H.F. 429 Section 1. Section 99G.3, subsection 14, Code 2021, is 1 amended to read as follows: 2 14. “Retailer” means a person , licensed by the authority, 3 who sells lottery tickets or shares on behalf of the authority 4 pursuant to a contract license issued by the authority . 5 Sec. 2. Section 99G.31, Code 2021, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 1A. The authority shall only pay prizes for 8 lottery tickets or shares that the authority determines were 9 legally purchased, legally possessed, and legally presented. 10 Sec. 3. Section 99G.36, Code 2021, is amended by adding the 11 following new subsections: 12 NEW SUBSECTION . 2A. A person who knowingly or intentionally 13 passes a lottery ticket or share in order to avoid the 14 application of an offset under section 99G.41 commits the 15 following: 16 (1) If passing the lottery ticket or share would avoid an 17 amount that exceeds ten thousand dollars, a class “C” felony. 18 (2) If passing the lottery ticket or share would avoid an 19 amount that exceeds one thousand five hundred dollars but does 20 not exceed ten thousand dollars, a class “D” felony. 21 (3) If passing the lottery ticket or share would avoid 22 an amount that exceeds seven hundred fifty dollars but does 23 not exceed one thousand five hundred dollars, an aggravated 24 misdemeanor. 25 (4) If passing the lottery ticket or share would avoid an 26 amount that exceeds three hundred dollars but does not exceed 27 seven hundred fifty dollars, a serious misdemeanor. 28 (5) If passing the lottery ticket or share would avoid an 29 amount that does not exceed three hundred dollars, a simple 30 misdemeanor. 31 NEW SUBSECTION . 2B. A person who knowingly or intentionally 32 passes a lottery ticket or share in order to circumvent 33 prohibited player provisions found in section 99G.31, 34 subsection 2, paragraph “g” or “h” , or applicable game specific 35 -1- HF 429 (4) 89 dg/rn/md 1/ 2
H.F. 429 rules commits a class “D” felony. 1 Sec. 4. Section 99G.36, subsection 3, Code 2021, is amended 2 to read as follows: 3 3. No person shall knowingly or intentionally make a 4 material false statement in any lottery prize claim, make a 5 material false statement in any application for a license or 6 proposal to conduct lottery activities , or make a material 7 false entry in any book or record which is compiled or 8 maintained or submitted to the authority or the board pursuant 9 to the provisions of this chapter .
