1.
NEW
SECTION

or
remote

for
traffic
law
enforcement
prohibited

1.
The
state
or
a
political
subdivision
of
the
state
shall
4
not
place
or
cause
to
be
placed
on
or
adjacent
to
a
highway,
or
5
maintain
or
employ
the
use
of,
any
automated
or
remote
system
6
for
traffic
law
enforcement.

2.
The
department
and
the
department
of
public
safety
shall
8
not
share
or
provide
information
used
to
impose
or
collect
a
9
civil
penalty
that
results
from
a
violation
captured
by
an
10
automated
or
remote
system
for
traffic
law
enforcement
through
11
any
existing
interstate
compact
that
does
not
specifically
12
allow
or
require
information
to
be
shared
or
provided
for
that
13
explicit
purpose.

For
purposes
of
this
section,
“automated
or
remote
system
15
for
traffic
law
enforcement”
means
a
camera
or
other
optical
16
device
designed
to
work
in
conjunction
with
an
official
traffic
17
control
signal
or
speed
measuring
device
to
identify
motor
18
vehicles
operating
in
violation
of
traffic
laws,
the
use
of
19
which
results
in
the
issuance
of
citations
sent
through
the
20
mail
or
by
electronic
means.

Sec.
2.
REMOVAL
OF
AUTOMATED
OR
REMOTE
SYSTEMS
FOR
22
TRAFFIC
LAW
ENFORCEMENT
——
VALIDITY
OF
PRIOR
NOTICES
AND
23
CITATIONS.
Prior
to
July
1,
2019,
a
local
authority
using
an
24
automated
or
remote
system
for
traffic
law
enforcement
shall
25
discontinue
using
the
system
and
remove
the
system
equipment.

Effective
July
1,
2019,
all
local
ordinances
authorizing
the
27
use
of
automated
or
remote
systems
for
traffic
law
enforcement
28
are
void.
However,
any
citation
issued
or
mailed
pursuant
29
to
such
an
ordinance
prior
to
July
1,
2019,
shall
not
be
30
invalidated
by
the
enactment
of
this
Act
and
shall
be
processed
31
according
to
the
provisions
of
law
under
which
the
citation
was
32
authorized.

Sec.
3.
EFFECTIVE
DATE.
The
section
of
this
Act
relating
34
to
the
removal
of
automated
or
remote
systems
for
traffic
law

of

being
deemed

of
immediate
importance,
takes
effect
upon
