Section
1.
Section
260C.14,
Code
2018,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
25.
Identify
the
courses
that
will
utilize
3
open
educational
resources
where
the
community
college
provides
4
information
or
mechanisms
for
course
registration,
which
may
5
be
on
the
internet.
The
community
college
shall
consider
6
opportunities
to
mitigate
the
marginal
costs
of
new
editions
7
of
existing
textbooks.
For
purposes
of
this
section,
“open
8
educational
resources”
means
materials
used
to
support
education
9
that
are
in
the
public
domain
or
are
under
an
open
license
and
10
that
may
be
freely
accessed,
reused,
modified,
and
shared,
11
including
but
not
limited
to
instructional
materials,
tests,
12
course
syllabi,
and
textbooks.

Sec.
2.
Section
261.2,
subsection
11,
Code
2018,
is
amended
14
to
read
as
follows:

11.
Require
any
postsecondary
institution
whose
students
16
are
eligible
for
or
who
receive
financial
assistance
under
17
programs
administered
by
the
commission
to
transmit
do
all
of
18
the
following:
19
a.
Transmit
annually
to
the
commission
information
about
the
20
numbers
of
minority
students
enrolled
in
and
minority
faculty
21
members
employed
at
the
institution.
The
commission
shall
22
compile
and
report
the
information
collected
to
the
general
23
assembly,
the
governor,
and
the
legislative
services
agency
by
24
March
1
annually.
25
b.
Identify
the
courses
that
will
utilize
open
educational
26
resources,
as
defined
in
section
260C.14,
subsection
25,
where
27
the
institution
provides
information
or
mechanisms
for
course
28
registration,
which
may
be
on
the
internet.
The
institution
29
shall
consider
opportunities
to
mitigate
the
marginal
costs
of
30
new
editions
of
existing
textbooks.

3.
Section
262.9,
Code
2018,
is
amended
by
adding
the

following
new
subsection:

Direct
each
institution
of
higher

learning
under
its
control
to
identify
the
courses
that
will

utilize
open
educational
resources,
as
defined
in
section
1
260C.14,
subsection
25,
where
the
institution
provides
2
information
or
mechanisms
for
course
registration,
which
may
be

on
the
internet.
In
addition,
each
institution
shall
develop
4
and
implement,
upon
receiving
board
approval,
a
five-year
plan
5
to
increase
the
number
of
courses
utilizing
open
educational
6
resources.
In
developing
the
plan,
the
institution
shall
7
consider
opportunities
to
mitigate
the
marginal
costs
of
8
new
editions
of
existing
textbooks.
The
plan
shall
include
9
metrics
and
goals
for
the
percentage
of
courses
that
utilize
10
open
educational
resources.
Prior
to
approving
a
plan
under
11
this
subsection,
the
board
shall
determine
whether
the
plan
is
12
sustainable
beyond
the
initial
five-year
implementation
and
13
whether
the
plan
will
effectively
reduce
students’
textbook
and
14
instructional
materials
costs.
