S.F. 2324 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF ADMINISTRATIVE SERVICES 9 a. For major maintenance projects included on the 10 department of administrative services unfunded major 11 maintenance project requests list issued for the third quarter 12 of the fiscal year beginning July 1, 2015, and ending June 30, 13 2016: 14 FY 2016-2017: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,250,000 16 However, of the moneys appropriated in this subsection, 17 $100,000 is allocated for the costs of major maintenance of 18 monuments without dedicated funds available for maintenance and 19 restoration, subject to a requirement that moneys shall not be 20 allocated unless a match of at least $2 for each $1 allocated 21 is received from private sources. 22 In addition, of the moneys appropriated in this subsection, 23 $250,000 is allocated for the costs of installing outdoor 24 lighting at the Iowa state capitol. 25 b. S.F. 2324 salaries, support, maintenance, and miscellaneous purposes, 1 notwithstanding section 8.57, subsection 5, paragraph “c”: 2 FY 2016-2017: 3 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,100,000 4 (2) (a) The moneys appropriated in this lettered 5 paragraph shall be used to support demonstration projects in 6 subwatersheds as designated by the department that are part 7 of high-priority watersheds identified by the water resources 8 coordinating council established pursuant to section 466B.3. 9 (b) The moneys appropriated in this lettered paragraph 10 shall be used to support demonstration projects in watersheds 11 generally, including regional watersheds, as designated by the 12 division and high-priority watersheds identified by the water 13 resources coordinating council established pursuant to section 14 466B.3. 15 (c) Of the moneys appropriated in this lettered paragraph, 16 $450,000 is allocated to the Iowa nutrient research center at 17 Iowa state university of science and technology for nutrient 18 water monitoring network technology and equipment. Of the 19 moneys allocated in this subparagraph division, not more than 20 $150,000 may be used for the operations and maintenance of the 21 nutrient water monitoring network. 22 (3) In supporting projects in watersheds and subwatersheds 23 as provided in subparagraph (2), subparagraph divisions (a) and 24 (b), all of the following shall apply: 25 (a) The demonstration projects shall utilize water quality 26 practices as described in the latest revision of the document 27 entitled “Iowa Nutrient Reduction Strategy” initially presented 28 in November 2012 by the department of agriculture and land 29 stewardship, the department of natural resources, and Iowa 30 state university of science and technology. 31 (b) The division shall implement demonstration projects 32 as provided in subparagraph division (a) by providing 33 for participation by persons who hold a legal interest in 34 agricultural land used in farming. To every extent practical, 35 -2- SF 2324 (3) 86 ec/tm/jh 2/ 21
S.F. 2324 the division shall provide for collaborative participation by 1 such persons who hold a legal interest in agricultural land 2 located within the same subwatershed. 3 (c) The division shall implement demonstration projects on 4 a cost-share basis as determined by the division. However, the 5 state’s share of the amount shall not exceed 50 percent of the 6 estimated cost of establishing the practice as determined by 7 the division or 50 percent of the actual cost of establishing 8 the practice, whichever is less. 9 (d) The demonstration projects shall be used to educate 10 other persons about the feasibility and value of establishing 11 similar water quality practices. The division shall promote 12 field day events for purposes of allowing interested persons to 13 establish water quality practices on their agricultural land. 14 (e) The division shall conduct water quality evaluations 15 within supported subwatersheds. Within a reasonable period 16 after accumulating information from such evaluations, the 17 division shall create an aggregated database of water quality 18 practices. Any information identifying a person holding a 19 legal interest in agricultural land or specific agricultural 20 land shall be a confidential record. 21 (4) The moneys appropriated in this lettered paragraph 22 shall be used to support education and outreach in a manner 23 that encourages persons who hold a legal interest in 24 agricultural land used for farming to implement water quality 25 practices, including the establishment of such practices in 26 watersheds generally, and not limited to subwatersheds or 27 high-priority watersheds. 28 (5) The moneys appropriated in this lettered paragraph 29 may be used to contract with persons to coordinate the 30 implementation of efforts provided in this paragraph. 31 (6) The moneys appropriated in this lettered paragraph 32 may be used by the department to support urban soil and water 33 conservation efforts, which may include but are not limited 34 to management practices related to bioretention, landscaping, 35 -3- SF 2324 (3) 86 ec/tm/jh 3/ 21
S.F. 2324 the use of permeable or pervious pavement, and soil quality 1 restoration. The moneys shall be allocated on a cost-share 2 basis as provided in chapter 161A. 3 (7) Notwithstanding any other provision of law to the 4 contrary, the department may use moneys appropriated in 5 this lettered paragraph to carry out the provisions of this 6 paragraph on a cost-share basis in combination with other 7 moneys available to the department from a state or federal 8 source. 9 (8) Not more than 10 percent of the moneys appropriated in 10 this lettered paragraph may be used for costs of administration 11 and implementation of the water quality initiative administered 12 by the soil conservation division. 13 b. S.F. 2324 Sec. 13. RETROACTIVE APPLICABILITY. The following 1 provision of this division of this Act applies retroactively to 2 July 1, 2015: 3 1. The section of this division of this Act amending 2015 4 Iowa Acts, chapter 139, section 1, subsection 6, paragraph d. 5 Sec. 14. EFFECTIVE UPON ENACTMENT. This division of this 6 Act, being deemed of immediate importance, takes effect upon 7 enactment. 8 DIVISION V 9 SHALLOW LAKES 10 Sec. 15. Section 456A.33B, Code 2016, is amended by adding 11 the following new subsection: 12 NEW SUBSECTION . 01. For purposes of this section, unless 13 the context otherwise requires: 14 a. “Lake” includes a significant public lake and a public 15 shallow lake or wetland. 16 b. Public shallow lake or wetland” means a water body that 17 meets the following criteria: 18 (1) Is owned by the federal government, the state of 19 Iowa, a county, or a municipal government, and is maintained 20 principally for public use. 21 (2) Is a multi-use system capable of supporting diverse 22 wildlife, fish, or recreational opportunities. 23 (3) Has a surface water area of at least ten acres. 24 (4) Does not have a watershed-to-lake surface area ratio of 25 greater than two hundred to one. 26 (5) Is an open freshwater system where maximum depth is 27 typically less than six to eight feet at its deepest spot and 28 is under four and one-half feet mean depth. 29 (6) Is typically fringed by a border of emergent vegetation 30 in water depth less than six feet and when clear is dominated 31 by both emergent and submergent vegetation and provides 32 important wildlife and fish habitat. 33 c. “Significant public lake” means a lake that meets all of 34 the following criteria: 35 -17- SF 2324 (3) 86 ec/tm/jh 17/ 21
S.F. 2324 (1) Is owned by the federal government, the state of 1 Iowa, a county, or a municipal government, and is maintained 2 principally for public use. 3 (2) Is a multi-use system capable of supporting diverse 4 wildlife, fish, or recreational opportunities. 5 (3) Has a surface water area of at least ten acres. 6 (4) Does not have a watershed-to-lake surface area ratio of 7 greater than two hundred to one. 8 (5) Is not an on-stream impoundment that emulates riverine 9 habitat rather than a lake environment. 10 (6) Is not used solely as a water supply reservoir. 11 Sec. 16. Section 456A.33B, subsection 1, paragraph b, Code 12 2016, is amended by adding the following new subparagraph: 13 NEW SUBPARAGRAPH . (6) When restored, will contribute to the 14 department’s fish and wildlife conservation plans. 15 Sec. 17. Section 456A.33B, subsection 2, paragraphs a and b, 16 Code 2016, are amended to read as follows: 17 a. The department , with input from stakeholders, shall 18 develop maintain an initial annual list of not more than 19 thirty-five significant public lakes and not more than five 20 public shallow lakes or wetlands to be considered for funding 21 based on the feasibility of restoring each lake and the use or 22 potential use of the lake, if restored. The list shall include 23 lake projects under active development that the department 24 shall recommend be given priority for funding so long as 25 progress toward completion of the projects remains consistent 26 with the goals of this section . 27 b. The department shall meet with stakeholders and 28 representatives of communities where lakes on the initial 29 annual list are located to provide an initial annual lake 30 restoration assessment and to explain the process and criteria 31 for receiving lake restoration funding. Communities with 32 lakes not included on the initial annual list may petition the 33 director of the department for a preliminary lake restoration 34 assessment and explanation of the funding process and criteria. 35 -18- SF 2324 (3) 86 ec/tm/jh 18/ 21
S.F. 2324 The department shall work with stakeholders and representatives 1 of each community to develop a joint lake restoration action 2 plan. At a minimum, each joint action plan shall document the 3 causes, sources, and magnitude of lake impairment, evaluate 4 the feasibility of the lake and watershed restoration options, 5 establish water quality and fishery and wildlife goals and a 6 schedule for attainment, describe long-term management actions, 7 assess the economic benefits of the project, identify the 8 sources and amounts of any leveraged funds, and describe the 9 community’s commitment to the project, including local funding. 10 The stakeholders’ and community’s commitment to the project may 11 include moneys to fund a lake diagnostic study and watershed 12 assessment, including development of a TMDL (total maximum 13 daily load). 14 Sec. 18. Section 456A.33B, subsection 2, paragraph c, 15 subparagraph (2), Code 2016, is amended to read as follows: 16 (2) If proposed, dredging of the lake will be conducted to 17 a mean depth of at least ten eight feet to gain water quality 18 benefits unless a combination of biologic and structural 19 controls is sufficient to assure water quality targets will be 20 achieved at a shallower average water depth. 21 Sec. 19. Section 456A.33B, subsection 2, paragraph d, Code 22 2016, is amended to read as follows: 23 d. The department shall evaluate the joint action plans 24 and prioritize the plans based on the criteria required in 25 this section . The department’s annual lake restoration plan 26 and report shall include the prioritized list and the amounts 27 of state and other funding the department recommends for each 28 lake restoration project. The department may shall seek public 29 comment on its recommendations prior to submitting the plan and 30 report to the general assembly. 31 Sec. 20. Section 456A.33B, subsection 2, Code 2016, is 32 amended by adding the following new paragraph: 33 NEW PARAGRAPH . e. The department shall ensure that at least 34 eight percent, but no more than twelve percent, of the annual 35 -19- SF 2324 (3) 86 ec/tm/jh 19/ 21
S.F. 2324 appropriation for lake restoration projects in accordance with 1 the department’s annual lake restoration plan and report shall 2 be invested in public shallow lakes or wetlands restoration 3 projects. 4 DIVISION VI 5 MISCELLANEOUS PROVISIONS 6 Sec. 21. Section 8.57C, subsection 3, paragraph a, 7 subparagraph (2), Code 2016, is amended to read as follows: 8 (2) The fiscal year beginning July 1, 2016 2017 , and for 9 each subsequent fiscal year thereafter. 10 Sec. 22. Section 12.79, subsection 3, Code 2016, is amended 11 to read as follows: 12 3. Moneys in the fund in a fiscal year shall be used as 13 appropriated by the general assembly for prison improvement and 14 prison construction projects. However, for the fiscal year 15 beginning July 1, 2016, any unobligated and unencumbered moneys 16 in the fund from the previous fiscal year are appropriated to 17 the department of corrections for major maintenance projects. 18 Sec. 23. IOWA COMMUNICATIONS NETWORK —— AUTHORIZATION 19 FOR CONTRACTS. Pursuant to section 8D.11, subsection 1, 20 paragraph “a”, the general assembly authorizes the Iowa 21 telecommunications and technology commission to enter into a 22 contract or contracts in excess of the contract limitation 23 amount established in section 8D.11, subsection 1, paragraph 24 “c”, for purposes of the commission’s network core upgrade 25 project. This authorization applies for the duration of the 26 commission’s project and to all existing or future contracts 27 associated with the project, whether or not the award is made 28 to a single vendor or multiple vendors. 29 Sec. 24. REBUILD IOWA INFRASTRUCTURE FUND —— LIMITATION ON 30 EXPENDITURES. 31 1. For purposes of this section, “restricted employee” 32 means an elective constitutional or statutory officer, a state 33 employee whose salary is set by the governor within a range set 34 by the general assembly, or a president of a state board of 35 -20- SF 2324 (3) 86 ec/tm/jh 20/ 21
S.F. 2324 regents institution. 1 2. Beginning July 1, 2016, moneys appropriated from the 2 rebuild Iowa infrastructure fund and used for public vertical 3 infrastructure projects as defined in section 8.57, subsection 4 5, paragraph “c”, shall not be used for salary or other 5 compensation costs of a restricted employee. 6 Sec. 25. REBUILD IOWA INFRASTRUCTURE FUND —— FY 2017-2018 7 BUDGET REQUEST INFORMATION. Finalized agency budget requests 8 submitted to the governor for the fiscal year beginning 9 July 1, 2017, that include a request for an appropriation 10 from the rebuild Iowa infrastructure fund to be used for a 11 public vertical infrastructure project as defined in section 12 8.57, subsection 5, paragraph “c”, shall include salary cost 13 information as required by this section. The salary cost 14 information shall include the number of full-time equivalent 15 positions to be utilized for the requested project and that 16 portion, in dollars, of salaries and any compensation costs 17 attributable to these full-time equivalent positions that will 18 be paid from the requested appropriation from the rebuild Iowa 19 infrastructure fund. 20 Sec. 26. EXECUTIVE COUNCIL —— PROPERTY ACQUISITION 21 AUTHORIZATION. For the fiscal year beginning July 1, 2016, the 22 executive council may, in its sole discretion, expend moneys 23 as a performance of duty expense pursuant to section 7D.29 to 24 provide funding for the acquisition of property located at 525 25 East 9th street in the vicinity of the capitol complex. 26 Sec. 27. EFFECTIVE UPON ENACTMENT. The following provision 27 of this division of this Act, being deemed of immediate 28 importance, takes effect upon enactment: 29 1.
