S.F. 2335 Section 1. NEW SECTION . 80B.11F Public safety training and 1 equipment trust fund. 2 1. A public safety training and equipment trust fund is 3 created in the state treasury under the control of the council. 4 2. The trust fund shall consist of moneys deposited in 5 the fund pursuant to section 432.1, subsection 7, and any 6 other devise, gift, bequest, donation, federal or other grant, 7 reimbursement, repayment, judgment, transfer, payment, or 8 appropriation from any source intended to be used for the 9 purposes of the trust fund. Of the moneys deposited in the 10 trust fund, an amount equal to ten percent of the moneys 11 deposited, or such lesser amount as determined by the council, 12 shall be allocated to a capital projects account for the 13 purposes of public safety training facility needs. 14 3. Moneys credited to the trust fund are not subject to 15 section 8.33 and shall not be transferred, used, obligated, 16 appropriated, or otherwise encumbered except as provided 17 in this section and for succeeding fiscal years shall 18 remain available for expenditure for purposes of the fund. 19 Notwithstanding section 12C.7, subsection 2, interest or 20 earnings on moneys deposited in the trust fund shall be 21 credited to the trust fund. Moneys shall not be appropriated 22 or expended from the trust fund until the first fiscal year 23 following the fiscal year in which the minimum balance of the 24 trust fund reaches eight million dollars. 25 4. a. Moneys in the trust fund shall be used for public 26 safety training costs incurred by the state or a political 27 subdivision of the state and for public safety personnel 28 equipment costs, excluding vehicles, incurred by the state or a 29 political subdivision of the state, subject to appropriation by 30 the general assembly. It is the intent of the general assembly 31 that all training costs incurred by the state or a political 32 subdivision be reimbursed from moneys in the trust fund and 33 that such remaining moneys in the trust fund, less such amount 34 needed for cash flow purposes of the trust fund, be used to 35 -1- SF 2335 (7) 84 ec/sc/jh 1/ 5
S.F. 2335 reimburse public safety personnel equipment costs. 1 b. Moneys in the capital projects account of the trust 2 fund shall be used for public safety training facility needs, 3 subject to appropriation by the general assembly. 4 Sec. 2. Section 432.1, Code 2011, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 7. a. Of the amount of premium tax 7 receipts collected pursuant to subsection 3 for the 2014 and 8 subsequent calendar years and deposited in the general fund 9 of the state, the department of revenue shall transfer the 10 applicable percent of such amount that exceeds the amount of 11 premium tax receipts collected pursuant to subsection 3 for 12 calendar year 2012 to the public safety training and equipment 13 trust fund created in section 80B.11F. 14 b. For purposes of this subsection, “applicable percent” 15 means as follows: 16 (1) For the 2014 through 2016 calendar years, one hundred 17 percent. 18 (2) For the 2017 calendar year, seventy-five percent. 19 (3) For the 2018 and subsequent calendar years, fifty 20 percent. 21 Sec. 3. PUBLIC SAFETY TRAINING AND FACILITIES TASK FORCE. 22 1. A public safety training and facilities task force is 23 established. The department of public safety shall provide 24 administrative support for the task force. 25 2. The task force shall consist of the following members: 26 a. One member appointed by the Iowa peace officers 27 association. 28 b. One member appointed by the Iowa state sheriff’s and 29 deputies association. 30 c. One member appointed by the Iowa police chiefs 31 association. 32 d. One member who is a fire chief appointed by the Iowa fire 33 chiefs association. 34 e. S.F. 2335 professional fire chiefs association. 1 f. One member who is the chief of the Iowa fire service 2 training bureau or the chief’s designee. 3 g. Two members who are representatives of the fire service 4 appointed by the Iowa firefighters association. 5 h. The director of the Iowa law enforcement academy or the 6 director’s designee. 7 i. The commissioner of the department of public safety or 8 the commissioner’s designee. 9 j. Two members who are appointed by the Iowa professional 10 firefighters. 11 k. The state fire marshal or the state fire marshal’s 12 designee. 13 l. The director of the department of corrections or the 14 director’s designee. 15 m. One member appointed by the chief of the bureau of 16 emergency medical services of the Iowa department of public 17 health. 18 n. One member appointed by the Iowa emergency medical 19 services association. 20 o. One member appointed by the Iowa state police 21 association. 22 p. One member appointed by the state police officers council 23 who is representing peace officers within the department of 24 public safety. 25 q. One member appointed by the state police officers council 26 who is representing employees of the department of natural 27 resources. 28 r. One member who is the chief of the law enforcement bureau 29 of the department of natural resources or the chief’s designee. 30 s. One member appointed by the governor who is a 31 public member who has no personal interest or occupational 32 responsibilities in the area of responsibility given to the 33 task force and represents the interests of the public in 34 general. 35 -3- SF 2335 (7) 84 ec/sc/jh 3/ 5
S.F. 2335 t. One member appointed by the collective bargaining 1 unit that represents the largest number of employees in the 2 department of corrections. 3 u. One member appointed by the collective bargaining unit 4 that represents the largest number of jailers and dispatchers 5 in this state. 6 v. One member appointed by the Iowa association of community 7 college presidents. 8 3. The members of the task force shall select one 9 chairperson and one vice chairperson. The vice chairperson 10 shall preside in the absence of the chairperson. Section 11 69.16A shall apply to the appointed members of the task force. 12 4. The task force shall consider and develop strategies 13 relating to public safety training facility governance with 14 the goal of all public safety disciplines being represented. 15 Each public safety discipline shall advise the task force 16 by developing individual training policies as determined by 17 the discipline’s governing bodies. The task force shall 18 also develop a proposal for a joint public safety training 19 facility, a budget for construction and future operation of 20 this facility, and potential locations, that are centrally 21 located in this state, for the facility. 22 5. a. The task force shall provide interim reports to the 23 general assembly by December 31 of each year concerning the 24 activities of the task force and shall submit its final report, 25 including its findings and recommendations, to the general 26 assembly by December 31, 2015. 27 b. The final report shall include but not be limited to 28 recommendations concerning the following: 29 (1) Consolidation of public safety governance within a 30 single board and the membership of the board. 31 (2) Development of a consolidated fire and police public 32 safety training facility, including possible locations, 33 building recommendations, and financing options. 34 (3) The distribution of moneys from the public safety 35 -4- SF 2335 (7) 84 ec/sc/jh 4/ 5

PUBLIC SAFETY TRAINING AND FACILITIES TASK FORCE —— 4 ADMINISTRATIVE SUPPORT. There is appropriated from the general 5 fund of the state to the department of public safety for the 6 fiscal period beginning July 1, 2012, and ending December 31, 7 2015, the following amount, or so much thereof as is necessary, 8 to be used for the purposes designated: 9 For providing administrative support for the public safety 10 training and facilities task force as enacted in this Act: 11 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 50,000 12 -5- SF 2335 (7) 84 ec/sc/jh 5/ 5
