H.F. 758 grants account for the fiscal year beginning July 1, 2019, and 1 ending June 30, 2020, not more than $265,950 is allocated for 2 the early childhood Iowa office and other technical assistance 3 activities. Moneys allocated under this lettered paragraph 4 may be used by the early childhood Iowa state board for the 5 purpose of skills development and support for ongoing training 6 of staff. However, except as otherwise provided in this 7 subsection, moneys shall not be used for additional staff or 8 for the reimbursement of staff. 9 b. Of the amount appropriated in this subsection for 10 deposit in the school ready children grants account of the 11 early childhood Iowa fund, $2,318,018 shall be used for efforts 12 to improve the quality of early care, health, and education 13 programs. Moneys allocated pursuant to this paragraph may be 14 used for additional staff and for the reimbursement of staff. 15 The early childhood Iowa state board may reserve a portion 16 of the allocation, not to exceed $88,650 for the technical 17 assistance expenses of the early childhood Iowa state office, 18 including the reimbursement of staff, and shall distribute 19 the remainder to early childhood Iowa areas for local quality 20 improvement efforts through a methodology identified by the 21 early childhood Iowa state board to make the most productive 22 use of the funding, which may include use of the distribution 23 formula, grants, or other means. 24 c. Of the amount appropriated in this subsection for 25 deposit in the school ready children grants account of 26 the early childhood Iowa fund, $825,030 shall be used for 27 support of professional development and training activities 28 for persons working in early care, health, and education by 29 the early childhood Iowa state board in collaboration with 30 the professional development component groups maintained by 31 the early childhood Iowa stakeholders alliance pursuant to 32 section 256I.12, subsection 7, paragraph “b”, and the early 33 childhood Iowa area boards. Expenditures shall be limited to 34 professional development and training activities agreed upon by 35 -6- HF 758 (4) 88 kh/tm/md 6/ 32
H.F. 758 the parties participating in the collaboration. 1 9. BIRTH TO AGE THREE SERVICES 2 a. For expansion of the federal Individuals with 3 Disabilities Education Improvement Act of 2004, Pub. L. The moneys appropriated in this subsection shall be 17 used for implementation and expansion of early head start 18 pilot projects addressing the comprehensive cognitive, social, 19 emotional, and developmental needs of children from birth to 20 age three, including prenatal support for qualified families. 21 The projects shall promote healthy prenatal outcomes and 22 healthy family functioning, and strengthen the development of 23 infants and toddlers in low-income families. Priority shall be 24 given to those organizations that have previously qualified for 25 and received state funding to administer an early head start 26 project. 27 11. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS 28 a. By January 15, 2020, the department shall submit a 5 written report to the general assembly regarding the program 6 and activities authorized under section 261E.8, subsection 7 7A, as enacted by 2018 Iowa Acts, chapter 1067, section 14. 8 The report shall include an analysis of the distribution of 9 funds to participating community colleges; the number of school 10 districts participating through a contractual arrangement 11 with each participating community college; information on the 12 programs and courses made available under each agreement; an 13 unduplicated count of enrollment and credit hours earned by 14 students participating under each agreement; and a summary of 15 major program costs. 16 16. The department may charge school districts and accredited 18 nonpublic schools a fee for the system not to exceed the actual 19 costs to purchase a statewide license for the early warning 20 assessment minus the moneys received by the department under 21 this subsection. The fee shall be determined by dividing the 22 actual remaining costs to purchase the statewide license for 23 the school year by the number of pupils assessed under the 24 system in the current fiscal year. School districts may use 25 moneys received pursuant to section 257.10, subsection 11, and 26 moneys received for purposes of implementing section 279.68, 27 subsection 2, to pay the early warning assessment system fee. 28 21. IOWA READING RESEARCH CENTER 29 a. For purposes of the Iowa reading research center in 30 order to implement, in collaboration with the area education 31 agencies, the provisions of section 256.9, subsection 49, 32 paragraph “c”: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,300,176 34 b. MIDWESTERN HIGHER EDUCATION COMPACT 30 a. H.F. 758 other evidences of indebtedness issued under section 262.48 to 1 finance projects that will result in energy cost savings in an 2 amount that will cause the state board to recover the cost of 3 the projects within an average of six years. 4 Sec. 12. PRESCRIPTION DRUG COSTS. Notwithstanding section 5 270.7, the department of administrative services shall pay 6 the state school for the deaf and the Iowa braille and sight 7 saving school the moneys collected from the counties during the 8 fiscal year beginning July 1, 2019, for expenses relating to 9 prescription drug costs for students attending the state school 10 for the deaf and the Iowa braille and sight saving school. 11 Sec. 13. Section 257.35, Code 2019, is amended by adding the 12 following new subsection: 13 NEW SUBSECTION . 13A. Notwithstanding subsection 1, and in 14 addition to the reduction applicable pursuant to subsection 15 2, the state aid for area education agencies and the portion 16 of the combined district cost calculated for these agencies 17 for the fiscal year beginning July 1, 2019, and ending June 18 30, 2020, shall be reduced by the department of management by 19 fifteen million dollars. The reduction for each area education 20 agency shall be prorated based on the reduction that the agency 21 received in the fiscal year beginning July 1, 2003. 22 Sec. 14. Section 257.51, if enacted by 2019 Iowa Acts, House 23 File 546, or successor legislation is amended by adding the 24 following new subsection: 25 NEW SUBSECTION . 4. The department of education shall 26 annually report to the general assembly by January 15 the 27 activities funded by and expenditures made from the career 28 academy fund during the preceding fiscal year. The report 29 shall summarize the amounts received by each grant recipient; 30 the opportunities made available to students, including but 31 not limited to coursework and work-based learning experiences; 32 outcome measures for students participating in career academies 33 funded through the career academy fund; delivery formats 34 utilized; and the amount of any other state, federal, or 35 -21- HF 758 (4) 88 kh/tm/md 21/ 32
H.F. 758 private funding used by the grant recipient to supplement 1 career academy fund moneys. 2 Sec. 15. Section 261.25, subsections 1 and 2, Code 2019, are 3 amended to read as follows: 4 1. There is appropriated from the general fund of the state 5 to the commission for each fiscal year the sum of forty-six 6 forty-seven million six seven hundred thirty three thousand 7 nine four hundred fifty-one sixty-three dollars for tuition 8 grants to qualified students who are enrolled in accredited 9 private institutions. 10 2. There is appropriated from the general fund of the state 11 to the commission for each fiscal year the sum of three hundred 12 seventy-six eighty-six thousand two hundred twenty dollars 13 for tuition grants for qualified students who are enrolled in 14 eligible institutions. Of the moneys appropriated under this 15 subsection , not more than eighty thousand dollars annually 16 shall be used for tuition grants to qualified students who 17 are attending an eligible institution under section 261.9, 18 subsection 3 , paragraph “b” . 19 Sec. 16. Section 261.86, subsection 1, unnumbered paragraph 20 1, Code 2019, is amended to read as follows: 21 A national guard educational assistance program service 22 scholarship is established to be administered by the college 23 student aid commission for members of the Iowa national guard 24 who are enrolled as undergraduate students in a community 25 college, an institution of higher learning under the state 26 board of regents, or an accredited private institution. The 27 college student aid commission shall adopt rules pursuant 28 to chapter 17A to administer this section . An individual 29 is eligible for the national guard educational assistance 30 service scholarship program if the individual meets all of the 31 following conditions: 32 Sec. 17. Section 261.86, subsection 1, paragraph a, Code 33 2019, is amended to read as follows: 34 a. Is a resident of the state and a member of an Iowa 35 -22- HF 758 (4) 88 kh/tm/md 22/ 32
H.F. 758 army or air national guard unit while receiving educational 1 assistance scholarship award payments issued pursuant to this 2 section . 3 Sec. 18. Section 261.86, subsections 2, 3, 4, and 5, Code 4 2019, are amended to read as follows: 5 2. Educational assistance Scholarship awards paid pursuant 6 to this section shall not exceed the resident tuition rate 7 established for institutions of higher learning under 8 the control of the state board of regents. If the amount 9 appropriated in a fiscal year for purposes of this section is 10 insufficient to provide educational assistance scholarships 11 to all national guard members who apply for the program and 12 who are determined by the adjutant general to be eligible 13 for the program, the adjutant general shall, in coordination 14 with the commission, determine the distribution of educational 15 assistance scholarships . However, educational assistance 16 scholarship awards paid pursuant to this section shall not 17 be less than fifty percent of the resident tuition rate 18 established for institutions of higher learning under the 19 control of the state board of regents or fifty percent of 20 the tuition rate at the institution attended by the national 21 guard member, whichever is lower. Neither eligibility nor 22 educational assistance scholarship award determinations shall 23 be based upon a national guard member’s unit, the location at 24 which drills are attended, or whether the eligible individual 25 is a member of the Iowa army or air national guard. 26 3. a. (1) An Except as provided in subparagraph (2), an 27 eligible member of the national guard, attending an institution 28 as provided in subsection 1 , paragraph “d” , shall not receive 29 educational assistance scholarship awards under this section 30 for more than one hundred twenty semester, or the equivalent, 31 credit hours of undergraduate study. 32 (2) An eligible member of the national guard, attending an 33 institution as provided in subsection 1, paragraph “d” , who is 34 enrolled in a program of education leading to a postsecondary 35 -23- HF 758 (4) 88 kh/tm/md 23/ 32
H.F. 758 degree that meets the eligibility requirements for the federal 1 Edith Nourse Rogers STEM scholarship established under 38 2 U.S.C. §3320, shall not receive scholarship awards issued under 3 this section for more than one hundred thirty semester, or the 4 equivalent, credit hours of undergraduate study. 5 (3) A national guard member who has met the educational 6 requirements for a baccalaureate degree is ineligible for 7 educational assistance a scholarship award under this section . 8 b. A member of the national guard who received educational 9 assistance under this section prior to July 1, 2015, shall 10 be deemed to have received educational assistance for the 11 following number of credit hours for educational assistance 12 received before that date: 13 (1) For each semester that the member received educational 14 assistance while attending an institution as a full-time 15 student, twelve credit hours. 16 (2) For each semester that the member received educational 17 assistance while attending an institution as a part-time 18 student, six credit hours. 19 (3) For each trimester or quarter that the member received 20 educational assistance while attending an institution as a 21 full-time or part-time student, the number of credit hours that 22 are determined to be the semester equivalent by the college 23 student aid commission. 24 4. The eligibility of applicants and scholarship award 25 amounts of educational assistance to be paid shall be 26 certified by the adjutant general of Iowa to the college 27 student aid commission, and all amounts that are or become 28 due to a community college, accredited private institution, 29 or institution of higher learning under the control of the 30 state board of regents under this section shall be paid to the 31 college or institution by the college student aid commission 32 upon receipt of certification by the president or governing 33 board of the educational institution as to accuracy of charges 34 made, and as to the attendance and academic progress of the 35 -24- HF 758 (4) 88 kh/tm/md 24/ 32
H.F. 758 individual at the educational institution. The college student 1 aid commission shall maintain an annual record of the number of 2 participants and the dollar value of the educational assistance 3 provided awards issued . 4 5. For purposes of this section , unless otherwise required, 5 “educational assistance” means the same as Scholarships awarded 6 under this section may be used by the recipient for the 7 recipient’s “cost of attendance” as defined in Tit. IV, pt. B, 8 of the federal Higher Education Act of 1965 as amended. 9 Sec. 19. Section 284.6A, Code 2019, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 2A. By January 15 of each year, the 12 department shall collect data from the prior fiscal year 13 regarding the status of computer science in Iowa’s school 14 districts and accredited nonpublic schools and shall summarize 15 the data in a report submitted to the general assembly. The 16 report shall include computer science instruction provided 17 by schools broken down by elementary, middle, and high 18 school, moneys deposited in the fund from public and private 19 sources, the amounts awarded, the impact of the provisions of 20 this section on teachers, and the department’s findings and 21 recommendations. 22 Sec. 20. Section 284.13, subsection 1, paragraphs a, b, c, 23 e, f, and g, Code 2019, are amended to read as follows: 24 a. For the fiscal year beginning July 1, 2018 2019 , and 25 ending June 30, 2019 2020 , to the department, the amount of 26 five hundred eight thousand two hundred fifty dollars for the 27 issuance of national board certification awards in accordance 28 with section 256.44 . Of the amount allocated under this 29 paragraph, not less than eighty-five thousand dollars shall 30 be used to administer the ambassador to education position in 31 accordance with section 256.45 . 32 b. For the fiscal year beginning July 1, 2018 2019 , and 33 ending June 30, 2019 2020 , up to seven hundred twenty-eight 34 thousand two hundred sixteen dollars to the department for 35 -25- HF 758 (4) 88 kh/tm/md 25/ 32
H.F. 758 purposes of implementing the professional development program 1 requirements of section 284.6 , assistance in developing model 2 evidence for teacher quality committees established pursuant to 3 section 284.4, subsection 1 , paragraph “b” , and the evaluator 4 training program in section 284.10 . A portion of the funds 5 allocated to the department for purposes of this paragraph may 6 be used by the department for administrative purposes and for 7 not more than four full-time equivalent positions. 8 c. For the fiscal year beginning July 1, 2018 2019 , 9 and ending June 30, 2019 2020 , an amount up to one million 10 seventy-seven thousand eight hundred ten dollars to the 11 department for the establishment of teacher development 12 academies in accordance with section 284.6, subsection 10 . A 13 portion of the funds allocated to the department for purposes 14 of this paragraph may be used for administrative purposes. 15 e. For the fiscal year beginning July 1, 2018 2019 , and 16 ending June 30, 2019 2020 , to the department an amount up to 17 twenty-five thousand dollars for purposes of the fine arts 18 beginning teacher mentoring program established under section 19 256.34 . 20 f. For the fiscal year beginning July 1, 2018 2019 , and 21 ending June 30, 2019 2020 , to the department an amount up 22 to six hundred twenty-six thousand one hundred ninety-one 23 dollars shall be used by the department for a delivery system, 24 in collaboration with area education agencies, to assist in 25 implementing the career paths and leadership roles considered 26 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 27 not limited to planning grants to school districts and area 28 education agencies, technical assistance for the department, 29 technical assistance for districts and area education agencies, 30 training and staff development, and the contracting of external 31 expertise and services. In using moneys allocated for purposes 32 of this paragraph, the department shall give priority to school 33 districts with certified enrollments of fewer than six hundred 34 students. A portion of the moneys allocated annually to the 35 -26- HF 758 (4) 88 kh/tm/md 26/ 32
H.F. 758 department for purposes of this paragraph may be used by the 1 department for administrative purposes and for not more than 2 five full-time equivalent positions. 3 g. For the fiscal year beginning July 1, 2019 2020 , and 4 for each subsequent fiscal year, to the department, ten 5 million dollars for purposes of implementing the supplemental 6 assistance for high-need schools provisions of section 284.11 . 7 Annually, of the moneys allocated to the department for 8 purposes of this paragraph, up to one hundred thousand dollars 9 may be used by the department for administrative purposes and 10 for not more than one full-time equivalent position. 11 Sec. 21. EFFECTIVE DATE. The following, being deemed of 12 immediate importance, takes effect upon enactment: 13 1. The section of this Act amending 2017 Iowa Acts, chapter 14 172, section 50, subsection 5, as amended by 2018 Iowa Acts, 15 chapter 1163, section 4. 16 2. The section of this Act amending 2017 Iowa Acts, chapter 17 172, section 50, subsection 12C, as enacted by 2018 Iowa Acts, 18 chapter 1163, section 4. 19 DIVISION II 20 WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS FY 2019-2020 21 Sec. 22. There is appropriated from the Iowa skilled worker 22 and job creation fund created in section 8.75 to the following 23 departments, agencies, and institutions for the fiscal year 24 beginning July 1, 2019, and ending June 30, 2020, the following 25 amounts, or so much thereof as is necessary, to be used for the 26 purposes designated: 27 1. DEPARTMENT OF EDUCATION 28 a. For distribution to community colleges for the purposes 1 of implementing adult education and literacy programs pursuant 2 to section 260C.50: 3 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,500,000 4 (1) From the moneys appropriated in this lettered paragraph 5 “b”, $3,883,000 shall be allocated pursuant to the formula 6 established in section 260C.18C. 7 (2) From the moneys appropriated in this lettered paragraph 8 “b”, not more than $150,000 shall be used by the department 9 for implementation of adult education and literacy programs 10 pursuant to section 260C.50. 11 (3) From the moneys appropriated in this lettered paragraph 12 “b”, not more than $1,257,000 shall be distributed as grants 13 to community colleges for the purpose of adult basic education 14 programs for students requiring instruction in English 15 as a second language. The department shall establish an 16 application process and criteria to award grants pursuant to 17 this subparagraph to community colleges. The criteria shall be 18 based on need for instruction in English as a second language 19 in the region served by each community college as determined by 20 factors including data from the latest federal decennial census 21 and outreach efforts to determine regional needs. 22 (4) From the moneys appropriated in this lettered paragraph 23 “b”, $210,000 shall be transferred to the department of human 24 services for purposes of administering a pilot project to 25 provide access to international resources to Iowans and new 26 Iowans to provide economic and leadership development resulting 27 in Iowa being a more inclusive and welcoming place to live, 28 work, and raise a family. The pilot project shall provide 29 supplemental support services for international refugees to 30 improve learning, English literacy, life skills, cultural 31 competencies, and integration in a county with a population 32 over 350,000 as determined by the 2010 federal decennial 33 census. The department of human services shall utilize a 34 request for proposals process to identify the entity best 35 -28- HF 758 (4) 88 kh/tm/md 28/ 32

Notwithstanding section 8.33, moneys appropriated 8 in this section of this Act that remain unencumbered or 9 unobligated at the close of the fiscal year shall not revert 10 but shall remain available for expenditure for the purposes 11 designated until the close of the succeeding fiscal year. 12 Sec. 23. IOWA INDUSTRIAL NEW JOBS TRAINING ACT —— FY 13 2018-2019 DEFINITIONS. Notwithstanding section 260E.2, for 14 the fiscal year beginning July 1, 2018, and ending June 30, 15 2019, “new job” includes a new, existing, or recalled job 16 in an industry which, for purposes of this section, means 17 a business existing on the effective date of this section 18 and located in a county with a population between 40,500 and 19 41,000, as determined by the 2010 federal decennial census, 20 that was declared a disaster area by the governor following a 21 weather-related natural disaster which impacted the county on 22 or about July 19, 2018. 23 Sec. 24. Section 260I.2, subsection 2, paragraph c, Code 24 2019, is amended to read as follows: 25 c. Moneys Except as provided in section 260I.10, subsection 26 4, moneys in the fund shall be allocated pursuant to the 27 formula established in section 260C.18C . Notwithstanding 28 section 8.33 , moneys in the fund at the close of the fiscal 29 year shall not revert to the general fund of the state but 30 shall remain available for expenditure for the purpose 31 designated for subsequent fiscal years. Notwithstanding 32 section 12C.7, subsection 2 , interest or earnings on moneys in 33 the fund shall be credited to the fund. 34 Sec. 25. Section 260I.3, subsection 1, Code 2019, is amended 35 -30- HF 758 (4) 88 kh/tm/md 30/ 32
H.F. 758 to read as follows: 1 1. The department state board of education, in consultation 2 with the economic development authority, shall adopt rules 3 pursuant to this chapter 17A defining eligibility criteria 4 for persons applying to receive tuition assistance under this 5 chapter . 6 Sec. 26. Section 260I.3, subsection 2, paragraph a, Code 7 2019, is amended to read as follows: 8 a. The applicant’s family income for the six three months 9 prior to the date of application or documentation of a 10 life-changing event . 11 Sec. 27. Section 260I.3, Code 2019, is amended by adding the 12 following new subsection: 13 NEW SUBSECTION . 6. The community college receiving the 14 application may limit an applicant to one eligible certificate 15 program or to eligible programs within one career pathway, 16 based on the funding available to the community college for 17 purposes of this program. 18 Sec. 28. Section 260I.4, subsection 4, Code 2019, is amended 19 by striking the subsection. 20 Sec. 29. Section 260I.7, Code 2019, is amended to read as 21 follows: 22 260I.7 Initial assessment. 23 An applicant for tuition assistance under this chapter shall 24 complete an initial assessment administered by the community 25 college receiving the application to determine the applicant’s 26 readiness to complete an eligible certificate program. The 27 assessment shall include assessments for completion of a 28 national career readiness certificate, including the areas of 29 reading for information, applied and mathematics , and locating 30 information . An applicant shall complete any additional 31 assessments and occupational research required by an eligible 32 certificate program. 33 Sec. 30. Section 260I.10, Code 2019, is amended by adding 34 the following new subsection: 35 -31- HF 758 (4) 88 kh/tm/md 31/ 32
H.F. 758 NEW SUBSECTION . 4. The department of education, in 1 coordination with the community colleges, may adjust the 2 allocations generated pursuant to section 260I, subsection 2, 3 paragraph “c” , to ensure efficient delivery of services. 4 Sec. 31. Section 260I.11, Code 2019, is amended to read as 5 follows: 6 260I.11 Rules. 7 The department of state board of education, in consultation 8 with the economic development authority and the community 9 colleges, shall adopt rules pursuant to chapter 17A and this 10 chapter to implement the provisions of this chapter . 11 Sec. 32. EFFECTIVE DATE.
