There is appropriated from the general fund of the state 5 to the department of justice for the fiscal year beginning July 6 1, 2015, and ending June 30, 2016, the following amounts, or 7 so much thereof as is necessary, to be used for the purposes 8 designated: 9 a. For victim assistance grants: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 6,734,400 25 The moneys appropriated in this lettered paragraph shall be 26 used to provide grants to care providers providing services to 27 crime victims of domestic abuse or to crime victims of rape and 28 sexual assault. 29 The balance of the victim compensation fund established in 30 section 915.94 may be used to provide salary and support of not 31 more than 24 FTEs and to provide maintenance for the victim 32 compensation functions of the department of justice. 33 The department of justice shall transfer at least $150,000 34 from the victim compensation fund established in section 915.94 35 -1- SF 497 (3) 86 jm/rn/jh 1/ 38
S.F. 497 to the victim assistance grant program. 1 Notwithstanding section 8.33, moneys appropriated in this 2 paragraph “b” that remain unencumbered or unobligated at the 3 close of the fiscal year shall not revert but shall remain 4 available for expenditure for the purposes designated until the 5 close of the succeeding fiscal year. 6 c. The department of justice, in submitting budget 10 estimates for the fiscal year commencing July 1, 2016, pursuant 11 to section 8.23, shall include a report of funding from sources 12 other than amounts appropriated directly from the general fund 13 of the state to the department of justice or to the office of 14 consumer advocate. These funding sources shall include but 15 are not limited to reimbursements from other state agencies, 16 commissions, boards, or similar entities, and reimbursements 17 from special funds or internal accounts within the department 18 of justice. The department of justice shall also report actual 19 reimbursements for the fiscal year commencing July 1, 2014, 20 and actual and expected reimbursements for the fiscal year 21 commencing July 1, 2015. 22 b. The department of justice shall include the report 23 required under paragraph “a”, as well as information regarding 24 any revisions occurring as a result of reimbursements actually 25 received or expected at a later date, in a report to the 26 co-chairpersons and ranking members of the joint appropriations 27 subcommittee on the justice system and the legislative services 28 agency. The department of justice shall submit the report on 29 or before January 15, 2016. 30 Sec. 2. OFFICE OF CONSUMER ADVOCATE. Each lease negotiated by the department of corrections 9 with a private corporation for the purpose of providing private 10 industry employment of inmates in a correctional institution 11 shall prohibit the private corporation from utilizing inmate 12 labor for partisan political purposes for any person seeking 13 election to public office in this state and that a violation 14 of this requirement shall result in a termination of the lease 15 agreement. 16 b. As a condition of receiving the appropriation provided 17 in this subsection the department of corrections shall not 18 enter into a lease or contractual agreement pursuant to section 19 904.809 with a private corporation for the use of building 20 space for the purpose of providing inmate employment without 21 providing that the terms of the lease or contract establish 22 safeguards to restrict, to the greatest extent feasible, access 23 by inmates working for the private corporation to personal 24 identifying information of citizens. 25 c. As a condition of receiving the appropriation provided 26 in this subsection the department of corrections shall not, 27 except as otherwise provided in paragraph “b”, enter into a 28 new contract, unless the contract is a renewal of an existing 29 contract, for the expenditure of moneys in excess of $100,000 30 during the fiscal year beginning July 1, 2015, for the 31 privatization of services performed by the department using 32 state employees as of July 1, 2015, or for the privatization 33 of new services by the department without prior consultation 34 with any applicable state employee organization affected 35 -5- SF 497 (3) 86 jm/rn/jh 5/ 38
S.F. 497 by the proposed new contract and prior notification of the 1 co-chairpersons and ranking members of the joint appropriations 2 subcommittee on the justice system. 3 d. The department of corrections shall add additional 4 correctional officer positions to the current number of 5 correctional officer positions as of July 1, 2015. 6 2. To maximize the funding for educational programs, 10 the department shall establish guidelines and procedures to 11 prioritize the availability of educational and vocational 12 training for inmates based upon the goal of facilitating an 13 inmate’s successful release from the correctional institution. 14 b. The director of the department of corrections may 15 transfer moneys from Iowa prison industries and the canteen 16 operating funds established pursuant to section 904.310, for 17 use in educational programs for inmates. 18 c. Notwithstanding section 8.33, moneys appropriated in 19 this subsection that remain unobligated or unexpended at the 20 close of the fiscal year shall not revert but shall remain 21 available to be used only for the purposes designated in this 22 subsection until the close of the succeeding fiscal year. 23 3. For the fiscal year addressed by this section the 30 department of corrections shall continue to operate the 31 correctional farms under the control of the department at 32 the same or greater level of participation and involvement 33 as existed as of January 1, 2011; shall not enter into any 34 rental agreement or contract concerning any farmland under 35 -6- SF 497 (3) 86 jm/rn/jh 6/ 38
S.F. 497 the control of the department that is not subject to a rental 1 agreement or contract as of January 1, 2011, without prior 2 legislative approval; and shall further attempt to provide 3 job opportunities at the farms for inmates. The department 4 shall attempt to provide job opportunities at the farms for 5 inmates by encouraging labor-intensive farming or gardening 6 where appropriate; using inmates to grow produce and meat for 7 institutional consumption; researching the possibility of 8 instituting food canning and cook-and-chill operations; and 9 exploring opportunities for organic farming and gardening, 10 livestock ventures, horticulture, and specialized crops. 11 Sec. 5. JUDICIAL DISTRICT DEPARTMENTS OF CORRECTIONAL 12 SERVICES. 13 1. There is appropriated from the general fund of the state 14 to the department of corrections for the fiscal year beginning 15 July 1, 2015, and ending June 30, 2016, for salaries, support, 16 maintenance, and miscellaneous purposes, the following amounts, 17 or so much thereof as is necessary, to be used for the purposes 18 designated: 19 a. Each judicial district department of correctional 26 services, within the funding available, shall continue programs 27 and plans established within that district to provide for 28 intensive supervision, sex offender treatment, diversion of 29 low-risk offenders to the least restrictive sanction available, 30 job development, and expanded use of intermediate criminal 31 sanctions. 32 3. Each judicial district department of correctional 33 services shall provide alternatives to prison consistent with 34 chapter 901B. The alternatives to prison shall ensure public 35 -8- SF 497 (3) 86 jm/rn/jh 8/ 38
S.F. 497 safety while providing maximum rehabilitation to the offender. 1 A judicial district department of correctional services may 2 also establish a day program. 3 4. The governor’s office of drug control policy shall 4 consider federal grants made to the department of corrections 5 for the benefit of each of the eight judicial district 6 departments of correctional services as local government 7 grants, as defined pursuant to federal regulations. 8 5. The department of corrections shall continue to contract 9 with a judicial district department of correctional services to 10 provide for the rental of electronic monitoring equipment which 11 shall be available statewide. 12 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 13 APPROPRIATIONS. Notwithstanding section 8.39, within the 14 moneys appropriated in this division of this Act to the 15 department of corrections, the department may reallocate the 16 moneys appropriated and allocated as necessary to best fulfill 17 the needs of the correctional institutions, administration 18 of the department, and the judicial district departments of 19 correctional services. However, in addition to complying with 20 the requirements of sections 904.116 and 905.8 and providing 21 notice to the legislative services agency, the department 22 of corrections shall also provide notice to the department 23 of management, prior to the effective date of the revision 24 or reallocation of an appropriation made pursuant to this 25 section. The department of corrections shall not reallocate an 26 appropriation or allocation for the purpose of eliminating any 27 program. 28 Sec. 7. INTENT —— REPORTS. 29 1. The department of corrections in cooperation with 30 townships, the Iowa cemetery associations, and other nonprofit 31 or governmental entities may use inmate labor during the 32 fiscal year beginning July 1, 2015, to restore or preserve 33 rural cemeteries and historical landmarks. The department in 34 cooperation with the counties may also use inmate labor to 35 -9- SF 497 (3) 86 jm/rn/jh 9/ 38
S.F. 497 clean up roads, major water sources, and other water sources 1 around the state. 2 2. On a quarterly basis the department shall provide a 3 status report regarding private-sector employment to the 4 legislative services agency beginning on July 1, 2015. The 5 report shall include the number of offenders employed in the 6 private sector, the combined number of hours worked by the 7 offenders, the total amount of allowances, and the distribution 8 of allowances pursuant to section 904.702, including any moneys 9 deposited in the general fund of the state. 10 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 11 corrections shall submit a report on electronic monitoring to 12 the general assembly, to the co-chairpersons and the ranking 13 members of the joint appropriations subcommittee on the justice 14 system, and to the legislative services agency by January 15 15, 2016. The report shall specifically address the number 16 of persons being electronically monitored and break down the 17 number of persons being electronically monitored by offense 18 committed. The report shall also include a comparison of any 19 data from the prior fiscal year with the current year. 20 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 21 1. As used in this section, unless the context otherwise 22 requires, “state agency” means the government of the state 23 of Iowa, including but not limited to all executive branch 24 departments, agencies, boards, bureaus, and commissions, the 25 judicial branch, the general assembly and all legislative 26 agencies, institutions within the purview of the state board of 27 regents, and any corporation whose primary function is to act 28 as an instrumentality of the state. 29 2. State agencies are encouraged to purchase products from 30 Iowa state industries, as defined in section 904.802, when 31 purchases are required and the products are available from 32 Iowa state industries. State agencies shall obtain bids from 33 Iowa state industries for purchases of office furniture during 34 the fiscal year beginning July 1, 2015, exceeding $5,000 or 35 -10- SF 497 (3) 86 jm/rn/jh 10/ 38
S.F. 497 in accordance with applicable administrative rules related to 1 purchases for the agency. 2 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 3 1. FTEs 24.00 14 The Iowa law enforcement academy shall provide training 15 of state and local law enforcement personnel concerning 16 the recognition of and response to persons with Alzheimer’s 17 disease. 18 The Iowa law enforcement academy may temporarily exceed and 19 draw more than the amount appropriated in this subsection and 20 incur a negative cash balance as long as there are receivables 21 equal to or greater than the negative balance and the amount 22 appropriated in this subsection is not exceeded at the close 23 of the fiscal year. 24 2. The Iowa law enforcement academy may select at least 25 five automobiles of the department of public safety, division 26 of state patrol, prior to turning over the automobiles to 27 the department of administrative services to be disposed 28 of by public auction, and the Iowa law enforcement academy 29 may exchange any automobile owned by the academy for each 30 automobile selected if the selected automobile is used in 31 training law enforcement officers at the academy. However, any 32 automobile exchanged by the academy shall be substituted for 33 the selected vehicle of the department of public safety and 34 sold by public auction with the receipts being deposited in the 35 -11- SF 497 (3) 86 jm/rn/jh 11/ 38

NEW SECTION . 710A.6 Outreach, public awareness, 15 and training programs. 16 The crime victim assistance division of the department of 17 justice, in cooperation with other governmental agencies and 18 nongovernmental or community organizations, shall develop and 19 conduct outreach, public awareness, and training programs for 20 the general public, law enforcement agencies, first responders, 21 potential victims, and persons conducting or regularly dealing 22 with businesses or other ventures that have a high statistical 23 incidence of debt bondage or forced labor or services. The 24 programs shall train participants to recognize and report 25 incidents of human trafficking and to suppress the demand that 26 fosters exploitation of persons and leads to human trafficking. 27 Sec. 21. Section 915.80, Code 2015, is amended by adding the 28 following new subsections: 29 NEW SUBSECTION . 4A. “Emergency relocation” means a 30 relocation that takes place within thirty days of the date of a 31 crime or the discovery of a crime, or within thirty days after 32 a crime could reasonably be reported. “Emergency relocation” 33 also includes a relocation that takes place within the thirty 34 days before or after an offender related to the crime is 35 -18- SF 497 (3) 86 jm/rn/jh 18/ 38
S.F. 497 released from incarceration. 1 NEW SUBSECTION . 4B. “Housing assistance” means living 2 expenses associated with owning or renting housing, including 3 essential utilities, intended to maintain or reestablish the 4 living arrangement, health, and safety of a victim impacted by 5 a crime. 6 Sec. 22. Section 915.84, Code 2015, is amended by adding the 7 following new subsection: 8 NEW SUBSECTION . 1A. The department may waive, for good 9 cause shown, the requirement that an emergency relocation must 10 take place within thirty days of the date or discovery of a 11 crime or within thirty days before or after the offender is 12 released from incarceration. 13 Sec. 23. Section 915.86, Code 2015, is amended by adding the 14 following new subsections: 15 NEW SUBSECTION . 16. Reasonable charges incurred by a 16 victim, a secondary victim, the survivor of a homicide victim 17 as described in subsection 9, or by a victim service program on 18 behalf of a victim, for emergency relocation expenses, not to 19 exceed one thousand dollars per person per lifetime. 20 NEW SUBSECTION . 17. Reasonable expenses incurred by a 21 victim, or by a victim service program on behalf of a victim, 22 for up to three months of housing assistance, not to exceed two 23 thousand dollars per person per lifetime. 24 Sec. 24. Section 915.94, Code 2015, is amended to read as 25 follows: 26 915.94 Victim compensation fund. 27 A victim compensation fund is established as a separate 28 fund in the state treasury. Moneys deposited in the fund 29 shall be administered by the department and dedicated to and 30 used for the purposes of section 915.41 and this subchapter . 31 In addition, the department may use moneys from the fund 32 for the purpose of the department’s prosecutor-based victim 33 service coordination, including the duties defined in sections 34 910.3 and 910.6 and this chapter , and for the award of funds 35 -19- SF 497 (3) 86 jm/rn/jh 19/ 38
S.F. 497 to programs that provide services and support to victims of 1 domestic abuse or sexual assault as provided in chapter 236 , 2 to victims under section 710A.2 , and for the support of an 3 automated victim notification system established in section 4 915.10A . The For each fiscal year, the department may also 5 use up to one three hundred thousand dollars from the fund 6 to provide training for victim service providers , to provide 7 training for related professionals concerning victim service 8 programming, and to provide training concerning homicide, 9 domestic assault, sexual assault, stalking, harassment, 10 and human trafficking as required by section 710A.6 . 11 Notwithstanding section 8.33 , any balance in the fund on June 12 30 of any fiscal year shall not revert to the general fund of 13 the state. 14 Sec. 25. Section 915.95, Code 2015, is amended to read as 15 follows: 16 915.95 Human trafficking victim fund. 17 A fund is created as a separate fund in the state treasury. 18 Moneys deposited in the fund shall be administered by the 19 department and dedicated to and used for awarding moneys to 20 programs that provide services and support to victims of human 21 trafficking under section 710A.2 , including the purposes of 22 public outreach and awareness programs and service provider 23 training programs , training local law enforcement and county 24 attorneys about recognizing human trafficking and aiding the 25 victims of human trafficking, and providing grants to local law 26 enforcement agencies for overtime costs incurred investigating 27 human trafficking offenses and making arrests . Notwithstanding 28 section 8.33 , any balance in the fund on June 30 of any fiscal 29 year shall not revert to the general fund of the state. 30 Sec. 26. 2012 Iowa Acts, chapter 1138, section 7, subsection 31 1, is amended to read as follows: 32 1. A mortgage servicing settlement fund is established, 33 separate and apart from all other public moneys or funds of 34 the state, under the control of the department of justice. 35 -20- SF 497 (3) 86 jm/rn/jh 20/ 38
S.F. 497 The department of justice shall deposit moneys received 1 by the department from the joint state-federal mortgage 2 servicing settlement into the fund. The department of 3 justice is authorized to make expenditures of moneys in the 4 fund consistent with the terms of the consent decree signed 5 in federal court on April 5, 2012. Any unencumbered or 6 unobligated moneys remaining in the fund on June 30, 2015, 7 shall be transferred to the general fund of the state human 8 trafficking victim fund created in section 915.95 . 9 Sec. 27. DEPARTMENT OF CORRECTIONS —— ADMINISTRATION. 11 There is appropriated from the general fund of the state to the 12 department of corrections for the fiscal year beginning July 13 1, 2016, and ending June 30, 2017, the following amounts, or 14 so much thereof as is necessary, to be used for the purposes 15 designated: 16 1. For general administration, including salaries, support, 17 maintenance, employment of an education director to administer 18 a centralized education program for the correctional system, 19 and miscellaneous purposes: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,635,005 21 a. Each lease negotiated by the department of corrections 22 with a private corporation for the purpose of providing private 23 industry employment of inmates in a correctional institution 24 shall prohibit the private corporation from utilizing inmate 25 labor for partisan political purposes for any person seeking 26 election to public office in this state and that a violation 27 of this requirement shall result in a termination of the lease 28 agreement. 29 b. As a condition of receiving the appropriation provided 30 in this subsection the department of corrections shall not 31 enter into a lease or contractual agreement pursuant to section 32 904.809 with a private corporation for the use of building 33 space for the purpose of providing inmate employment without 34 providing that the terms of the lease or contract establish 35 -25- SF 497 (3) 86 jm/rn/jh 25/ 38
S.F. 497 safeguards to restrict, to the greatest extent feasible, access 1 by inmates working for the private corporation to personal 2 identifying information of citizens. 3 c. As a condition of receiving the appropriation provided 4 in this subsection the department of corrections shall not, 5 except as otherwise provided in paragraph “b”, enter into a 6 new contract, unless the contract is a renewal of an existing 7 contract, for the expenditure of moneys in excess of $100,000 8 during the fiscal year beginning July 1, 2016, for the 9 privatization of services performed by the department using 10 state employees as of July 1, 2016, or for the privatization 11 of new services by the department without prior consultation 12 with any applicable state employee organization affected 13 by the proposed new contract and prior notification of the 14 co-chairpersons and ranking members of the joint appropriations 15 subcommittee on the justice system. 16 d. The department of corrections shall add additional 17 correctional officer positions to the current number of 18 correctional officer positions as of July 1, 2016. 19 2. To maximize the funding for educational programs, 23 the department shall establish guidelines and procedures to 24 prioritize the availability of educational and vocational 25 training for inmates based upon the goal of facilitating an 26 inmate’s successful release from the correctional institution. 27 b. The director of the department of corrections may 28 transfer moneys from Iowa prison industries and the canteen 29 operating funds established pursuant to section 904.310, for 30 use in educational programs for inmates. 31 c. Notwithstanding section 8.33, moneys appropriated in 32 this subsection that remain unobligated or unexpended at the 33 close of the fiscal year shall not revert but shall remain 34 available to be used only for the purposes designated in this 35 -26- SF 497 (3) 86 jm/rn/jh 26/ 38

For the fiscal year addressed by this section the 8 department of corrections shall continue to operate the 9 correctional farms under the control of the department at 10 the same or greater level of participation and involvement 11 as existed as of January 1, 2011; shall not enter into any 12 rental agreement or contract concerning any farmland under 13 the control of the department that is not subject to a rental 14 agreement or contract as of January 1, 2011, without prior 15 legislative approval; and shall further attempt to provide 16 job opportunities at the farms for inmates. The department 17 shall attempt to provide job opportunities at the farms for 18 inmates by encouraging labor-intensive farming or gardening 19 where appropriate; using inmates to grow produce and meat for 20 institutional consumption; researching the possibility of 21 instituting food canning and cook-and-chill operations; and 22 exploring opportunities for organic farming and gardening, 23 livestock ventures, horticulture, and specialized crops. 24 Sec. 32. Each judicial district department of correctional 4 services, within the funding available, shall continue programs 5 and plans established within that district to provide for 6 intensive supervision, sex offender treatment, diversion of 7 low-risk offenders to the least restrictive sanction available, 8 job development, and expanded use of intermediate criminal 9 sanctions. 10 3. Each judicial district department of correctional 11 services shall provide alternatives to prison consistent with 12 chapter 901B. The alternatives to prison shall ensure public 13 safety while providing maximum rehabilitation to the offender. 14 A judicial district department of correctional services may 15 also establish a day program. 16 4. The governor’s office of drug control policy shall 17 consider federal grants made to the department of corrections 18 for the benefit of each of the eight judicial district 19 departments of correctional services as local government 20 grants, as defined pursuant to federal regulations. 21 5. The department of corrections shall continue to contract 22 with a judicial district department of correctional services to 23 provide for the rental of electronic monitoring equipment which 24 shall be available statewide. 25 Sec. 33. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 26 APPROPRIATIONS. Notwithstanding section 8.39, within the 27 moneys appropriated in this division of this Act to the 28 department of corrections, the department may reallocate the 29 moneys appropriated and allocated as necessary to best fulfill 30 the needs of the correctional institutions, administration 31 of the department, and the judicial district departments of 32 correctional services. However, in addition to complying with 33 the requirements of sections 904.116 and 905.8 and providing 34 notice to the legislative services agency, the department 35 -29- SF 497 (3) 86 jm/rn/jh 29/ 38
S.F. 497 of corrections shall also provide notice to the department 1 of management, prior to the effective date of the revision 2 or reallocation of an appropriation made pursuant to this 3 section. The department of corrections shall not reallocate an 4 appropriation or allocation for the purpose of eliminating any 5 program. 6 Sec. 34. INTENT —— REPORTS. 7 1. The department of corrections in cooperation with 8 townships, the Iowa cemetery associations, and other nonprofit 9 or governmental entities may use inmate labor during the 10 fiscal year beginning July 1, 2016, to restore or preserve 11 rural cemeteries and historical landmarks. The department in 12 cooperation with the counties may also use inmate labor to 13 clean up roads, major water sources, and other water sources 14 around the state. 15 2. On a quarterly basis the department shall provide a 16 status report regarding private-sector employment to the 17 legislative services agency beginning on July 1, 2016. The 18 report shall include the number of offenders employed in the 19 private sector, the combined number of hours worked by the 20 offenders, the total amount of allowances, and the distribution 21 of allowances pursuant to section 904.702, including any moneys 22 deposited in the general fund of the state. 23 Sec. 35. ELECTRONIC MONITORING REPORT. The department of 24 corrections shall submit a report on electronic monitoring to 25 the general assembly, to the co-chairpersons and the ranking 26 members of the joint appropriations subcommittee on the justice 27 system, and to the legislative services agency by January 28 15, 2017. The report shall specifically address the number 29 of persons being electronically monitored and break down the 30 number of persons being electronically monitored by offense 31 committed. The report shall also include a comparison of any 32 data from the prior fiscal year with the current year. 33 Sec. 36. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 34 1. As used in this section, unless the context otherwise 35 -30- SF 497 (3) 86 jm/rn/jh 30/ 38
S.F. 497 requires, “state agency” means the government of the state 1 of Iowa, including but not limited to all executive branch 2 departments, agencies, boards, bureaus, and commissions, the 3 judicial branch, the general assembly and all legislative 4 agencies, institutions within the purview of the state board of 5 regents, and any corporation whose primary function is to act 6 as an instrumentality of the state. 7 2. State agencies are encouraged to purchase products from 8 Iowa state industries, as defined in section 904.802, when 9 purchases are required and the products are available from 10 Iowa state industries. State agencies shall obtain bids from 11 Iowa state industries for purchases of office furniture during 12 the fiscal year beginning July 1, 2016, exceeding $5,000 or 13 in accordance with applicable administrative rules related to 14 purchases for the agency. 15 Sec. 37. IOWA LAW ENFORCEMENT ACADEMY. 16 1. The Iowa law enforcement academy may select at least 3 five automobiles of the department of public safety, division 4 of state patrol, prior to turning over the automobiles to 5 the department of administrative services to be disposed 6 of by public auction, and the Iowa law enforcement academy 7 may exchange any automobile owned by the academy for each 8 automobile selected if the selected automobile is used in 9 training law enforcement officers at the academy. However, any 10 automobile exchanged by the academy shall be substituted for 11 the selected vehicle of the department of public safety and 12 sold by public auction with the receipts being deposited in the 13 depreciation fund to the credit of the department of public 14 safety, division of state patrol. 15 Sec. 38.
