S.F. 615 DIVISION I 1 FY 2019-2020 2 APPROPRIATIONS 3 Section 1. DEPARTMENT OF JUSTICE. 4 1. There is appropriated from the general fund of the state 5 to the department of justice for the fiscal year beginning July 6 1, 2019, and ending June 30, 2020, the following amounts, or 7 so much thereof as is necessary, to be used for the purposes 8 designated: 9 a. FTEs 215.00 18 As a condition of receiving the appropriation provided 19 in this lettered paragraph, the department of justice shall 20 maintain a record of the estimated time incurred representing 21 each agency or department. 22 The general office of attorney general may temporarily 23 exceed and draw more than the amount appropriated in this 24 lettered paragraph and incur a negative cash balance as long 25 as there are receivables equal to or greater than the negative 26 balances and the amount appropriated in this paragraph is not 27 exceeded at the close of the fiscal year. 28 b. For victim assistance grants: 29 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,016,708 30 The moneys appropriated in this lettered paragraph shall be 31 used to provide grants to care providers providing services to 32 crime victims of domestic abuse or to crime victims of rape and 33 sexual assault. 34 The balance of the victim compensation fund established 35 -1- SF 615 (3) 88 asf/tm/mb 1/ 23
S.F. 615 in section 915.94 may be used to provide salary and support 1 of not more than 24.00 full-time equivalent positions and to 2 provide maintenance for the victim compensation functions 3 of the department of justice. In addition to the full-time 4 equivalent positions authorized pursuant to this paragraph, 5 5.00 full-time equivalent positions are authorized and shall 6 be used by the department of justice to employ one accountant 7 and four program planners. The department of justice may 8 employ the additional 5.00 full-time equivalent positions 9 authorized pursuant to this paragraph that are in excess of the 10 number of full-time equivalent positions authorized only if 11 the department of justice receives sufficient federal moneys 12 to maintain employment for the additional full-time equivalent 13 positions during the current fiscal year. The department 14 of justice shall only employ the additional 5.00 full-time 15 equivalent positions in succeeding fiscal years if sufficient 16 federal moneys are received during each of those succeeding 17 fiscal years. 18 The department of justice shall transfer at least $150,000 19 from the victim compensation fund established in section 915.94 20 to the victim assistance grant program. 21 Notwithstanding section 8.33, moneys appropriated in this 22 paragraph “b” that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available for expenditure for the purposes designated until the 25 close of the succeeding fiscal year. 26 c. The department of justice, in submitting budget 30 estimates for the fiscal year commencing July 1, 2020, pursuant 31 to section 8.23, shall include a report of funding from sources 32 other than amounts appropriated directly from the general fund 33 of the state to the department of justice or to the office of 34 consumer advocate. These funding sources shall include but 35 -2- SF 615 (3) 88 asf/tm/mb 2/ 23
S.F. 615 are not limited to reimbursements from other state agencies, 1 commissions, boards, or similar entities, and reimbursements 2 from special funds or internal accounts within the department 3 of justice. The department of justice shall also report actual 4 reimbursements for the fiscal year commencing July 1, 2018, 5 and actual and expected reimbursements for the fiscal year 6 commencing July 1, 2019. 7 b. The department of justice shall include the report 8 required under paragraph “a”, as well as information regarding 9 any revisions occurring as a result of reimbursements actually 10 received or expected at a later date, in a report to the 11 co-chairpersons and ranking members of the joint appropriations 12 subcommittee on the justice system and the legislative services 13 agency. The department of justice shall submit the report on 14 or before January 15, 2020. 15 3. a. The department of justice shall fully reimburse 16 the costs and necessary related expenses incurred by the Iowa 17 law enforcement academy to continue to employ one additional 18 instructor position who shall provide training for human 19 trafficking-related issues throughout the state. 20 b. The department of justice shall obtain the moneys 21 necessary to reimburse the Iowa law enforcement academy to 22 employ such an instructor from unrestricted moneys from either 23 the victim compensation fund established in section 915.94, the 24 human trafficking victim fund established in section 915.95, or 25 the human trafficking enforcement fund established in 2015 Iowa 26 Acts, chapter 138, section 141. 27 Sec. 2. OFFICE OF CONSUMER ADVOCATE. It is the intent of the general assembly that each 5 lease negotiated by the department of corrections with a 6 private corporation for the purpose of providing private 7 industry employment of inmates in a correctional institution 8 shall prohibit the private corporation from utilizing inmate 9 labor for partisan political purposes for any person seeking 10 election to public office in this state and that a violation 11 of this requirement shall result in a termination of the lease 12 agreement. 13 b. It is the intent of the general assembly that as a 14 condition of receiving the appropriation provided in this 15 subsection the department of corrections shall not enter into 16 a lease or contractual agreement pursuant to section 904.809 17 with a private corporation for the use of building space for 18 the purpose of providing inmate employment without providing 19 that the terms of the lease or contract establish safeguards to 20 restrict, to the greatest extent feasible, access by inmates 21 working for the private corporation to personal identifying 22 information of citizens. 23 2. To maximize the funding for educational programs, 27 the department shall establish guidelines and procedures to 28 prioritize the availability of educational and vocational 29 training for inmates based upon the goal of facilitating an 30 inmate’s successful release from the correctional institution. 31 b. The director of the department of corrections may 32 transfer moneys from Iowa prison industries and the canteen 33 operating funds established pursuant to section 904.310, for 34 use in educational programs for inmates. 35 -6- SF 615 (3) 88 asf/tm/mb 6/ 23

Each judicial district department of correctional 25 services, within the funding available, shall continue programs 26 and plans established within that district to provide for 27 intensive supervision, sex offender treatment, diversion of 28 low-risk offenders to the least restrictive sanction available, 29 job development, and expanded use of intermediate criminal 30 sanctions. 31 3. Each judicial district department of correctional 32 services shall provide alternatives to prison consistent with 33 chapter 901B. The alternatives to prison shall ensure public 34 safety while providing maximum rehabilitation to the offender. 35 -8- SF 615 (3) 88 asf/tm/mb 8/ 23
S.F. 615 A judicial district department of correctional services may 1 also establish a day program. 2 4. The governor’s office of drug control policy shall 3 consider federal grants made to the department of corrections 4 for the benefit of each of the eight judicial district 5 departments of correctional services as local government 6 grants, as defined pursuant to federal regulations. 7 5. The department of corrections shall continue to contract 8 with a judicial district department of correctional services to 9 provide for the rental of electronic monitoring equipment which 10 shall be available statewide. 11 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 12 APPROPRIATIONS. Notwithstanding section 8.39, within the 13 moneys appropriated in this division of this Act to the 14 department of corrections, the department may reallocate the 15 moneys appropriated and allocated as necessary to best fulfill 16 the needs of the correctional institutions, administration 17 of the department, and the judicial district departments of 18 correctional services. However, in addition to complying with 19 the requirements of sections 904.116 and 905.8 and providing 20 notice to the legislative services agency, the department 21 of corrections shall also provide notice to the department 22 of management, prior to the effective date of the revision 23 or reallocation of an appropriation made pursuant to this 24 section. The department of corrections shall not reallocate an 25 appropriation or allocation for the purpose of eliminating any 26 program. 27 Sec. 7. INTENT —— REPORTS. 28 1. The department of corrections in cooperation with 29 townships, the Iowa cemetery associations, and other nonprofit 30 or governmental entities may use inmate labor during the 31 fiscal year beginning July 1, 2019, to restore or preserve 32 rural cemeteries and historical landmarks. The department in 33 cooperation with the counties may also use inmate labor to 34 clean up roads, major water sources, and other water sources 35 -9- SF 615 (3) 88 asf/tm/mb 9/ 23
S.F. 615 around the state. 1 2. On a quarterly basis the department shall provide a 2 status report regarding private-sector employment to the 3 legislative services agency beginning on July 1, 2019. The 4 report shall include the number of offenders employed in the 5 private sector, the combined number of hours worked by the 6 offenders, the total amount of allowances, and the distribution 7 of allowances pursuant to section 904.702, including any moneys 8 deposited in the general fund of the state. 9 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 10 corrections shall submit a report on electronic monitoring to 11 the general assembly, to the co-chairpersons and the ranking 12 members of the joint appropriations subcommittee on the justice 13 system, and to the legislative services agency by January 14 15, 2020. The report shall specifically address the number 15 of persons being electronically monitored and break down the 16 number of persons being electronically monitored by offense 17 committed. The report shall also include a comparison of any 18 data from the prior fiscal year with the current year. 19 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 20 1. As used in this section, unless the context otherwise 21 requires, “state agency” means the government of the state 22 of Iowa, including but not limited to all executive branch 23 departments, agencies, boards, bureaus, and commissions, the 24 judicial branch, the general assembly and all legislative 25 agencies, institutions within the purview of the state board of 26 regents, and any corporation whose primary function is to act 27 as an instrumentality of the state. 28 2. State agencies are encouraged to purchase products from 29 Iowa state industries, as defined in section 904.802, when 30 purchases are required and the products are available from 31 Iowa state industries. State agencies shall obtain bids from 32 Iowa state industries for purchases of office furniture during 33 the fiscal year beginning July 1, 2019, exceeding $5,000 or 34 in accordance with applicable administrative rules related to 35 -10- SF 615 (3) 88 asf/tm/mb 10/ 23
S.F. 615 purchases for the agency. 1 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 2 1. There is appropriated from the general fund of the 3 state to the Iowa law enforcement academy for the fiscal year 4 beginning July 1, 2019, and ending June 30, 2020, the following 5 amount, or so much thereof as is necessary, to be used for the 6 purposes designated: 7 a. The Iowa law enforcement academy may temporarily exceed 17 and draw more than the amount appropriated in this subsection 18 and incur a negative cash balance as long as there are 19 receivables equal to or greater than the negative balance and 20 the amount appropriated in this subsection is not exceeded at 21 the close of the fiscal year. 22 2. The Iowa law enforcement academy may select at least 23 five automobiles of the department of public safety, division 24 of state patrol, prior to turning over the automobiles to 25 the department of administrative services to be disposed 26 of by public auction, and the Iowa law enforcement academy 27 may exchange any automobile owned by the academy for each 28 automobile selected if the selected automobile is used in 29 training law enforcement officers at the academy. However, any 30 automobile exchanged by the academy shall be substituted for 31 the selected vehicle of the department of public safety and 32 sold by public auction with the receipts being deposited in the 33 depreciation fund to the credit of the department of public 34 safety, division of state patrol. 35 -11- SF 615 (3) 88 asf/tm/mb 11/ 23
S.F. 615 3. The Iowa law enforcement academy shall provide training 1 for domestic abuse and human trafficking-related issues 2 throughout the state. The training shall be offered at no 3 cost to the attendees and the training shall not replace any 4 existing domestic abuse or human trafficking training offered 5 by the academy. 6 Sec. 11. STATE PUBLIC DEFENDER. There is appropriated from 7 the general fund of the state to the office of the state public 8 defender of the department of inspections and appeals for the 9 fiscal year beginning July 1, 2019, and ending June 30, 2020, 10 the following amounts, or so much thereof as is necessary, to 11 be used for the purposes designated: 12 1. The attorney general shall report which 32 funds are designated to receive the moneys and under what legal 33 authority the designation is being made. 34 Sec. 25. REPEAL. CONSUMER EDUCATION AND LITIGATION FUND. 5 Notwithstanding section 714.16C , for each fiscal year of the 6 period beginning July 1, 2014, and ending June 30, 2019 2021 , 7 the annual appropriations in section 714.16C , are increased 8 from $1,125,000 to $1,875,000, and $75,000 to $125,000 9 respectively. 10 DIVISION IV 11 FIRE SERVICE TRAINING REVOLVING FUND 12 Sec. 27. Section 100B.4, Code 2019, is amended to read as 13 follows: 14 100B.4 Fees —— retention —— use —— fund . 15 1. Fees assessed pursuant to this chapter shall be retained 16 by the division of state fire marshal and such repayments 17 received shall be used exclusively to offset the cost of 18 fire service training. Fees charged by regional emergency 19 response training centers for fire service training programs as 20 described in section 100B.6 shall not be greater than the fee 21 schedule established by rule by the state fire marshal. 22 2. Notwithstanding section 8.33 , repayment receipts 23 collected by the division of state fire marshal for the fire 24 service training bureau that remain unencumbered or unobligated 25 at the close of the fiscal year shall not revert but shall 26 remain available for expenditure for the purposes designated 27 until the close of the succeeding fiscal year. 28 3. A fire service training revolving fund is created in the 29 state treasury under the control of the department of public 30 safety. The fund shall consist of fees assessed pursuant to 31 this section, and deposited into the fire service training 32 revolving fund. All moneys in the fund are appropriated to 33 the department of public safety for purposes of fire service 34 training and shall be under the control of the state fire 35 -21- SF 615 (3) 88 asf/tm/mb 21/ 23

Notwithstanding section 8.33, moneys in the fund 1 that remain unencumbered or unobligated at the close of a 2 fiscal year shall not revert but shall remain available for 3 expenditures for the purposes designated until the close of 4 the succeeding fiscal year. Notwithstanding section 12C.7, 5 subsection 2, interest or earnings on moneys in the fund shall 6 be credited to the fund. 7 Sec. 28. EFFECTIVE DATE. This division of this Act, being 8 deemed of immediate importance, takes effect upon enactment. 9 Sec. 29. RETROACTIVE APPLICABILITY. This division of this 10 Act applies retroactively to July 1, 2018. 11 DIVISION V 12 DEPARTMENT OF CORRECTIONS 13 Sec. 30. DEPARTMENT OF CORRECTIONS. Notwithstanding 14 sections 8.33 and 8.39, the department of corrections may use 15 any general fund resources appropriated to the department 16 for the fiscal year beginning July 1, 2018, and ending June 17 30, 2019, for the resolution of the settlement agreement 18 with the division of labor services to the amended citation 19 P1582-1281728 dated October 18, 2018; requiring the department 20 to remedy citation 1(a) by providing adequate means of 21 communication for employees to summon assistance during violent 22 attacks, which must be abated by March 1, 2020. 23 Sec. 31. EFFECTIVE DATE. This division of this Act, being 24 deemed of immediate importance, takes effect upon enactment. 25 DIVISION VI 26 INDIGENT DEFENSE 27 Sec. 32. 2016 Iowa Acts, chapter 1137, section 21, 28 subsection 1, is amended to read as follows: 29 1. Notwithstanding any other provision of the law to the 30 contrary, for each fiscal year for the period beginning July 1, 31 2016, and ending June 30, 2019 2022 , the state public defender 32 may establish a pilot project allowing an indigent person to 33 choose an eligible attorney to represent the person in the 34 person’s case that requires such representation. S.F. 615 public defender shall have sole discretion to establish the 1 pilot project in no more than four counties throughout the 2 state. The state public defender may coordinate with other 3 agencies and organizations in order to seek grant funding and 4 to measure the results of the pilot project. 5 Sec. 33. EFFECTIVE DATE.
