H.F. 146 Section 1. Section 648.5, Code 2017, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4A. The notice requirements of this 3 section shall be deemed to have been satisfied if the defendant 4 or the defendant’s attorney appears at the hearing. If the 5 hearing will be held fewer than three days after service of 6 the original notice or if notice is deemed satisfied pursuant 7 to this subsection, and the defendant is not represented 8 by an attorney, the court shall grant a continuance at the 9 defendant’s request to allow the defendant to prepare for the 10 hearing or to retain an attorney and shall inform the defendant 11 of such a right to a continuance. 12 -1- HF 146 (2) 87 jh/rj/md 1/ 1
