S.F. 2324 Section 1. Section 321.373, subsection 3, Code 2018, is 1 amended to read as follows: 2 3. a. The rules prescribed for school buses shall include 3 special rules for passenger automobiles, and other vehicles 4 designed to carry eight or fewer pupils, when used as school 5 buses. The rules shall allow pickups designed to carry nine 6 passengers or less, including the driver, and weighing ten 7 thousand pounds or less, to be used as school buses if such a 8 pickup does not carry more passengers than there are safety 9 belts or safety harnesses in the pickup as installed by the 10 manufacturer and if such a pickup is not operated while any 11 passenger is present in the bed of the pickup. The operator 12 of a pickup used as a school bus pursuant to such rules shall 13 comply with the qualification, licensing, and instruction 14 requirements set forth in sections 321.375 and 321.376, other 15 than the requirement to obtain a commercial driver’s license. 16 However, the rules shall allow the board of directors of a 17 school district to prohibit the use of pickups as school buses 18 by the school district. 19 b. The rules prescribed for school buses shall allow 20 passenger vans designed to carry twelve or fewer passengers, 21 including the driver, and weighing ten thousand pounds or less, 22 to be used as school buses if such a van does not carry more 23 passengers than there are safety belts or safety harnesses in 24 the van as installed by the manufacturer. The operator of a 25 van used as a school bus pursuant to such rules shall comply 26 with the qualification, licensing, and instruction requirements 27 set forth in sections 321.375 and 321.376. 28 -1- SF 2324 (2) 87 ns/rh/ko 1/ 1
