H.F. 591 Section 1. NEW SECTION . 148C.5 Supervising physicians —— 1 board of medicine —— rulemaking requirements. 2 1. If the board commences a contested case hearing against 3 a physician assistant by delivering a statement of charges 4 and notice of hearing to the physician assistant, the board 5 shall deliver a copy of the statement of charges and notice of 6 hearing to the physician assistant’s supervising physician. 7 2. The board shall adopt rules pursuant to chapter 17A to 8 establish specific procedures for consulting with and sharing 9 information with the board of medicine regarding complaints 10 that a physician assistant may have been inadequately 11 supervised by the physician assistant’s supervising physician. 12 3. The board shall not amend or rescind any of the following 13 rules unless, prior to the submission of such an amendment or 14 rescission to the administrative rules coordinator, the board 15 consults with and receives approval from the board of medicine 16 to make such a submission: 17 a. 645 IAC 326.1 regarding the following terms: 18 (1) “Physician”. 19 (2) “Physician assistant”. 20 (3) “Supervising physician”. 21 (4) “Supervision”. 22 b. 645 IAC 326.2(1)(f). 23 c. 645 IAC 326.4(6). 24 d. 645 IAC 326.8. 25 e. 645 IAC 326.19(3)(b)(3). 26 f. 645 IAC 327.1(1)(s)(1)-(4). 27 g. 645 IAC 327.1(1)(u). 28 h. 645 IAC 327.1(1)(z). 29 i. 645 IAC 327.4(1)(b)(2)-(4). 30 j. 645 IAC 327.4(2). 31 k. 645 IAC 327.6(1)(d). 32 Sec. 2. REPEAL. 2015 Iowa Acts, chapter 137, section 113, 33 is repealed. 34 Sec. 3. PHYSICIAN ASSISTANT SUPERVISION RULEMAKING ACTIONS. 35 -1- HF 591 (3) 87 tr/nh/md 1/ 2
H.F. 591 1. The board of physician assistants shall take no further 1 action relating to ARC 2832C. ARC 2832C is terminated as of 2 the effective date of this Act. 3 2. a. The amendments to 653 Iowa administrative code, rules 4 21.4, 21.5, 21.6, 21.7, and 21.8; and 653 Iowa administrative 5 code, chapter 21, implementation sentence, as appearing in ARC 6 2532C, as published in the Iowa administrative bulletin, volume 7 XXXVIII, number 23, dated May 11, 2016, pp. 2190-2193, are 8 rescinded. 9 b. As soon as practicable, the Iowa administrative code 10 editor shall restore the language of the Iowa administrative 11 code referenced in paragraph “a” of this subsection to the 12 language that existed on May 10, 2016. 13 Sec. 4. RETROACTIVE APPLICABILITY. The section of this Act 14 repealing 2015 Iowa Acts, chapter 137, section 113, applies 15 retroactively to July 1, 2015. 16 Sec. 5. EFFECTIVE DATE.
