S.F. 2249 Section 1. Section 309.57, subsection 1, Code 2020, is 1 amended to read as follows: 2 1. The county board of supervisors, after consultation with 3 the county engineer, and for purposes of specifying levels of 4 maintenance effort and access, may classify the area service 5 system into three classifications termed area service “A”, 6 area service “B”, and area service “C”. The area service 7 “A” classification roads shall be maintained in conformance 8 with applicable statutes. Area service “B” classification 9 roads may have a lesser level of maintenance as specified by 10 the county board of supervisors, after consultation with the 11 county engineer. Area service “C” classification roads may 12 have restricted access and a minimal level of maintenance as 13 specified by the county board of supervisors after consultation 14 with the county engineer. An area service “C” classification 15 shall apply to the entire portion of a road between the road’s 16 access points. The county board of supervisors shall not 17 classify only part of a road between the road’s access points, 18 or only a bridge on the road, as area service “C”. For purposes 19 of this subsection, “access point” includes but is not limited 20 to a driveway as defined in section 306.19. 21 Sec. 2. APPLICABILITY. All area service “C” 22 classifications in effect on the effective date of this 23 Act that are not in compliance with this Act shall be expanded 24 or reclassified to meet the requirements of this Act on or 25 before January 1, 2021. 26 -1- SF 2249 (2) 88 mo/ns/mb 1/ 1
