H.F. 2579 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the fiscal year beginning July 1, 2022, and ending June 6 30, 2023, the following amounts, or so much thereof as is 7 necessary, to be used for the purposes designated: 8 1. (1) The moneys appropriated in this subsection shall 27 be used to support demonstration projects in subwatersheds as 28 designated by the department that are part of high-priority 29 watersheds identified by the water resources coordinating 30 council. 31 (2) The moneys appropriated in this subsection shall be 32 used to support demonstration projects in watersheds generally, 33 including regional watersheds, as designated by the division 34 and high-priority watersheds identified by the water resources 35 -1- HF 2579 (2) 89 ec/tm/md 1/ 18

In supporting projects in watersheds and subwatersheds 2 as provided in paragraph “b”, all of the following shall apply: 3 (1) The demonstration projects shall utilize water quality 4 practices as described in the latest revision of the document 5 entitled “Iowa Nutrient Reduction Strategy” initially presented 6 in November 2012 by the department of agriculture and land 7 stewardship, the department of natural resources, and Iowa 8 state university of science and technology. 9 (2) The division shall implement demonstration projects as 10 provided in subparagraph (1) by providing for participation by 11 persons who hold a legal interest in agricultural land used in 12 farming. To every extent practical, the division shall provide 13 for collaborative participation by such persons who hold a 14 legal interest in agricultural land located within the same 15 subwatershed. 16 (3) The division shall implement demonstration projects on 17 a cost-share basis as determined by the division. Except for 18 edge-of-field practices, the state’s share of the amount shall 19 not exceed 50 percent of the estimated cost of establishing the 20 practice as determined by the division or 50 percent of the 21 actual cost of establishing the practice, whichever is less. 22 (4) The demonstration projects shall be used to educate 23 other persons about the feasibility and value of establishing 24 similar water quality practices. The division shall promote 25 field day events for purposes of allowing interested persons to 26 establish water quality practices on their agricultural land. 27 (5) The division shall conduct water quality evaluations 28 within supported subwatersheds. Within a reasonable period 29 after accumulating information from such evaluations, the 30 division shall create an aggregated database of water quality 31 practices. Any information identifying a person holding a 32 legal interest in agricultural land or specific agricultural 33 land shall be a confidential record. 34 d. The moneys appropriated in this subsection shall be used 35 -2- HF 2579 (2) 89 ec/tm/md 2/ 18
H.F. 2579 to support education and outreach in a manner that encourages 1 persons who hold a legal interest in agricultural land used for 2 farming to implement water quality practices, including the 3 establishment of such practices in watersheds generally, and 4 not limited to subwatersheds or high-priority watersheds. 5 e. The moneys appropriated in this subsection may be used 6 to contract with persons to coordinate the implementation of 7 efforts provided in this subsection. 8 f. The moneys appropriated in this subsection may be used 9 by the department to support urban soil and water conservation 10 efforts, which may include but are not limited to management 11 practices related to bioretention, landscaping, the use of 12 permeable or pervious pavement, and soil quality restoration. 13 The moneys shall be allocated on a cost-share basis as provided 14 in chapter 161A . 15 g. Notwithstanding any other provision of law to the 16 contrary, the department may use moneys appropriated in this 17 subsection to carry out the provisions of this subsection on a 18 cost-share basis in combination with other moneys available to 19 the department from a state or federal source. 20 h. Not more than 10 percent of the moneys appropriated in 21 this subsection may be used for costs of administration and 22 implementation of the water quality initiative administered by 23 the soil conservation division. 24 3. For purposes of section 8.33, unless specifically 16 provided otherwise, unencumbered or unobligated moneys from an 17 appropriation made in section 3, subsection 4, of this division 18 of this 2018 Act shall not revert but shall remain available 19 for expenditure for the purposes designated until the close 20 of the fiscal year that ends four years after the end of the 21 fiscal year for which the appropriation is made, or until the 22 project for which the appropriation was made is completed, 23 whichever is earlier. 24 Sec. 7. 2019 Iowa Acts, chapter 137, section 2, is amended 25 to read as follows: 26 SEC. 2. REVERSION. 27 1. Section 8.57C, subsection 3, paragraph a, 1 subparagraph (3), Code 2022, is amended to read as follows: 2 (3) For the fiscal year beginning July 1, 2022 2023 , and for 3 each subsequent fiscal year thereafter, the sum of seventeen 4 million five hundred thousand dollars. 5 Sec. 14. Section 8.57C, subsection 3, Code 2022, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . j. There is appropriated from the rebuild 8 Iowa infrastructure fund for the fiscal year beginning July 1, 9 2022, and ending June 30, 2023, the sum of twenty million five 10 hundred thousand dollars to the technology reinvestment fund, 11 notwithstanding section 8.57, subsection 5, paragraph “c” . 12 Sec. 15. Section 15.261, Code 2022, is amended to read as 13 follows: 14 15.261 Vacant state buildings demolition fund. 15 1. A vacant state buildings demolition fund is created in 16 the state treasury under the control of the authority. The 17 fund shall consist of all moneys appropriated to the fund. 18 2. Moneys in the vacant state buildings demolition fund 19 are appropriated to the authority for purposes of funding a 20 grant program for the demolition of vacant buildings owned by 21 the state or by a county that has purchased real property from 22 the federal government which are no longer used for a state or 23 federal purpose. Grant program criteria shall provide that 24 no more than fifty percent of the cost of a project for the 25 demolition of vacant buildings shall be funded from a grant 26 under the program. The authority shall give preference to 27 applicants that have not previously been awarded money from 28 this fund. 29 3. Notwithstanding section 12C.7, subsection 2 , interest 30 or earnings on moneys deposited in the vacant state buildings 31 demolition fund shall be credited to the vacant state buildings 32 demolition fund. Notwithstanding section 8.33 , moneys credited 33 to the vacant state buildings demolition fund shall not revert 34 at the close of a fiscal year. 35 -14- HF 2579 (2) 89 ec/tm/md 14/ 18
H.F. 2579 Sec. 16. Section 15.262, Code 2022, is amended to read as 1 follows: 2 15.262 Vacant state buildings rehabilitation fund. 3 1. A vacant state buildings rehabilitation fund is created 4 in the state treasury under the control of the authority. The 5 fund shall consist of all moneys appropriated to the fund. 6 2. Moneys in the vacant state buildings rehabilitation fund 7 are appropriated to the authority for purposes of funding a 8 loan program for the rehabilitation or redevelopment of vacant 9 buildings owned by the state or by a county that has purchased 10 real property from the federal government which are no longer 11 used for a state or federal purpose. The authority shall give 12 preference to applicants that have not previously been awarded 13 money from this fund. 14 3. Notwithstanding section 12C.7, subsection 2 , interest 15 or earnings on moneys deposited in the vacant state buildings 16 rehabilitation fund shall be credited to the vacant state 17 buildings rehabilitation fund. Notwithstanding section 8.33 , 18 moneys credited to the vacant state buildings rehabilitation 19 fund shall not revert at the close of a fiscal year. 20 Sec. 17. Section 602.11101, subsection 1, paragraph e, 21 subparagraph (2), Code 2022, is amended to read as follows: 22 (2) Until July 1, 1986, the county shall remain responsible 23 for the compensation of and operating costs for court 24 employees not presently designated for state financing and 25 for miscellaneous costs of the judicial branch related to 26 furnishings, supplies, and equipment purchased, leased, or 27 maintained for the use of judicial officers, referees, and 28 their staff. Effective July 1, 1986, the state shall assume 29 the responsibility for the compensation of and operating costs 30 for court employees presently designated for state financing 31 and for miscellaneous costs of the judicial branch related to 32 furnishings, supplies, and equipment purchased, leased, or 33 maintained for the use of judicial officers, referees, and 34 their staff. H.F. 2579 responsible for the provision of suitable courtrooms, offices, 1 and other physical facilities pursuant to section 602.1303, 2 subsection 1 , including paint, wall covering, and fixtures in 3 the facilities. In addition, however, effective July 1, 2023, 4 if a county expends moneys for the renovation or construction 5 of suitable courtrooms, offices, and other physical facilities 6 pursuant to section 602.1303, that requires the purchase of 7 furnishings, supplies, and equipment for the use of judicial 8 officers, referees, and their staff as a result of that 9 renovation or construction, the state shall be responsible for 10 only fifty percent of the cost of the purchase. 11 Sec. 18. DES MOINES AREA REGIONAL TRANSIT AUTHORITY 12 ALTERNATIVE FUNDING ADVISORY COMMITTEE —— REPORT. 13 1. The department of transportation shall establish a Des 14 Moines area regional transit authority alternative funding 15 advisory committee to study the most effective and efficient 16 methods to increase funding for the Des Moines area regional 17 transit authority that are alternative to an increase in 18 property taxes. 19 2. The committee shall consist of five voting members and 20 four ex officio, nonvoting members. 21 a. The voting members of the committee shall be composed of 22 all of the following: 23 (1) The director of the department of transportation or a 24 designee. 25 (2) The director of the department of revenue or a designee. 26 (3) A Polk county supervisor appointed by the governor. 27 (4) A member of a city council of a city in Polk county in 28 which the Des Moines area regional transit authority operates, 29 appointed by the governor. 30 (5) A representative of the Des Moines area regional transit 31 authority appointed by the Des Moines area regional transit 32 authority. 33 b. The ex officio, nonvoting members of the committee shall 34 be two state representatives, one appointed by the speaker of 35 -16- HF 2579 (2) 89 ec/tm/md 16/ 18
H.F. 2579 the house of representatives and one by the minority leader 1 of the house of representatives, and two state senators, one 2 appointed by the majority leader of the senate and one by the 3 minority leader of the senate. 4 3. Staffing services shall be provided by the department of 5 transportation in coordination with the department of revenue. 6 4. The committee shall submit a report containing its 7 findings and recommendations to the general assembly on or 8 before December 15, 2022. 9 5. This section is repealed January 1, 2023. 10 Sec. 19. EFFECTIVE DATE. The following, being deemed of 11 immediate importance, take effect upon enactment: 12 The sections of this division of this Act amending sections 13 15.261 and 15.262. 14 Sec. 20. RETROACTIVE APPLICABILITY. The following apply 15 retroactively to June 1, 2020: 16 The sections of this division of this Act amending sections 17 15.261 and 15.262. 18 DIVISION V 19 SPORTS TOURISM PROGRAM 20 Sec. 21. Section 15F.401, subsections 4, 5, and 6, Code 21 2022, are amended to read as follows: 22 4. An applicant shall demonstrate matching funds in order 23 to receive financial assistance pursuant to this section . The 24 amount of matching funds that may be required shall be at the 25 board’s discretion. An applicant under the program shall not 26 receive financial assistance from the sports tourism program 27 fund created in section 15F.403 in an amount exceeding fifty 28 twenty-five percent of the total cost of the project. 29 5. The board shall make final funding decisions on 30 each application and may approve, deny, defer, or modify 31 applications for financial assistance under the program, in 32 its discretion, in order to fund as many projects with the 33 moneys available as possible. The board and the authority may 34 negotiate with applicants regarding the details of projects 35 -17- HF 2579 (2) 89 ec/tm/md 17/ 18
H.F. 2579 and the amount and terms of any award. The total amount of 1 financial assistance provided to an applicant in any one 2 fiscal year shall not exceed five hundred thousand ten million 3 dollars. In making final funding decisions pursuant to this 4 subsection , the board and the authority are exempt from chapter 5 17A . 6 6. a. A city, county, or public entity may use financial 7 assistance received under the program for marketing and 8 promotions. Whether an activity or individual cost item is 9 directly related to the promotion of the sporting event shall 10 be within the discretion of the authority infrastructure . 11 b. All applications to the authority for financial 12 assistance shall be made at least ninety days prior to an 13 event’s scheduled date.
