EARLY CHILDHOOD IOWA FUND —— GENERAL AID 25 For deposit in the school ready children grants account of 26 the early childhood Iowa fund created in section 256I.11: 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,386,113 28 a. From the moneys deposited in the school ready children 29 grants account for the fiscal year beginning July 1, 2011, and 30 ending June 30, 2012, not more than $265,950 is allocated for 31 the early childhood Iowa office and other technical assistance 32 activities. The early childhood Iowa state board shall direct 33 staff to work with the early childhood stakeholders alliance 34 created in section 256I.12 to inventory technical assistance 35 -5- HF 645 (7) 84 kh/tm/mb 5/ 51

Moneys allocated under this lettered paragraph may be 1 used by the early childhood Iowa state board for the purpose of 2 skills development and support for ongoing training of staff. 3 However, except as otherwise provided in this subsection, 4 moneys shall not be used for additional staff or for the 5 reimbursement of staff. 6 b. As a condition of receiving moneys appropriated in 7 this subsection, each early childhood Iowa area board shall 8 report to the early childhood Iowa state board progress on 9 each of the local indicators approved by the area board. Each 10 early childhood Iowa area board must also submit an annual 11 budget for the area’s comprehensive school ready children 12 grant developed for providing services for children from birth 13 through five years of age, and provide other information 14 specified by the early childhood Iowa state board, including 15 budget amendments as needed. The early childhood Iowa state 16 board shall establish a submission deadline for the annual 17 budget and any budget amendments that allow a reasonable period 18 of time for preparation by the early childhood Iowa area boards 19 and for review and approval or request for modification of 20 the materials by the early childhood Iowa state board. In 21 addition, each early childhood Iowa area board must continue to 22 comply with reporting provisions and other requirements adopted 23 by the early childhood Iowa state board in implementing section 24 256I.9. 25 c. Of the amount appropriated in this subsection for 26 deposit in the school ready children grants account of the 27 early childhood Iowa fund, $2,318,018 shall be used for efforts 28 to improve the quality of early care, health, and education 29 programs. Moneys allocated pursuant to this paragraph may be 30 used for additional staff and for the reimbursement of staff. 31 The early childhood Iowa state board may reserve a portion 32 of the allocation, not to exceed $88,650, for the technical 33 assistance expenses of the early childhood Iowa state office, 34 including the reimbursement of staff, and shall distribute 35 -6- HF 645 (7) 84 kh/tm/mb 6/ 51
H.F. 645 the remainder to early childhood Iowa areas for local quality 1 improvement efforts through a methodology identified by the 2 early childhood Iowa state board to make the most productive 3 use of the funding, which may include use of the distribution 4 formula, grants, or other means. 5 d. Of the amount appropriated in this subsection for 6 deposit in the school ready children grants account of 7 the early childhood Iowa fund, $825,030 shall be used for 8 support of professional development and training activities 9 for persons working in early care, health, and education by 10 the early childhood Iowa state board in collaboration with 11 the professional development component group of the early 12 childhood Iowa stakeholders alliance maintained pursuant to 13 section 256I.12, subsection 7, paragraph “b”, and the early 14 childhood Iowa area boards. Expenditures shall be limited to 15 professional development and training activities agreed upon by 16 the parties participating in the collaboration. 17 11. EARLY CHILDHOOD IOWA FUND —— PRESCHOOL TUITION 18 ASSISTANCE 19 a. For deposit in the school ready children grants account 20 of the early childhood Iowa fund created in section 256I.11: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,128,877 22 b. The amount appropriated in this subsection shall be 23 used for early care, health, and education programs to assist 24 low-income parents with tuition for preschool and other 25 supportive services for children ages three, four, and five 26 who are not attending kindergarten in order to increase the 27 basic family income eligibility requirement to not more than 28 200 percent of the federal poverty level. In addition, if 29 sufficient funding is available after addressing the needs of 30 those who meet the basic income eligibility requirement, an 31 early childhood Iowa area board may provide for eligibility 32 for those with a family income in excess of the basic income 33 eligibility requirement through use of a sliding scale or other 34 copayment provisions. 35 -7- HF 645 (7) 84 kh/tm/mb 7/ 51

ENERGY COST-SAVINGS PROJECTS —— FINANCING. For 12 the fiscal year beginning July 1, 2011, and ending June 30, 13 2012, the state board of regents may use notes, bonds, or 14 other evidences of indebtedness issued under section 262.48 to 15 finance projects that will result in energy cost savings in an 16 amount that will cause the state board to recover the cost of 17 the projects within an average of six years. 18 Sec. 9. PRESCRIPTION DRUG COSTS. Notwithstanding section 19 270.7, the department of administrative services shall pay 20 the state school for the deaf and the Iowa braille and sight 21 saving school the moneys collected from the counties during the 22 fiscal year beginning July 1, 2011, for expenses relating to 23 prescription drug costs for students attending the state school 24 for the deaf and the Iowa braille and sight saving school. 25 Sec. 10. Section 256I.9, subsection 3, paragraph b, Code 26 2011, is amended to read as follows: 27 b. Family support services and parent education programs 28 promoted to parents of children from zero through age five. 29 Family support services shall include but are not limited 30 to home visitation. Of the state funding from all sources 31 that an area board designates for family support programs, at 32 least sixty percent shall be committed to programs with a home 33 visitation component. 34 Sec. 11. Section 261.19, Code 2011, is amended to read as 35 -16- HF 645 (7) 84 kh/tm/mb 16/ 51
H.F. 645 follows: 1 261.19 Osteopathic physician Health care professional 2 recruitment program. 3 1. A physician health care professional recruitment program 4 is established , to be administered by the college student aid 5 commission , for Des Moines university —— osteopathic medical 6 center . The program shall consist of a forgivable loan program 7 and a tuition scholarship program for students and a loan 8 repayment program for physicians health care professionals . 9 The commission shall regularly adjust the physician service 10 requirement under each aspect of the program to provide, to the 11 extent possible, an equal financial benefit for each period of 12 service required. 13 2. a. Notwithstanding the administration provisions of 14 subsection 1 , the forgivable loan program established pursuant 15 to subsection 1 shall be administered by the commission in 16 conjunction with Des Moines university —— osteopathic medical 17 center. Des Moines university —— osteopathic medical center 18 shall match on an equal basis state aid appropriated for 19 purposes of the forgivable loan program. 20 b. Des Moines university —— osteopathic medical center 21 shall provide recommendations to the commission for students 22 who meet the eligibility requirements of the forgivable loan 23 program. A forgivable loan may be awarded to a resident of 24 Iowa who is enrolled at Des Moines university —— osteopathic 25 medical center if the student agrees to practice in this state 26 for a period of time to be determined by the commission at 27 the time the loan is awarded. Forgivable loans to eligible 28 students shall not become due until after the student completes 29 a residency program. Interest on the loans shall begin to 30 accrue the day following the student’s graduation date. If 31 the student completes the period of practice established by 32 the commission and agreed to by the student, the loan amount 33 shall be forgiven. The loan amount shall not be forgiven if 34 the osteopathic physician fails to complete the required time 35 -17- HF 645 (7) 84 kh/tm/mb 17/ 51
H.F. 645 period of practice in this state or fails to satisfactorily 1 continue in the university’s program of medical education. 2 3. A student enrolled at Des Moines university —— 3 osteopathic medical center shall be eligible for a tuition 4 scholarship for the student’s study at the university. The 5 scholarship shall be for an amount not to exceed the annual 6 tuition at the university. A student who receives a tuition 7 scholarship shall not be eligible for the loan repayment 8 program provided for by this section . A student who receives 9 a tuition scholarship shall agree to practice in an eligible 10 rural community in this state for a period of time to be 11 determined by the commission at the time the scholarship is 12 awarded. The student shall repay the scholarship to the 13 commission if the student fails to practice in a medically 14 underserved rural community in this state for the required 15 period of time. 16 4. A physician health care professional shall be eligible 17 for the physician loan repayment program if the physician 18 health care professional agrees to practice in an eligible 19 rural community in this state. Des Moines university —— 20 osteopathic medical center shall recruit and place physicians 21 health care professionals in rural communities which have 22 agreed to provide additional funds for the physician’s 23 recipient’s loan repayment. The contract for the loan 24 repayment shall stipulate the time period the physician 25 recipient shall practice in an eligible rural community in this 26 state. In addition, the contract shall stipulate that the 27 physician recipient repay any funds paid on the physician’s 28 recipient’s loan by the commission if the physician recipient 29 fails to practice in an eligible rural community in this state 30 for the required period of time. 31 3. A health care professional recruitment revolving fund 32 is created in the state treasury as a separate fund under 33 the control of the commission. The commission shall deposit 34 payments made by health care professional recruitment program 35 -18- HF 645 (7) 84 kh/tm/mb 18/ 51
H.F. 645 recipients and the proceeds from the sale of osteopathic loans 1 awarded pursuant to section 261.19, subsection 2, paragraph 2 “b” , Code 2011, into the health care professional recruitment 3 revolving fund. Moneys credited to the fund shall be used to 4 supplement moneys appropriated for the health care professional 5 recruitment program, for loan repayment in accordance with this 6 section, and to pay for loan or interest repayment defaults by 7 program recipients. Notwithstanding section 8.33, any balance 8 in the fund on June 30 of any fiscal year shall not revert to 9 the general fund of the state. 10 4. For purposes of this subsection , “eligible section: 11 a. “Eligible rural community” means a medically underserved 12 rural community which agrees to match state funds provided 13 on at least a dollar-for-dollar basis for the loan repayment 14 of a physician health care professional who practices in the 15 community. 16 b. “Health care professional” means a physician, physician 17 assistant, podiatrist, or physical therapist. 18 5. The commission shall adopt rules pursuant to chapter 17A 19 to administer this section . 20 Sec. 12. Section 261.25, subsections 1 and 2, Code 2011, are 21 amended to read as follows: 22 1. There is appropriated from the general fund of the state 23 to the commission for each fiscal year the sum of forty-four 24 forty-three million thirteen thousand four hundred forty-eight 25 dollars for tuition grants. 26 2. There is appropriated from the general fund of the state 27 to the commission for each fiscal year the sum of four two 28 million six hundred fifty thousand four hundred eighty-seven 29 dollars for tuition grants for students attending for-profit 30 accredited private institutions located in Iowa. A for-profit 31 institution which, effective March 9, 2005, or effective 32 January 8, 2010, purchased an accredited private institution 33 that was exempt from taxation under section 501(c) of the 34 Internal Revenue Code, shall be an eligible institution under 35 -19- HF 645 (7) 84 kh/tm/mb 19/ 51
H.F. 645 the tuition grant program. For purposes of the tuition grant 1 program, “for-profit accredited private institution” means 2 an accredited private institution which is not exempt from 3 taxation under section 501(c)(3) of the Internal Revenue Code 4 but which otherwise meets the requirements of section 261.9, 5 subsection 1 , paragraph “b” , and whose students were eligible 6 to receive tuition grants in the fiscal year beginning July 1, 7 2003. 8 Sec. 13. Section 284.13, subsection 1, paragraphs a through 9 c, Code 2011, are amended to read as follows: 10 a. For the fiscal year beginning July 1, 2010 2011 , and 11 ending June 30, 2011 succeeding fiscal years , to the department 12 of education, the amount of nine six hundred sixty-four 13 eighty-five thousand dollars for the issuance of national 14 board certification awards in accordance with section 256.44 . 15 Of the amount allocated under this paragraph, not less than 16 seventy-six eighty-five thousand five hundred dollars shall 17 be used to administer the ambassador to education position in 18 accordance with section 256.45 . 19 b. For the fiscal year beginning July 1, 2010 2011 , and 20 succeeding fiscal years, an amount up to four three million 21 one two hundred seven thousand two hundred forty dollars 22 for first-year and second-year beginning teachers, to the 23 department of education for distribution to school districts 24 and area education agencies for purposes of the beginning 25 teacher mentoring and induction programs. A school district or 26 area education agency shall receive one thousand three hundred 27 dollars per beginning teacher participating in the program. 28 If the funds appropriated for the program are insufficient to 29 pay mentors, school districts, and area education agencies 30 as provided in this paragraph, the department shall prorate 31 the amount distributed to school districts and area education 32 agencies based upon the amount appropriated. Moneys received 33 by a school district or area education agency pursuant to 34 this paragraph shall be expended to provide each mentor with 35 -20- HF 645 (7) 84 kh/tm/mb 20/ 51
H.F. 645 an award of five hundred dollars per semester, at a minimum, 1 for participation in the school district’s or area education 2 agency’s beginning teacher mentoring and induction program; 3 to implement the plan; and to pay any applicable costs of the 4 employer’s share of contributions to federal social security 5 and the Iowa public employees’ retirement system or a pension 6 and annuity retirement system established under chapter 294 , 7 for such amounts paid by the district or area education agency. 8 c. For the fiscal year beginning July 1, 2010 2011 , and 9 ending June 30, 2011 succeeding fiscal years , up to six hundred 10 thirteen thousand eight hundred seventy-eight dollars to the 11 department for purposes of implementing the professional 12 development program requirements of section 284.6 , assistance 13 in developing model evidence for teacher quality committees 14 established pursuant to section 284.4, subsection 1 , paragraph 15 “c” , and the evaluator training program in section 284.10 . 16 A portion of the funds allocated to the department for 17 purposes of this paragraph may be used by the department for 18 administrative purposes and for not more than four full-time 19 equivalent positions. 20 Sec. 14. Section 284.13, subsection 1, paragraph d, Code 21 2011, is amended by striking the paragraph. 22 Sec. 15. Section 299A.2, Code 2011, is amended to read as 23 follows: 24 299A.2 Competent private instruction by licensed 25 practitioner. 26 If a licensed practitioner provides competent instruction 27 to a school-age child of compulsory attendance age , the 28 practitioner shall possess a valid license or certificate which 29 has been issued by the state board of educational examiners 30 under chapter 272 and which is appropriate to the ages and 31 grade levels of the children to be taught. Competent private 32 instruction may include , but is not limited to , a home school 33 assistance program which provides instruction or instructional 34 supervision offered through an accredited nonpublic school or 35 -21- HF 645 (7) 84 kh/tm/mb 21/ 51
H.F. 645 public school district by a teacher, who is employed by the 1 accredited nonpublic school or public school district, who 2 assists and supervises a parent, guardian, or legal custodian 3 in providing instruction to a child. If competent private 4 instruction is provided through a public school district, the 5 child shall be enrolled and included in the basic enrollment 6 of the school district as provided in section 257.6 . Sections 7 299A.3 through 299A.7 do not apply to competent private 8 instruction provided by a licensed practitioner under this 9 section . However, the reporting requirement contained in 10 section 299A.3, subsection 1 , shall apply to competent private 11 instruction provided by licensed practitioners that is not 12 part of a home school assistance program offered through an 13 accredited nonpublic school or public school district. 14 Sec. 16. Section 299A.8, Code 2011, is amended to read as 15 follows: 16 299A.8 Dual enrollment. 17 If a parent, guardian, or legal custodian of a school-age 18 child who is receiving competent private instruction under 19 this chapter or a child over compulsory age who is receiving 20 private instruction submits a request, the child shall also be 21 registered in a public school for dual enrollment purposes. 22 If the child is enrolled in a public school district for 23 dual enrollment purposes, the child shall be permitted to 24 participate in any academic activities in the district and 25 shall also be permitted to participate on the same basis as 26 public school children in any extracurricular activities 27 available to children in the child’s grade or group, and the 28 parent, guardian, or legal custodian shall not be required to 29 pay the costs of any annual evaluation under this chapter . If 30 the child is enrolled for dual enrollment purposes, the child 31 shall be included in the public school’s basic enrollment 32 under section 257.6 . A pupil who is participating only in 33 extracurricular activities shall be counted under section 34 257.6, subsection 1 , paragraph “a” , subparagraph (6). H.F. 645 enrolled in grades nine through twelve under this section shall 1 be counted in the same manner as a shared-time pupil under 2 section 257.6, subsection 1 , paragraph “a” , subparagraph (3). 3 Sec. 17. Section 299A.12, subsection 1, Code 2011, is 4 amended to read as follows: 5 1. The board of directors of a school district may shall 6 expend moneys received pursuant to section 257.6, subsection 7 1 , paragraph “a” , subparagraph (5), for purposes of providing a 8 home school assistance program. 9 Sec. 18. Section 299A.12, subsection 2, paragraphs a and b, 10 Code 2011, are amended to read as follows: 11 a. Assisting Instruction for students and assisting parents 12 with instruction. 13 b. Student Support services for students and teaching-parent 14 support services teaching parents and staff support services. 15 Sec. 19. Section 299A.12, subsection 2, paragraph g, 16 unnumbered paragraph 1, Code 2011, is amended to read as 17 follows: 18 Resources, materials, computer software and hardware, and 19 supplies, and purchased services that meet the following 20 criteria: 21 Sec. 20. Section 299A.12, subsection 3, paragraphs b, c, e, 22 and f, Code 2011, are amended to read as follows: 23 b. Operational or maintenance costs in addition to the cost 24 of maintaining school district facilities other than those 25 necessary to operate and maintain the program . 26 c. Capital expenditures other than equipment or facility 27 acquisition, including the lease or rental of space to 28 supplement existing schoolhouse facilities . 29 e. Administrative costs other than the costs necessary to 30 administer the program . 31 f. Concurrent and dual enrollment program costs and 32 postsecondary enrollment options program costs. 33 Sec. 21. REPEAL. H.F. 645 STATEWIDE PRESCHOOL PROGRAM FOR FOUR-YEAR-OLD CHILDREN 1 Sec. 22. Section 237A.21, subsection 3, paragraph p, Code 2 2011, is amended to read as follows: 3 p. One person who is part of a local program implementing 4 the statewide preschool program for four-year-old children 5 under chapter 256C 256J . 6 Sec. 23. Section 237A.22, subsection 1, paragraph f, Code 7 2011, is amended to read as follows: 8 f. Make recommendations for improving collaborations between 9 the child care programs involving the department and programs 10 supporting the education and development of young children 11 including but not limited to the federal head start program , 12 the statewide preschool program for four-year-old children 13 and the early childhood, at-risk, and other early education 14 programs administered by the department of education. 15 Sec. 24. Section 256.11, subsection 1, paragraph c, Code 16 2011, is amended to read as follows: 17 c. For the purposes of this subsection , “prekindergarten 18 program” includes but is not limited to a school district’s 19 implementation of the preschool program established pursuant to 20 chapter 256C 256J . 21 Sec. 25. Section 257.16, subsection 1, Code 2011, is amended 22 to read as follows: 23 1. There is appropriated each year from the general fund 24 of the state an amount necessary to pay the foundation aid 25 under this chapter , the preschool foundation aid under chapter 26 256C , supplementary aid under section 257.4, subsection 2 , and 27 adjusted additional property tax levy aid under section 257.15, 28 subsection 4 . 29 Sec. 26. Section 272.2, subsection 18, Code 2011, is amended 30 to read as follows: 31 18. May adopt rules for practitioners who are not eligible 32 for a statement of professional recognition under subsection 33 10 , but have received a baccalaureate degree and provide a 34 service to students at any or all levels from prekindergarten 35 -24- HF 645 (7) 84 kh/tm/mb 24/ 51
H.F. 645 through grade twelve for a school district, accredited 1 nonpublic school, area education agency, or preschool program 2 established pursuant to chapter 256C 256J . 3 Sec. 27. Section 285.1, subsection 1, paragraph a, 4 subparagraph (3), Code 2011, is amended to read as follows: 5 (3) Children attending prekindergarten programs offered or 6 sponsored by the district or nonpublic school and approved by 7 the department of education or department of human services 8 or children participating in preschool in an approved local 9 program under chapter 256C 256J may be provided transportation 10 services. However, transportation services provided to 11 nonpublic school children are not eligible for reimbursement 12 under this chapter . 13 Sec. 28. REPEAL. Chapter 256C, Code 2011, is repealed. 14 Sec. 29. EFFECTIVE DATE AND APPLICABILITY. This division of 15 this Act takes effect July 1, 2011, and applies to budget years 16 beginning on or after July 1, 2011. 17 DIVISION III 18 PRESCHOOL PROGRAM FOR FOUR-YEAR-OLD CHILDREN 19 Sec. 30. NEW SECTION . 256J.1 Definitions. 20 As used in this chapter: 21 1. “Department” means the department of education. 22 2. “Director” means the director of the department of 23 education. 24 3. “Eligible school district” or “school district” means 25 a school corporation organized under chapter 274 that meets 26 the requirements of section 256J.3, subsection 4, and has been 27 approved by the department to implement preschool programs as 28 provided in this chapter. 29 4. “High-quality preschool program” means a preschool 30 program that meets the federal head start program performance 31 standards adopted pursuant to the federal Improving Head Start 32 for School Readiness Act of 2007, Pub. L. No. 110-134, the Iowa 33 quality preschool program standards and criteria as determined 34 by the department in accordance with 281 IAC 16.3, and the 35 -25- HF 645 (7) 84 kh/tm/mb 25/ 51
H.F. 645 national association for the education of young children 1 program standards and accreditation criteria. 2 5. “Preschool scholarship” means the state funding allocated 3 to school districts to pay tuition for eligible children 4 enrolled in preschool programs implemented pursuant to this 5 chapter. 6 6. “Private education partner” means a private preschool 7 provider that may submit claims for reimbursement to a school 8 district for providing high-quality preschool instruction to 9 four-year-old children receiving scholarships in accordance 10 with this chapter. 11 7. “State board” means the state board of education. 12 Sec. 31. NEW SECTION . 256J.2 Preschool program for 13 four-year-old children —— scholarships —— purpose. 14 1. A preschool program for four-year-old children is 15 established in the department to provide an opportunity for 16 all eligible children, including economically disadvantaged 17 children, to enter school ready to learn. The purpose 18 of the preschool scholarship program shall be to provide 19 scholarships to pay for eligible four-year-old children to 20 attend high-quality preschool provided by school districts or 21 private education partners. 22 2. The state board shall adopt rules pursuant to chapter 23 17A, and may adopt emergency rules under section 17A.4, 24 subsection 3, and section 17A.5, subsection 2, paragraph “b” , as 25 necessary to implement this chapter. 26 Sec. 32. NEW SECTION . 256J.3 Preschool program 27 requirements. 28 1. Eligible children. A child who is a resident of Iowa 29 and is four years of age on or before September 15 of a school 30 year is eligible to enroll, based on order of registration, in 31 a preschool program implemented pursuant to this chapter and 32 may be eligible for a preschool scholarship based upon the most 33 current sliding tuition scale determined and published by the 34 department in accordance with subsection 5. H.F. 645 approved to participate in the preschool program pursuant to 1 this chapter may enroll a younger child or an older child in 2 the preschool program if space is available; however, the child 3 shall not be counted in the preschool enrollment count for 4 preschool scholarship funding purposes under section 256J.5. 5 a. A family may choose to enroll the family’s four-year-old 6 child in an approved school district preschool program or a 7 preschool program implemented by a private education partner. 8 Families shall complete all enrollment requirements, including 9 but not limited to income verification. 10 b. A school district or a private education partner may 11 charge tuition for children participating in the preschool 12 program, but shall not charge more for tuition than the amount 13 determined and published by the department. All families 14 enrolling eligible children are required to pay tuition based 15 on income and the most current sliding tuition scale determined 16 and published by the department. 17 2. Teacher requirements. 18 a. An individual serving as a preschool teacher in the 19 preschool program for four-year-old children shall be employed 20 by or under contract with the approved school district or by a 21 private education partner located within the approved school 22 district’s boundaries and shall meet one of the following 23 qualifications: 24 (1) The individual is appropriately licensed under chapter 25 272 and meets the requirements of chapter 284. 26 (2) The individual possesses, or is working toward 27 obtaining within two years of starting employment under this 28 subsection, an early childhood certificate of eligibility 29 issued under chapter 272, and meets either of the following 30 conditions: 31 (a) Holds a bachelor’s or graduate degree from an accredited 32 college or university. 33 (b) Holds an associate of arts degree and is working 34 toward obtaining a bachelor’s degree within three years. H.F. 645 subparagraph division (b) is repealed August 31, 2014. 1 b. A preschool teacher in an approved preschool program 2 shall collaborate with other agencies, organizations, and 3 boards in the community to further the program’s capacity to 4 meet the diverse needs of the children enrolled in the program 5 and the families of the children, such as needs for early 6 care, health, and human services. In addition, the approved 7 preschool program shall work to maintain relationships with 8 each child’s family in order to enhance the child’s development 9 in all settings by collaborating with providers of parent 10 education and family support opportunities. 11 3. Program requirements —— program approval. The state board 12 shall adopt rules to further define the following preschool 13 program requirements, which shall be used to determine whether 14 or not a local program implemented by a school district or 15 private education partner qualifies for approval to implement a 16 preschool program: 17 a. Maximum and minimum teacher-to-child ratios and class 18 sizes. 19 b. Applicable state and federal program standards, including 20 but not limited to the federal head start program performance 21 standards adopted pursuant to the federal Improving Head Start 22 for School Readiness Act of 2007, Pub. L. No. 110-134, the Iowa 23 quality preschool program standards and criteria as determined 24 by the department in accordance with 281 IAC 16.3, and the 25 national association for the education of young children 26 program standards and accreditation criteria. 27 c. Student learning standards. 28 d. Applicable comprehensive statewide child assessment 29 determined by the department. 30 e. Provisions for the integration of children from other 31 state and federally funded preschools. 32 f. Collaboration with participating families, early care 33 providers, and community partners including but not limited 34 to early childhood Iowa area boards, head start programs, 35 -28- HF 645 (7) 84 kh/tm/mb 28/ 51
H.F. 645 shared visions, licensed child care centers, registered child 1 development homes, early childhood special education programs, 2 services funded by Tit. I of the federal Elementary and 3 Secondary Education Act of 1965, and family support programs. 4 g. A minimum of ten hours per week, thirty-four weeks per 5 year, of instruction delivered on the skills and knowledge 6 included in the student learning standards developed for the 7 preschool program. 8 h. Family involvement in the preschool program. 9 i. Provision for ensuring that children receiving care from 10 other child care arrangements can participate in the preschool 11 program with minimal disruption due to transportation and 12 movement from one site to another. 13 4. School district requirements. The state board shall 14 adopt rules to further define the following requirements for 15 school districts implementing a preschool program pursuant to 16 this chapter: 17 a. Collect documentation of school district and private 18 education partner readiness to meet program requirements. The 19 school district shall submit documentation to the department 20 that demonstrates that the school district contacted all 21 known potential private education partners within the school 22 district, including but not limited to, and only as applicable, 23 accredited nonpublic schools and faith-based preschools, 24 the early childhood Iowa area board, the federal head start 25 program, shared visions and other programs provided under the 26 auspices of the child development coordinating council, and 27 center-based providers of child care services. 28 b. Collaborate with all approved high-quality preschool 29 program sites in the district to better serve children enrolled 30 in the preschool program in the following ways: 31 (1) Extending the day, for children eligible for preschool 32 scholarships, through other state funding and federal funding, 33 including but not limited to funding available through early 34 childhood Iowa area boards, federal head start programs, shared 35 -29- HF 645 (7) 84 kh/tm/mb 29/ 51
H.F. 645 visions and other programs provided under the auspices of the 1 child development coordinating council, licensed child care 2 centers, registered child development homes, early childhood 3 special education programs, services funded by Tit. I of the 4 federal Elementary and Secondary Education Act of 1965, and 5 family support programs. 6 (2) Promoting family involvement through family support 7 programs as well as district programs. 8 c. Participate in data collection and performance 9 measurement processes and reporting, including reporting fall 10 and spring applicable comprehensive statewide child assessment 11 data as specified by the department. 12 d. Identify eligible children through targeted outreach to 13 all families in partnership with the early childhood Iowa area 14 board. 15 e. Collect information regarding and verify family income to 16 implement the sliding tuition scale determined and published by 17 the department in accordance with subsection 5. 18 f. Address professional development for school district 19 preschool teachers in the school district’s professional 20 development plan implemented in accordance with section 284.6. 21 g. Collaborate with private education partners to provide a 22 coordinated system of appropriate professional development for 23 preschool teachers and staff employed in the preschool program. 24 h. Pay only those claims submitted by the school district’s 25 private education partners which are verified by the process 26 set forth in section 279.29. 27 5. Department requirements. The department shall do the 28 following: 29 a. Implement an application and approval process for school 30 district participation in the preschool program that includes 31 but is not limited to the enrollment requirements provided 32 under subsection 1. 33 b. Track the progress of all children served by a school 34 district preschool program and by the school district’s private 35 -30- HF 645 (7) 84 kh/tm/mb 30/ 51
H.F. 645 education partners and track the children’s performance in 1 elementary and secondary education. 2 c. Implement procedures to monitor the quality of the 3 programming provided under the preschool program at all school 4 district and private education partner sites. 5 d. Determine a statewide comprehensive child assessment to 6 measure child outcomes for all children participating in the 7 preschool program at school districts and private education 8 partner sites. 9 e. Submit an annual report to the governor, the general 10 assembly, the early childhood Iowa state board, and the child 11 development coordinating council. 12 (1) The early childhood Iowa state board and the child 13 development coordinating council shall advise the department 14 regarding collaboration of high-quality preschool programs for 15 eligible children. 16 (2) The early childhood Iowa state board shall promote 17 the preschool program in local communities to increase family 18 awareness of quality preschool programs and scholarship 19 opportunities. 20 (3) The early childhood Iowa area boards shall collaborate 21 with school districts and their private education partners to 22 strengthen preschool quality. 23 f. Develop a statewide list of approved school district 24 and private education partner preschool programs and publish 25 the list on its website. The list shall include information 26 about preschool scholarships and the sliding tuition scale in 27 addition to other information for families. 28 g. Develop and review annually a sliding tuition scale for 29 purposes of granting preschool program scholarships to families 30 whose incomes are at or below three hundred percent of the 31 federal poverty level as defined by the most recently revised 32 poverty income guidelines published by the United States 33 department of health and human services. 34 6. Private education partner —— religious expression. An 35 -31- HF 645 (7) 84 kh/tm/mb 31/ 51
H.F. 645 approved high-quality preschool program offered by a religious 1 entity or organization shall not be prohibited from the free 2 exercise of religion during the program’s hours of instruction 3 if the program meets the program requirements established 4 pursuant to this section. 5 Sec. 33. NEW SECTION . 256J.4 Funding provisions —— 6 enrollment. 7 1. General. 8 a. State funding provided for preschool scholarships shall 9 be allocated to school districts for each school year based 10 upon the amount appropriated and the funding formula set forth 11 in section 256J.5. 12 b. Except as otherwise provided in chapter 298A, a school 13 district approved to participate in the preschool program may 14 authorize expenditures for the school district’s preschool 15 programming from any of the revenue sources available to the 16 district from the sources listed in chapter 298A, provided the 17 expenditures are within the uses permitted for the revenue 18 source. In addition, the use of the revenue source for 19 preschool programming must have been approved prior to any 20 expenditure from the revenue source for the school district’s 21 preschool program. 22 c. Funding provided for the preschool program pursuant to 23 this chapter is intended to supplement, not supplant, existing 24 public funding for preschool programming. 25 d. Preschool scholarship funding shall not be commingled 26 with the other state aid payments made under section 257.16 27 to a school district and shall be accounted for by the school 28 district separately from the other state aid payments. 29 Preschool scholarship payments made to school districts are 30 miscellaneous income for purposes of chapter 257. A school 31 district shall maintain a separate listing within its budget 32 for preschool scholarship payments received and expenditures 33 made. A school district shall certify to the department that 34 preschool scholarship funding received by the school district 35 -32- HF 645 (7) 84 kh/tm/mb 32/ 51
H.F. 645 was used to supplement, not supplant, moneys otherwise received 1 and used by the school district for preschool programming. 2 e. Preschool scholarship funding shall not be used for the 3 costs of constructing a facility in connection with a school 4 district or private education partner preschool program. 5 f. Preschool scholarship funding received by a school 6 district or private education partner may be used in 7 conjunction with funding from family-paid tuition to support 8 the school district or private education partner in providing 9 the preschool program. Not more than five percent of the 10 scholarship funding received annually by a school district 11 shall be used for the costs of supervising the program. 12 2. Eligible student enrollment. 13 a. To be included as an eligible student in the preschool 14 enrollment count by a school district, a child shall meet the 15 requirements of section 256J.3, subsection 1, and shall be 16 enrolled in and attending a preschool program implemented by 17 a school district or a school district’s private education 18 partner. 19 b. The enrollment count for the preschool program shall 20 include all eligible children who are enrolled in and attending 21 a preschool program implemented by a school district and the 22 school district’s private education partners shall be collected 23 by the school district on the date prescribed in section 257.6 24 and shall be certified to the department by the school district 25 by October 15. 26 Sec. 34. NEW SECTION . 256J.5 State funding allocation —— 27 expenditure limitation. 28 1. State funding. 29 a. Allocation formula. For each fiscal year in which 30 moneys are appropriated by the general assembly for purposes 31 of the preschool program for four-year-old children, preschool 32 scholarship funding shall be allocated to approved school 33 districts on a per pupil basis calculated on the proportion 34 that the number of the approved school district’s first grade 35 -33- HF 645 (7) 84 kh/tm/mb 33/ 51
H.F. 645 children who are eligible for free or reduced price meals under 1 the federal Healthy, Hungry-Free Kids Act of 2010, Pub. L. No. 2 111-296, multiplied by the average of the previous three years 3 of certified kindergarten enrollment, bears to the sum of the 4 number of first grade children in all approved school districts 5 who are eligible for free or reduced price meals under the 6 federal Healthy, Hungry-Free Kids Act of 2010, Pub. L. No. 7 111-296, multiplied by the average of the previous three years 8 of certified kindergarten enrollment in all approved school 9 districts in the state for the base year. 10 b. Redistribution of state funding. Based on the October 11 1 certified preschool enrollment count determined pursuant to 12 section 256J.4, subsection 2, the department shall evaluate 13 the needs of approved school districts and approved private 14 education partners and shall take action to redistribute unused 15 state funding as appropriate. 16 c. Limited purpose. State funds provided for purposes 17 of this chapter shall not be expended for any purpose not 18 expressly authorized in this chapter or in administrative rules 19 adopted to administer this chapter. 20 2. Program sites —— conditional allocation. A school 21 district shall not receive preschool scholarship funding 22 without school district or private education partner preschool 23 program sites. 24 3. Program continuation subject to approval. For subsequent 25 budget years, continuation of a school district’s participation 26 in the preschool program is subject to the approval of the 27 department based upon the school district’s compliance with 28 accountability provisions and the department’s on-site review 29 of the school district’s implementation of the preschool 30 program. 31 4. Insufficient funding. If the amount appropriated 32 annually for purposes of this section is not sufficient to 33 pay the total allocation to approved school districts, the 34 allocation shall be based on the proportion that the total 35 -34- HF 645 (7) 84 kh/tm/mb 34/ 51
H.F. 645 allocation for each approved school district bears to the sum 1 of the total allocations to all approved school districts. 2 5. Payments to private education partners. Reimbursements 3 shall be provided to private education partners by approved 4 school districts on a monthly basis, beginning with the month 5 in which the school district receives payment under subsection 6 1, paragraph “a” , and ending in July, upon submission and 7 verification of actual instructional costs incurred in the 8 school year. 9 6. Department administration and oversight. Except as 10 otherwise provided by law for a fiscal year, of the amount 11 appropriated by the general assembly for a fiscal year for 12 purposes of this chapter, the department may use an amount 13 sufficient to fund up to four full-time equivalent positions 14 which shall be in addition to the number of positions 15 authorized for the department for the fiscal year to provide 16 administration and oversight of the preschool program. 17 Oversight shall include but not be limited to data collection 18 requirements, maintenance of website listings of school 19 district and private education partners providing high-quality 20 preschool programs, and assessment results. 21 7. Open enrollment not applicable. Section 282.18 shall not 22 apply to preschool programs implemented under this chapter. 23 However, approved programs shall be open to all eligible Iowa 24 children, regardless of a child’s district of residence. 25 8. Participation in preschool not good cause. Participation 26 by a child in an approved preschool program under this chapter 27 does not qualify as “good cause” , as defined in section 28 282.18, subsection 4, paragraph “b” , for purposes of claiming 29 continuous enrollment in a school district other than the 30 district of residence. 31 Sec. 35. Section 272.2, Code 2011, is amended by adding the 32 following new subsection: 33 NEW SUBSECTION . 19. Adopt rules establishing an early 34 childhood certificate of eligibility for individuals who meet 35 -35- HF 645 (7) 84 kh/tm/mb 35/ 51
H.F. 645 the requirements of section 256J.3, subsection 2, paragraph 1 “a” , subparagraph (2), for preschool teachers. The rules for 2 obtaining such a certificate shall require that an applicant 3 successfully complete twelve hours of coursework from an 4 accredited institution of higher education in early childhood 5 education, child development, elementary education, or 6 early childhood special education, and this coursework shall 7 encompass child development and learning of children from birth 8 through kindergarten; family and community relationships; 9 observing, documenting, and assessing young children; teaching 10 and learning; and professional practices and development. 11 DIVISION IV 12 FY 2012-2013 13 DEPARTMENT FOR THE BLIND 14 Sec. 36. The early childhood Iowa state board shall direct 11 staff to work with the early childhood stakeholders alliance 12 created in section 256I.12 to inventory technical assistance 13 needs. Moneys allocated under this lettered paragraph may be 14 used by the early childhood Iowa state board for the purpose of 15 skills development and support for ongoing training of staff. 16 However, except as otherwise provided in this subsection, 17 moneys shall not be used for additional staff or for the 18 reimbursement of staff. 19 b. As a condition of receiving moneys appropriated in 20 this subsection, each early childhood Iowa area board shall 21 report to the early childhood Iowa state board progress on 22 each of the local indicators approved by the area board. Each 23 early childhood Iowa area board must also submit an annual 24 budget for the area’s comprehensive school ready children 25 grant developed for providing services for children from birth 26 through five years of age, and provide other information 27 specified by the early childhood Iowa state board, including 28 budget amendments as needed. The early childhood Iowa state 29 board shall establish a submission deadline for the annual 30 budget and any budget amendments that allow a reasonable period 31 of time for preparation by the early childhood Iowa area boards 32 and for review and approval or request for modification of 33 the materials by the early childhood Iowa state board. In 34 addition, each early childhood Iowa area board must continue to 35 -41- HF 645 (7) 84 kh/tm/mb 41/ 51
H.F. 645 comply with reporting provisions and other requirements adopted 1 by the early childhood Iowa state board in implementing section 2 256I.9. 3 c. Of the amount appropriated in this subsection for 4 deposit in the school ready children grants account of the 5 early childhood Iowa fund, $2,318,018 shall be used for efforts 6 to improve the quality of early care, health, and education 7 programs. Moneys allocated pursuant to this paragraph may be 8 used for additional staff and for the reimbursement of staff. 9 The early childhood Iowa state board may reserve a portion 10 of the allocation, not to exceed $88,650, for the technical 11 assistance expenses of the early childhood Iowa state office, 12 including the reimbursement of staff, and shall distribute 13 the remainder to early childhood Iowa areas for local quality 14 improvement efforts through a methodology identified by the 15 early childhood Iowa state board to make the most productive 16 use of the funding, which may include use of the distribution 17 formula, grants, or other means. 18 d. Of the amount appropriated in this subsection for 19 deposit in the school ready children grants account of 20 the early childhood Iowa fund, $825,030 shall be used for 21 support of professional development and training activities 22 for persons working in early care, health, and education by 23 the early childhood Iowa state board in collaboration with 24 the professional development component group of the early 25 childhood Iowa stakeholders alliance maintained pursuant to 26 section 256I.12, subsection 7, paragraph “b”, and the early 27 childhood Iowa area boards. Expenditures shall be limited to 28 professional development and training activities agreed upon by 29 the parties participating in the collaboration. 30 11. EARLY CHILDHOOD IOWA FUND —— PRESCHOOL TUITION 31 ASSISTANCE 32 a. For 3 the fiscal year beginning July 1, 2012, and ending June 30, 4 2013, the state board of regents may use notes, bonds, or 5 other evidences of indebtedness issued under section 262.48 to 6 finance projects that will result in energy cost savings in an 7 amount that will cause the state board to recover the cost of 8 the projects within an average of six years. 9 Sec. 44. PRESCRIPTION DRUG COSTS. Notwithstanding section 10 270.7, the department of administrative services shall pay 11 the state school for the deaf and the Iowa braille and sight 12 saving school the moneys collected from the counties during the 13 fiscal year beginning July 1, 2012, for expenses relating to 14 prescription drug costs for students attending the state school 15 for the deaf and the Iowa braille and sight saving school. 16 Sec. 45. EFFECTIVE UPON ENACTMENT. The section of this 17 Act transferring moneys appropriated pursuant to 2010 Iowa 18 Acts, chapter 1183, section 6, subsection 18, being deemed of 19 immediate importance, takes effect upon enactment. 20 Sec. 46.
