Notwithstanding section 1 261.72, the moneys deposited in the chiropractic loan revolving 2 fund created pursuant to section 261.72, for the fiscal year 3 beginning July 1, 2017, and ending June 30, 2018, may be used 4 for purposes of the chiropractic loan forgiveness program 5 established in section 261.73. 6 Sec. 4. WORK-STUDY APPROPRIATION. Notwithstanding section 7 261.85, for the fiscal year beginning July 1, 2017, and ending 8 June 30, 2018, the amount appropriated from the general fund 9 of the state to the college student aid commission for the 10 work-study program under section 261.85 shall be zero. 11 DEPARTMENT OF EDUCATION 12 Sec. 5. From the moneys deposited in the school ready children 25 grants account for the fiscal year beginning July 1, 2017, and 26 ending June 30, 2018, not more than $265,950 is allocated for 27 the early childhood Iowa office and other technical assistance 28 activities. Moneys allocated under this lettered paragraph 29 may be used by the early childhood Iowa state board for the 30 purpose of skills development and support for ongoing training 31 of staff. However, except as otherwise provided in this 32 subsection, moneys shall not be used for additional staff or 33 for the reimbursement of staff. 34 b. Of the amount appropriated in this subsection for 35 -5- HF 642 (5) 87 kh/tm/md 5/ 53
H.F. 642 deposit in the school ready children grants account of the 1 early childhood Iowa fund, $2,318,018 shall be used for efforts 2 to improve the quality of early care, health, and education 3 programs. Moneys allocated pursuant to this paragraph may be 4 used for additional staff and for the reimbursement of staff. 5 The early childhood Iowa state board may reserve a portion 6 of the allocation, not to exceed $88,650, for the technical 7 assistance expenses of the early childhood Iowa state office, 8 including the reimbursement of staff, and shall distribute 9 the remainder to early childhood Iowa areas for local quality 10 improvement efforts through a methodology identified by the 11 early childhood Iowa state board to make the most productive 12 use of the funding, which may include use of the distribution 13 formula, grants, or other means. 14 c. Of the amount appropriated in this subsection for 15 deposit in the school ready children grants account of 16 the early childhood Iowa fund, $825,030 shall be used for 17 support of professional development and training activities 18 for persons working in early care, health, and education by 19 the early childhood Iowa state board in collaboration with 20 the professional development component groups maintained by 21 the early childhood Iowa stakeholders alliance pursuant to 22 section 256I.12, subsection 7, paragraph “b”, and the early 23 childhood Iowa area boards. Expenditures shall be limited to 24 professional development and training activities agreed upon by 25 the parties participating in the collaboration. 26 9. BIRTH TO AGE THREE SERVICES 27 a. For expansion of the federal Individuals with 28 Disabilities Education Improvement Act of 2004, Pub. L. EARLY HEAD START PROJECTS 4 a. For early head start projects: 5 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 574,500 6 b. The moneys appropriated in this subsection shall be 7 used for implementation and expansion of early head start 8 pilot projects addressing the comprehensive cognitive, social, 9 emotional, and developmental needs of children from birth to 10 age three, including prenatal support for qualified families. 11 The projects shall promote healthy prenatal outcomes and 12 healthy family functioning, and strengthen the development of 13 infants and toddlers in low-income families. Priority shall be 14 given to those organizations that have previously qualified for 15 and received state funding to administer an early head start 16 project. 17 11. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS 18 a. The fee shall be determined by dividing the 2 actual remaining costs to purchase the statewide license for 3 the school year by the number of pupils assessed under the 4 system in the current fiscal year. School districts may use 5 moneys received pursuant to section 257.10, subsection 11, and 6 moneys received for purposes of implementing section 279.68, 7 subsection 2, to pay the early warning assessment system fee. 8 18. IOWA READING RESEARCH CENTER 9 a. For purposes of the Iowa reading research center in 10 order to implement, in collaboration with the area education 11 agencies, the provisions of section 256.9, subsection 49, 12 paragraph “c”: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 957,500 14 b. MIDWESTERN HIGHER EDUCATION COMPACT 20 a. H.F. 642 Sec. 8. ENERGY COST-SAVINGS PROJECTS —— FINANCING. For 1 the fiscal year beginning July 1, 2017, and ending June 30, 2 2018, the state board of regents may use notes, bonds, or 3 other evidences of indebtedness issued under section 262.48 to 4 finance projects that will result in energy cost savings in an 5 amount that will cause the state board to recover the cost of 6 the projects within an average of six years. 7 Sec. 9. PRESCRIPTION DRUG COSTS. Notwithstanding section 8 270.7, the department of administrative services shall pay 9 the state school for the deaf and the Iowa braille and sight 10 saving school the moneys collected from the counties during the 11 fiscal year beginning July 1, 2017, for expenses relating to 12 prescription drug costs for students attending the state school 13 for the deaf and the Iowa braille and sight saving school. 14 Sec. 10. Section 256.9, subsection 59, Code 2017, is amended 15 by striking the subsection. 16 Sec. 11. Section 261.1, subsection 2, paragraphs a and d, 17 Code 2017, are amended to read as follows: 18 a. A member of the state board of regents to be named by the 19 board, or the executive director of the board if so appointed 20 by the board, who shall serve for a four-year term or until the 21 expiration of the member’s term of office. Such member shall 22 convene the organizational meeting of the commission. 23 d. Eight Nine additional members to be appointed by the 24 governor . as follows: 25 (1) One of the members member shall be selected to represent 26 private colleges and universities located in the state of Iowa. 27 When appointing this member, the governor shall give careful 28 consideration to any person or persons nominated or recommended 29 by any organization or association of some or all private 30 colleges and universities located in the state of Iowa. 31 (2) One of the members member shall be selected to represent 32 Iowa’s community colleges located in the state of Iowa . 33 When appointing this member, the governor shall give careful 34 consideration to any person or persons nominated or recommended 35 -17- HF 642 (5) 87 kh/tm/md 17/ 53
H.F. 642 by any organization or association of Iowa community colleges. 1 (3) One member shall be enrolled as a student at a an 2 institution of higher learning governed by the board of regents 3 institution , a community college, or an accredited private 4 institution. 5 (4) One member shall be a representative of a lending 6 institution located in this state. One member shall be 7 an individual who is repaying or has repaid a student loan 8 guaranteed by the commission parent of a student enrolled 9 at an institution of higher learning governed by the board 10 of regents, a community college, or an accredited private 11 institution . 12 (5) One member shall represent practitioners licensed 13 under chapter 272. When appointing this member, the governor 14 shall give careful consideration to any person nominated by 15 an Iowa teacher association or other education stakeholder 16 organization. 17 (6) The other three Four members shall represent the 18 general public , none of whom shall be official officers, board 19 members , or trustees of an institution of higher learning or 20 of an association of institutions of higher learning , shall be 21 selected to represent the general public . 22 Sec. 12. Section 261.1, subsection 3, Code 2017, is amended 23 to read as follows: 24 3. The members of the commission appointed by the governor 25 shall serve for a term of four years. The voting members of 26 the commission shall elect a chairperson and vice chairperson. 27 Meetings may be called by the chairperson or a majority of the 28 voting members. 29 Sec. 13. Section 261.1, subsection 4, paragraph b, Code 30 2017, is amended to read as follows: 31 b. A vacancy shall exist on the commission when a 32 legislative member of the commission ceases to be a member of 33 the general assembly , when a parent member no longer has a 34 child enrolled in postsecondary education, or when a student 35 -18- HF 642 (5) 87 kh/tm/md 18/ 53
H.F. 642 member ceases to be enrolled as a student. Such vacancy shall 1 be filled within thirty days. 2 Sec. 14. Section 261.2, subsections 6 and 8, Code 2017, are 3 amended to read as follows: 4 6. Develop and implement, in cooperation with the 5 department of human services and the judicial branch, a program 6 to assist juveniles who are sixteen years of age or older and 7 who have a case permanency plan under chapter 232 or 237 or are 8 otherwise under the jurisdiction of chapter 232 in applying 9 for federal and state aid available for higher education. 10 The commission shall also develop and implement the all Iowa 11 opportunity foster care grant program in accordance with 12 section 261.6 . 13 8. Submit by January 15 annually a report to the general 14 assembly which provides, by program, the number of individuals 15 who received loan forgiveness or loan repayment in the previous 16 fiscal year, the amount amounts paid to or on behalf of 17 individuals under sections 261.73, 261.112, and 261.116, and 18 the institutions from which individuals graduated, and that 19 includes any proposed statutory changes and the commission’s 20 findings and recommendations. 21 Sec. 15. Section 261.9, Code 2017, is amended by adding the 22 following new subsection: 23 NEW SUBSECTION . 2A. “Eligible institution” means an 24 institution of higher learning located in Iowa which is 25 operated privately and not controlled or administered by any 26 state agency or any subdivision of the state, which is not 27 exempt from taxation under section 501(c)(3) of the Internal 28 Revenue Code, and which meets all of the criteria in subsection 29 1, paragraphs “d” through “i” , and the criteria in paragraphs 30 “a” or “b” as follows: 31 a. Is accredited by the higher learning commission and 32 which, effective January 8, 2010, purchased an accredited 33 private institution that was exempt from taxation under section 34 501(c) of the Internal Revenue Code, or whose students were 35 -19- HF 642 (5) 87 kh/tm/md 19/ 53
H.F. 642 eligible to receive tuition grants in the fiscal year beginning 1 July 1, 2003. The eligible institution shall annually provide 2 a matching aggregate amount of institutional financial aid 3 which shall increase by the percentage of increase each 4 fiscal year of funds appropriated for Iowa tuition grants 5 under section 261.25, subsection 2, to a maximum match of one 6 hundred percent as initiated under section 261.9, subsection 1, 7 paragraph “b” , Code 2005. 8 b. Is a barber school licensed under section 158.7 or 9 a school of cosmetology arts and sciences licensed under 10 chapter 157 and is accredited by a national accrediting agency 11 recognized by the United States department of education. For 12 the fiscal year beginning July 1, 2017, an eligible institution 13 under this paragraph shall provide a matching aggregate amount 14 of institutional financial aid equal to at least seventy-five 15 percent of the amount received by the institution’s students 16 for Iowa tuition grant assistance under section 261.16A. 17 For the fiscal year beginning July 1, 2018, the institution 18 shall provide a matching aggregate amount of institutional 19 financial aid equal to at least eighty-five percent of the 20 amount received in that fiscal year. Commencing with the 21 fiscal year beginning July 1, 2019, and each succeeding fiscal 22 year, the matching aggregate amount of institutional financial 23 aid shall be at least equal to the match provided by eligible 24 institutions under section 261.16A, subsection 2. 25 Sec. 16. Section 261.12, subsection 1, paragraph b, Code 26 2017, is amended to read as follows: 27 b. For the fiscal year beginning July 1, 2015 2017 , and for 28 each succeeding fiscal year, six thousand dollars an amount 29 equivalent to the average resident tuition and mandatory fees 30 for two semesters or the equivalent of undergraduate study at 31 the institutions of higher learning governed by the state board 32 of regents . 33 Sec. 17. NEW SECTION . 261.16A Iowa tuition grants —— 34 for-profit institutions. 35 -20- HF 642 (5) 87 kh/tm/md 20/ 53
H.F. 642 1. Students qualified. A tuition grant from moneys 1 appropriated under section 261.25, subsection 2, may be awarded 2 to a resident of Iowa who is admitted and in attendance as 3 a full-time or part-time resident student at an eligible 4 institution and who establishes financial need. 5 2. Extent of grant. 6 a. A qualified full-time resident student enrolled in an 7 eligible institution that meets the criteria of section 261.9, 8 subsection 2A, paragraph “a” , may receive tuition grants for 9 not more than eight semesters of undergraduate study or the 10 equivalent; a qualified part-time resident student enrolled 11 in the eligible institution may receive tuition grants for 12 not more than sixteen semesters of undergraduate study or the 13 equivalent. 14 b. A qualified full-time resident student enrolled in an 15 eligible institution that meets the criteria of section 261.9, 16 subsection 2A, paragraph “b” , may receive tuition grants for not 17 more than four semesters or the equivalent of two full years 18 of study. However, if a student resumes study after at least 19 a two-year absence, the student may again be eligible for the 20 specified amount of time, except that the student shall not 21 receive assistance for courses for which credit was previously 22 received. 23 3. Amount of grant. 24 a. The amount of a tuition grant to a qualified full-time 25 student for the fall and spring semesters, or the equivalent, 26 shall be the amount of the student’s financial need for that 27 period. However, a tuition grant shall not exceed six thousand 28 dollars. 29 b. The amount of a tuition grant to a qualified full-time 30 student for the summer semester or equivalent shall be one-half 31 the amount of the tuition grant the student receives under 32 paragraph “a” . 33 c. The amount of a tuition grant to a qualified part-time 34 student enrolled in a course of study including at least three 35 -21- HF 642 (5) 87 kh/tm/md 21/ 53
H.F. 642 semester hours but fewer than twelve semester hours for the 1 fall, spring, and summer semesters, or the equivalent, shall be 2 equal to the amount of a tuition grant that would be paid to a 3 full-time student times a number which represents the number 4 of hours in which the part-time student is actually enrolled 5 divided by twelve semester hours, or the equivalent. 6 d. If a qualified student receives financial aid under any 7 other program, the full amount of such financial aid shall be 8 considered part of the student’s financial resources available 9 in determining the amount of the student’s financial need 10 for that period. In no case may the state’s total financial 11 contribution to the student’s education, including financial 12 aid under any other state or federal program, exceed the 13 tuition and mandatory fees at the eligible institution the 14 student attends. 15 4. Grant payments —— attendance discontinued. 16 a. Payments under the tuition grant shall be allocated 17 equally among the semesters or the equivalent and shall be 18 paid at the beginning of each semester or equivalent upon 19 certification by the eligible institution that the student is 20 admitted and in full-time or part-time attendance in a course 21 of study. 22 b. If the student discontinues attendance before the end of 23 any semester, or the equivalent, after receiving payment under 24 the grant, the entire amount of any refund due that student, 25 up to the amount of any payments made under the annual grant, 26 shall be paid by the eligible institution to the state. 27 5. Commission responsibilities. The commission’s 28 responsibilities for administering tuition grants under this 29 section shall be the same as provided under section 261.15. 30 The commission may require an eligible institution to promptly 31 furnish any information which the commission may request in 32 connection with the tuition grant program. 33 6. Grant applications. Each applicant for a tuition grant 34 under this section shall meet the requirements of section 35 -22- HF 642 (5) 87 kh/tm/md 22/ 53
H.F. 642 261.16. 1 7. Reports to commission. An eligible institution shall 2 file annual reports with the commission, as required by the 3 commission and under section 261.9, prior to receipt of tuition 4 grant moneys under this chapter. 5 Sec. 18. Section 261.25, subsections 1, 2, and 3, Code 2017, 6 are amended to read as follows: 7 1. There is appropriated from the general fund of the state 8 to the commission for each fiscal year the sum of forty-five 9 forty-six million five six hundred thirteen thirty thousand 10 four nine hundred forty-eight fifty-one dollars for tuition 11 grants to qualified students who are enrolled in accredited 12 private institutions . 13 2. There is appropriated from the general fund of the 14 state to the commission for each fiscal year the sum of two 15 one million five hundred thousand dollars for tuition grants 16 for qualified students attending for-profit accredited private 17 who are enrolled in eligible institutions located in Iowa . 18 A for-profit institution which, effective March 9, 2005, or 19 effective January 8, 2010, purchased an accredited private 20 institution that was exempt from taxation under section 501(c) 21 of the Internal Revenue Code , shall be an eligible institution 22 under the tuition grant program. For purposes of the tuition 23 grant program, “for-profit accredited private institution” means 24 an accredited private institution which is not exempt from 25 taxation under section 501(c)(3) of the Internal Revenue Code 26 but which otherwise meets the requirements of section 261.9, 27 subsection 1 , paragraph “b” , and whose students were eligible 28 to receive tuition grants in the fiscal year beginning July 1, 29 2003. 30 3. There is appropriated from the general fund of the 31 state to the commission for each fiscal year the sum of two 32 one million two seven hundred fifty thousand one hundred 33 eighty-five dollars for vocational-technical tuition grants. 34 Sec. 19. Section 261.25, subsection 5, Code 2017, is amended 35 -23- HF 642 (5) 87 kh/tm/md 23/ 53
H.F. 642 by striking the subsection. 1 Sec. 20. Section 261.87, subsection 1, Code 2017, is amended 2 by adding the following new paragraph: 3 NEW PARAGRAPH . 0b. “Eligible foster care student” means 4 a person who has a high school diploma or a high school 5 equivalency diploma under chapter 259A and is described by any 6 of the following: 7 (1) Is age seventeen and is in a court-ordered placement 8 under chapter 232 under the care and custody of the department 9 of human services or juvenile court services. 10 (2) Is age seventeen and has been placed in a state juvenile 11 institution pursuant to a court order entered under chapter 232 12 under the care and custody of the department of human services. 13 (3) Is age eighteen through twenty-three and is described 14 by any of the following: 15 (a) On the date the person reached age eighteen or during 16 the thirty calendar days preceding or succeeding that date, 17 the person was in a licensed foster care placement pursuant 18 to a court order entered under chapter 232 under the care and 19 custody of the department of human services or juvenile court 20 services. 21 (b) On the date the person reached age eighteen or during 22 the thirty calendar days preceding or succeeding that date, the 23 person was under a court order under chapter 232 to live with a 24 relative or other suitable person. 25 (c) The person was in a licensed foster care placement 26 pursuant to an order entered under chapter 232 prior to being 27 legally adopted after reaching age sixteen. 28 (d) On the date the person reached age eighteen or during 29 the thirty calendar days preceding or succeeding that date, 30 the person was placed in a state juvenile institution pursuant 31 to a court order entered under chapter 232 under the care and 32 custody of the department of human services. 33 Sec. 21. Section 261.87, subsection 2, paragraph b, Code 34 2017, is amended by striking the paragraph. 35 -24- HF 642 (5) 87 kh/tm/md 24/ 53
H.F. 642 Sec. 22. Section 261.87, subsection 2, paragraph g, Code 1 2017, is amended to read as follows: 2 g. Begins enrollment at an eligible institution within 3 two academic years of graduation from high school or receipt 4 of a high school equivalency diploma under chapter 259A and 5 continuously receives awards as a full-time or part-time 6 student to maintain eligibility. However, the student may 7 defer participation in the program for up to two years in order 8 to pursue obligations that meet conditions established by the 9 commission by rule or to fulfill military obligations. 10 Sec. 23. Section 261.87, Code 2017, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 2A. Priority for scholarship 13 awards. Priority for scholarships under this section shall be 14 given to eligible foster care students who meet the eligibility 15 criteria under subsection 2. Following distribution to 16 students who meet the eligibility criteria under subsection 2, 17 the commission may establish priority for awarding scholarships 18 using any moneys that remain in the all Iowa opportunity 19 scholarship fund. 20 Sec. 24. Section 261.87, subsection 3, Code 2017, is amended 21 to read as follows: 22 3. Extent of scholarship. A qualified student at an 23 eligible institution may receive scholarships for not more than 24 the equivalent of two eight full-time academic years semesters 25 of undergraduate study, excluding summer semesters. A 26 qualified student attending part-time may receive scholarships 27 for not more than the equivalent of sixteen part-time semesters 28 of undergraduate study. Scholarships awarded pursuant to this 29 section may, at the qualified student’s request, be disbursed 30 over a single academic year or two academic years, and shall 31 not exceed the least of the following amounts, as determined 32 by the commission: 33 a. The student’s financial need. 34 b. The One-half of the average resident tuition rate and 35 -25- HF 642 (5) 87 kh/tm/md 25/ 53
H.F. 642 mandatory fees established for institutions of higher learning 1 governed by the state board of regents for a scholarship 2 disbursed over one academic year, or one-half of that amount 3 for a scholarship disbursed over two academic years . 4 c. The resident tuition and mandatory fees charged for the 5 program of enrollment by the eligible institution at which the 6 student is enrolled. 7 Sec. 25. Section 271.2, Code 2017, is amended by striking 8 the section and inserting in lieu thereof the following: 9 271.2 Purposes. 10 The Oakdale campus shall serve as an extension of the 11 university of Iowa’s main campus in Iowa City. The Oakdale 12 campus shall serve the university’s mission, including being 13 the location for the state hygienic laboratory, the university 14 of Iowa research park, and various other research and support 15 facilities. 16 Sec. 26. Section 272.28, subsection 1, unnumbered paragraph 17 1, Code 2017, is amended to read as follows: 18 Requirements for teacher licensure beyond an initial license 19 shall include successful completion of a beginning teacher 20 mentoring and induction program approved by the state board of 21 education pursuant to section 284.5; or two years of successful 22 teaching experience in a school district with an approved 23 career paths, leadership roles, and compensation framework or 24 approved comparable system as provided in section 284.15; or 25 evidence of not less than three years of successful teaching 26 experience at any of the following: 27 Sec. 27. Section 279.68, subsection 1, paragraph a, Code 28 2017, is amended to read as follows: 29 a. A school district shall assess all students enrolled 30 in kindergarten through grade three at the beginning of each 31 school year for their level of reading or reading readiness 32 on locally determined or statewide assessments, as provided 33 in section 256.7, subsection 31 . If a student is not reading 34 proficiently and is persistently at risk in reading, based upon 35 -26- HF 642 (5) 87 kh/tm/md 26/ 53
H.F. 642 the assessments administered in accordance with this paragraph, 1 the school district shall provide intensive reading instruction 2 to the student. The student’s reading proficiency shall be 3 periodically reassessed by locally determined or statewide 4 assessments including periodic universal screening and annual 5 standard-based assessments. The student shall continue to be 6 provided with intensive reading instruction , at grade levels 7 beyond grade three if necessary, until the student is reading 8 at grade level, as determined by the student’s consistently 9 proficient performance on valid and reliable measures of 10 reading ability. For purposes of this section , “persistently at 11 risk” means the student has not met the grade-level benchmark on 12 two consecutive screening assessments administered under this 13 paragraph. 14 Sec. 28. Section 279.68, subsection 1, paragraph c, Code 15 2017, is amended by striking the paragraph. 16 Sec. 29. Section 279.68, subsection 2, paragraph e, Code 17 2017, is amended by striking the paragraph. 18 Sec. 30. Section 279.68, subsections 3 and 5, Code 2017, are 19 amended by striking the subsections. 20 Sec. 31. Section 282.10, subsection 4, paragraph a, Code 21 2017, is amended by striking the paragraph. 22 Sec. 32. Section 284.1, subsection 1, Code 2017, is amended 23 by striking the subsection. 24 Sec. 33. Section 284.4, subsection 1, paragraph b, Code 25 2017, is amended by striking the paragraph. 26 Sec. 34. Section 284.5, subsections 2 and 3, Code 2017, are 27 amended to read as follows: 28 2. Each school district and area education agency shall may 29 provide a beginning teacher mentoring and induction program for 30 all teachers who are beginning teachers , and notwithstanding 31 section 284.4, subsection 1 , a school district and an area 32 education agency shall be eligible to receive moneys under 33 section 284.13, subsection 1 , paragraph “b” , for purposes 34 of implementing a beginning teacher mentoring and induction 35 -27- HF 642 (5) 87 kh/tm/md 27/ 53
H.F. 642 program in accordance with this section . 1 3. Each school district and area education agency that 2 provides a beginning teacher mentoring and induction program 3 under this chapter shall develop a plan for the program. A 4 school district shall include its plan in the school district’s 5 comprehensive school improvement plan submitted pursuant to 6 section 256.7, subsection 21 . The plan shall, at a minimum, 7 provide for a two-year sequence of induction program content 8 and activities to support the Iowa teaching standards and 9 beginning teacher professional and personal needs; mentor 10 training that includes, at a minimum, skills of classroom 11 demonstration and coaching, and district expectations for 12 beginning teacher competence on Iowa teaching standards; 13 placement of mentors and beginning teachers; the process for 14 dissolving mentor and beginning teacher partnerships; district 15 organizational support for release time for mentors and 16 beginning teachers to plan, provide demonstration of classroom 17 practices, observe teaching, and provide feedback; structure 18 for mentor selection and assignment of mentors to beginning 19 teachers; a district facilitator; and program evaluation. 20 Sec. 35. Section 284.6, subsection 8, Code 2017, is amended 21 to read as follows: 22 8. For each year in which a school district receives funds 23 calculated and paid to school districts for professional 24 development pursuant to section 257.10, subsection 10 , or 25 section 257.37A, subsection 2 , the school district shall create 26 quality professional development opportunities. Not less than 27 thirty-six hours in the school calendar, held outside of the 28 minimum school day, shall be set aside during nonpreparation 29 time or designated professional development time to allow 30 practitioners to collaborate with each other to deliver 31 educational programs and assess student learning, or to engage 32 in peer review pursuant to section 284.8, subsection 1 . The 33 funds may be used to implement the professional development 34 provisions of the teacher career paths and leadership roles 35 -28- HF 642 (5) 87 kh/tm/md 28/ 53
H.F. 642 specified in section 284.15 , including but not limited to 1 providing professional development to teachers, including 2 additional salaries for time beyond the normal negotiated 3 agreement; activities and pay to support a beginning teacher 4 mentoring and induction program that meets the requirements 5 of section 284.5; pay for substitute teachers, professional 6 development materials, speakers, and professional development 7 content; and costs associated with implementing the individual 8 professional development plans. The use of the funds shall 9 be balanced between school district, attendance center, 10 and individual professional development plans, making every 11 reasonable effort to provide equal access to all teachers. 12 Sec. 36. Section 284.13, subsection 1, paragraphs a, c, d, 13 and f, Code 2017, are amended to read as follows: 14 a. For the fiscal year beginning July 1, 2016 2017 , and 15 ending June 30, 2017 2018 , to the department of education , the 16 amount of eight hundred forty-six thousand two hundred fifty 17 dollars for the issuance of national board certification awards 18 in accordance with section 256.44 . Of the amount allocated 19 under this paragraph, not less than eighty-five thousand 20 dollars shall be used to administer the ambassador to education 21 position in accordance with section 256.45 . 22 c. For the fiscal year beginning July 1, 2016 2017 , and 23 ending June 30, 2017 2018 , up to seven hundred eighty-six 24 seventy-four thousand eight three hundred sixteen dollars to 25 the department for purposes of implementing the professional 26 development program requirements of section 284.6 , assistance 27 in developing model evidence for teacher quality committees 28 established pursuant to section 284.4, subsection 1 , paragraph 29 “c” , and the evaluator training program in section 284.10 . 30 A portion of the funds allocated to the department for 31 purposes of this paragraph may be used by the department for 32 administrative purposes and for not more than four full-time 33 equivalent positions. 34 d. For the fiscal year beginning July 1, 2016 2017 , and 35 -29- HF 642 (5) 87 kh/tm/md 29/ 53
H.F. 642 ending June 30, 2017 2018 , an amount up to one million one 1 hundred thirty-six twenty-three thousand four nine hundred ten 2 dollars to the department for the establishment of teacher 3 development academies in accordance with section 284.6, 4 subsection 10 . A portion of the funds allocated to the 5 department for purposes of this paragraph may be used for 6 administrative purposes. 7 f. For the fiscal year beginning July 1, 2017 2018 , 8 and for each subsequent fiscal year, to the department of 9 education, ten million dollars for purposes of implementing 10 the supplemental assistance for high-need schools provisions 11 of section 284.11 . Annually, of the moneys allocated to 12 the department for purposes of this paragraph, up to one 13 hundred thousand dollars may be used by the department for 14 administrative purposes and for not more than one full-time 15 equivalent position. 16 Sec. 37. Section 284.13, subsection 1, paragraph b, Code 17 2017, is amended by striking the paragraph. 18 Sec. 38. Section 284.13, subsection 1, Code 2017, is amended 19 by adding the following new paragraphs: 20 NEW PARAGRAPH . 0f. For the fiscal year beginning July 1, 21 2017, and ending June 30, 2018, to the department an amount up 22 to twenty-five thousand dollars for purposes of the fine arts 23 beginning teacher mentoring program established under section 24 256.34. 25 NEW PARAGRAPH . 00f. For the fiscal year beginning July 1, 26 2017, and ending June 30, 2018, to the department an amount 27 up to six hundred twenty-six thousand one hundred ninety-one 28 dollars shall be used by the department for a delivery system, 29 in collaboration with area education agencies, to assist in 30 implementing the career paths and leadership roles considered 31 pursuant to sections 284.15, 284.16, and 284.17, including but 32 not limited to planning grants to school districts and area 33 education agencies, technical assistance for the department, 34 technical assistance for districts and area education agencies, 35 -30- HF 642 (5) 87 kh/tm/md 30/ 53
H.F. 642 training and staff development, and the contracting of external 1 expertise and services. In using moneys allocated for purposes 2 of this paragraph, the department shall give priority to school 3 districts with certified enrollments of fewer than six hundred 4 students. A portion of the moneys allocated annually to the 5 department for purposes of this paragraph may be used by the 6 department for administrative purposes and for not more than 7 five full-time equivalent positions. 8 Sec. 39. Section 284.15, subsection 2, paragraph a, 9 subparagraph (1), Code 2017, is amended to read as follows: 10 (1) The salary for an initial teacher who has successfully 11 completed an approved practitioner preparation program as 12 defined in section 272.1 or holds an initial or intern teacher 13 license issued under chapter 272 , and who participates in the 14 beginning teacher mentoring and induction program as provided 15 in this chapter , shall be at least thirty-three thousand five 16 hundred dollars, which shall also constitute the minimum salary 17 for an Iowa teacher. 18 Sec. 40. Section 284.15, subsection 2, paragraph b, 19 subparagraph (1), Code 2017, is amended by striking the 20 subparagraph. 21 Sec. 41. Section 284.16, subsection 1, paragraph a, 22 subparagraph (3), Code 2017, is amended by striking the 23 subparagraph. 24 Sec. 42. Section 284.16, subsection 1, paragraph b, 25 subparagraph (1), Code 2017, is amended to read as follows: 26 (1) Has successfully completed the beginning teacher 27 mentoring and induction program and has successfully completed 28 a comprehensive evaluation. 29 Sec. 43. REPEAL. Sections 261.6, 261.61, 261.129, 263.4, 30 263.5, and 263.6, Code 2017, are repealed. 31 DIVISION II 32 WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS FY 2017-2018 33 Sec. 44.
