1.
NEW
SECTION
.
15.231
Community
catalyst
building
1
remediation
program
——
fund.
2
1.
a.
The
economic
development
authority
shall,
pursuant
3
to
section
15.106A,
subsection
1,
paragraph
“o”
,
establish
a
4
community
catalyst
building
remediation
fund
for
the
purpose
of
5
providing
grants
to
cities
for
the
remediation
of
underutilized
6
buildings.
The
authority
shall
administer
the
fund
in
a
manner
7
to
make
grant
moneys
annually
available
to
cities
for
the
8
purposes
of
this
section.

b.
The
fund
may
consist
of
any
moneys
appropriated
by
the
10
general
assembly
for
purposes
of
this
section
and
any
other
11
moneys
that
are
lawfully
available
to
the
authority,
including
12
moneys
transferred
or
deposited
from
other
funds
created
13
pursuant
to
section
15.106A,
subsection
1,
paragraph
“o”
.

c.
The
authority
shall
use
any
moneys
specifically
15
appropriated
for
purposes
of
this
section
only
for
the
purposes
16
of
this
section.
The
authority
may
use
all
other
moneys
in
the
17
fund,
including
interest,
earnings,
and
recaptures
for
purposes
18
of
this
section,
or
the
authority
may
transfer
the
other
moneys
19
to
other
funds
created
pursuant
to
section
15.106A,
subsection
20
1,
paragraph
“o”
.

d.
Notwithstanding
section
8.33,
moneys
in
the
community
22
catalyst
building
remediation
fund
at
the
end
of
each
fiscal
23
year
shall
not
revert
to
any
other
fund
but
shall
remain
in
the
24
fund
for
expenditure
for
subsequent
fiscal
years.

e.
The
authority
may
use
not
more
than
five
percent
of
the
26
moneys
in
the
fund
at
the
beginning
of
the
fiscal
year
for
27
purposes
of
administrative
costs,
marketing,
and
technical
28
assistance
and
other
program
support.

2.
The
authority
shall
use
moneys
in
the
fund
to
provide
30
grants
to
cities
for
the
remediation
of
underutilized
31
buildings.
The
authority
may
provide
grants
under
this
section
32
using
a
competitive
scoring
process.
33
3.
In
providing
grants
under
this
section,
the
authority
34
shall
dedicate
forty
percent
of
the
moneys
available
at
the

beginning
of
each
fiscal
year
to
cities
with
populations
of
1
less
than
one
thousand
five
hundred
as
shown
by
the
most
recent
2
federal
decennial
census.
If
at
the
end
of
each
application
3
period
the
amount
of
grants
awarded
to
cities
with
a
population
4
of
less
than
one
thousand
five
hundred
is
less
than
the
5
amount
to
be
dedicated
to
such
cities
under
this
subsection,
6
the
balance
may
be
awarded
to
any
approved
applicant
city
7
regardless
of
city
population.

4.
The
authority
shall
enter
into
an
agreement
with
each
9
city
for
the
receipt
of
grants
under
this
section.
For
a
city
10
to
receive
grant
moneys
under
this
section,
the
agreement
must
11
require
the
city
to
provide
resources,
including
financial
or
12
in-kind
resources,
to
the
remediation
project.
The
authority
13
may
negotiate
the
terms
of
the
agreement.

5.
In
providing
grants
under
this
section,
the
authority
15
shall
coordinate
with
a
city
to
develop
a
plan
for
the
use
of
16
grant
moneys
that
is
consistent
with
the
community
development,
17
housing,
and
economic
development
goals
of
the
city.
The
terms
18
of
the
agreement
entered
into
pursuant
to
subsection
4
and
the
19
use
of
grants
provided
under
this
section
shall
reflect
the
20
plan
developed.

6.
If
a
city
receives
a
grant
under
this
section,
the
amount
22
of
any
lien
created
for
costs
related
to
the
remediation
of
the
23
building
shall
not
include
any
moneys
that
the
city
received
24
pursuant
to
this
section.
25
7.
The
authority
shall
submit
a
report
to
the
general
26
assembly
and
the
governor's
office
on
or
before
January
27
31,
2020,
describing
the
results
of
the
program
implemented
28
pursuant
to
this
section
and
making
recommendations
for
program
29
changes.
30
Sec.
2.
Section
15.335B,
subsection
2,
paragraph
a,
Code

2016,
is
amended
by
adding
the
following
new
subparagraph:
