H.F. 2642 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 14 a. (1) For deposit in the water quality initiative fund 15 created in section 466B.45 for purposes of supporting the 16 water quality initiative administered by the division of soil 17 conservation and water quality as provided in section 466B.42, 18 including salaries, support, maintenance, and miscellaneous 19 purposes, notwithstanding section 8.57, subsection 5, paragraph 20 “c”: 21 FY 2020-2021: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 23 (2) (a) The moneys appropriated in this lettered 24 paragraph shall be used to support demonstration projects in 25 subwatersheds as designated by the department that are part 26 of high-priority watersheds identified by the water resources 27 coordinating council. 28 (b) The moneys appropriated in this lettered paragraph 29 shall be used to support demonstration projects in watersheds 30 generally, including regional watersheds, as designated by the 31 division and high-priority watersheds identified by the water 32 resources coordinating council. 33 (3) In supporting projects in watersheds and subwatersheds 34 as provided in subparagraph (2), subparagraph divisions (a) and 35 -1- HF 2642 (2) 88 ec/tm/md 1/ 16
H.F. 2642 (b), all of the following shall apply: 1 (a) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (b) The division shall implement demonstration projects 8 as provided in subparagraph division (a) by providing 9 for participation by persons who hold a legal interest in 10 agricultural land used in farming. To every extent practical, 11 the division shall provide for collaborative participation by 12 such persons who hold a legal interest in agricultural land 13 located within the same subwatershed. 14 (c) The division shall implement demonstration projects on 15 a cost-share basis as determined by the division. Except for 16 edge-of-field practices, the state’s share of the amount shall 17 not exceed 50 percent of the estimated cost of establishing the 18 practice as determined by the division or 50 percent of the 19 actual cost of establishing the practice, whichever is less. 20 (d) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (e) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record. 32 (4) The moneys appropriated in this lettered paragraph 33 shall be used to support education and outreach in a manner 34 that encourages persons who hold a legal interest in 35 -2- HF 2642 (2) 88 ec/tm/md 2/ 16
H.F. 2642 agricultural land used for farming to implement water quality 1 practices, including the establishment of such practices in 2 watersheds generally, and not limited to subwatersheds or 3 high-priority watersheds. 4 (5) The moneys appropriated in this lettered paragraph 5 may be used to contract with persons to coordinate the 6 implementation of efforts provided in this paragraph. 7 (6) The moneys appropriated in this lettered paragraph 8 may be used by the department to support urban soil and water 9 conservation efforts, which may include but are not limited 10 to management practices related to bioretention, landscaping, 11 the use of permeable or pervious pavement, and soil quality 12 restoration. The moneys shall be allocated on a cost-share 13 basis as provided in chapter 161A. 14 (7) Notwithstanding any other provision of law to the 15 contrary, the department may use moneys appropriated in 16 this lettered paragraph to carry out the provisions of this 17 paragraph on a cost-share basis in combination with other 18 moneys available to the department from a state or federal 19 source. 20 (8) Not more than 10 percent of the moneys appropriated in 21 this lettered paragraph may be used for costs of administration 22 and implementation of the water quality initiative administered 23 by the soil conservation division. 24 b. For Except as provided in subsection 2, for purposes 1 of section 8.33 , unless specifically provided otherwise, 2 unencumbered or unobligated moneys made from an appropriation 3 in this division of this Act shall not revert but shall remain 4 available for expenditure for the purposes designated until the 5 close of the fiscal year that ends three years after the end of 6 the fiscal year for which the appropriation is made. However, 7 if the project or projects for which such appropriation was 8 made are completed in an earlier fiscal year, unencumbered 9 or unobligated moneys shall revert at the close of that same 10 fiscal year. 11 2. EFFECTIVE DATE. This division of this Act, being 19 deemed of immediate importance, takes effect upon enactment. 20 DIVISION IV 21 MISCELLANEOUS PROVISIONS 22 Sec. 11. Section 2.12B, Code 2020, is amended by adding the 23 following new subsection: 24 NEW SUBSECTION . 2A. The facilities manager for facilities 25 under the control of the general assembly shall develop and 26 submit to the legislative council by December 15, 2020, a 27 five-year maintenance project schedule report, with annual 28 written updates thereafter, for the Iowa state capitol and the 29 Ola Babcock Miller building. 30 Sec. 12. Section 8.57C, subsection 3, paragraph a, 31 subparagraph (2), Code 2020, is amended to read as follows: 32 (2) The fiscal year beginning July 1, 2020 2021 , and for 33 each subsequent fiscal year thereafter. 34 Sec. 13. There is appropriated from the rebuild 2 Iowa infrastructure fund for the fiscal year beginning July 1, 3 2020, and ending June 30, 2021, the sum of seventeen million 4 five hundred thousand dollars to the technology reinvestment 5 fund, notwithstanding section 8.57, subsection 5, paragraph 6 “c” . 7 Sec. 14. ROUTINE MAINTENANCE FUND. Notwithstanding the 8 standing appropriation in section 8A.330, there is appropriated 9 from the rebuild Iowa infrastructure fund to the department of 10 administrative services for deposit in the routine maintenance 11 fund established in section 8A.330 for the fiscal year 12 beginning July 1, 2020, the sum of one million dollars. 13 DIVISION V 14 REBUILD IOWA INFRASTRUCTURE FUND APPROPRIATION 15 Sec. 15. IOWA ECONOMIC EMERGENCY FUND TRANSFERS. 16 Notwithstanding any provision of section 8.55 to the contrary 17 and for purposes of transfers from the Iowa economic emergency 18 fund created in section 8.55 as provided in this section during 19 the fiscal year beginning July 1, 2020, the maximum balance of 20 the Iowa economic emergency fund is the amount equal to two 21 and one-half percent of the adjusted revenue estimate for the 22 fiscal year beginning July 1, 2020. If the amount of moneys 23 in the Iowa economic emergency fund is equal to the maximum 24 balance, moneys in excess of this amount shall be distributed 25 as follows during the fiscal year beginning July 1, 2020: 26 1. The first seventy million dollars shall be transferred to 27 the general fund of the state. 28 2. Of the excess remaining after the transfer in subsection 29 1, the difference, reduced by the transfer made in subsection 30 1, between the actual net revenue for the general fund of the 31 state for the fiscal year beginning July 1, 2019, and ending 32 June 30, 2020, and the adjusted revenue estimate for the fiscal 33 year beginning July 1, 2019, and ending June 30, 2020, shall 34 be transferred to the taxpayer relief fund created in section 35 -15- HF 2642 (2) 88 ec/tm/md 15/ 16
H.F. 2642 8.57E. 1 3. The remainder of the excess, if any, shall be transferred 2 to the general fund of the state. 3 Sec. 16. REBUILD IOWA INFRASTRUCTURE FUND —— GENERAL FUND 4 APPROPRIATION. There is appropriated from the general fund 5 of the state for the fiscal year beginning July 1, 2019, and 6 ending June 30, 2020, to the rebuild Iowa infrastructure fund 7 created in section 8.57, the sum of seventy million dollars. 8 Sec. 17. EFFECTIVE DATE. This division of this Act, being 9 deemed of immediate importance, takes effect upon enactment. 10 Sec. 18. RETROACTIVE APPLICABILITY. This division of this 11 Act applies retroactively to June 1, 2020. 12 DIVISION VI 13 CONTINGENT EFFECTIVE DATE AND RETROACTIVE APPLICABILITY 14 Sec. 19. EFFECTIVE UPON ENACTMENT. Unless otherwise 15 provided, this Act, if approved by the governor on or after 16 July 1, 2020, takes effect upon enactment. 17 Sec. 20. RETROACTIVE APPLICABILITY.
