H.F. 2494 Section 1. Section 249K.2, subsection 4, Code 2022, is 1 amended to read as follows: 2 4. “Major renovations” means construction or facility 3 improvements to a nursing facility in which the total amount 4 expended exceeds one million five seven hundred fifty thousand 5 dollars. 6 Sec. 2. Section 249K.5, subsection 2, Code 2022, is amended 7 by adding the following new paragraph: 8 NEW PARAGRAPH . c. The nursing facility for which relief 9 or an exception is requested is proposing replacement or 10 enhancement of an HVAC, as defined in section 105.2, system for 11 improved infection control. 12 Sec. 3. ADMINISTRATIVE RULES —— ADOPTION AND AMENDMENT. The 13 department of human services shall adopt or amend rules 14 pursuant to chapter 17A to administer this Act. Specifically, 15 the department shall amend 441 IAC 81.6(16)(h)(3)(1) to provide 16 that with regard to the additional requirements a nursing 17 facility must meet, the facility has Medicaid utilization at 18 or above forty percent for the two-month period before the 19 request for additional reimbursement is submitted. Medicaid 20 utilization for this purpose is calculated as total nursing 21 facility Medicaid patient days divided by total in-house 22 patient days as reported on the facility’s most current 23 financial and statistical report. 24 -1- HF 2494 (2) 89 pf/rh/md 1/ 1
