the

the

being

photographed,
or
filmed

has
a
reasonable
expectation
of
privacy,
and
if
the
person

being
viewed,
photographed,
or
filmed
does
not
consent
or

cannot
consent
to
being
viewed,
photographed,
or
filmed.

subsection

is
amended

trespasses
upon
the
property
of

simple
misdemeanor

except
that
any
person

trespasses
as
defined
in

serious
misdemeanor
