 2 with federal education laws including but not limited to the 3 federal Elementary and Secondary Education Act of 1965, the 4 federal Individuals with Disabilities Education Act, 20 U.S.C. 5 §1400 et seq., as amended, the federal Civil Rights Act of 6 1964, chapter 216, section 279.73 if enacted by House File 744, 7 or section 279.74 if enacted by House File 802, the director 8 shall recommend that the state board shall do one of the 9 following within thirty days of the finding of noncompliance: 10 (a) Impose conditions on funding provided to a school 11 district, including directing the use of school district funds 12 and designating the school district a high-risk grantee under 13 2 C.F.R. §200.207. 14 (b) Withhold payment of state or federal funds to a 15 school district, in whole or in part, until noncompliance 16 is corrected. Initial withholding of state funds is at the 17 discretion of the director for a period of sixty calendar days, 18 after which it is subject to approval of the state board every 19 sixty calendar days. Withholding of federal funds is subject 20 to the governing federal statute or regulation. 21 (3) The director may use any of the following permitted 22 enforcement mechanisms and shall exercise discretion to ensure 23 that enforcement actions are proportionate to school district 24 or nonpublic school noncompliance: 25 (a) Advise the school district or nonpublic school on the 26 availability of appropriate technical assistance. 27 (b) Require the school district or nonpublic school to 28 complete a corrective action plan or plan for improvement by 29 a reasonable deadline. 30 (c) Recommend a phase II visit to the school district or 31 nonpublic school to the state board. 32 (d) Refer conduct of school district or nonpublic school 33 staff or school board members, or school authorities, to the 34 office of the attorney general for investigation. 35 -32- HF 868 (2) 89 kh/tm/md 32/ 37
H.F. 868 (e) Refer financial concerns to the auditor of state for 1 investigation. 2 (f) Recommend removal of accreditation of the school 3 district or school to the state board. 4 (g) Take any other enforcement mechanism available to the 5 director. 6 (4) The department shall focus enforcement activities on 7 all of the following: 8 (a) Improving educational results for children, families, 9 and students. 10 (b) Ensuring that public agencies and their governing 11 boards meet requirements of state and federal laws. 12 11. a. If the recommendation pursuant to subsection 10 13 is that a school district or nonpublic school not remain 14 accredited, the accreditation committee shall provide the 15 school district or nonpublic school with a report that includes 16 a list of all of the deficiencies, a plan prescribing the 17 actions that must be taken to correct the deficiencies, and 18 a deadline date for completion of the prescribed actions. 19 The accreditation committee shall advise the school district 20 or nonpublic school of available resources and technical 21 assistance to improve areas of weakness. The school district 22 or nonpublic school shall be provided with the opportunity 23 to respond to the accreditation committee’s report. The 24 director shall review the accreditation committee’s report 25 and the response of the school district or nonpublic school 26 and shall provide a report to the state board along with 27 copies of the accreditation committee’s report, the response 28 to the accreditation committee’s report, and other pertinent 29 information. At the request of the school district or 30 nonpublic school, the school district or nonpublic school may 31 appear before the state board and address the state board 32 directly regarding any part of the plan specified in the 33 report. The state board may modify the plan. During the 34 period of time specified in the plan for its implementation by 35 -33- HF 868 (2) 89 kh/tm/md 33/ 37
H.F. 868 a school district or nonpublic school, the school district or 1 school shall remain accredited. 2 b. The accreditation committee shall revisit the school 3 district or nonpublic school and shall determine whether the 4 deficiencies in the standards have been corrected. 5 c. The accreditation team shall make a report and 6 recommendation to the director and the state board. The 7 committee recommendation shall specify whether the school 8 district or nonpublic school shall remain accredited. For a 9 school district, the committee report and recommendation shall 10 also specify under what conditions the district may remain 11 accredited. The conditions may include but are not limited to 12 providing temporary oversight authority, operational authority, 13 or both oversight and operational authority to the director and 14 the state board for some or all aspects of the school district 15 in order to bring the school district into compliance with 16 minimum standards. 17 d. The state board shall review the report and 18 recommendation, may request additional information, and shall 19 determine whether the deficiencies have been corrected. 20 e. If the deficiencies have not been corrected, and the 21 conditional accreditation alternatives contained in the report 22 are not mutually acceptable to the state board and the local 23 board, the state board shall deaccredit the school district and 24 merge the territory of the school district with one or more 25 contiguous school districts at the end of the school year. The 26 state board may place a district under receivership for the 27 remainder of the school year. The receivership shall be under 28 the direct supervision and authority of the area education 29 agency in which the district is located. The decision of 30 whether to deaccredit the school district or to place the 31 district under receivership shall be based upon a determination 32 by the state board of the best interests of the students, 33 parents, residents of the community, teachers, administrators, 34 and school district board members and upon the recommendations 35 -34- HF 868 (2) 89 kh/tm/md 34/ 37
H.F. 868 of the accreditation committee and the director. 1 f. In the case of a nonpublic school, if the deficiencies 2 have not been corrected, the state board may deaccredit the 3 nonpublic school. The deaccreditation shall take effect on the 4 date established by the resolution of the state board, which 5 shall be no later than the end of the school year in which the 6 nonpublic school is deaccredited. 7 Sec. 25. Section 272.2, Code 2021, is amended by adding the 8 following new subsection: 9 NEW SUBSECTION . 24. Establish, collect, and refund 10 fees from an administrator for the administrative costs 11 of processing complaints and conducting hearings if the 12 administrator is the respondent in a complaint for violation of 13 the code of professional conduct and ethics, developed pursuant 14 to subsection 1, for which final board action results in a 15 sanction against the administrator. 16 Sec. 26. Section 272.10, Code 2021, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 5. The fees established by the board 19 for the administrative costs of processing complaints and 20 conducting hearings pursuant to section 272.2, subsection 24, 21 may include a fee for personal service by a sheriff, a fee for 22 legal notice when placed in a newspaper, transcription service 23 or court reporter fee, and other fees assessed as costs by 24 the board. The fees collected annually in accordance with 25 this subsection shall be retained by and are appropriated to 26 the board for the purposes related to the board’s duties. 27 Notwithstanding section 8.33, fees retained by and appropriated 28 to the board pursuant to this subsection that remain 29 unencumbered or unobligated at the close of the fiscal year 30 shall not revert but shall remain available for expenditure for 31 the activities of the board as provided in this chapter until 32 the close of the succeeding fiscal year. 33 Sec. 27. NEW SECTION . 279.8B Petition for public hearing. 34 1. Upon petition signed by eligible electors of a school 35 -35- HF 868 (2) 89 kh/tm/md 35/ 37
H.F. 868 district equal in number to at least five percent of the 1 persons who voted in the last preceding election of school 2 officials under section 277.1, the board of directors of the 3 school district shall hold a public hearing on the proposal 4 specified in the petition. If the proposal relates to 5 curriculum, the school district may halt use of the subject 6 instructional materials until the school board holds the public 7 hearing and makes a decision regarding the proposal. 8 2. The board of directors of the school district shall 9 hold the public hearing within thirty days of receipt of the 10 petition filed in accordance with subsection 1. Notice of the 11 time and place of the public hearing shall be posted for public 12 viewing on the school district’s internet site for at least the 13 five days immediately preceding the public hearing. Notice 14 shall include a brief description of the proposal. 15 Sec. 28. Section 279.66, Code 2021, is amended to read as 16 follows: 17 279.66 Discipline and personal conduct standards. 18 1. The board of directors of a school district shall review 19 and modify existing policies related to student discipline 20 and student conduct that are designed to promote responsible 21 behavior on school property and at school functions in 22 order that the policy shall govern the conduct of students, 23 teachers and other school personnel, and visitors; provide 24 opportunities for students to exercise self-discipline 25 and practice cooperative classroom behavior; and encourage 26 students and practitioners to model fairness, equity, and 27 respect. The policy shall specify the responsibilities of 28 students, parents and guardians, and practitioners in creating 29 an atmosphere where all individuals feel a sense of respect, 30 safety, and belonging, and shall set forth the consequences for 31 unacceptable behavior. The policy shall be published in the 32 student handbook. 33 2. The board of directors of a school district shall 34 include or reference in the student handbook guidance published 35 -36- HF 868 (2) 89 kh/tm/md 36/ 37
H.F. 868 pursuant to section 256.9, subsection 63, by the department of 1 education for parents, guardians, and community members who 2 have concerns about school districts or their governing boards. 3 Sec. 29. NEW SECTION . 279.75 Training for equity 4 coordinators. 5 The board of directors of a school district shall provide 6 training on free speech under the first amendment to the 7 Constitution of the United States to any equity coordinator 8 employed by the school district. 9 Sec. 30. CODE EDITOR DIRECTIVE. The Code editor shall 10 correct and eliminate any references in this division of this 11 Act to Code section 279.73 or 279.74, as appropriate, if either 12 or both Code sections are not enacted by House File 744 or 13 House File 802, by the Eighty-ninth General Assembly, 2021 14 Regular Session, or any extraordinary session. 15 Sec. 31. TRANSITION PROVISION —— ACCREDITATION. School 16 districts and accredited nonpublic schools that are currently 17 accredited on the effective date of this division of this Act 18 shall remain accredited until the state board of education 19 adopts rules, and the department of education implements such 20 rules, to administer the accreditation process established 21 in accordance with section 256.11, subsections 10 and 11, as 22 amended by this division of this Act. 23 -37- HF 868 (2) 89 kh/tm/md 37/ 37
