S.F. 2274 Section 1. Section 260C.14, subsection 14, paragraph b, 1 subparagraph (2), subparagraph division (b), Code Supplement 2 2009, is amended to read as follows: 3 (b) “Qualified military person” means a person on active 4 duty in the military service of the United States who is 5 stationed in this state or at the Rock Island arsenal. If 6 the qualified military person is transferred, deployed, or 7 restationed while the person’s spouse or dependent child 8 is enrolled in the community college, the spouse or 9 dependent child shall continue to be classified as a resident 10 until the close of the fiscal year in which provided the spouse 11 or dependent child is enrolled maintains continuous enrollment . 12 Sec. 2. Section 260C.14, subsection 14, paragraph b, 13 subparagraph (2), subparagraph division (c), subparagraph 14 subdivision (ii), Code Supplement 2009, is amended to read as 15 follows: 16 (ii) Is domiciled Has resided in this state at least one 17 year or sufficient time to have filed an Iowa tax return in the 18 preceding twelve months . 19 Sec. 3. Section 260C.14, subsection 20, unnumbered 20 paragraph 1, Code Supplement 2009, is amended to read as 21 follows: 22 Adopt a policy to offer not less than the following options 23 to a student who is a member , or the spouse of a member if 24 the member has a dependent child as defined in subsection 14, 25 paragraph “b” , subparagraph (2), subparagraph division (a), of 26 the Iowa national guard or reserve forces of the United States 27 and who is ordered to state military service or federal service 28 or duty: 29 Sec. 4. Section 261.9, subsection 1, paragraph g, Code 2009, 30 is amended to read as follows: 31 g. (1) Adopts a policy to offer not less than the following 32 options to a student who is a member , or the spouse of a member 33 if the member has a dependent child, of the Iowa national guard 34 or reserve forces of the United States and who is ordered to 35 -1- SF 2274 (5) 83 kh/sc/jh 1/ 4
S.F. 2274 state military service or federal service or duty: 1 (1) (a) Withdraw from the student’s entire registration and 2 receive a full refund of tuition and mandatory fees. 3 (2) (b) Make arrangements with the student’s instructors 4 for course grades, or for incompletes that shall be completed 5 by the student at a later date. If such arrangements are made, 6 the student’s registration shall remain intact and tuition and 7 mandatory fees shall be assessed for the courses in full. 8 (3) (c) Make arrangements with only some of the student’s 9 instructors for grades, or for incompletes that shall be 10 completed by the student at a later date. If such arrangements 11 are made, the registration for those courses shall remain 12 intact and tuition and mandatory fees shall be assessed for 13 those courses. Any course for which arrangements cannot be 14 made for grades or incompletes shall be considered dropped and 15 the tuition and mandatory fees for the course refunded. 16 (2) As used in this lettered paragraph, “dependent 17 child” means the same as defined in section 260C.14, subsection 18 14, paragraph “b” , subparagraph (2), subparagraph division (a). 19 Sec. 5. Section 262.9, subsection 17, paragraph b, 20 subparagraph (2), subparagraph division (b), Code Supplement 21 2009, is amended to read as follows: 22 (b) “Qualified military person” means a person on active 23 duty in the military service of the United States who is 24 stationed in this state or at the Rock Island arsenal. If 25 the qualified military person is transferred, deployed, or 26 restationed while the person’s spouse or dependent child is 27 enrolled in an institution of higher education under the 28 control of the board, the spouse or dependent child shall 29 continue to be classified as a resident until the close of the 30 fiscal year in which provided the spouse or dependent child is 31 enrolled maintains continuous enrollment . 32 Sec. 6. Section 262.9, subsection 17, paragraph b, 33 subparagraph (2), subparagraph division (c), subparagraph 34 subdivision (ii), Code Supplement 2009, is amended to read as 35 -2- SF 2274 (5) 83 kh/sc/jh 2/ 4
S.F. 2274 follows: 1 (ii) Is domiciled Has resided in this state at least one 2 year or sufficient time to have filed an Iowa tax return in the 3 preceding twelve months . 4 Sec. 7. Section 262.9, subsection 30, unnumbered paragraph 5 1, Code Supplement 2009, is amended to read as follows: 6 Direct the institutions of higher education under its 7 control to adopt a policy to offer not less than the following 8 options to a student who is a member , or the spouse of a member 9 if the member has a dependent child as defined in subsection 10 17, paragraph “b” , subparagraph (2), subparagraph division 11 (a), of the Iowa national guard or reserve forces of the United 12 States and who is ordered to state military service or federal 13 service or duty: 14 Sec. 8. Section 272.8, Code 2009, is amended to read as 15 follows: 16 272.8 License to applicants from other states or countries. 17 1. The board may issue a license to an applicant from 18 another state or country if the applicant files evidence of the 19 possession of the required or equivalent requirements with the 20 board. If the applicant is the spouse of a military person who 21 is on duty or in active state duty as defined in section 29A.1, 22 subsections 9 and 11, the board shall assign a consultant to 23 be the single point of contact for the applicant regarding 24 nontraditional licensure. 25 2. The executive director of the board may, subject to board 26 approval, enter into reciprocity agreements with another state 27 or country for the licensing of practitioners on an equitable 28 basis of mutual exchange, when the action is in conformity with 29 law. 30 3. Practitioner preparation and professional development 31 programs offered in this state by out-of-state institutions 32 must be approved by the board in order to fulfill requirements 33 for licensure or renewal of a license by an applicant. 34 Sec. 9. NATIONAL SECURITY EDUCATION PROGRAM WORKING 35 -3- SF 2274 (5) 83 kh/sc/jh 3/ 4

The department of education, in collaboration with the 1 state board of regents, shall convene a working group that 2 includes but is not limited to representatives of the business 3 community of this state, to explore the possibility of securing 4 the cooperation and assistance of the United States department 5 of defense, the national defense university, and the national 6 security education board to participate in the federal national 7 security education program and establish a foreign language 8 road map, flagship program, and timeline in this state for K-16 9 and graduate-level students. The working group also shall 10 study the feasibility, including but not limited to the costs, 11 of establishing the road map, program, and timeline, and shall 12 submit a report of its findings and recommendations to the 13 general assembly by January 15, 2011. 14 Sec. 10. DEPARTMENT OF VETERANS AFFAIRS —— VETERANS AND 15 DEPENDENT CHILDREN POSTSECONDARY UNDERGRADUATE EDUCATION 16 BENEFITS STUDY. The department of veterans affairs shall 17 conduct a study, in collaboration with the state board of 18 regents and the department of education and other postsecondary 19 stakeholders as determined by the department of veterans 20 affairs, of the need to provide greater postsecondary 21 undergraduate education benefits for veterans and their 22 dependents, including but not limited to dependent children of 23 service-connected disabled veterans. The study shall include 24 a review of current federal education benefits for veterans 25 and their dependents, cost and participation estimates, and a 26 review of educational benefits currently provided to veterans 27 and their dependents by other states throughout the country. 28 The department of veterans affairs shall submit its findings 29 and recommendations in a report to the general assembly by 30 December 31, 2010. 31 -4- SF 2274 (5) 83 kh/sc/jh 4/ 4
