ENACTED
BY
THE
GENERAL
ASSEMBLY
OF
THE
STATE
OF
IOWA:

Section
1.
Section
17A.4,
Code
2016,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
10.
If
an
agency
determines
that
rulemaking
3
by
the
agency
is
required
or
necessary
in
order
to
implement
or
4
administer
a
provision
of
an
Act
of
the
general
assembly,
the
5
agency
shall
make
one
of
the
following
submissions
regarding
6
such
rulemaking
within
one
hundred
eighty
days
of
the
date
on
7
which
the
provision
becomes
effective:
8
a.
Submit
a
notice
of
intended
action
to
the
administrative
9
rules
coordinator
and
the
administrative
code
editor
pursuant
10
to
subsection
1.
11
b.
Submit
written
notification
to
the
administrative
rules
12
review
committee
that
the
agency
has
not
submitted
a
notice
of
13
intended
action
to
the
administrative
rules
coordinator
and
14
the
administrative
code
editor
pursuant
to
subsection
1.
The
15
notification
shall
include
the
provision
of
the
Act
of
the
16
general
assembly
for
which
rulemaking
is
required
or
necessary,
17
the
subject
matter
of
the
provision,
an
explanation
of
the
18
delay
in
the
submission
of
a
notice
of
intended
action,
and
19
an
estimated
timeline
for
submission
of
a
notice
of
intended
20
action.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
22
immediate
importance,
takes
effect
upon
enactment.
23
Sec.
3.
APPLICABILITY.
This
Act
applies
to
any
provisions
24
of
Acts
enacted
on
or
after
the
effective
date
of
this
Act.
