MONEYS CREDITED TO THE WATERSHED 4 IMPROVEMENT FUND —— FARM MANAGEMENT DEMONSTRATION 5 PROGRAM. Notwithstanding 2017 Iowa Acts, chapter 168, section 6 22, as amended by 2017 Iowa Acts, chapter 170, section 42, 7 of the moneys credited to the watershed improvement fund 8 that are unencumbered or unobligated and managed by and 9 otherwise appropriated to the department of agriculture and 10 land stewardship pursuant to those sections, the department 11 shall expend the following amount, or so much thereof as is 12 necessary, for the fiscal year beginning July 1, 2018, and 13 ending June 30, 2019, for the purpose designated: 14 1. FARMERS WITH DISABILITIES PROGRAM. 19 1. The moneys appropriated in subsection 1 shall be used for 29 the public purpose of providing a grant to a national nonprofit 30 organization with over 80 years of experience in assisting 31 children and adults with disabilities and special needs. The 32 moneys shall be used to support a nationally recognized program 33 that began in 1986 and has been replicated in at least 30 other 34 states, but which is not available through any other entity 35 -5- HF 2491 (3) 87 da/rn/md 5/ 25
H.F. 2491 in this state, and that provides assistance to farmers with 1 disabilities in all 99 counties to allow the farmers to remain 2 in their own homes and be gainfully engaged in farming through 3 provision of agricultural worksite and home modification 4 consultations, peer support services, services to families, 5 information and referral, and equipment loan services. 6 3. Notwithstanding section 8.33 , moneys appropriated in 7 this section that remain unencumbered or unobligated at the 8 close of the fiscal year shall not revert but shall remain 9 available for expenditure for the purposes designated until the 10 close of the succeeding fiscal year. 11 Sec. 9. 2017 Iowa Acts, chapter 168, is amended by adding 12 the following new section: 13 NEW SECTION . SEC. 42A. FOREIGN ANIMAL DISEASES AFFLICTING 14 LIVESTOCK. There is appropriated from the general fund of the 15 state to the department of agriculture and land stewardship for 16 the fiscal year beginning July 1, 2018, and ending June 30, 17 2019, the following amount, or so much thereof as is necessary, 18 to be used for the purposes designated: 19 For deposit in the foreign animal disease preparedness and 20 response fund created in section 163.3B: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 250,000 22 DIVISION II 23 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 24 GENERAL WATER QUALITY INITIATIVE APPROPRIATION 25 GENERAL FUND 26 Sec. 10. 2017 Iowa Acts, chapter 168, section 43, is amended 27 to read as follows: 28 SEC. 43. WATER QUALITY INITIATIVE —— GENERAL. 29 1. There is appropriated from the general fund of the state 30 to the department of agriculture and land stewardship for the 31 fiscal year beginning July 1, 2018, and ending June 30, 2019, 32 the following amount, or so much thereof as is necessary, to be 33 used for the purposes designated: 34 For deposit in the water quality initiative fund created in 35 -6- HF 2491 (3) 87 da/rn/md 6/ 25

The moneys appropriated in subsection 1 shall be 7 used to support projects in subwatersheds as designated by the 8 division that are part of high-priority watersheds identified 9 by the water resources coordinating council established 10 pursuant to section 466B.3 . 11 b. The moneys appropriated in subsection 1 shall be used to 12 support projects in watersheds generally, including regional 13 watersheds, as designated by the division and high-priority 14 watersheds identified by the water resources coordinating 15 council established pursuant to section 466B.3 . 16 3. In supporting projects in subwatersheds and watersheds 17 as provided in subsection 2, all of the following shall apply: 18 a. The demonstration projects shall utilize water quality 19 practices as described in the latest revision of the document 20 entitled “Iowa Nutrient Reduction Strategy” initially presented 21 in November 2012 by the department of agriculture and land 22 stewardship, the department of natural resources, and Iowa 23 state university of science and technology Iowa nutrient 24 reduction strategy as defined in section 455B.171, as amended 25 by 2018 Iowa Acts, Senate File 512, section 18 . 26 b. The division shall implement demonstration projects as 27 provided in paragraph “a” by providing for participation by 28 persons who hold a legal interest in agricultural land used in 29 farming. To every extent practical, the division shall provide 30 for collaborative participation by such persons who hold a 31 legal interest in agricultural land located within the same 32 subwatershed. 33 c. The division shall implement a demonstration project on 34 a cost-share basis as determined by the division. However, 35 -7- HF 2491 (3) 87 da/rn/md 7/ 25
H.F. 2491 except for edge-of-field practices, the state’s share of the 1 amount shall not exceed 50 percent of the estimated cost of 2 establishing the practice as determined by the division or 3 50 percent of the actual cost of establishing the practice, 4 whichever is less. 5 d. The demonstration projects shall be used to educate other 6 persons about the feasibility and value of establishing similar 7 water quality practices. The division shall promote field day 8 events for purposes of allowing interested persons to establish 9 water quality practices on their agricultural land. 10 e. The division shall conduct water quality evaluations 11 within supported subwatersheds. Within a reasonable period 12 after accumulating information from such evaluations, the 13 division shall create an aggregated database of water quality 14 practices. Any information identifying a person holding a 15 legal interest in agricultural land or specific agricultural 16 land shall be a confidential record under section 22.7 . 17 4. The moneys appropriated in subsection 1 shall be used 18 to support education and outreach in a manner that encourages 19 persons who hold a legal interest in agricultural land used for 20 farming to implement water quality practices, including the 21 establishment of such practices in watersheds generally, and 22 not limited to subwatersheds or high-priority watersheds. 23 5. The moneys appropriated in subsection 1 may be used 24 to contract with persons to coordinate the implementation of 25 efforts provided in this section. 26 6. The moneys appropriated in subsection 1 may be used by 27 the department to support urban soil and water conservation 28 efforts, which may include but are not limited to management 29 practices related to bioretention, landscaping, the use of 30 permeable or pervious pavement, and soil quality restoration. 31 The moneys shall be allocated on a cost-share basis as provided 32 in chapter 161A . 33 7. Notwithstanding any other provision of law to the 34 contrary, the department may use moneys appropriated in 35 -8- HF 2491 (3) 87 da/rn/md 8/ 25
H.F. 2491 subsection 1 to carry out the provisions of this section on a 1 cost-share basis in combination with other moneys available to 2 the department from a state or federal source. 3 8. Not more than 10 percent of the moneys appropriated in 4 this section may be used to pay for the costs of administering 5 and implementing the water quality initiative by the 6 department’s division of soil conservation and water quality as 7 provided in section 466B.42 and this section. 8 DIVISION III 9 DEPARTMENT OF NATURAL RESOURCES 10 GENERAL APPROPRIATIONS 11 GENERAL FUND AND MAJOR FUNDS 12 Sec. 11. 2017 Iowa Acts, chapter 168, section 44, is amended 13 to read as follows: 14 SEC. 44. GENERAL FUND —— DEPARTMENT. 15 1. Of the number of full-time equivalent positions 28 authorized to the department pursuant to subsection 1, 50 29 full-time equivalent positions shall be allocated by the 30 department for seasonal employees for purposes of providing 31 maintenance, upkeep, and sanitary services at state parks. 32 This subsection shall not impact park ranger or park manager 33 positions within the department. 34 3. The report shall describe in 5 detail the expenditure of moneys appropriated under this 6 section to support the department’s administration, regulation, 7 and programs. 8 Sec. 12. 2017 Iowa Acts, chapter 168, section 45, is amended 9 to read as follows: 10 SEC. 45. STATE FISH AND GAME PROTECTION FUND —— REGULATION 11 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 12 1. There is appropriated from the state fish and game 13 protection fund created pursuant to section 456A.17 to the 14 department of natural resources for the fiscal year beginning 15 July 1, 2018, and ending June 30, 2019, the following amount, 16 or so much thereof as is necessary, to be used for the purposes 17 designated: 18 For purposes of supporting the regulation or advancement of 19 hunting, fishing, or trapping, or the protection, propagation, 20 restoration, management, or harvest of fish or wildlife, 21 including for administration, regulation, law enforcement, and 22 programs; and for salaries, support, maintenance, equipment, 23 and miscellaneous purposes: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 21,573,996.50 25 43,768,530 26 2. Notwithstanding section 455A.10 , the department may use 27 the unappropriated balance remaining in the state fish and game 28 protection fund to provide for the funding of health and life 29 insurance premium payments from unused sick leave balances of 30 conservation peace officers employed in a protection occupation 31 who retire, pursuant to section 97B.49B . 32 3. Notwithstanding section 455A.10 , the department of 33 natural resources may use the unappropriated balance remaining 34 in the state fish and game protection fund for the fiscal 35 -10- HF 2491 (3) 87 da/rn/md 10/ 25

The demonstration projects shall utilize water quality 23 practices as described in the latest revision of the document 24 entitled “Iowa Nutrient Reduction Strategy” initially presented 25 in November 2012 by the department of agriculture and land 26 stewardship, the department of natural resources, and Iowa 27 state university of science and technology Iowa nutrient 28 reduction strategy as defined in section 455B.171, as amended 29 by 2018 Iowa Acts, Senate File 512, section 18 . 30 b. The division shall implement demonstration projects as 31 provided in paragraph “a” by providing for participation by 32 persons who hold a legal interest in agricultural land used in 33 farming. To every extent practical, the division shall provide 34 for collaborative participation by such persons who hold a 35 -21- HF 2491 (3) 87 da/rn/md 21/ 25
H.F. 2491 legal interest in agricultural land located within the same 1 subwatershed. 2 c. The division shall implement a demonstration project on 3 a cost-share basis as determined by the division. However, 4 except for edge-of-field practices, the state’s share of the 5 amount shall not exceed 50 percent of the estimated cost of 6 establishing the practice as determined by the division or 7 50 percent of the actual cost of establishing the practice, 8 whichever is less. 9 d. The demonstration projects shall be used to educate other 10 persons about the feasibility and value of establishing similar 11 water quality practices. The division shall promote field day 12 events for purposes of allowing interested persons to establish 13 water quality practices on their agricultural land. 14 e. The division shall conduct water quality evaluations 15 within supported subwatersheds. Within a reasonable period 16 after accumulating information from such evaluations, the 17 division shall create an aggregated database of water quality 18 practices. Any information identifying a person holding a 19 legal interest in agricultural land or specific agricultural 20 land shall be a confidential record under section 22.7 . 21 4. The moneys appropriated in subsection 1 shall be used 22 to support education and outreach in a manner that encourages 23 persons who hold a legal interest in agricultural land used for 24 farming to implement water quality practices, including the 25 establishment of such practices in watersheds generally, and 26 not limited to subwatersheds or high-priority watersheds. 27 5. The moneys appropriated in subsection 1 may be used 28 to contract with persons to coordinate the implementation of 29 efforts provided in this section. 30 6. The moneys appropriated in subsection 1 may be used by 31 the department to support urban soil and water conservation 32 efforts, which may include but are not limited to management 33 practices related to bioretention, landscaping, the use of 34 permeable or pervious pavement, and soil quality restoration. 35 -22- HF 2491 (3) 87 da/rn/md 22/ 25

Notwithstanding any other provision of law to the 3 contrary, the department may use moneys appropriated in 4 subsection 1 to carry out the provisions of this section on a 5 cost-share basis in combination with other moneys available to 6 the department from a state or federal source. 7 8. Notwithstanding section 12 455A.19, subsection 1, paragraph “a”, subparagraph (1), of 13 the moneys allocated to the open spaces account of the Iowa 14 resources enhancement and protection fund, up to $1,000,000 may 15 be used by the department of natural resources for state park 16 maintenance and repair for the fiscal year beginning July 1, 17 2018, and ending on June 30, 2019. 18 DIVISION VIII 19 IOWA CODE CHANGES 20 Sec. 26. NEW SECTION . 455B.262B Cooperation with the state 21 geologist. 22 The department may request and shall receive assistance from 23 the state geologist pursuant to section 456.14 to allow for the 24 allocation and use of water resources, and the preclusion of 25 conflicts among users of water resources, as provided in this 26 part. 27 Sec. 27. NEW SECTION . 456.14 Water resource management. 28 1. The state geologist shall maintain historical data, 29 collect existing data, and compile new data regarding water 30 resources, including surface water sources and groundwater 31 sources, and geological formations that impact upon those water 32 resources. Such data shall be managed in a manner that allows 33 it to be made available for use by the department of natural 34 resources and the public. 35 -24- HF 2491 (3) 87 da/rn/md 24/ 25

The state geologist shall measure, assess, and evaluate 1 groundwater sources and subsurface geological formations in 2 a manner that assists the department of natural resources in 3 optimizing allocations and uses of groundwater sources in 4 this state, including as provided in chapter 455B, division 5 III, part 4. The state geologist may use data described in 6 subsection 1 to measure, assess, and evaluate all of the 7 following: 8 a. The sustainability and existing or potential 9 vulnerabilities of groundwater sources. 10 b. The risk, prediction, or indication of drought, the 11 impacts of drought, and the presence, intensity, or duration 12 of drought conditions. 13 c. Subsurface geologic hazards to groundwater resources. 14 d. The recharge of groundwater sources, including recharge 15 rates. 16 e. The presence of reserves of groundwater sources. 17 f. The potential of groundwater sources present in 18 subsurface geologic formations. 19 3. The state geologist shall develop and use management 20 tools, computer programming, or modeling as necessary or 21 convenient to administer this section. 22 4. The state geologist shall prepare, use, and make 23 available maps or other methods of presentation that provide 24 for the geospatial visualization of data described in 25 subsection 1 as necessary or convenient to administer this 26 section. 27 5. Upon request by the department of natural resources, the 28 state geologist shall assist the department in regulating water 29 quantity from water resources as provided in section 455B.262B. 30 -25- HF 2491 (3) 87 da/rn/md 25/ 25
