The report shall describe in 26 detail the expenditure of moneys appropriated in this section 27 to support the department’s administration, regulation, and 28 programs. 29 DESIGNATED APPROPRIATIONS 30 MISCELLANEOUS FUNDS 31 Sec. 2. UNCLAIMED PARI-MUTUEL WAGERING WINNINGS —— 32 HORSE AND DOG RACING. The department shall establish and administer programs 20 for the auditing of motor fuel including biofuel processing 21 and production plants, for screening and testing motor fuel, 22 including renewable fuel, and for the inspection of motor fuel 23 sold by dealers including retail dealers who sell and dispense 24 motor fuel from motor fuel pumps. 25 SPECIAL APPROPRIATIONS 26 GENERAL FUND 27 Sec. 4. DAIRY REGULATION. 28 1. There is appropriated from the general fund of the state 29 to the department of agriculture and land stewardship for the 30 fiscal year beginning July 1, 2017, and ending June 30, 2018, 31 the following amount, or so much thereof as is necessary, to be 32 used for the purposes designated: 33 For purposes of performing functions pursuant to section 34 192.109 , including conducting a survey of grade “A” milk and 35 -2- SF 510 (5) 87 da/rn/jh 2/ 45

LOCAL FOOD AND FARM PROGRAM. 8 1. The department shall enter into a cost-sharing agreement 17 with Iowa state university of science and technology to support 18 the local food and farm program coordinator position as part of 19 the university’s cooperative extension service in agriculture 20 and home economics pursuant to chapter 267A . 21 3. Notwithstanding section 8.33 , moneys appropriated in 22 this section that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available to be used for the purposes designated until the 25 close of the succeeding fiscal year. 26 Sec. 6. AGRICULTURAL EDUCATION. 27 1. There is appropriated from the general fund of the state 28 to the department of agriculture and land stewardship for the 29 fiscal year beginning July 1, 2017, and ending June 30, 2018, 30 the following amount, or so much thereof as is necessary, to be 31 used for the purposes designated: 32 For purposes of allocating moneys to an Iowa association 33 affiliated with a national organization which promotes 34 agricultural education providing for future farmers: 35 -3- SF 510 (5) 87 da/rn/jh 3/ 45

FARMERS WITH DISABILITIES PROGRAM. 7 1. There is appropriated from the general fund of the state 8 to the department of agriculture and land stewardship for the 9 fiscal year beginning July 1, 2017, and ending June 30, 2018, 10 the following amount, or so much thereof as is necessary, to be 11 used for the purposes designated: 12 For purposes of supporting a program for farmers with 13 disabilities: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 130,000 15 2. The moneys appropriated in subsection 1 shall be used for 16 the public purpose of providing a grant to a national nonprofit 17 organization with over 80 years of experience in assisting 18 children and adults with disabilities and special needs. The 19 moneys shall be used to support a nationally recognized program 20 that began in 1986 and has been replicated in at least 30 other 21 states, but which is not available through any other entity 22 in this state, and that provides assistance to farmers with 23 disabilities in all 99 counties to allow the farmers to remain 24 in their own homes and be gainfully engaged in farming through 25 provision of agricultural worksite and home modification 26 consultations, peer support services, services to families, 27 information and referral, and equipment loan services. 28 3. Notwithstanding section 8.33 , moneys appropriated in 29 this section that remain unencumbered or unobligated at the 30 close of the fiscal year shall not revert but shall remain 31 available for expenditure for the purposes designated until the 32 close of the succeeding fiscal year. 33 DIVISION II 34 GENERAL FUND 35 -4- SF 510 (5) 87 da/rn/jh 4/ 45
S.F. 510 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 1 WATER QUALITY INITIATIVE 2 APPROPRIATIONS FOR FY 2017-2018 3 Sec. 8. WATER QUALITY INITIATIVE —— GENERAL. 4 1. There is appropriated from the general fund of the state 5 to the department of agriculture and land stewardship for the 6 fiscal year beginning July 1, 2017, and ending June 30, 2018, 7 the following amount, or so much thereof as is necessary, to be 8 used for the purposes designated: 9 For deposit in the water quality initiative fund created in 10 section 466B.45 , for purposes of supporting the water quality 11 initiative administered by the division of soil conservation 12 and water quality as provided in section 466B.42 , including 13 salaries, support, maintenance, and miscellaneous purposes: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 15 2. a. The moneys appropriated in subsection 1 shall be 16 used to support projects in subwatersheds as designated by the 17 division that are part of high-priority watersheds identified 18 by the water resources coordinating council established 19 pursuant to section 466B.3 . 20 b. The moneys appropriated in subsection 1 shall be used to 21 support projects in watersheds generally, including regional 22 watersheds, as designated by the division and high-priority 23 watersheds identified by the water resources coordinating 24 council established pursuant to section 466B.3. 25 3. In supporting projects in subwatersheds and watersheds 26 as provided in subsection 2, all of the following shall apply: 27 a. The demonstration projects shall utilize water quality 28 practices as described in the latest revision of the document 29 entitled “Iowa Nutrient Reduction Strategy” initially presented 30 in November 2012 by the department of agriculture and land 31 stewardship, the department of natural resources, and Iowa 32 state university of science and technology. 33 b. The division shall implement demonstration projects as 34 provided in paragraph “a” by providing for participation by 35 -5- SF 510 (5) 87 da/rn/jh 5/ 45
S.F. 510 persons who hold a legal interest in agricultural land used in 1 farming. To every extent practical, the division shall provide 2 for collaborative participation by such persons who hold a 3 legal interest in agricultural land located within the same 4 subwatershed. 5 c. The division shall implement a demonstration project on 6 a cost-share basis as determined by the division. However, 7 except for edge-of-field practices, the state’s share of the 8 amount shall not exceed 50 percent of the estimated cost of 9 establishing the practice as determined by the division or 10 50 percent of the actual cost of establishing the practice, 11 whichever is less. 12 d. The demonstration projects shall be used to educate other 13 persons about the feasibility and value of establishing similar 14 water quality practices. The division shall promote field day 15 events for purposes of allowing interested persons to establish 16 water quality practices on their agricultural land. 17 e. The division shall conduct water quality evaluations 18 within supported subwatersheds. Within a reasonable period 19 after accumulating information from such evaluations, the 20 division shall create an aggregated database of water quality 21 practices. Any information identifying a person holding a 22 legal interest in agricultural land or specific agricultural 23 land shall be a confidential record under section 22.7 . 24 4. The moneys appropriated in subsection 1 shall be used 25 to support education and outreach in a manner that encourages 26 persons who hold a legal interest in agricultural land used for 27 farming to implement water quality practices, including the 28 establishment of such practices in watersheds generally, and 29 not limited to subwatersheds or high-priority watersheds. 30 5. The moneys appropriated in subsection 1 may be used 31 to contract with persons to coordinate the implementation of 32 efforts provided in this section. 33 6. The moneys appropriated in subsection 1 may be used by 34 the department to support urban soil and water conservation 35 -6- SF 510 (5) 87 da/rn/jh 6/ 45
S.F. 510 efforts, which may include but are not limited to management 1 practices related to bioretention, landscaping, the use of 2 permeable or pervious pavement, and soil quality restoration. 3 The moneys shall be allocated on a cost-share basis as provided 4 in chapter 161A. 5 7. Notwithstanding any other provision of law to the 6 contrary, the department may use moneys appropriated in 7 subsection 1 to carry out the provisions of this section on a 8 cost-share basis in combination with other moneys available to 9 the department from a state or federal source. 10 8. Not more than 10 percent of the moneys appropriated in 11 this section may be used to pay for the costs of administering 12 and implementing the water quality initiative by the 13 department’s division of soil conservation and water quality as 14 provided in section 466B.42 and this section. 15 DIVISION III 16 DEPARTMENT OF NATURAL RESOURCES 17 GENERAL APPROPRIATIONS FOR FY 2017-2018 18 Sec. 9. GENERAL FUND —— DEPARTMENT. 19 1. There is appropriated from the general fund of the state 20 to the department of natural resources for the fiscal year 21 beginning July 1, 2017, and ending June 30, 2018, the following 22 amount, or so much thereof as is necessary, to be used for the 23 purposes designated: 24 For purposes of supporting the department, including its 25 divisions, for administration, regulation, and programs; for 26 salaries, support, maintenance, and miscellaneous purposes; and 27 for not more than the following full-time equivalent positions: 28 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,299,811 29 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . STATE FISH AND GAME PROTECTION FUND —— REGULATION 12 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 13 1. There is appropriated from the state fish and game 14 protection fund to the department of natural resources for the 15 fiscal year beginning July 1, 2017, and ending June 30, 2018, 16 the following amount, or so much thereof as is necessary, to be 17 used for the purposes designated: 18 For purposes of supporting the regulation or advancement of 19 hunting, fishing, or trapping, or the protection, propagation, 20 restoration, management, or harvest of fish or wildlife, 21 including for administration, regulation, law enforcement, and 22 programs; and for salaries, support, maintenance, equipment, 23 and miscellaneous purposes: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 43,147,993 25 2. Notwithstanding section 455A.10 , the department may use 26 the unappropriated balance remaining in the state fish and game 27 protection fund to provide for the funding of health and life 28 insurance premium payments from unused sick leave balances of 29 conservation peace officers employed in a protection occupation 30 who retire, pursuant to section 97B.49B . 31 3. Notwithstanding section 455A.10 , the department of 32 natural resources may use the unappropriated balance remaining 33 in the state fish and game protection fund for the fiscal 34 year beginning July 1, 2017, and ending June 30, 2018, as is 35 -8- SF 510 (5) 87 da/rn/jh 8/ 45
S.F. 510 necessary to fund salary adjustments for departmental employees 1 for which the general assembly has made an operating budget 2 appropriation in subsection 1. 3 Sec. 11. GROUNDWATER PROTECTION FUND —— WATER 4 QUALITY. Notwithstanding section 8.33 , moneys appropriated in 20 subsection 1 that remain unencumbered or unobligated at the 21 close of the fiscal year shall not revert but shall remain 22 available for expenditure for the purposes designated until the 23 close of the succeeding fiscal year. 24 Sec. 15. FORESTRY HEALTH MANAGEMENT. 25 1. VETERINARY DIAGNOSTIC LABORATORY. 8 1. There is appropriated from the general fund of the state 9 to Iowa state university of science and technology for the 10 fiscal year beginning July 1, 2017, and ending June 30, 2018, 11 the following amount, or so much thereof as is necessary, to be 12 used for the purposes designated: 13 For purposes of supporting the college of veterinary 14 medicine for the operation of the veterinary diagnostic 15 laboratory and for not more than the following full-time 16 equivalent positions: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,000,000 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Iowa state university of science and technology 20 shall not reduce the amount that it allocates to support the 21 college of veterinary medicine from any other source due to the 22 appropriation made in this section. 23 b. Paragraph “a” does not apply to a reduction made to 24 support the college of veterinary medicine, if the same 25 percentage of reduction imposed on the college of veterinary 26 medicine is also imposed on all of Iowa state university of 27 science and technology’s budget units. 28 3. If by June 30, 2018, Iowa state university of science and 29 technology fails to allocate the moneys appropriated in this 30 section to the college of veterinary medicine in accordance 31 with this section, the moneys appropriated in this section for 32 that fiscal year shall revert to the general fund of the state. 33 DIVISION V 34 ENVIRONMENT FIRST FUND 35 -11- SF 510 (5) 87 da/rn/jh 11/ 45

CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 9 a. Of any remaining amount of that appropriation 22 allocated by the department to a district, 30 percent may be 23 expended by the district for that same purpose. 24 e. Not more than 5 percent of the moneys appropriated in 25 paragraph “c” may be allocated for cost sharing to address 26 complaints filed under section 161A.47 . 27 f. Of the moneys appropriated in paragraph “c”, 5 percent 28 shall be allocated for financial incentives to establish 29 practices to protect watersheds above publicly owned lakes of 30 the state from soil erosion and sediment as provided in section 31 161A.73 . 32 g. The state soil conservation committee established by 33 section 161A.4 may allocate moneys appropriated in paragraph 34 “c” to conduct research and demonstration projects to promote 35 -14- SF 510 (5) 87 da/rn/jh 14/ 45
S.F. 510 conservation tillage and nonpoint source pollution control 1 practices. 2 h. The allocation of moneys as financial incentives as 3 provided in section 161A.73 may be used in combination with 4 moneys allocated by the department of natural resources. 5 i. Not more than 15 percent of the moneys appropriated 6 in paragraph “c” may be used for costs of administration and 7 implementation of soil and water conservation practices. 8 j. In lieu of moneys appropriated in section 466A.5 , not 9 more than $25,000 of the moneys appropriated in paragraph “c” 10 shall be used by the division of soil conservation and water 11 quality of the department of agriculture and land stewardship 12 to provide administrative support to the watershed improvement 13 review board established in section 466A.3 . 14 Sec. 18. DEPARTMENT OF NATURAL RESOURCES. S.F. 510 to be used for the purposes designated until the close of the 1 succeeding fiscal year, or until the project for which the 2 appropriation was made is completed, whichever is earlier. 3 b. Notwithstanding section 8.33, moneys appropriated for 4 the fiscal year beginning July 1, 2017, in this division of 5 this Act to the department of agriculture and land stewardship 6 to provide financial assistance for the establishment of 7 permanent soil and water conservation practices that remain 8 unencumbered or unobligated at the close of the fiscal year 9 shall not revert but instead shall remain available for 10 expenditure for the purposes designated until the close of the 11 fiscal year beginning July 1, 2020. 12 2. Subsection 1 does not apply to moneys transferred 13 pursuant to this division to the loess hills development and 14 conservation fund created in section 161D.2 which shall not 15 revert as provided in that section. 16 DIVISION VI 17 ENVIRONMENT FIRST FUND 18 SPECIAL APPROPRIATIONS FOR FY 2017-2018 19 Sec. 20. WATER QUALITY INITIATIVE —— DEPARTMENT OF 20 AGRICULTURE AND LAND STEWARDSHIP. 21 1. There is appropriated from the environment first fund 22 created in section 8.57A to the department of agriculture 23 and land stewardship for the fiscal year beginning July 1, 24 2017, and ending June 30, 2018, the following amount, or so 25 much thereof as is necessary, to be used for the purposes 26 designated: 27 For deposit in the water quality initiative fund created in 28 section 466B.45 , for purposes of supporting the water quality 29 initiative administered by the division of soil conservation 30 and water quality as provided in section 466B.42 , including 31 salaries, support, maintenance, and miscellaneous purposes: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,375,000 33 2. a. The moneys appropriated in subsection 1 shall be 34 used to support projects in subwatersheds as designated by the 35 -17- SF 510 (5) 87 da/rn/jh 17/ 45
S.F. 510 division that are part of high-priority watersheds identified 1 by the water resources coordinating council established 2 pursuant to section 466B.3 . 3 b. The moneys appropriated in subsection 1 shall be used to 4 support projects in watersheds generally, including regional 5 watersheds, as designated by the division and high-priority 6 watersheds identified by the water resources coordinating 7 council established pursuant to section 466B.3. 8 3. In supporting projects in subwatersheds and watersheds 9 as provided in subsection 2, all of the following shall apply: 10 a. The demonstration projects shall utilize water quality 11 practices as described in the latest revision of the document 12 entitled “Iowa Nutrient Reduction Strategy” initially presented 13 in November 2012 by the department of agriculture and land 14 stewardship, the department of natural resources, and Iowa 15 state university of science and technology. 16 b. The division shall implement demonstration projects as 17 provided in paragraph “a” by providing for participation by 18 persons who hold a legal interest in agricultural land used in 19 farming. To every extent practical, the division shall provide 20 for collaborative participation by such persons who hold a 21 legal interest in agricultural land located within the same 22 subwatershed. 23 c. The division shall implement a demonstration project on 24 a cost-share basis as determined by the division. However, 25 except for edge-of-field practices, the state’s share of the 26 amount shall not exceed 50 percent of the estimated cost of 27 establishing the practice as determined by the division or 28 50 percent of the actual cost of establishing the practice, 29 whichever is less. 30 d. The demonstration projects shall be used to educate other 31 persons about the feasibility and value of establishing similar 32 water quality practices. The division shall promote field day 33 events for purposes of allowing interested persons to establish 34 water quality practices on their agricultural land. 35 -18- SF 510 (5) 87 da/rn/jh 18/ 45
S.F. 510 e. The division shall conduct water quality evaluations 1 within supported subwatersheds. Within a reasonable period 2 after accumulating information from such evaluations, the 3 division shall create an aggregated database of water quality 4 practices. Any information identifying a person holding a 5 legal interest in agricultural land or specific agricultural 6 land shall be a confidential record under section 22.7 . 7 4. The moneys appropriated in subsection 1 shall be used 8 to support education and outreach in a manner that encourages 9 persons who hold a legal interest in agricultural land used for 10 farming to implement water quality practices, including the 11 establishment of such practices in watersheds generally, and 12 not limited to subwatersheds or high-priority watersheds. 13 5. The moneys appropriated in subsection 1 may be used 14 to contract with persons to coordinate the implementation of 15 efforts provided in this section. 16 6. The moneys appropriated in subsection 1 may be used by 17 the department to support urban soil and water conservation 18 efforts, which may include but are not limited to management 19 practices related to bioretention, landscaping, the use of 20 permeable or pervious pavement, and soil quality restoration. 21 The moneys shall be allocated on a cost-share basis as provided 22 in chapter 161A. 23 7. Notwithstanding any other provision of law to the 24 contrary, the department may use moneys appropriated in 25 subsection 1 to carry out the provisions of this section on a 26 cost-share basis in combination with other moneys available to 27 the department from a state or federal source. 28 8. Not more than 10 percent of the moneys appropriated in 29 this section may be used to pay for the costs of administering 30 and implementing the water quality initiative by the 31 department’s division of soil conservation and water quality as 32 provided in section 466B.42 and this section. 33 Sec. 21. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. 34 Notwithstanding the standing appropriation in section 455A.18, 35 -19- SF 510 (5) 87 da/rn/jh 19/ 45
S.F. 510 there is appropriated from the environment first fund created 1 in section 8.57A to the Iowa resources enhancement and 2 protection fund, in lieu of the appropriation made in section 3 455A.18, for the fiscal year beginning July 1, 2017, and 4 ending June 30, 2018, the following amount, to be allocated as 5 provided in section 455A.19: 6 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 7 DIVISION VII 8 ELIMINATION OF WATERSHED IMPROVEMENT REVIEW BOARD 9 SPECIAL APPROPRIATION FOR FY 2017-2018 10 RELATED STATUTORY CHANGES 11 Sec. 22. MANAGEMENT OF MONEYS IN THE WATERSHED IMPROVEMENT 12 FUND —— APPROPRIATION. 13 1. Notwithstanding section 466A.2, and the repeal of 14 chapter 466A as provided in this division of this Act, on and 15 after December 31, 2017, the department of agriculture and land 16 stewardship shall manage the watershed improvement fund in the 17 same manner as required in 2016 Acts, chapter 1134, section 18 35, including by making necessary payments to satisfy any 19 outstanding obligations incurred by the watershed improvement 20 review board prior to December 31, 2017. 21 2. Any unobligated and unencumbered moneys remaining in 22 the watershed improvement fund on December 31, 2017, are 23 appropriated to the department for use by the department in 24 providing for soil and water conservation administration, the 25 conservation of soil and water resources, or the support of 26 soil and water conservation districts in the same manner as 27 provided in the section of this Act appropriating moneys to the 28 department from the environment first fund created in section 29 8.57A. 30 Sec. 23. Section 461.33, subsection 2, paragraph a, Code 31 2017, is amended to read as follows: 32 a. Soil conservation and watershed protection, including by 33 supporting the division of soil conservation and water quality 34 within the department of agriculture and land stewardship 35 -20- SF 510 (5) 87 da/rn/jh 20/ 45
S.F. 510 and soil and water conservation district commissioners. The 1 department may provide for the installation of conservation 2 practices and watershed protection improvements as provided in 3 chapters 161A , 161C , 461A , and 466 , and 466A . 4 Sec. 24. REPEAL. Chapter 466A, Code 2017, is repealed. 5 Sec. 25. EFFECTIVE DATES. 6 1. The section of this division of this Act repealing 7 chapter 466A takes effect January 1, 2018. 8 2. The remainder of the provisions in this division of this 9 Act take effect July 1, 2017. 10 DIVISION VIII 11 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 12 SPECIAL USE OF MONEYS FOR FY 2017-2018 13 Sec. 26. OPEN SPACES ACCOUNT —— PARK MAINTENANCE AND 14 REPAIR. Notwithstanding section 455A.19, subsection 1, 15 paragraph “a”, subparagraph (1), of the moneys allocated to 16 the open spaces account of the Iowa resources enhancement and 17 protection fund, $288,000 shall be used by the department of 18 natural resources for state park maintenance and repair for 19 the fiscal year beginning July 1, 2017, and ending on June 30, 20 2018. 21 DIVISION IX 22 LIVESTOCK HEALTH SPECIAL APPROPRIATION FOR FY 2017-2018 23 GENERAL FUND —— RELATED STATUTORY CHANGES 24 Sec. 27. FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK —— 25 APPROPRIATION. There is appropriated from the general fund of 26 the state to the department of agriculture and land stewardship 27 for the fiscal year beginning July 1, 2017, and ending June 30, 28 2018, the following amount, or so much thereof as is necessary, 29 to be used for the purposes designated: 30 1. For deposit in the foreign animal disease preparedness 31 and response fund created in section 163.3B as enacted in this 32 division of this Act: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 34 2. In developing a foreign animal disease preparedness and 35 -21- SF 510 (5) 87 da/rn/jh 21/ 45
S.F. 510 response strategy as required in section 163.3C as enacted in 1 this division of this Act, the department shall prepare an 2 interim report to be submitted to the joint appropriations 3 subcommittee on agriculture and natural resources not later 4 than January 10, 2018. The interim report shall include 5 preliminary findings and recommendations together with plans 6 for completing the strategy. The department shall prepare 7 a final report to be submitted to the joint appropriations 8 subcommittee on agriculture and natural resources not later 9 than January 10, 2019. The report shall include final 10 findings and recommendations for establishing the strategy, 11 and may include any proposed notice of intended action for 12 consideration by the department or proposed legislation for 13 consideration by the general assembly. 14 Sec. 28. NEW SECTION . 163.3B Foreign animal disease 15 preparedness and response fund. 16 1. A foreign animal disease preparedness and response 17 fund is created in the state treasury under the control and 18 management of the department. 19 2. The fund shall include moneys appropriated by the general 20 assembly credited to the fund. The fund may include other 21 moneys available to and obtained or accepted by the department 22 as provided in section 159.6A, including but not limited to the 23 federal government, other public sources, or private sources. 24 3. Moneys in the fund are appropriated to the department and 25 shall be used exclusively to develop, establish, and implement 26 a foreign animal disease preparedness and response strategy 27 as described in section 163.3C, and shall not require further 28 special authorization by the general assembly. 29 4. a. Notwithstanding section 12C.7, interest or earnings 30 on moneys in the fund shall be credited to the fund. 31 b. Notwithstanding section 8.33, moneys credited to the fund 32 that remain unexpended or unobligated at the end of a fiscal 33 year shall not revert to any other fund. 34 Sec. 29. NEW SECTION . 163.3C Foreign animal disease 35 -22- SF 510 (5) 87 da/rn/jh 22/ 45
S.F. 510 preparedness and response strategy. 1 1. As used in this section, unless the context otherwise 2 requires: 3 a. “Foreign animal disease” means a disease introduced into 4 this state that negatively affects the health of livestock 5 and is transmittable between the same or different species of 6 livestock. 7 b. “Livestock” means an animal belonging to the bovine, 8 caprine, equine, ovine, or porcine species, ostriches, rheas, 9 emus; farm deer as defined in section 170.1; or turkeys, 10 chickens, or other poultry. 11 2. The department shall develop and establish a foreign 12 animal disease preparedness and response strategy for use by 13 the department in order to prevent, control, or eradicate the 14 transmission of foreign animal diseases among populations 15 of livestock. The strategy may be part of the department’s 16 veterinary emergency preparedness and response services 17 as provided in section 163.3A. The strategy shall provide 18 additional expertise and resources to increase biosecurity 19 efforts that assist in the prevention of a foreign animal 20 disease outbreak in this state. In developing and establishing 21 the strategy, the department shall consult with interested 22 persons including but not limited to the following: 23 a. The Iowa cattlemen’s association. 24 b. The Iowa state dairy association. 25 c. The Iowa pork producers association. 26 d. The Iowa sheep producers industry association. 27 e. The Iowa turkey federation. 28 f. The Iowa poultry association. 29 g. The college of veterinary medicine at Iowa state 30 university. 31 h. The livestock health advisory council created in section 32 267.2. 33 3. The department shall implement the foreign animal 34 disease preparedness and response strategy if necessary 35 -23- SF 510 (5) 87 da/rn/jh 23/ 45
S.F. 510 to prevent, control, or eradicate the transmission and 1 incidence of foreign animal diseases that may threaten or 2 actually threaten livestock in this state. In implementing 3 the strategy, the department may utilize emergency response 4 measures as otherwise required under section 163.3A. The 5 department may but is not required to consult with interested 6 persons when implementing the strategy. 7 DIVISION X 8 APPROPRIATION AND STATUTORY CHANGES —— ELIMINATION 9 OF LEOPOLD CENTER FOR SUSTAINABLE AGRICULTURE 10 Sec. 30. Section 266.39A, Code 2017, is amended to read as 11 follows: 12 266.39A Agricultural research. 13 Iowa state university of science and technology shall 14 conduct continuing agricultural research to provide information 15 about environmental and social impacts of agricultural research 16 on the small or family farm and information about population 17 trends and impact of the trends on Iowa agriculture , in 18 addition to research that may include the categories specified 19 in section 266.39B, subsection 2 . The research shall include 20 an agricultural land tenure study conducted every five years to 21 determine the ownership of farmland, and to analyze ownership 22 trends, using the categories of land ownership defined in 23 chapter 9H . The study shall be conducted on the basis of 24 regions established by the university. A region shall be 25 composed of not more than twenty-three contiguous counties. 26 Sec. 31. Section 455E.11, subsection 2, paragraph b, 27 subparagraph (3), subparagraph division (a), Code 2017, is 28 amended to read as follows: 29 (a) Thirty-five percent is appropriated annually for 30 the Leopold center for sustainable agriculture at Iowa state 31 university of science and technology to the Iowa nutrient 32 research fund created in section 466B.46 . 33 Sec. 32. Section 466B.46, subsection 2, Code 2017, is 34 amended by adding the following new paragraph: 35 -24- SF 510 (5) 87 da/rn/jh 24/ 45
S.F. 510 NEW PARAGRAPH . 0b. Moneys appropriated from the agriculture 1 management account of the groundwater protection fund pursuant 2 to section 455E.11, subsection 2, paragraph “b” , subparagraph 3 (3), subparagraph division (a). 4 Sec. 33. ONGOING ACTIVITIES AND EXPENSES. 5 1. Until July 1, 2017, the Leopold center for sustainable 6 agriculture established in section 266.39 shall not initiate 7 any new activity that otherwise could be conducted under 8 section 266.39 or 266.39B, including but not limited to 9 research grants and projects. The Leopold center for 10 sustainable agriculture shall not incur any obligation or 11 expense unless approved by the college of agriculture and life 12 sciences at Iowa state university of science and technology. 13 The Leopold center for sustainable agriculture shall cancel 14 any existing grant or project that is not in the process of 15 being immediately completed. However, the Leopold center 16 for sustainable agriculture shall not cancel a grant or 17 project that would result in a default of a legal or equitable 18 obligation, including breach of contract. 19 2. On and after July 1, 2017, the college of agriculture 20 and life sciences at Iowa state university of science and 21 technology shall administer any ongoing activity that the 22 Leopold center for sustainable agriculture had administered 23 under section 266.39 or 266.39B prior to that date. The 24 college may expend moneys appropriated from the Iowa nutrient 25 research fund created in section 466B.46 in order to pay for 26 any necessary expenses associated with the Leopold center 27 for sustainable agriculture and for completing any ongoing 28 activity. The college shall cancel any existing grant 29 or project that is not in the process of being completed. 30 However, the college shall not cancel a grant or project that 31 would result in a default of a legal or equitable obligation, 32 including breach of contract. The college shall submit a 33 report to the general assembly by January 10, 2018, which 34 shall include a summary of the ongoing activities and expenses 35 -25- SF 510 (5) 87 da/rn/jh 25/ 45
S.F. 510 described in this section and the expected completion date of 1 those activities and expenses. 2 Sec. 34. REPEAL. Sections 266.39 and 266.39B, Code 2017, 3 are repealed. 4 Sec. 35. EFFECTIVE DATES. 5 1. The section of this division of this Act providing for 6 ongoing activities and expenses, being deemed of immediate 7 importance, takes effect upon enactment. 8 2. The remaining sections of this division of this Act, 9 including the section of this division of this Act repealing 10 sections 266.39 and 266.39B take effect on July 1, 2017. 11 DIVISION XI 12 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 13 GENERAL APPROPRIATION FOR FY 2018-2019 14 Sec. 36. GENERAL FUND —— DEPARTMENT. 15 1. The 30 moneys shall be used to support a nationally recognized program 31 that began in 1986 and has been replicated in at least 30 other 32 states, but which is not available through any other entity 33 in this state, and that provides assistance to farmers with 34 disabilities in all 99 counties to allow the farmers to remain 35 -29- SF 510 (5) 87 da/rn/jh 29/ 45
S.F. 510 in their own homes and be gainfully engaged in farming through 1 provision of agricultural worksite and home modification 2 consultations, peer support services, services to families, 3 information and referral, and equipment loan services. 4 3. Notwithstanding section 8.33 , moneys appropriated in 5 this section that remain unencumbered or unobligated at the 6 close of the fiscal year shall not revert but shall remain 7 available for expenditure for the purposes designated until the 8 close of the succeeding fiscal year. 9 DIVISION XII 10 GENERAL FUND 11 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 12 WATER QUALITY INITIATIVE 13 APPROPRIATIONS FOR FY 2018-2019 14 Sec. 43. WATER QUALITY INITIATIVE —— GENERAL. 15 1. There is appropriated from the general fund of the state 16 to the department of agriculture and land stewardship for the 17 fiscal year beginning July 1, 2018, and ending June 30, 2019, 18 the following amount, or so much thereof as is necessary, to be 19 used for the purposes designated: 20 For deposit in the water quality initiative fund created in 21 section 466B.45 , for purposes of supporting the water quality 22 initiative administered by the division of soil conservation 23 and water quality as provided in section 466B.42 , including 24 salaries, support, maintenance, and miscellaneous purposes: 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,500,000 26 2. a. The moneys appropriated in subsection 1 shall be 27 used to support projects in subwatersheds as designated by the 28 division that are part of high-priority watersheds identified 29 by the water resources coordinating council established 30 pursuant to section 466B.3 . 31 b. The moneys appropriated in subsection 1 shall be used to 32 support projects in watersheds generally, including regional 33 watersheds, as designated by the division and high-priority 34 watersheds identified by the water resources coordinating 35 -30- SF 510 (5) 87 da/rn/jh 30/ 45
S.F. 510 council established pursuant to section 466B.3. 1 3. In supporting projects in subwatersheds and watersheds 2 as provided in subsection 2, all of the following shall apply: 3 a. The demonstration projects shall utilize water quality 4 practices as described in the latest revision of the document 5 entitled “Iowa Nutrient Reduction Strategy” initially presented 6 in November 2012 by the department of agriculture and land 7 stewardship, the department of natural resources, and Iowa 8 state university of science and technology. 9 b. The division shall implement demonstration projects as 10 provided in paragraph “a” by providing for participation by 11 persons who hold a legal interest in agricultural land used in 12 farming. To every extent practical, the division shall provide 13 for collaborative participation by such persons who hold a 14 legal interest in agricultural land located within the same 15 subwatershed. 16 c. The division shall implement a demonstration project on 17 a cost-share basis as determined by the division. However, 18 except for edge-of-field practices, the state’s share of the 19 amount shall not exceed 50 percent of the estimated cost of 20 establishing the practice as determined by the division or 21 50 percent of the actual cost of establishing the practice, 22 whichever is less. 23 d. The demonstration projects shall be used to educate other 24 persons about the feasibility and value of establishing similar 25 water quality practices. The division shall promote field day 26 events for purposes of allowing interested persons to establish 27 water quality practices on their agricultural land. 28 e. The division shall conduct water quality evaluations 29 within supported subwatersheds. Within a reasonable period 30 after accumulating information from such evaluations, the 31 division shall create an aggregated database of water quality 32 practices. Any information identifying a person holding a 33 legal interest in agricultural land or specific agricultural 34 land shall be a confidential record under section 22.7 . 35 -31- SF 510 (5) 87 da/rn/jh 31/ 45

The moneys appropriated in subsection 1 shall be used 1 to support education and outreach in a manner that encourages 2 persons who hold a legal interest in agricultural land used for 3 farming to implement water quality practices, including the 4 establishment of such practices in watersheds generally, and 5 not limited to subwatersheds or high-priority watersheds. 6 5. The moneys appropriated in subsection 1 may be used 7 to contract with persons to coordinate the implementation of 8 efforts provided in this section. 9 6. The moneys appropriated in subsection 1 may be used by 10 the department to support urban soil and water conservation 11 efforts, which may include but are not limited to management 12 practices related to bioretention, landscaping, the use of 13 permeable or pervious pavement, and soil quality restoration. 14 The moneys shall be allocated on a cost-share basis as provided 15 in chapter 161A. 16 7. Notwithstanding any other provision of law to the 17 contrary, the department may use moneys appropriated in 18 subsection 1 to carry out the provisions of this section on a 19 cost-share basis in combination with other moneys available to 20 the department from a state or federal source. 21 8. Not more than 10 percent of the moneys appropriated in 22 this section may be used to pay for the costs of administering 23 and implementing the water quality initiative by the 24 department’s division of soil conservation and water quality as 25 provided in section 466B.42 and this section. 26 DIVISION XIII 27 DEPARTMENT OF NATURAL RESOURCES 28 GENERAL APPROPRIATIONS FOR FY 2018-2019 29 Sec. 44. GENERAL FUND —— DEPARTMENT. 30 1. The report shall describe in 19 detail the expenditure of moneys appropriated under this 20 section to support the department’s administration, regulation, 21 and programs. 22 Sec. 45. STATE FISH AND GAME PROTECTION FUND —— REGULATION 23 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 24 1. There is appropriated from the state fish and game 25 protection fund to the department of natural resources for the 26 fiscal year beginning July 1, 2018, and ending June 30, 2019, 27 the following amount, or so much thereof as is necessary, to be 28 used for the purposes designated: 29 For purposes of supporting the regulation or advancement of 30 hunting, fishing, or trapping, or the protection, propagation, 31 restoration, management, or harvest of fish or wildlife, 32 including for administration, regulation, law enforcement, and 33 programs; and for salaries, support, maintenance, equipment, 34 and miscellaneous purposes: 35 -33- SF 510 (5) 87 da/rn/jh 33/ 45

Of the amount appropriated in paragraph “c” that the 26 department allocates to a soil and water conservation district, 27 the first $7,500 may be expended by the district for the 28 purpose of providing financial incentives under section 161A.73 29 to establish management practices for the control of soil 30 erosion on land that is row-cropped, including but not limited 31 to nontill planting, ridge-till planting, and contouring 32 strip-cropping. S.F. 510 e. Not more than 5 percent of the moneys appropriated in 1 paragraph “c” may be allocated for cost sharing to address 2 complaints filed under section 161A.47 . 3 f. Of the moneys appropriated in paragraph “c”, 5 percent 4 shall be allocated for financial incentives to establish 5 practices to protect watersheds above publicly owned lakes of 6 the state from soil erosion and sediment as provided in section 7 161A.73 . 8 g. The state soil conservation committee established by 9 section 161A.4 may allocate moneys appropriated in paragraph 10 “c” to conduct research and demonstration projects to promote 11 conservation tillage and nonpoint source pollution control 12 practices. 13 h. The allocation of moneys as financial incentives as 14 provided in section 161A.73 may be used in combination with 15 moneys allocated by the department of natural resources. 16 i. Not more than 15 percent of the moneys appropriated 17 in paragraph “c” may be used for costs of administration and 18 implementation of soil and water conservation practices. 19 Sec. 53. DEPARTMENT OF NATURAL RESOURCES. There is 20 appropriated from the environment first fund created in section 21 8.57A to the department of natural resources for the fiscal 22 year beginning July 1, 2018, and ending June 30, 2019, the 23 following amounts, or so much thereof as is necessary, to be 24 used for the purposes designated: 25 1. S.F. 510 1. a. Except as provided in paragraph “b”, and 1 notwithstanding section 8.33 , moneys appropriated for the 2 fiscal year beginning July 1, 2018, in this division of this 3 Act that remain unencumbered or unobligated at the close of the 4 fiscal year shall not revert but instead shall remain available 5 to be used for the purposes designated until the close of the 6 succeeding fiscal year, or until the project for which the 7 appropriation was made is completed, whichever is earlier. 8 b. Notwithstanding section 8.33, moneys appropriated for 9 the fiscal year beginning July 1, 2018, in this division of 10 this Act to the department of agriculture and land stewardship 11 to provide financial assistance for the establishment of 12 permanent soil and water conservation practices that remain 13 unencumbered or unobligated at the close of the fiscal year 14 shall not revert but instead shall remain available for 15 expenditure for the purposes designated until the close of the 16 fiscal year beginning July 1, 2021. 17 2. Subsection 1 does not apply to moneys transferred 18 pursuant to this division to the loess hills development and 19 conservation fund created in section 161D.2 which shall not 20 revert as provided in that section. 21 DIVISION XVI 22 ENVIRONMENT FIRST FUND 23 SPECIAL APPROPRIATION FOR FY 2018-2019 24 Sec. 55. WATER QUALITY INITIATIVE —— DEPARTMENT OF 25 AGRICULTURE AND LAND STEWARDSHIP. 26 1. There is appropriated from the environment first fund 27 created in section 8.57A to the department of agriculture 28 and land stewardship for the fiscal year beginning July 1, 29 2018, and ending June 30, 2019, the following amount, or so 30 much thereof as is necessary, to be used for the purposes 31 designated: 32 For deposit in the water quality initiative fund created in 33 section 466B.45 , for purposes of supporting the water quality 34 initiative administered by the division of soil conservation 35 -42- SF 510 (5) 87 da/rn/jh 42/ 45

The moneys appropriated in subsection 1 shall be 4 used to support projects in subwatersheds as designated by the 5 division that are part of high-priority watersheds identified 6 by the water resources coordinating council established 7 pursuant to section 466B.3 . 8 b. The moneys appropriated in subsection 1 shall be used to 9 support projects in watersheds generally, including regional 10 watersheds, as designated by the division and high-priority 11 watersheds identified by the water resources coordinating 12 council established pursuant to section 466B.3. 13 3. In supporting projects in subwatersheds and watersheds 14 as provided in subsection 2, all of the following shall apply: 15 a. The demonstration projects shall utilize water quality 16 practices as described in the latest revision of the document 17 entitled “Iowa Nutrient Reduction Strategy” initially presented 18 in November 2012 by the department of agriculture and land 19 stewardship, the department of natural resources, and Iowa 20 state university of science and technology. 21 b. The division shall implement demonstration projects as 22 provided in paragraph “a” by providing for participation by 23 persons who hold a legal interest in agricultural land used in 24 farming. To every extent practical, the division shall provide 25 for collaborative participation by such persons who hold a 26 legal interest in agricultural land located within the same 27 subwatershed. 28 c. The division shall implement a demonstration project on 29 a cost-share basis as determined by the division. However, 30 except for edge-of-field practices, the state’s share of the 31 amount shall not exceed 50 percent of the estimated cost of 32 establishing the practice as determined by the division or 33 50 percent of the actual cost of establishing the practice, 34 whichever is less. 35 -43- SF 510 (5) 87 da/rn/jh 43/ 45
S.F. 510 d. The demonstration projects shall be used to educate other 1 persons about the feasibility and value of establishing similar 2 water quality practices. The division shall promote field day 3 events for purposes of allowing interested persons to establish 4 water quality practices on their agricultural land. 5 e. The division shall conduct water quality evaluations 6 within supported subwatersheds. Within a reasonable period 7 after accumulating information from such evaluations, the 8 division shall create an aggregated database of water quality 9 practices. Any information identifying a person holding a 10 legal interest in agricultural land or specific agricultural 11 land shall be a confidential record under section 22.7 . 12 4. The moneys appropriated in subsection 1 shall be used 13 to support education and outreach in a manner that encourages 14 persons who hold a legal interest in agricultural land used for 15 farming to implement water quality practices, including the 16 establishment of such practices in watersheds generally, and 17 not limited to subwatersheds or high-priority watersheds. 18 5. The moneys appropriated in subsection 1 may be used 19 to contract with persons to coordinate the implementation of 20 efforts provided in this section. 21 6. The moneys appropriated in subsection 1 may be used by 22 the department to support urban soil and water conservation 23 efforts, which may include but are not limited to management 24 practices related to bioretention, landscaping, the use of 25 permeable or pervious pavement, and soil quality restoration. 26 The moneys shall be allocated on a cost-share basis as provided 27 in chapter 161A. 28 7. Notwithstanding any other provision of law to the 29 contrary, the department may use moneys appropriated in 30 subsection 1 to carry out the provisions of this section on a 31 cost-share basis in combination with other moneys available to 32 the department from a state or federal source. 33 8. Not more than 10 percent of the moneys appropriated in 34 this section may be used to pay for the costs of administering 35 -44- SF 510 (5) 87 da/rn/jh 44/ 45
