S.F. 509 DIVISION I 1 FY 2017-2018 2 APPROPRIATIONS 3 Section 1. DEPARTMENT OF JUSTICE. 4 1. There is appropriated from the general fund of the state 5 to the department of justice for the fiscal year beginning July 6 1, 2017, and ending June 30, 2018, the following amounts, or 7 so much thereof as is necessary, to be used for the purposes 8 designated: 9 a. For victim assistance grants: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,016,708 24 The moneys appropriated in this lettered paragraph shall be 25 used to provide grants to care providers providing services to 26 crime victims of domestic abuse or to crime victims of rape and 27 sexual assault. 28 The balance of the victim compensation fund established 29 in section 915.94 may be used to provide salary and support 30 of not more than 24.00 full-time equivalent positions and to 31 provide maintenance for the victim compensation functions 32 of the department of justice. In addition to the full-time 33 equivalent positions authorized pursuant to this paragraph, 34 5.00 full-time equivalent positions are authorized and shall 35 -1- SF 509 (2) 87 jm/rn/jh 1/ 39
S.F. 509 be used by the department of justice to employ one accountant 1 and four program planners. The department of justice may 2 employ the additional 5.00 full-time equivalent positions 3 authorized pursuant to this paragraph that are in excess of the 4 number of full-time equivalent positions authorized only if 5 the department of justice receives sufficient federal moneys 6 to maintain employment for the additional full-time equivalent 7 positions during the current fiscal year. The department 8 of justice shall only employ the additional 5.00 full-time 9 equivalent positions in succeeding fiscal years if sufficient 10 federal moneys are received during each of those succeeding 11 fiscal years. 12 The department of justice shall transfer at least $150,000 13 from the victim compensation fund established in section 915.94 14 to the victim assistance grant program. 15 Notwithstanding section 8.33, moneys appropriated in this 16 paragraph “b” that remain unencumbered or unobligated at the 17 close of the fiscal year shall not revert but shall remain 18 available for expenditure for the purposes designated until the 19 close of the succeeding fiscal year. 20 c. The department of justice, in submitting budget 24 estimates for the fiscal year commencing July 1, 2018, pursuant 25 to section 8.23, shall include a report of funding from sources 26 other than amounts appropriated directly from the general fund 27 of the state to the department of justice or to the office of 28 consumer advocate. These funding sources shall include but 29 are not limited to reimbursements from other state agencies, 30 commissions, boards, or similar entities, and reimbursements 31 from special funds or internal accounts within the department 32 of justice. The department of justice shall also report actual 33 reimbursements for the fiscal year commencing July 1, 2017, 34 and actual and expected reimbursements for the fiscal year 35 -2- SF 509 (2) 87 jm/rn/jh 2/ 39
S.F. 509 commencing July 1, 2018. 1 b. The department of justice shall include the report 2 required under paragraph “a”, as well as information regarding 3 any revisions occurring as a result of reimbursements actually 4 received or expected at a later date, in a report to the 5 co-chairpersons and ranking members of the joint appropriations 6 subcommittee on the justice system and the legislative services 7 agency. The department of justice shall submit the report on 8 or before January 15, 2018. 9 3. a. The department of justice shall reimburse the 10 costs and necessary related expenses incurred by the Iowa 11 law enforcement academy to employ one additional instructor 12 position who shall provide training for domestic abuse and 13 human trafficking-related issues throughout the state. 14 b. The department of justice shall obtain the moneys 15 necessary to reimburse the Iowa law enforcement academy to 16 employ such an instructor from unrestricted moneys from either 17 the victim compensation fund established in section 915.94, the 18 human trafficking victim fund established in section 915.95, or 19 the human trafficking enforcement fund established in 2015 Iowa 20 Acts, chapter 138, section 141. 21 Sec. 2. CONSUMER EDUCATION AND LITIGATION —— FARM 22 MEDIATION. It is the intent of the general assembly that each 8 lease negotiated by the department of corrections with a 9 private corporation for the purpose of providing private 10 industry employment of inmates in a correctional institution 11 shall prohibit the private corporation from utilizing inmate 12 labor for partisan political purposes for any person seeking 13 election to public office in this state and that a violation 14 of this requirement shall result in a termination of the lease 15 agreement. 16 b. It is the intent of the general assembly that as a 17 condition of receiving the appropriation provided in this 18 subsection the department of corrections shall not enter into 19 a lease or contractual agreement pursuant to section 904.809 20 with a private corporation for the use of building space for 21 the purpose of providing inmate employment without providing 22 that the terms of the lease or contract establish safeguards to 23 restrict, to the greatest extent feasible, access by inmates 24 working for the private corporation to personal identifying 25 information of citizens. 26 2. Notwithstanding section 8.33, moneys appropriated in 4 this subsection that remain unobligated or unexpended at the 5 close of the fiscal year shall not revert but shall remain 6 available to be used only for the purposes designated in this 7 subsection until the close of the succeeding fiscal year. 8 3. S.F. 509 low-risk offenders to the least restrictive sanction available, 1 job development, and expanded use of intermediate criminal 2 sanctions. 3 3. Each judicial district department of correctional 4 services shall provide alternatives to prison consistent with 5 chapter 901B. The alternatives to prison shall ensure public 6 safety while providing maximum rehabilitation to the offender. 7 A judicial district department of correctional services may 8 also establish a day program. 9 4. The governor’s office of drug control policy shall 10 consider federal grants made to the department of corrections 11 for the benefit of each of the eight judicial district 12 departments of correctional services as local government 13 grants, as defined pursuant to federal regulations. 14 5. The department of corrections shall continue to contract 15 with a judicial district department of correctional services to 16 provide for the rental of electronic monitoring equipment which 17 shall be available statewide. 18 Sec. 7. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 19 APPROPRIATIONS. Notwithstanding section 8.39, within the 20 moneys appropriated in this division of this Act to the 21 department of corrections, the department may reallocate the 22 moneys appropriated and allocated as necessary to best fulfill 23 the needs of the correctional institutions, administration 24 of the department, and the judicial district departments of 25 correctional services. However, in addition to complying with 26 the requirements of sections 904.116 and 905.8 and providing 27 notice to the legislative services agency, the department 28 of corrections shall also provide notice to the department 29 of management, prior to the effective date of the revision 30 or reallocation of an appropriation made pursuant to this 31 section. The department of corrections shall not reallocate an 32 appropriation or allocation for the purpose of eliminating any 33 program. 34 Sec. 8. INTENT —— REPORTS. 35 -9- SF 509 (2) 87 jm/rn/jh 9/ 39
S.F. 509 1. The department of corrections in cooperation with 1 townships, the Iowa cemetery associations, and other nonprofit 2 or governmental entities may use inmate labor during the 3 fiscal year beginning July 1, 2017, to restore or preserve 4 rural cemeteries and historical landmarks. The department in 5 cooperation with the counties may also use inmate labor to 6 clean up roads, major water sources, and other water sources 7 around the state. 8 2. On a quarterly basis the department shall provide a 9 status report regarding private-sector employment to the 10 legislative services agency beginning on July 1, 2017. The 11 report shall include the number of offenders employed in the 12 private sector, the combined number of hours worked by the 13 offenders, the total amount of allowances, and the distribution 14 of allowances pursuant to section 904.702, including any moneys 15 deposited in the general fund of the state. 16 Sec. 9. ELECTRONIC MONITORING REPORT. The department of 17 corrections shall submit a report on electronic monitoring to 18 the general assembly, to the co-chairpersons and the ranking 19 members of the joint appropriations subcommittee on the justice 20 system, and to the legislative services agency by January 21 15, 2018. The report shall specifically address the number 22 of persons being electronically monitored and break down the 23 number of persons being electronically monitored by offense 24 committed. The report shall also include a comparison of any 25 data from the prior fiscal year with the current year. 26 Sec. 10. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 27 1. As used in this section, unless the context otherwise 28 requires, “state agency” means the government of the state 29 of Iowa, including but not limited to all executive branch 30 departments, agencies, boards, bureaus, and commissions, the 31 judicial branch, the general assembly and all legislative 32 agencies, institutions within the purview of the state board of 33 regents, and any corporation whose primary function is to act 34 as an instrumentality of the state. 35 -10- SF 509 (2) 87 jm/rn/jh 10/ 39

State agencies are encouraged to purchase products from 1 Iowa state industries, as defined in section 904.802, when 2 purchases are required and the products are available from 3 Iowa state industries. State agencies shall obtain bids from 4 Iowa state industries for purchases of office furniture during 5 the fiscal year beginning July 1, 2017, exceeding $5,000 or 6 in accordance with applicable administrative rules related to 7 purchases for the agency. 8 Sec. 11. IOWA LAW ENFORCEMENT ACADEMY. 9 1. There is appropriated from the general fund of the 10 state to the Iowa law enforcement academy for the fiscal year 11 beginning July 1, 2017, and ending June 30, 2018, the following 12 amount, or so much thereof as is necessary, to be used for the 13 purposes designated: 14 For salaries, support, maintenance, and miscellaneous 15 purposes, including jailer training and technical assistance, 16 and for not more than the following full-time equivalent 17 positions: 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 954,756 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . FTEs 25.00 20 The Iowa law enforcement academy may temporarily exceed and 21 draw more than the amount appropriated in this subsection and 22 incur a negative cash balance as long as there are receivables 23 equal to or greater than the negative balance and the amount 24 appropriated in this subsection is not exceeded at the close 25 of the fiscal year. 26 2. The Iowa law enforcement academy may select at least 27 five automobiles of the department of public safety, division 28 of state patrol, prior to turning over the automobiles to 29 the department of administrative services to be disposed 30 of by public auction, and the Iowa law enforcement academy 31 may exchange any automobile owned by the academy for each 32 automobile selected if the selected automobile is used in 33 training law enforcement officers at the academy. However, any 34 automobile exchanged by the academy shall be substituted for 35 -11- SF 509 (2) 87 jm/rn/jh 11/ 39
S.F. 509 the selected vehicle of the department of public safety and 1 sold by public auction with the receipts being deposited in the 2 depreciation fund to the credit of the department of public 3 safety, division of state patrol. 4 3. The Iowa law enforcement academy shall provide training 5 for domestic abuse and human trafficking-related issues 6 throughout the state. The training shall be offered at no 7 cost to the attendees and the training shall not replace any 8 existing domestic abuse or human trafficking training offered 9 by the academy. 10 Sec. 12. STATE PUBLIC DEFENDER. There is appropriated from 11 the general fund of the state to the office of the state public 12 defender of the department of inspections and appeals for the 13 fiscal year beginning July 1, 2017, and ending June 30, 2018, 14 the following amounts, or so much thereof as is necessary, to 15 be used for the purposes designated: 16 1. Section 35A.13, subsection 6, Code 2017, is amended 23 by adding the following new paragraph: 24 NEW PARAGRAPH . n. Expenses related to survivor outreach 25 activities supported by the department of public defense 26 established in section 29.1. 27 Sec. 22. NEW SECTION . 80B.19 Academy internal training fund 28 clearing account. 29 1. Activities of the academy shall be accounted for within 30 the general fund of the state, except the academy may establish 31 and maintain an internal training clearing fund in accordance 32 with generally accepted accounting principles, as defined in 33 section 8.57, subsection 4, for activities of the academy 34 which are primarily from billings to governmental entities for 35 -19- SF 509 (2) 87 jm/rn/jh 19/ 39
S.F. 509 services rendered by the academy. 1 2. Internal training funds in the internal training 2 clearing fund shall be administered by the academy and shall 3 consist of moneys collected by the academy from billings issued 4 in accordance with chapter 80B, and any other moneys obtained 5 or accepted by the academy, including but not limited to gifts, 6 loans, donations, grants, and contributions, which are obtained 7 or designated to support the activities of the academy. 8 3. The proceeds of an internal training clearing fund 9 established pursuant to this section shall be used by the 10 academy and expended through the appropriated account of the 11 academy for the operations of the academy consistent with this 12 chapter. However, this usage requirement shall not limit or 13 restrict the academy from using proceeds from gifts, loans, 14 donations, grants, and contributions in conformance with any 15 conditions, directions, limitations, or instructions attached 16 or related thereto. 17 4. Section 8.33 does not apply to any moneys in the internal 18 training clearing fund established pursuant to this section. 19 Notwithstanding section 12C.7, subsection 2, interest or 20 earnings on moneys deposited in the fund shall be credited to 21 the fund. 22 Sec. 23. Section 805.6, subsection 4, paragraphs a, b, and 23 c, Code 2017, are amended to read as follows: 24 a. If the offense is one to which an assessment of a minimum 25 fine is applicable and the entry is otherwise not prohibited 26 by this section , an amount equal to one and one-half times the 27 minimum fine and applicable surcharge assessed pursuant to 28 chapter 911, plus court costs. 29 b. If the offense is one to which a scheduled fine is 30 applicable, an amount equal to one and one-half times the 31 scheduled fine and applicable surcharge assessed pursuant to 32 chapter 911, plus court costs. 33 c. S.F. 509 is not applicable, the amount of one hundred dollars and 1 applicable surcharge assessed pursuant to chapter 911, plus 2 court costs. 3 Sec. 24. 2014 Iowa Acts, chapter 1138, section 21, as 4 amended by 2016 Iowa Acts, chapter 1137, section 18, is amended 5 to read as follows: 6 SEC. 21. CONSUMER EDUCATION AND LITIGATION FUND. 7 Notwithstanding section 714.16C , for each fiscal year of the 8 period beginning July 1, 2014, and ending June 30, 2018 2019 , 9 the annual appropriations in section 714.16C , are increased 10 from $1,125,000 to $1,875,000, and $75,000 to $125,000 11 respectively. 12 Sec. 25. Notwithstanding section 714.16C, for the fiscal year 15 beginning July 1, 2017, and ending June 30, 2018, not more than 16 one million three hundred thousand dollars is appropriated 17 from the consumer education and litigation fund established in 18 section 714.16C, to the department of justice to be used for 19 salaries, support, maintenance, and miscellaneous purposes for 20 criminal prosecutions, criminal appeals, and performing duties 21 pursuant to Code chapter 669. 22 Sec. 26. REPEAL. Sections 904.203, 904.204, 904.205, and 23 904.206, Code 2017, are repealed. 24 DIVISION III 25 FY 2018-2019 26 APPROPRIATIONS 27 Sec. 27. DEPARTMENT OF JUSTICE. 28 1. In addition to the full-time 22 equivalent positions authorized pursuant to this paragraph, 23 5.00 full-time equivalent positions are authorized and shall 24 be used by the department of justice to employ one accountant 25 and four program planners. The department of justice may 26 employ the additional 5.00 full-time equivalent positions 27 authorized pursuant to this paragraph that are in excess of the 28 number of full-time equivalent positions authorized only if 29 the department of justice receives sufficient federal moneys 30 to maintain employment for the additional full-time equivalent 31 positions during the current fiscal year. S.F. 509 fiscal years. 1 The department of justice shall transfer at least $150,000 2 from the victim compensation fund established in section 915.94 3 to the victim assistance grant program. 4 Notwithstanding section 8.33, moneys appropriated in this 5 paragraph “b” that remain unencumbered or unobligated at the 6 close of the fiscal year shall not revert but shall remain 7 available for expenditure for the purposes designated until the 8 close of the succeeding fiscal year. 9 c. These funding sources shall include but 18 are not limited to reimbursements from other state agencies, 19 commissions, boards, or similar entities, and reimbursements 20 from special funds or internal accounts within the department 21 of justice. The department of justice shall also report actual 22 reimbursements for the fiscal year commencing July 1, 2017, 23 and actual and expected reimbursements for the fiscal year 24 commencing July 1, 2018. 25 b. The department of justice shall include the report 26 required under paragraph “a”, as well as information regarding 27 any revisions occurring as a result of reimbursements actually 28 received or expected at a later date, in a report to the 29 co-chairpersons and ranking members of the joint appropriations 30 subcommittee on the justice system and the legislative services 31 agency. The department of justice shall submit the report on 32 or before January 15, 2019. 33 3. a. The governor’s office of drug control policy shall 24 consider federal grants made to the department of corrections 25 for the benefit of each of the eight judicial district 26 departments of correctional services as local government 27 grants, as defined pursuant to federal regulations. 28 5. The department of corrections shall continue to contract 29 with a judicial district department of correctional services to 30 provide for the rental of electronic monitoring equipment which 31 shall be available statewide. 32 Sec. 32. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 33 APPROPRIATIONS. Notwithstanding section 8.39, within the 34 moneys appropriated in this division of this Act to the 35 -29- SF 509 (2) 87 jm/rn/jh 29/ 39
S.F. 509 department of corrections, the department may reallocate the 1 moneys appropriated and allocated as necessary to best fulfill 2 the needs of the correctional institutions, administration 3 of the department, and the judicial district departments of 4 correctional services. However, in addition to complying with 5 the requirements of sections 904.116 and 905.8 and providing 6 notice to the legislative services agency, the department 7 of corrections shall also provide notice to the department 8 of management, prior to the effective date of the revision 9 or reallocation of an appropriation made pursuant to this 10 section. The department of corrections shall not reallocate an 11 appropriation or allocation for the purpose of eliminating any 12 program. 13 Sec. 33. INTENT —— REPORTS. 14 1. The department of corrections in cooperation with 15 townships, the Iowa cemetery associations, and other nonprofit 16 or governmental entities may use inmate labor during the 17 fiscal year beginning July 1, 2018, to restore or preserve 18 rural cemeteries and historical landmarks. The department in 19 cooperation with the counties may also use inmate labor to 20 clean up roads, major water sources, and other water sources 21 around the state. 22 2. On a quarterly basis the department shall provide a 23 status report regarding private-sector employment to the 24 legislative services agency beginning on July 1, 2018. The 25 report shall include the number of offenders employed in the 26 private sector, the combined number of hours worked by the 27 offenders, the total amount of allowances, and the distribution 28 of allowances pursuant to section 904.702, including any moneys 29 deposited in the general fund of the state. 30 Sec. 34. ELECTRONIC MONITORING REPORT. The department of 31 corrections shall submit a report on electronic monitoring to 32 the general assembly, to the co-chairpersons and the ranking 33 members of the joint appropriations subcommittee on the justice 34 system, and to the legislative services agency by January 35 -30- SF 509 (2) 87 jm/rn/jh 30/ 39
S.F. 509 15, 2019. The report shall specifically address the number 1 of persons being electronically monitored and break down the 2 number of persons being electronically monitored by offense 3 committed. The report shall also include a comparison of any 4 data from the prior fiscal year with the current year. 5 Sec. 35. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 6 1. As used in this section, unless the context otherwise 7 requires, “state agency” means the government of the state 8 of Iowa, including but not limited to all executive branch 9 departments, agencies, boards, bureaus, and commissions, the 10 judicial branch, the general assembly and all legislative 11 agencies, institutions within the purview of the state board of 12 regents, and any corporation whose primary function is to act 13 as an instrumentality of the state. 14 2. State agencies are encouraged to purchase products from 15 Iowa state industries, as defined in section 904.802, when 16 purchases are required and the products are available from 17 Iowa state industries. State agencies shall obtain bids from 18 Iowa state industries for purchases of office furniture during 19 the fiscal year beginning July 1, 2018, exceeding $5,000 or 20 in accordance with applicable administrative rules related to 21 purchases for the agency. 22 Sec. 36. IOWA LAW ENFORCEMENT ACADEMY. 23 1. Notwithstanding section 8.33, moneys appropriated in 4 this subsection that remain unencumbered or unobligated at the 5 close of the fiscal year shall not revert but shall remain 6 available for expenditure only for the purpose designated in 7 this subsection until the close of the succeeding fiscal year. 8 b. Notwithstanding section 8.39, the department of public 9 safety may reallocate moneys appropriated in this section 10 as necessary to best fulfill the needs provided for in the 11 appropriation. However, the department shall not reallocate 12 moneys appropriated to the department in this section unless 13 notice of the reallocation is given to the legislative services 14 agency and the department of management prior to the effective 15 date of the reallocation. The notice shall include information 16 regarding the rationale for reallocating the moneys.
