  1  1    Section 1.  Section 462A.14, subsection 1, unnumbered
  1  2 paragraph 1, Code 2009, is amended to read as follows:
  1  3    A person commits the offense of operating a motorboat or
  1  4 sailboat while intoxicated if the person operates a motorboat
  1  5 or sailboat on the navigable waters of this state under the
  1  6 jurisdiction of the commission in any of the following
  1  7 conditions:
  1  8    Sec. 2.  Section 462A.14, subsection 1, paragraph b, Code
  1  9 2009, is amended to read as follows:
  1 10    b.  While having an alcohol concentration of .10 .08 or
  1 11 more.
