Before the division expends or encumbers 22 an amount in excess of the moneys budgeted for regulation, the 23 division shall first do both of the following: 24 (a) Notify the department of management, the legislative 25 services agency, and the legislative fiscal committee of the 26 need for the expenditures. 27 (b) File with each of the entities named in subparagraph 28 division (a) the legislative and regulatory justification for 29 the expenditures, along with an estimate of the expenditures. 30 3. CHARGES. The report 6 shall include but is not limited to a summary of the number 7 of cases investigated, case outcomes, overpayment dollars 8 identified, amount of cost avoidance, and actual dollars 9 recovered. 10 4. The department shall, in coordination with the health 26 facilities division, make the following information available 27 to the public as part of the department’s development efforts 28 to revise the department’s internet site: 29 (1) The number of inspections conducted by the division 30 annually by type of service provider and type of inspection. 31 (2) The total annual operations budget for the division, 32 including general fund appropriations and federal contract 33 dollars received by type of service provider inspected. 34 (3) The total number of full-time equivalent positions in 35 -10- SF 2416 (2) 87 gh/tm/jh 10/ 20
S.F. 2416 the division, to include the number of full-time equivalent 1 positions serving in a supervisory capacity, and serving as 2 surveyors, inspectors, or monitors in the field by type of 3 service provider inspected. 4 (4) Identification of state and federal survey trends, 5 cited regulations, the scope and severity of deficiencies 6 identified, and federal and state fines assessed and collected 7 concerning nursing and assisted living facilities and programs. 8 c. It is the intent of the general assembly that the 9 department and division continuously solicit input from 10 facilities regulated by the division to assess and improve 11 the division’s level of collaboration and to identify new 12 opportunities for cooperation. 13 5. EMPLOYMENT APPEAL BOARD 14 a. Notwithstanding section 8.39 , the 25 department of inspections and appeals, in consultation with the 26 department of management, may reallocate moneys appropriated 27 in this section as necessary to best fulfill the needs of the 28 department provided for in the appropriation. However, the 29 department of inspections and appeals shall not reallocate 30 moneys appropriated to the department child advocacy board in 31 this section unless notice of the reallocation is given to the 32 legislative services agency prior to the effective date of the 33 reallocation in excess of $2,470,605 . The notice shall include 34 information regarding the rationale for reallocating the 35 -12- SF 2416 (2) 87 gh/tm/jh 12/ 20

The department of inspections and appeals shall not 1 reallocate moneys appropriated in this section for the purpose 2 of eliminating any program. 3 Sec. 11. 2017 Iowa Acts, chapter 171, section 40, is amended 4 to read as follows: 5 SEC. 40. DEPARTMENT OF INSPECTIONS AND APPEALS —— LICENSE OR 6 REGISTRATION FEES. 7 1. For the fiscal year beginning July 1, 2018, and ending 8 June 30, 2019, the department of inspections and appeals 9 shall collect any license or registration fees or electronic 10 transaction fees generated during the fiscal year as a result 11 of licensing and registration activities under chapters 99B , 12 137C , 137D , and 137F . 13 2. From the fees collected by the department under this 14 section on behalf of a municipal corporation with which 15 the department has an agreement pursuant to section 137F.3 , 16 through a statewide electronic licensing system operated by 17 the department, notwithstanding section 137F.6, subsection 3 , 18 the department shall remit the amount of those fees to the 19 municipal corporation for whom the fees were collected less 20 any electronic transaction fees collected by the department to 21 enable electronic payment. 22 3. From the fees collected by the department under this 23 section, other than those fees described in subsection 2, the 24 department shall deposit the amount of $400,000 $800,000 into 25 the general fund of the state prior to June 30, 2019. 26 4. From the fees collected by the department under this 27 section, other than those fees described in subsections 2 and 28 3, the department shall retain the remainder of the fees for 29 the purposes of enforcing the provisions of chapters 99B , 137C , 30 137D , and 137F . Notwithstanding section 8.33 , moneys retained 31 by the department pursuant to this subsection that remain 32 unencumbered or unobligated at the end of the fiscal year 33 shall not revert but shall remain available for expenditure 34 for the purposes of enforcing the provisions of chapters 99B , 35 -13- SF 2416 (2) 87 gh/tm/jh 13/ 20

Section 8A.311, subsection 20, Code 2018, is 10 amended to read as follows: 11 20. Life cycle cost and energy efficiency shall be included 12 in the criteria used by the department, institutions under the 13 control of the state board of regents, the state department 14 of transportation, the department for the blind, and other 15 state agencies in developing standards and specifications for 16 purchasing energy-consuming products. For purposes of this 17 subsection , the life cycle costs of American motor vehicles 18 shall be reduced by five percent in order to determine if the 19 motor vehicle is comparable to foreign-made motor vehicles. 20 “American motor vehicles” includes those vehicles manufactured 21 in this state and those vehicles in which at least seventy 22 percent of the value of the motor vehicle was manufactured 23 in the United States or Canada and at least fifty percent of 24 the motor vehicle sales of the manufacturer are in the United 25 States or Canada. In determining the life cycle costs of a 26 motor vehicle, the costs shall be determined on the basis of 27 the bid price, the resale value, and the operating costs based 28 upon a useable life of five years or seventy-five thousand 29 miles, whichever occurs first.
