S.F. 2389 Section 1. NEW SECTION . 455A.14 Camping and rental 1 facilities and other privileges —— fees. 2 1. Notwithstanding any provision of law to the contrary, 3 the department is authorized to establish fees for camping 4 and use of rental facilities and other special privileges at 5 state parks and recreation areas under the jurisdiction of the 6 department. 7 2. The fees established by the department pursuant to this 8 section shall be in such amounts as may be determined by the 9 department to be reasonably competitive with fees established 10 in other public parks or recreation areas that provide the same 11 or similar privileges and are located within sixty miles of the 12 perimeter of the state park or recreation area for which the 13 department is establishing fees. Such fees may be increased, 14 reduced, or waived by the department for special promotional 15 events or efforts or on the basis of special seasonal or 16 holiday rates, on a statewide basis or on the basis of an 17 individual state park or recreation area. 18 3. Fees established pursuant to this section shall be 19 considered a specification of prices to be charged for goods or 20 services as provided in section 17A.2, subsection 11, paragraph 21 ā€œgā€ . 22 4. The department shall adopt rules pursuant to chapter 17A 23 for the purpose of setting forth the methodology to be used in 24 establishing fees pursuant to this section. 25 5. The department shall prepare an annual report reviewing 26 the fees established pursuant to this section. The report 27 shall include information about fees and occupancy rates 28 at each camping and rental facility in the state under the 29 jurisdiction of the department, special promotional events or 30 holiday rates for which fees were increased, reduced, or waived 31 at those camping and rental facilities, and any recommendations 32 for changes in fees or rules adopted pursuant to this section. 33 The report shall be submitted to the senate standing committee 34 on natural resources and environment and the house standing 35 -1- SF 2389 (2) 87 js/rn/jh 1/ 2
