Section
1.
NEW
SECTION
.
217.45
Background
investigations.
1
1.
A
background
investigation
may
be
conducted
by
2
the
department
of
human
services
on
all
of
the
following
3
individuals:
4
a.
An
applicant
for
employment
with
the
department.
5
b.
A
contractor,
vendor,
or
employee
performing
work
for
6
the
department
with
access
to
federal
tax
information
used
for
7
purposes
of
the
department.

2.
An
individual
subject
to
this
section
shall
authorize
the
9
release
of
the
results
of
all
of
the
following:
10
a.
A
work
history.
11
b.
A
state
criminal
history
background
check.
12
c.
A
national
criminal
history
check
through
the
federal
13
bureau
of
investigation.

3.
An
individual
subject
to
this
section
shall
provide
the
15
individual’s
fingerprints
to
the
department.
The
department
16
shall
request
the
national
criminal
history
check
and
shall
17
provide
the
individual’s
fingerprints
to
the
department
of
18
public
safety
for
submission
through
the
state
criminal
history
19
repository
to
the
federal
bureau
of
investigation.

4.
The
department
shall
pay
the
actual
cost
of
the
21
fingerprinting
and
the
national
criminal
history
check,
if
any,
22
unless
otherwise
agreed
to
as
part
of
a
vendor
contract
or
23
other
contract
with
the
department.

5.
A
contractor,
vendor,
or
employee
performing
work
for
25
the
department
with
access
to
federal
tax
information
used
26
for
purposes
of
the
department
may
be
subject
to
a
background
27
investigation
by
the
department
at
least
once
every
ten
years
28
after
the
date
of
the
initial
contract
with
the
contractor
or
29
vendor
or
initial
date
of
hire
of
the
employee.
30
6.
The
results
of
background
investigations
conducted
31
pursuant
to
this
section
shall
not
be
considered
public
records
32
under
chapter
22.
