Section
1.
Section
135G.6,
subsection
2,
paragraphs
b
and
c,
1
Code
2015,
are
amended
to
read
as
follows:
2
b.
The
department
of
human
services
shall
not
give
approval
3
to
an
application
which
would
cause
the
number
of
publicly
4
funded
subacute
care
facility
beds
licensed
under
this
chapter
5
to
exceed
fifty
seventy-five
beds.
6
c.
The
subacute
care
facility
beds
identified
by
the
7
a
request
for
proposals
process
initiated
on
or
after
the
8
effective
date
of
this
Act
shall
be
existing
beds
which
have
9
been
awarded
a
new
beds
located
in
hospitals
and
facilities
10
existing
under
a
current
certificate
of
need
pursuant
to
11
chapter
135
.
Such
beds
shall
not
be
required
to
obtain
an
12
additional
certificate
of
need
upon
conversion
to
licensed
13
subacute
care
facility
beds
.

Sec.
2.
Section
229.13,
subsection
1,
Code
2015,
is
amended
15
by
adding
the
following
new
paragraph:

.
c.
If
the
court
orders
evaluation
and
17
treatment
of
the
respondent
on
an
inpatient
basis
under
this
18
section,
the
court
may
order
the
respondent
placed
under
the
19
care
of
an
appropriate
subacute
care
facility
licensed
under
20
chapter
135G.

Sec.
3.
Section
229.14,
subsection
2,
Code
2015,
is
amended
22
by
adding
the
following
new
paragraph:

.
e.
If
the
court
orders
placement
and
24
treatment
of
the
respondent
on
an
inpatient
basis
under
this
25
section,
the
court
may
order
the
respondent
placed
under
the
26
care
of
an
appropriate
subacute
care
facility
licensed
under
27
chapter
135G.

4.
DEPARTMENT
OF
INSPECTIONS
AND
APPEALS
——

RULES.
The
administrative
rules
adopted
by
the
department
of
30
inspections
and
appeals
relating
to
eligibility
requirements
31
for
individualized
subacute
mental
health
services
in
subacute
32
care
facilities
licensed
under
chapter
135G
shall
allow
for
the
33
treatment
of
persons
involuntarily
hospitalized
under
chapter
34
229.
