From the moneys deposited in the school ready children 18 grants account for the fiscal year beginning July 1, 2016, 19 and ending June 30, 2017, not more than $132,975 $265,950 20 is allocated for the early childhood Iowa office and other 21 technical assistance activities. Moneys allocated under this 22 lettered paragraph may be used by the early childhood Iowa 23 state board for the purpose of skills development and support 24 for ongoing training of staff. However, except as otherwise 25 provided in this subsection, moneys shall not be used for 26 additional staff or for the reimbursement of staff. 27 b. Of the amount appropriated in this subsection for 28 deposit in the school ready children grants account of the 29 early childhood Iowa fund, $1,159,009 $2,318,018 shall 30 be used for efforts to improve the quality of early care, 31 health, and education programs. Moneys allocated pursuant to 32 this paragraph may be used for additional staff and for the 33 reimbursement of staff. The early childhood Iowa state board 34 may reserve a portion of the allocation, not to exceed $44,325 35 -7- SF 2323 (3) 86 kh/tm/jh 7/ 34
S.F. 2323 $88,650 , for the technical assistance expenses of the early 1 childhood Iowa state office, including the reimbursement of 2 staff, and shall distribute the remainder to early childhood 3 Iowa areas for local quality improvement efforts through a 4 methodology identified by the early childhood Iowa state board 5 to make the most productive use of the funding, which may 6 include use of the distribution formula, grants, or other 7 means. 8 c. Of the amount appropriated in this subsection for 9 deposit in the school ready children grants account of the 10 early childhood Iowa fund, $412,515 $825,030 shall be used for 11 support of professional development and training activities 12 for persons working in early care, health, and education by 13 the early childhood Iowa state board in collaboration with 14 the professional development component groups maintained by 15 the early childhood Iowa stakeholders alliance pursuant to 16 section 256I.12, subsection 7 , paragraph “b”, and the early 17 childhood Iowa area boards. Expenditures shall be limited to 18 professional development and training activities agreed upon by 19 the parties participating in the collaboration. 20 10. The moneys appropriated in this subsection shall be 15 used for implementation and expansion of early head start 16 pilot projects addressing the comprehensive cognitive, social, 17 emotional, and developmental needs of children from birth to 18 age three, including prenatal support for qualified families. 19 The projects shall promote healthy prenatal outcomes and 20 healthy family functioning, and strengthen the development of 21 infants and toddlers in low-income families. Priority shall be 22 given to those organizations that have previously qualified for 23 and received state funding to administer an early head start 24 project. 25 14. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS 26 a. The average number of years spent in English language 26 learner programming for limited English proficient students 27 served by the school district. 28 d. The number of full-time equivalent employees directly 29 serving limited English proficient students and the 30 student-to-teacher ratios for such students. 31 e. A review of the number and the percentage of the total of 32 limited English proficient students achieving English language 33 proficiency over the previous five years. 34 f. Section 256.7, subsection 21, paragraph b, 20 subparagraph (2), Code 2016, is amended to read as follows: 21 (2) Notwithstanding subparagraph (1), for the school year 22 beginning July 1, 2016 2017 , and each succeeding school year, 23 the rules shall provide that all students enrolled in school 24 districts in grades three through eleven shall be administered 25 an assessment during the last quarter of the school year that 26 at a minimum assesses the core academic indicators identified 27 in this paragraph “b” ; is aligned with the Iowa common core 28 standards in both content and rigor; accurately describes 29 student achievement and growth for purposes of the school, the 30 school district, and state accountability systems; and provides 31 valid, reliable, and fair measures of student progress toward 32 college or career readiness. 33 Sec. 7. NEW SECTION . 256.34 Fine arts beginning teacher 34 mentoring program. 35 -23- SF 2323 (3) 86 kh/tm/jh 23/ 34

The department shall establish a fine arts beginning 1 teacher mentoring program under a contract with an Iowa-based 2 nonprofit organization that is exempt from federal income 3 taxation pursuant to section 501(c)(3) of the Internal Revenue 4 Code; has membership from the six state fine arts organizations 5 representing kindergarten through grade twelve general music, 6 choral music, instrumental music, visual arts, and drama and 7 theater arts educators; and has administered a federally funded 8 statewide fine arts mentoring program since 2006. 9 2. Program criteria shall include a required match of one 10 dollar provided by the organization contracting to deliver 11 services under subsection 1 for each dollar provided to the 12 organization by the department. Moneys in the fund established 13 under subsection 6 shall not be disbursed until the department 14 receives evidence that the organization meets or will meet the 15 match requirement. 16 3. The program provided under contract by the nonprofit 17 organization shall provide for all of the following: 18 a. Activities and consultation in support of beginning fine 19 arts teachers employed in Iowa’s school districts, including 20 but not limited to guidance in the classroom and at meetings, 21 and resources of materials, time, and financial scholarship 22 for state conferences that will support a beginning fine arts 23 teacher’s effectiveness in the classroom. 24 b. Coordination of retired and currently employed 25 experienced fine arts mentor educators with beginning fine arts 26 educators. 27 c. Materials and advice specifically designed to prepare 28 beginning fine arts teachers for success in the fine arts 29 classroom and to prepare kindergarten through grade twelve 30 students for school district fine arts performances and 31 festivals. 32 4. The nonprofit organization under contract with the 33 department under this section shall provide quarterly reports 34 detailing the organization’s compliance with the requirements 35 -24- SF 2323 (3) 86 kh/tm/jh 24/ 34
S.F. 2323 of subsection 3 and the expenditures of moneys for purposes of 1 the fine arts beginning teacher mentoring program. 2 5. The director of the department may for good cause 3 suspend, revoke, or refuse to renew a contract entered into in 4 accordance with the provisions of this section. 5 6. There is established in the state treasury a fine arts 6 beginning teacher mentoring fund that is under the control 7 of and administered by the department of education. The 8 department may accept gifts, grants, bequests, and other 9 private contributions, as well as state or federal funds, and 10 shall deposit the moneys in the fund to be used for purposes of 11 the fine arts beginning teacher mentoring program. Moneys in 12 the fund are appropriated to the department and shall be used 13 for the purposes of this section. Moneys in the fund may be 14 used to reimburse mentors for business travel expenses incurred 15 in the performance of a mentor’s duties at a rate not to exceed 16 the current rate of reimbursement allowed under the standard 17 method for computation of business travel expenses pursuant to 18 the Internal Revenue Code. The department shall not commingle 19 federal, state, and private funds within the fund. Moneys 20 appropriated for the program shall supplement, not supplant, 21 moneys appropriated for purposes of the beginning teacher 22 mentoring and induction program created under section 284.5. 23 Notwithstanding section 8.33, moneys in the fund that remain 24 unencumbered or unobligated at the close of the fiscal year 25 shall not revert but shall remain available for expenditure 26 for the purposes designated until the close of the succeeding 27 fiscal year. Notwithstanding section 12C.7, subsection 2, 28 interest earned on moneys in the fine arts beginning teacher 29 mentoring fund shall be credited to the fund. 30 Sec. 8. Section 256C.4, subsection 1, paragraph e, Code 31 2016, is amended to read as follows: 32 e. Preschool foundation aid funding shall not be used for 33 the costs of constructing a facility in connection with an 34 approved local program. Preschool foundation aid funding may 35 -25- SF 2323 (3) 86 kh/tm/jh 25/ 34
S.F. 2323 be used by approved local programs and community providers 1 for professional development for preschool teachers, for 2 instructional equipment, for material and equipment designed 3 to develop pupils’ large and small motor skills, and for other 4 direct costs. Preschool foundation aid funding may be used 5 by approved local programs for the costs of transportation 6 involving children participating in the preschool program. 7 The costs of transporting other children associated with the 8 preschool program or transported as provided in section 256C.3, 9 subsection 3, paragraph “h” , may be prorated by the school 10 district. Preschool foundation aid funding received by an 11 approved local program that remain unexpended or unobligated 12 at the end of a fiscal year shall be used to build the approved 13 local program’s preschool program capacity in the next 14 succeeding fiscal year. 15 Sec. 9. Section 261.6, Code 2016, is amended by adding the 16 following new subsection: 17 NEW SUBSECTION . 4. An all Iowa opportunity foster care 18 grant fund is created in the state treasury as a separate fund 19 under the control of the commission. The fund shall consist 20 of any moneys appropriated to the commission for purposes of 21 the program and any other moneys available to and obtained or 22 accepted by the commission for placement in the fund. All 23 moneys in the fund are appropriated to the commission to be 24 used for grants for students meeting the requirements of this 25 section. Notwithstanding section 8.33, any balance in the fund 26 on June 30 of each fiscal year shall not revert to the general 27 fund of the state, but shall be transferred to the all Iowa 28 opportunity scholarship fund established pursuant to section 29 261.87 to be used for purposes of the all Iowa opportunity 30 scholarship program. 31 Sec. 10. Section 261.86, subsection 6, Code 2016, is amended 32 to read as follows: 33 6. Notwithstanding section 8.33 , until one year after the 34 date the president of the United States or the Congress of 35 -26- SF 2323 (3) 86 kh/tm/jh 26/ 34
S.F. 2323 the United States declares a cessation of hostilities ending 1 operation Iraqi freedom, operation new dawn, and operation 2 enduring freedom, funds appropriated for purposes of this 3 section which remain unencumbered or unobligated at the close 4 of the fiscal year for which the funds were appropriated shall 5 not revert but shall be available for expenditure for the 6 following fiscal year for purposes of this section . 7 Sec. 11. Section 272.28, subsection 1, Code 2016, is amended 8 to read as follows: 9 1. Effective July 1, 2003, requirements Requirements for 10 teacher licensure beyond an initial license shall include 11 successful completion of a beginning teacher mentoring and 12 induction program approved by the state board of education or 13 evidence of not less than three years of successful teaching 14 experience at any of the following: 15 a. An accredited nonpublic school in this state . 16 b. A preschool program approved by the United States 17 department of health and human services. 18 c. Preschool programs at school districts approved to 19 participate in the preschool program under chapter 256C. 20 d. Shared visions programs receiving grants from the child 21 development coordinating council under section 256A.3. 22 e. Preschool programs receiving moneys from the school 23 ready children grants account of the early childhood Iowa fund 24 created in section 256I.11. 25 Sec. 12. Section 279.68, subsection 1, paragraph c, Code 26 2016, is amended to read as follows: 27 c. Beginning May 1, 2017 2018 , unless the school district 28 is granted a waiver pursuant to subsection 2 , paragraph “e” , 29 if the student’s reading deficiency is not remedied by the 30 end of grade three, as demonstrated by scoring on a locally 31 determined or statewide assessment as provided in section 32 256.7, subsection 31 , the school district shall notify the 33 student’s parent or guardian that the parent or guardian may 34 enroll the student in an intensive summer reading program 35 -27- SF 2323 (3) 86 kh/tm/jh 27/ 34
S.F. 2323 offered in accordance with subsection 2 , paragraph “e” . If 1 the parent or guardian does not enroll the student in the 2 intensive summer reading program and the student is ineligible 3 for the good cause exemption under subsection 5 , the student 4 shall be retained in grade three pursuant to subsection 3 . 5 If the student is exempt from participating in an intensive 6 summer reading program for good cause, pursuant to subsection 7 5 , or completes the intensive summer reading program but is 8 not reading proficient upon completion of the program, the 9 student may be promoted to grade four, but the school district 10 shall continue to provide the student with intensive reading 11 instruction until the student is proficient in reading as 12 demonstrated by scoring on locally determined or statewide 13 assessments. 14 Sec. 13. Section 279.68, subsection 2, paragraph e, Code 15 2016, is amended to read as follows: 16 e. Offer each summer, beginning in the summer of 2017 17 2018 , unless the school district receives a waiver from this 18 requirement from the department of education for the summer of 19 2017 2018 , an intensive summer literacy program for students 20 assessed as exhibiting a substantial deficiency in reading. 21 The program shall meet the criteria and follow the guidelines 22 established pursuant to section 256.9, subsection 53 , paragraph 23 “c” , subparagraph (1), subparagraph division (g). 24 Sec. 14. Section 284.13, subsection 1, paragraphs a, b, c, 25 and d, Code 2016, are amended to read as follows: 26 a. For the fiscal year beginning July 1, 2015 2016 , and 27 ending June 30, 2016 2017 , to the department of education, the 28 amount of eight hundred forty-six thousand two hundred fifty 29 dollars for the issuance of national board certification awards 30 in accordance with section 256.44 . Of the amount allocated 31 under this paragraph, not less than eighty-five thousand 32 dollars shall be used to administer the ambassador to education 33 position in accordance with section 256.45 . 34 b. For the fiscal year beginning July 1, 2015 2016 , and 35 -28- SF 2323 (3) 86 kh/tm/jh 28/ 34
S.F. 2323 ending June 30, 2016 2017 , an amount up to four million 1 twenty-one thousand eight hundred seventy-five dollars 2 for first-year and second-year beginning teachers, to the 3 department of education for distribution to school districts 4 and area education agencies for purposes of the beginning 5 teacher mentoring and induction programs. A school district or 6 area education agency shall receive one thousand three hundred 7 dollars per beginning teacher participating in the program. 8 If the funds appropriated for the program are insufficient to 9 pay mentors, school districts, and area education agencies 10 as provided in this paragraph, the department shall prorate 11 the amount distributed to school districts and area education 12 agencies based upon the amount appropriated. Moneys received 13 by a school district or area education agency pursuant to 14 this paragraph shall be expended to provide each mentor with 15 an award of five hundred dollars per semester, at a minimum, 16 for participation in the school district’s or area education 17 agency’s beginning teacher mentoring and induction program; 18 to implement the plan; and to pay any applicable costs of the 19 employer’s share of contributions to federal social security 20 and the Iowa public employees’ retirement system or a pension 21 and annuity retirement system established under chapter 294 , 22 for such amounts paid by the district or area education agency. 23 c. For the fiscal year beginning July 1, 2015 2016 , and 24 ending June 30, 2016 2017 , up to seven hundred eighty-six 25 thousand eight hundred sixteen dollars to the department for 26 purposes of implementing the professional development program 27 requirements of section 284.6 , assistance in developing model 28 evidence for teacher quality committees established pursuant to 29 section 284.4, subsection 1 , paragraph “c” , and the evaluator 30 training program in section 284.10 . A portion of the funds 31 allocated to the department for purposes of this paragraph may 32 be used by the department for administrative purposes and for 33 not more than four full-time equivalent positions. 34 d. For the fiscal year beginning July 1, 2015 2016 , and 35 -29- SF 2323 (3) 86 kh/tm/jh 29/ 34
S.F. 2323 ending June 30, 2016 2017 , an amount up to one million one 1 hundred thirty-six thousand four hundred ten dollars to 2 the department for the establishment of teacher development 3 academies in accordance with section 284.6, subsection 10 . A 4 portion of the funds allocated to the department for purposes 5 of this paragraph may be used for administrative purposes. 6 Sec. 15. Section 284.13, subsection 1, paragraph e, 7 subparagraph (1), subparagraph division (b), Code 2016, is 8 amended to read as follows: 9 (b) For the fiscal year beginning July 1, 2016, and ending 10 June 30, 2017, fifty million six hundred thousand dollars. 11 Sec. 16. Section 284.13, subsection 1, paragraph f, Code 12 2016, is amended to read as follows: 13 f. For the fiscal year beginning July 1, 2016 2017 , 14 and for each subsequent fiscal year, to the department of 15 education, ten million dollars for purposes of implementing 16 the supplemental assistance for high-need schools provisions 17 of section 284.11 . Annually, of the moneys allocated to 18 the department for purposes of this paragraph, up to one 19 hundred thousand dollars may be used by the department for 20 administrative purposes and for not more than one full-time 21 equivalent position. 22 Sec. 17. 2016 Iowa Acts, House File 2370, is amended by 23 adding the following new section: 24 NEW SECTION . SEC. 3. EFFECTIVE DATE. This Act, being 25 deemed of immediate importance, takes effect upon enactment. 26 Sec. 18. EFFECTIVE UPON ENACTMENT.
