Any moneys and premiums collected by the department 27 for workers’ compensation shall be segregated into a separate 28 workers’ compensation fund in the state treasury to be used 29 for payment of state employees’ workers’ compensation claims 30 and administrative costs. Notwithstanding section 8.33 , 31 unencumbered or unobligated moneys remaining in this workers’ 32 compensation fund at the end of the fiscal year shall not 33 revert but shall be available for expenditure for purposes of 34 the fund for subsequent fiscal years. 35 -1- HF 759 (3) 88 gh/tm/md 1/ 21

The department shall conduct a study regarding the 1 feasibility, timeline, and costs of developing and maintaining 2 a searchable database available on the department’s internet 3 site containing a listing, updated annually, of real property 4 owned or leased by the state. Real property listed in the 5 searchable database shall be listed by location and searchable 6 by county, address, and any other method deemed beneficial 7 to the public. If real property listed in the searchable 8 database is leased by the state, the searchable database shall 9 also include the rental or lease costs of such real property. 10 The department shall submit its findings and recommendations 11 in a report to the general assembly and to the chairpersons 12 and ranking members of the senate and house committees on 13 appropriations by December 31, 2019. 14 Sec. 2. REVOLVING FUNDS. There is appropriated to the 15 department of administrative services for the fiscal year 16 beginning July 1, 2019, and ending June 30, 2020, from the 17 revolving funds designated in chapter 8A and from internal 18 service funds created by the department such amounts as the 19 department deems necessary for the operation of the department 20 consistent with the requirements of chapter 8A . 21 Sec. 3. STATE EMPLOYEE HEALTH INSURANCE ADMINISTRATION 22 CHARGE. For the fiscal year beginning July 1, 2019, and ending 23 June 30, 2020, the monthly per contract administrative charge 24 which may be assessed by the department of administrative 25 services shall be $2 per contract on all health insurance plans 26 administered by the department. 27 Sec. 4. AUDITOR OF STATE. 28 1. The auditor 10 of state shall notify the department of management, the 11 legislative fiscal committee, and the legislative services 12 agency of the additional full-time equivalent positions 13 retained. 14 3. The auditor of state shall allocate moneys from the 15 appropriation in this section solely for audit work related to 16 the comprehensive annual financial report, federally required 17 audits, and investigations of embezzlement, theft, or other 18 significant financial irregularities until the audit of the 19 comprehensive annual financial report is complete. 20 Sec. 5. IOWA ETHICS AND CAMPAIGN DISCLOSURE BOARD. The department shall, in coordination with the health 23 facilities division, make the following information available 24 to the public as part of the department’s development efforts 25 to revise the department’s internet site: 26 (1) The number of inspections conducted by the division 27 annually by type of service provider and type of inspection. 28 (2) The total annual operations budget for the division, 29 including general fund appropriations and federal contract 30 dollars received by type of service provider inspected. 31 (3) The total number of full-time equivalent positions in 32 the division, to include the number of full-time equivalent 33 positions serving in a supervisory capacity, and serving as 34 surveyors, inspectors, or monitors in the field by type of 35 -9- HF 759 (3) 88 gh/tm/md 9/ 21
H.F. 759 service provider inspected. 1 (4) Identification of state and federal survey trends, 2 cited regulations, the scope and severity of deficiencies 3 identified, and federal and state fines assessed and collected 4 concerning nursing and assisted living facilities and programs. 5 c. It is the intent of the general assembly that the 6 department and division continuously solicit input from 7 facilities regulated by the division to assess and improve 8 the division’s level of collaboration and to identify new 9 opportunities for cooperation. 10 5. EMPLOYMENT APPEAL BOARD 11 a. CHILD ADVOCACY BOARD 26 a. The court appointed special advocate program shall 3 investigate and develop opportunities for expanding 4 fund-raising for the program. 5 d. Administrative costs charged by the department of 6 inspections and appeals for items funded under this subsection 7 shall not exceed 4 percent of the amount appropriated in this 8 subsection. 9 7. Notwithstanding section 16 8.39 , the department of inspections and appeals, in 17 consultation with the department of management, may reallocate 18 moneys appropriated in this section as necessary to best 19 fulfill the needs of the department provided for in the 20 appropriation. However, the department of inspections and 21 appeals shall not reallocate moneys appropriated to the child 22 advocacy board in this section. 23 Sec. 13. DEPARTMENT OF INSPECTIONS AND APPEALS —— LICENSE OR 24 REGISTRATION FEES. 25 1. For the fiscal year beginning July 1, 2019, and ending 26 June 30, 2020, the department of inspections and appeals 27 shall collect any license or registration fees or electronic 28 transaction fees generated during the fiscal year as a result 29 of licensing and registration activities under chapters 99B , 30 137C , 137D , and 137F . 31 2. From the fees collected by the department under this 32 section on behalf of a municipal corporation with which 33 the department has an agreement pursuant to section 137F.3 , 34 through a statewide electronic licensing system operated by 35 -11- HF 759 (3) 88 gh/tm/md 11/ 21
H.F. 759 the department, notwithstanding section 137F.6, subsection 2 , 1 the department shall remit the amount of those fees to the 2 municipal corporation for whom the fees were collected less 3 any electronic transaction fees collected by the department to 4 enable electronic payment. 5 3. From the fees collected by the department under this 6 section, other than those fees described in subsection 2, 7 the department shall deposit the amount of $800,000 into the 8 general fund of the state prior to June 30, 2020. 9 4. From the fees collected by the department under this 10 section, other than those fees described in subsections 2 and 11 3, the department shall retain the remainder of the fees for 12 the purposes of enforcing the provisions of chapters 99B , 137C , 13 137D , and 137F . Notwithstanding section 8.33 , moneys retained 14 by the department pursuant to this subsection that remain 15 unencumbered or unobligated at the end of the fiscal year 16 shall not revert but shall remain available for expenditure 17 for the purposes of enforcing the provisions of chapters 99B , 18 137C , 137D , and 137F during the succeeding fiscal year. The 19 department shall provide an annual report to the department of 20 management and the legislative services agency on fees billed 21 and collected and expenditures from the moneys retained by 22 the department in a format as determined by the department 23 of management in consultation with the legislative services 24 agency. 25 Sec. 14. Section 8A.111, Code 2019, is amended by adding the 24 following new subsection: 25 NEW SUBSECTION . 12. By December 31, 2020, and by the same 26 date each year thereafter, an annual report submitted to the 27 general assembly and to the chairpersons and ranking members of 28 the senate and house committees on appropriations containing 29 a listing of real property owned or leased by the state. The 30 report shall be grouped by county and shall include identifying 31 information for each real property listed, including but not 32 limited to the physical address. H.F. 759 Sec. 32. Section 8B.9, Code 2019, is amended by adding the 1 following new subsection: 2 NEW SUBSECTION . 6. Beginning October 1, 2019, a quarterly 3 report regarding the status of technology upgrades or 4 enhancements for state agencies, submitted to the general 5 assembly and to the chairpersons and ranking members of 6 the senate and house committees on appropriations. The 7 quarterly report shall also include a listing of state agencies 8 coordinating or working with the office and a listing of state 9 agencies not coordinating or working with the office. 10 Sec. 33. Section 19B.12, subsection 4, Code 2019, is amended 11 to read as follows: 12 4. a. The department of administrative services for 13 all state agencies, and the state board of regents for its 14 institutions, shall adopt rules and appropriate internal, 15 confidential grievance procedures to implement this section , 16 and shall adopt procedures for determining violations of 17 this section and for ordering appropriate dispositions that 18 may include, but are not limited to, discharge, suspension, 19 or reduction in rank or grade as defined in section 8A.413, 20 subsection 19 . 21 b. Upon receipt or referral of a complaint alleging 22 sexual harassment from a state employee, the department of 23 administrative services or the state board of regents, as 24 applicable, shall initiate an investigation of the complaint 25 and shall complete the investigation within one hundred eighty 26 days of the receipt or referral of the complaint. 27 c. Notwithstanding any provision of law to the contrary, a 28 state employee alleging to be aggrieved by a violation of this 29 section may file a civil action within two years after the date 30 of the alleged violation in a court of competent jurisdiction 31 in the county where the violation is alleged to have occurred 32 or where the employer has its principal office. 33 Sec. 34.
