H.F. 710 Section 1. Section 726.6, Code 2021, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 1A. A person who is required to register 3 as a sex offender under chapter 692A for a sex offense 4 against a minor who knowingly has control of a minor, or who 5 knowingly has unsupervised access to a minor, commits child 6 endangerment. However, this subsection does not apply to any 7 of the following: 8 a. A person who is required to register as a sex offender 9 under chapter 692A for a sex offense against a minor who 10 knowingly has control of a minor, or who knowingly has 11 unsupervised access to a minor, when the person is the legal 12 parent or guardian of the minor and the control or unsupervised 13 access is not otherwise illegal. 14 b. A person who is required to register as a sex offender 15 under chapter 692A for a sex offense against a minor who 16 knowingly has control of a minor, or who knowingly has 17 unsupervised access to a minor, when the person is married to 18 and living with the legal parent or guardian of the minor and 19 the control or unsupervised access is not otherwise illegal. 20 Sec. 2. Section 726.6, subsection 6, Code 2021, is amended 21 to read as follows: 22 6. A person who commits child endangerment resulting in 23 bodily injury to a child or minor or child endangerment in 24 violation of subsection 1 , paragraph ā€œgā€ , that does not result 25 in a serious injury, or a person who commits child endangerment 26 in violation of subsection 1A, is guilty of a class ā€œDā€ felony. 27 -1- HF 710 (3) 89 as/rh/md 1/ 1
