S.F. 2314 workers’ compensation fund in the state treasury to be used 1 for payment of state employees’ workers’ compensation claims 2 and administrative costs. Notwithstanding section 8.33 , 3 unencumbered or unobligated moneys remaining in this workers’ 4 compensation fund at the end of the fiscal year shall not 5 revert but shall be available for expenditure for purposes of 6 the fund for subsequent fiscal years. 7 Sec. 2. 2015 Iowa Acts, chapter 141, is amended by adding 8 the following new sections: 9 NEW SECTION . SEC. 41A. DEPARTMENT OF ADMINISTRATIVE 10 SERVICES —— CITY OF DES MOINES FRANCHISE FEE REFUND —— 11 APPROPRIATION. 12 1. There is created a franchise fee refund fund in the state 13 treasury under the control of the department of administrative 14 services. A franchise fee that is refunded to the state by the 15 city of Des Moines pursuant to a court order shall be deposited 16 in the fund. 17 2. Moneys in the fund are appropriated to the department 18 of administrative services for the fiscal year beginning July 19 1, 2015, and ending June 30, 2016, for purposes of reimbursing 20 gas and electric utility costs. Notwithstanding section 21 8.33, any excess moneys appropriated for reimbursing gas and 22 electric utility costs in this subsection shall not revert to 23 the general fund of the state at the end of the fiscal year but 24 shall remain available for expenditure for the purposes of this 25 subsection during the succeeding fiscal year. 26 3. This section is repealed July 1, 2017. 27 NEW SECTION . SEC. 41B. DEPARTMENT OF ADMINISTRATIVE 28 SERVICES —— CONTRACT FOR FAMILY MEDICAL LEAVE ACT THIRD-PARTY 29 ADMINISTRATION SERVICES —— REPORT. Beginning on February 30 1, 2017, and annually on each February 1 during the term of 31 the contract to provide third-party administration services 32 of the federal Family and Medical Leave Act of 1993 for the 33 department of administrative services, the department shall 34 submit a report to the joint appropriations subcommittee on 35 -2- SF 2314 (4) 86 av/tm/jh 2/ 26
S.F. 2314 administration and regulation and the legislative services 1 agency. The annual report shall include but is not limited 2 to an analysis of cost savings to the state, if any, that 3 have resulted from the use of such third-party administration 4 services, a comparison of the use of and denial of leave 5 requests prior to and during the contract period, and an 6 analysis of appeals of denials of leave and the result of such 7 appeals, prior to and during the contract period. Within sixty 8 days of the conclusion of the contract, the department shall 9 submit a final report to the general assembly summarizing 10 the content of the annual reports and including conclusions 11 and recommendations concerning the use of such third-party 12 administration services. 13 Sec. 3. 2015 Iowa Acts, chapter 141, section 42, is amended 14 to read as follows: 15 SEC. 42. AUDITOR OF STATE. 16 1. S.F. 2314 the fiscal year beginning July 1, 2016, and ending June 30, 1 2017, the first $375,000 $750,000 collected by the department 2 of transportation and transferred to the treasurer of state 3 with respect to the fees for transactions involving the 4 furnishing of a certified abstract of a vehicle operating 5 record under section 321A.3, subsection 1 , shall be transferred 6 to the IowAccess revolving fund created in section 8B.33 for 7 the purposes of developing, implementing, maintaining, and 8 expanding electronic access to government records as provided 9 by law. 10 b. For 1 the fiscal year beginning July 1, 2016, and ending June 2 30, 2017, the department of inspections and appeals shall 3 retain collect any license or registration fees or electronic 4 transaction fees generated during the fiscal year as a result 5 of actions licensing and registration activities under section 6 137F.3A occurring during the period beginning July 1, 2009, 7 and ending June 30, 2017, for the purpose of enforcing the 8 provisions of chapters 99B, 137C , 137D , and 137F . 9 1. From the fees collected by the department under this 10 section on behalf of a municipal corporation with which 11 the department has an agreement pursuant to section 137F.3, 12 through a statewide electronic licensing system operated by 13 the department, notwithstanding section 137F.6, subsection 3, 14 the department shall remit the amount of those fees to the 15 municipal corporation for whom the fees were collected less 16 any electronic transaction fees collected by the department to 17 enable electronic payment. 18 2. From the fees collected by the department under this 19 section, other than those fees described in subsection 1, 20 the department shall deposit the amount of $800,000 into the 21 general fund of the state prior to June 30, 2017. 22 3. From the fees collected by the department under this 23 section, other than those fees described in subsections 1 and 24 2, the department shall retain the remainder of the fees for 25 the purposes of enforcing the provisions of chapters 99B, 137C, 26 137D, and 137F. DEPARTMENT OF MANAGEMENT CUSTOMER COUNCIL AND 13 MAINTENANCE OF CEREMONIAL SPACE INTERIM STUDY. The legislative 14 council is requested to establish an interim study committee 15 consisting of ten members representing both political parties 16 and both houses of the general assembly. Five members shall 17 be members of the senate, three of whom shall be appointed by 18 the majority leader of the senate and two of whom shall be 19 appointed by the minority leader of the senate. The other 20 five members shall be members of the house of representatives, 21 three of whom shall be appointed by the speaker of the house 22 of representatives and two of whom shall be appointed by 23 the minority leader of the house of representatives. The 24 committee shall review and consider the rate methodologies 25 that are reviewed and approved by the customer council created 26 in the department of management pursuant to section 8.6, in 27 setting rates for the services provided by the department of 28 administrative services. The committee shall also review 29 and consider the allocation of resources and moneys for 30 maintenance of the areas designated as ceremonial space by the 31 department of administrative services. For purposes of this 32 review, “ceremonial space” means the state capitol building and 33 parking lots, Ola Babcock Miller building and parking lots, 34 historical building and parking areas, parking facility located 35 -17- SF 2314 (4) 86 av/tm/jh 17/ 26
S.F. 2314 at Pennsylvania avenue and Des Moines street, West Capitol 1 Terrace and Finkbine parking areas, monuments and adjacent 2 land, capitol complex tunnels, and Iowa building (Mercy 3 Capitol) and annex sites and parking lots. The committee shall 4 submit its findings, together with any recommendations, in a 5 report submitted to the general assembly and to the legislative 6 services agency by January 17, 2017. 7 3. RATE INCREASES PROHIBITED. The customer council shall 8 not approve an increase in rates for services provided by the 9 department of administrative services or impose additional fees 10 for services beyond those rates and fees that have already been 11 approved by the customer council for the fiscal year beginning 12 July 1, 2015, and ending June 30, 2016, and the fiscal year 13 beginning July 1, 2016, and ending June 30, 2017, until after 14 July 3, 2017, and following submission of the department of 15 management report required in subsection 5. 16 4. ROUTINE MAINTENANCE. All moneys collected pursuant to 17 increases in association rates and fees for the state capitol 18 complex and the state laboratories facility in Ankeny for the 19 fiscal year beginning July 1, 2015, and ending June 30, 2016, 20 and the fiscal year beginning July 1, 2016, and ending June 30, 21 2017, shall be used solely and directly for routine maintenance 22 of the state capitol complex and the state laboratories 23 facility in Ankeny and shall not be reallocated for other 24 purposes. 25 5. DEPARTMENT OF MANAGEMENT REPORT. In addition to 26 the annual reports required pursuant to subsection 1, the 27 department of management, in consultation with the department 28 of administrative services, shall submit a report to the 29 general assembly that explains the rate methodologies that 30 are utilized by the department of administrative services and 31 reviewed and approved by the customer council in approving 32 rates set for the services provided by the department of 33 administrative services. The report shall include a review 6 of what services or projects are included in the services 7 provided by the department of administrative services for 8 which rates are set and fees imposed, specifically as they 9 pertain to performance of routine maintenance. An amount equal to such fees and 1 assessments deposited into the department of commerce revolving 2 fund is appropriated from the department of commerce revolving 3 fund to the banking division of the department of commerce for 4 the fiscal year in which a federally chartered bank or savings 5 and loan association converted to a state-chartered bank and an 6 amount equal to such annualized fees and assessments deposited 7 into the department of commerce revolving fund in succeeding 8 years is appropriated from the department of commerce revolving 9 fund to the banking division of the department of commerce 10 for succeeding fiscal years for purposes related to the 11 discharge of the duties and responsibilities imposed upon 12 the banking division of the department of commerce, the 13 superintendent, and the state banking council by the laws of 14 this state. This appropriation shall be in addition to the 15 appropriation of moneys otherwise described in this section. 16 If a state-chartered bank converts to a federally chartered 17 bank or savings and loan association, any appropriation made 18 pursuant to this subsection for the following fiscal year 19 shall be reduced by the amount of the assessment paid by 20 the state-chartered bank during the fiscal year in which the 21 state-chartered bank converted to a federally chartered bank or 22 savings and loan association. 23 NEW SUBSECTION . 4A. All moneys received by the 24 superintendent pursuant to a multi-state settlement with a 25 provider of financial services such as a mortgage lender, a 26 mortgage servicer, or any other person regulated by the banking 27 division of the department of commerce shall be deposited 28 into the department of commerce revolving fund created in 29 section 546.12 and an amount equal to the amount deposited 30 into the fund is appropriated to the banking division of the 31 department of commerce for the fiscal year in which such moneys 32 are received and in succeeding fiscal years for the purpose 33 of supporting those duties of the banking division related 34 to financial regulation that are limited to nonrecurring 35 -24- SF 2314 (4) 86 av/tm/jh 24/ 26
