H.F. 485 Section 1. Section 8A.311, subsection 10, paragraph a, Code 1 2019, is amended to read as follows: 2 a. The director shall adopt rules providing that any state 3 agency may, upon request and approval by the department, 4 purchase directly from a vendor if the direct purchasing is 5 more economical than purchasing through the department, if the 6 agency shows that direct purchasing by the state agency would 7 be in the best interests of the state due to an immediate or 8 emergency need, or if the purchase will not exceed ten thousand 9 dollars an amount, not to exceed twenty-five thousand dollars, 10 determined by the department by rule and the purchase would 11 contribute to the agency complying with the targeted small 12 business procurement goals under sections 73.15 through 73.21 . 13 Sec. 2. Section 8A.311, subsection 10, Code 2019, is amended 14 by adding the following new paragraph: 15 NEW PARAGRAPH . c. By January 15 of each year, the 16 department shall submit to the general assembly electronically 17 an annual report of contracts awarded to targeted small 18 businesses, as defined in section 15.102, in the previous 19 fiscal year pursuant to paragraph “a” authorizing direct 20 purchasing by a state agency if the purchase will not exceed 21 an amount determined by the department by rule and would 22 contribute to the agency complying with the targeted small 23 business goals under sections 73.15 through 73.21. 24 -1- HF 485 (3) 88 ec/rn/md 1/ 1
