Section
1.
HAWK-I
COVERED
SPEECH
THERAPY
BENEFIT.
The
1
hawk-i
covered
speech
therapy
benefit
shall
provide
for
2
coverage
of
both
habilitative
and
rehabilitative
services
3
for
children
with
speech,
language,
and
hearing
disorders
as
4
medically
necessary.
The
determination
that
a
service
is
5
medically
necessary
shall
not
be
interpreted
to
require
loss
6
or
impairment
as
the
result
of
a
stroke,
accidental
injury,
or
7
surgery
to
the
head
or
neck
as
a
prerequisite
to
coverage
of
8
services.

Sec.
2.
HAWK-I
BOARD
DUTIES
——
BENEFIT
PACKAGE.
The
10
hawk-i
board
shall
review
the
benefit
package
design
of,
the
11
noninclusive
list
of
benefits
for,
and
the
definition
of
12
medically
necessary
utilized
under
the
hawk-i
program,
and
13
shall
approve
a
benefit
package
and
adopt
rules,
pursuant
to
14
the
duties
specified
in
section
514I.5,
to
provide
benefits
15
uniformly
and
consistently
across
all
participating
insurers,
16
in
the
type
and
manner
that
reflects
and
meets
the
needs
of
the
17
child
population,
including
children
with
special
health
care
18
needs,
under
the
hawk-i
program.

Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
20
immediate
importance,
takes
effect
upon
enactment.
21
Sec.
4.
RETROACTIVE
APPLICABILITY.
This
Act
applies
22
retroactively
to
March
1,
2016.
