H.F. 2475 Section 1. Section 388.3, Code 2022, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 4. Any person appointed as a board member 3 of a utility board pursuant to this section may be removed from 4 office by the mayor with the unanimous approval of the city 5 council for any of the following reasons: 6 a. For any reason enumerated in section 66.1A. 7 b. For habitual nonattendance of board meetings. 8 NEW SUBSECTION . 5. A removal pursuant to this section 9 shall begin with a written notice, sent by certified mail to 10 the board member stating the grounds for removal, with a copy 11 of the notice filed with the city clerk. The board member 12 shall be entitled to a public hearing within thirty days 13 of the mailing of the notice, on all issues connected with 14 the removal, unless the board member requests a later date. 15 After the passage of thirty days or after the public hearing 16 described provided by this subsection, the city council shall 17 vote on whether to approve the removal of the board member. 18 NEW SUBSECTION . 6. The provisions of this section do not 19 apply to a city with a population of more than two hundred 20 thousand according to the 2020 federal decennial census. 21 Sec. 2. EFFECTIVE DATE.
