Section
1.
Section
136C.3,
subsection
10,
Code
2017,
is
1
amended
to
read
as
follows:
2
10.
a.
Adopt
rules
specifying
the
minimum
training
and
3
performance
standards
for
an
individual
using
a
radiation
4
machine
for
mammography,
and
other
rules
necessary
to
5
implement
section
136C.15
.
The
rules
shall
complement
federal
6
requirements
applicable
to
similar
radiation
machinery
and
7
shall
not
be
less
stringent
than
those
federal
requirements.
8
b.
(1)
Adopt
rules,
in
collaboration
with
appropriate
9
stakeholders,
to
require
that,
by
January
1,
2018,
a
facility
10
at
which
mammography
services
are
performed
shall
include
11
information
on
breast
density
in
mammogram
reports
sent
to
all
12
mammography
patients,
pursuant
to
regulations
implementing
the
13
federal
Mammography
Quality
Standards
Act
of
1992,
Pub.
L.
14
No.
102-539,
as
amended.
The
mammogram
report
shall
include
15
information
on
a
patient’s
breast
density,
as
categorized
by
16
an
interpreting
physician
at
the
facility
based
on
standards
17
as
defined
in
nationally
recognized
guidelines
or
systems
for
18
breast
imaging
reporting
of
mammography
screening,
including
19
the
breast
imaging
reporting
and
data
system
of
the
American
20
college
of
radiology.
For
patients
categorized
as
having
21
heterogeneously
dense
breasts
or
extremely
dense
breasts,
or
22
an
equivalent
determination
by
another
nationally
recognized
23
density
gradient
system,
the
report
to
the
patient
shall
24
include
evidence-based
information
on
dense
breast
tissue,
the
25
increased
risk
associated
with
dense
breast
tissue,
and
the
26
effects
of
dense
breast
tissue
on
screening
mammography.

(2)
Nothing
in
this
paragraph
“b”
shall
be
construed
to
28
modify
the
existing
liability
of
a
facility
where
mammography
29
services
are
performed
beyond
the
duty
to
provide
the
30
information
set
forth
in
this
paragraph
“b”
.
Notwithstanding
31
any
other
provision
of
law
to
the
contrary,
this
paragraph
“b”
32
shall
not
create
a
cause
of
action
or
create
a
standard
of
33
care,
obligation,
or
duty
that
provides
grounds
for
a
cause
of
34
action.

shall
be
deemed
to
require

a
notice
or
the
provision
of
information
that
is
inconsistent

amended,
or
any

regulations
promulgated
pursuant
to
that
Act.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
6
immediate
importance,
takes
effect
upon
enactment.
