  1  1           DIVISION I REBUILD IOWA INFRASTRUCTURE FUND
  1  2    Section 1.  There is appropriated from the rebuild Iowa
  1  3 infrastructure fund to the following departments and agencies
  1  4 for the fiscal year beginning July 1, 2009, and ending June
  1  5 30, 2010, the following amounts, or so much thereof as is
  1  6 necessary, to be used for the purposes designated:
  1  7    1.  DEPARTMENT OF ADMINISTRATIVE SERVICES
  1  8    a.  For distribution to other governmental entities for the
  1  9 payment of services related to the integrated information for
  1 10 Iowa system, notwithstanding section 8.57, subsection 6,
  1 11 paragraph "c":
  1 12 .................................................. $  3,700,000
  1 13    Moneys appropriated in this lettered paragraph shall be
  1 14 separately accounted for in a distribution account and shall
  1 15 be distributed to other governmental entities based upon a
  1 16 formula established by the department to pay for services
  1 17 provided during the fiscal year to such other governmental
  1 18 entities by the department associated with the integrated
  1 19 information for Iowa system.
  1 20    During the fiscal year, the department may use up to
  1 21 $1,000,000 of unexpended or unobligated funds in the
  1 22 information technology operations fund established under the
  1 23 provisions of section 8A.123 to provide funding for costs
  1 24 associated with the integrated information for Iowa system.
  1 25 By October 31, 2010, the department shall report to the
  1 26 department of management and the legislative services agency
  1 27 regarding any moneys that are used for this purpose.
  1 28    b.  For routine maintenance of state buildings and
  1 29 facilities, notwithstanding section 8.57, subsection 6,
  1 30 paragraph "c":
  1 31 .................................................. $  3,000,000
  1 32    c.  For costs associated with improvements to and
  1 33 renovation of the Wallace building for extending the useful
  1 34 life of the building:
  1 35 .................................................. $  1,500,000
  2  1    d.  For upgrades to the electrical distribution system

  2  4    e.  For costs associated with capitol interior and exterior
  2  5 restoration and for compliance with the federal Americans With

  2  9 improvements in the Hoover state office building:

  2 14    h.  For costs associated with Mercy capitol hospital
  2 15 building operations upon acquisition of the hospital,
  2 16 notwithstanding section 8.57, subsection 6, paragraph "c":

  2 18    i.  For costs associated with the restoration and
  2 19 renovation, including major repairs and major maintenance, at
  2 20 the governor's mansion at Terrace Hill:

  2 22    2.  DEPARTMENT OF CORRECTIONS
  2 23    For project management costs at Fort Madison and
  2 24 Mitchellville prison, associated with construction projects at
  2 25 the department, notwithstanding section 8.57, subsection 6,
  2 26 paragraph "c":
  2 27 .................................................. $  1,750,000
  2 28    3.  DEPARTMENT OF CULTURAL AFFAIRS
  2 29    a.  For deposit into the Iowa great places program fund
  2 30 created in section 303.3D for Iowa great places program
  2 31 projects that meet the definition of the term "vertical
  2 32 infrastructure" in section 8.57, subsection 6, paragraph "c":
  2 33 .................................................. $  1,900,000
  2 34    b.  For costs relating to a traveling exhibit and museum
  2 35 exhibit of the sesquicentennial of the American civil war
  3  1 including but not limited to restoration and duplication of
  3  2 muster records, publishing and publication costs, relocation
  3  3 of battle flag laboratory to a public viewing area including
  3  4 educational and program costs, notwithstanding section 8.57,
  3  5 subsection 6, paragraph "c":
  3  6 .................................................. $    350,000
  3  7    c.  For grants for a cultural community grant program,
  3  8 notwithstanding section 8.57, subsection 6, paragraph "c":
  3  9 .................................................. $    200,000
  3 10    The department shall establish a cultural community grant
  3 11 program to provide grants for a cultural and educational
  3 12 center to showcase an immigrant community from Laos and
  3 13 Vietnam and their cultures.  The department shall distribute
  3 14 the grants on a competitive basis to communities with an
  3 15 approved plan for the establishment of the cultural center.
  3 16 Applications must be submitted to the department no later than
  3 17 July 15, 2009.
  3 18    d.  For historical site preservation grants to be used for
  3 19 the restoration, preservation, and development of historic
  3 20 sites:
  3 21 .................................................. $  1,000,000
  3 22    In making grants pursuant to this lettered paragraph, the
  3 23 department shall consider the existence and amount of other
  3 24 funds available to an applicant for the designated project.  A
  3 25 grant awarded from moneys appropriated in this lettered
  3 26 paragraph shall not exceed $100,000 per project.  Not more
  3 27 than $200,000 may be awarded in the same county in the same
  3 28 round of grant reviews.
  3 29    4.  DEPARTMENT OF ECONOMIC DEVELOPMENT
  3 30    a.  For equal distribution to regional sports authority
  3 31 districts certified by the department pursuant to section
  3 32 15E.321, notwithstanding section 8.57, subsection 6, paragraph
  3 33 "c":
  3 34 .................................................. $    500,000
  3 35    b.  For deposit into the workforce training and economic
  4  1 development funds for each community college in section
  4  2 260C.18A, notwithstanding section 8.57, subsection 6,
  4  3 paragraph "c":
  4  4 .................................................. $  2,000,000
  4  5    Moneys from this lettered paragraph may be used to provide
  4  6 job training services to underserved populations in Iowa.
  4  7 "Underserved populations" include people making less than
  4  8 twenty thousand dollars annual net income, minorities, women,
  4  9 disabled persons, the elderly, and people convicted of
  4 10 felonies trying to reenter society after release from prison.
  4 11    c.  For a city with a population between seven hundred
  4 12 fifty and eight hundred fifty within a county with a
  4 13 population of between six thousand seven hundred and six
  4 14 thousand eight hundred as determined by the 2000 certified
  4 15 federal census for demolition costs for a building asbestos
  4 16 abatement:
  4 17 .................................................. $     50,000
  4 18    d.  For costs associated with the hosting of a national
  4 19 junior summer olympics by a nonprofit sports organization,
  4 20 notwithstanding section 8.57, subsection 6, paragraph "c":
  4 21 .................................................. $    200,000
  4 22    e.  For the renovation of a building for the relocation of
  4 23 a juvenile courthouse in a county with a population between
  4 24 thirty=nine thousand and forty=one thousand as determined by
  4 25 the 2000 certified federal census:
  4 26 .................................................. $    100,000
  4 27    f.  For fire station improvements in a city with a
  4 28 population between twenty=one thousand and twenty=three
  4 29 thousand as determined by the 2000 certified federal census:

  4 31    g.  For a community center that hosts congregate meals in a
  4 32 city with a population between seven hundred forty=six and
  4 33 seven hundred fifty=six as determined by the 2000 certified
  4 34 federal census for compliance with the federal Americans With
  4 35 Disabilities Act:

  5  2    5.  DEPARTMENT OF EDUCATION
  5  3    To provide resources for structural and technological
  5  4 improvements to local libraries and for the enrich Iowa
  5  5 program, notwithstanding section 8.57, subsection 6, paragraph
  5  6 "c":
  5  7 .................................................. $  1,000,000
  5  8    Of the moneys appropriated in this subsection, $50,000
  5  9 shall be allocated equally to each library service area.
  5 10    6.  DEPARTMENT OF HUMAN SERVICES
  5 11    For a mental health systems community development building
  5 12 safety improvements including electrical wiring and emergency
  5 13 systems in a city with a population between five thousand
  5 14 fifty and six thousand fifty as determined by the 2000
  5 15 certified federal census:
  5 16 .................................................. $    200,000
  5 17    7.  DEPARTMENT OF NATURAL RESOURCES
  5 18    a.  For implementation of lake projects that have
  5 19 established watershed improvement initiatives and community
  5 20 support in accordance with the department's annual lake
  5 21 restoration plan and report, notwithstanding section 8.57,
  5 22 subsection 6, paragraph "c":
  5 23 .................................................. $ 2,800,000
  5 24    It is the intent of the general assembly that the
  5 25 department of natural resources shall implement the lake
  5 26 restoration annual report and plan submitted to the joint
  5 27 appropriations subcommittee on transportation, infrastructure,
  5 28 and capitals and the legislative services agency pursuant to
  5 29 section 456A.33B.  The lake restoration projects that are
  5 30 recommended by the department to receive funding for fiscal
  5 31 year 2007=2008 and that satisfy the criteria in section
  5 32 456A.33B, including local commitment of funding for the
  5 33 projects, shall be funded in the amounts provided in the
  5 34 report.
  5 35    b.  For floodplain management and dam safety,
  6  1 notwithstanding section 8.57, subsection 6, paragraph "c":
  6  2 .................................................. $  2,000,000
  6  3    Of the amounts appropriated in this lettered paragraph, up
  6  4 to $400,000 is authorized for stream gages to be used for
  6  5 tracking and predicting flood events and for compiling
  6  6 necessary data relating to flood frequency analysis.
  6  7    Of the number of full=time equivalent positions authorized
  6  8 to the department for FY 2009=2010 pursuant to 2009 Iowa Acts,
  6  9 Senate File 467, if enacted, up to 21.00 full=time equivalent
  6 10 positions shall be allocated for the floodplain management and
  6 11 dam safety program.
  6 12    c.  For deposit in the loess hills development and
  6 13 conservation fund created in section 161D.2 for allocation to
  6 14 the fund's hungry canyons account for purposes of streambed
  6 15 erosion and degradation to the loess hills area,
  6 16 notwithstanding section 8.57, subsection 6, paragraph "c":
  6 17 .................................................. $    100,000
  6 18    d.  For the administration of a water trails and low head
  6 19 dam public hazard statewide plan, including salaries, support,
  6 20 maintenance, and miscellaneous purposes, notwithstanding

  6 23    8.  DEPARTMENT OF PUBLIC DEFENSE
  6 24    a.  For major maintenance projects at national guard
  6 25 armories and facilities:

  6 28 aviation readiness center:
  6 29 .................................................. $  2,000,000
  6 30    c.  For construction and renovation costs at the Mt.

  6 33    9.  DEPARTMENT OF PUBLIC HEALTH
  6 34    For a grant to an existing national affiliated volunteer
  6 35 eye organization that has an established program for children
  7  1 and adults and that is solely dedicated to preserving sight
  7  2 and preventing blindness through education, nationally
  7  3 certified vision screening and training, community and patient
  7  4 service programs, notwithstanding section 8.57, subsection 6,
  7  5 paragraph "c":
  7  6 .................................................. $    130,000
  7  7    10.  STATE BOARD OF REGENTS
  7  8    For the establishment and administration of an Iowa flood
  7  9 center at the state university of Iowa for use by the
  7 10 university's college of engineering, pursuant to section
  7 11 466C.1, as enacted in this Act, notwithstanding section 8.57,
  7 12 subsection 6, paragraph "c":
  7 13 .................................................. $  1,300,000
  7 14    11.  IOWA STATE FAIR
  7 15    For infrastructure improvements to the Iowa state
  7 16 fairgrounds including but not limited to the construction of
  7 17 an agricultural exhibition center on the Iowa state
  7 18 fairgrounds:
  7 19 .................................................. $  5,500,000
  7 20    12.  DEPARTMENT OF TRANSPORTATION
  7 21    a.  To provide funds for capital improvements and for
  7 22 related studies for expanding passenger rail services in Iowa,
  7 23 notwithstanding section 8.57, subsection 6, paragraph "c":
  7 24 .................................................. $  3,000,000
  7 25    b.  For acquiring, constructing, and improving recreational
  7 26 trails within the state:
  7 27 .................................................. $  3,500,000
  7 28    Moneys appropriated in this lettered paragraph may be used
  7 29 for purposes of building equestrian or snowmobile trails that
  7 30 run parallel to a recreational trail.  It is the intent of the
  7 31 general assembly to promote multiple uses for trails funding
  7 32 in this lettered paragraph and to maximize the number of trail
  7 33 users.
  7 34    Of the amounts appropriated in this lettered paragraph,
  7 35 $750,000 shall be allocated for the development of a riverwalk
  8  1 in a central Iowa city with a population between one hundred
  8  2 ninety=five thousand and two hundred thousand as determined by
  8  3 the 2000 federal census and $500,000 shall be allocated for
  8  4 the construction and development of a trail bridge across a
  8  5 river located in northeastern Iowa that would link the east
  8  6 and west sides of the Pinicon ridge park.
  8  7    c.  For deposit into the railroad revolving loan and grant
  8  8 fund created in section 327H.20A, notwithstanding section
  8  9 8.57, subsection 6, paragraph "c":
  8 10 .................................................. $  1,500,000
  8 11    d.  For infrastructure improvement grants at general
  8 12 aviation airports within the state:
  8 13 .................................................. $    750,000
  8 14    e. For deposit into the public transit
  8 15 infrastructure grant fund created in section 324A.6A:
  8 16 .................................................. $  1,250,000
  8 17    f.  For a discretionary grant program to assist local
  8 18 governments to rebuild and repair local roads, notwithstanding
  8 19 section 8.57, subsection 6, paragraph "c":
  8 20 .................................................. $ 14,750,000
  8 21    The department shall allocate the amount appropriated in
  8 22 this lettered paragraph as follows:  50 percent shall be
  8 23 allocated to the street construction fund of the cities and 50
  8 24 percent shall be allocated to the secondary road fund of the
  8 25 counties, to be used for construction, reconstruction, repair,
  8 26 and maintenance of city roads or secondary roads.  The moneys
  8 27 allocated to such funds shall be expended within two years.
  8 28 Any allocated moneys not expended within two years shall be
  8 29 reallocated by the state transportation commission to other
  8 30 projects.  The department shall, in cooperation with the
  8 31 cities and counties, provide a report to the legislative
  8 32 services agency regarding the projects funded by this
  8 33 appropriation by January 15 each year until the projects are
  8 34 completed.
  8 35    13.  TREASURER OF STATE
  9  1    a.  For county fair infrastructure improvements for
  9  2 distribution in accordance with chapter 174 to qualified fairs
  9  3 which belong to the association of Iowa fairs:
  9  4 .................................................. $  1,590,000
  9  5    b.  For deposit in the watershed improvement fund created
  9  6 in section 466A.2, notwithstanding section 8.57, subsection 6,
  9  7 paragraph "c":
  9  8 .................................................. $  5,000,000
  9  9    14.  DEPARTMENT OF VETERANS AFFAIRS
  9 10    For transfer to the Iowa finance authority for the
  9 11 continuation of the home ownership assistance program for
  9 12 persons who are or were eligible members of the armed forces
  9 13 of the United States, pursuant to section 16.54,
  9 14 notwithstanding section 8.57, subsection 6, paragraph "c":
  9 15 .................................................. $  1,600,000
  9 16    Of the funds transferred pursuant to this subsection, the
  9 17 Iowa finance authority may retain not more than $20,000 for
  9 18 administrative purposes.
  9 19    Sec. 2.  There is appropriated from the rebuild Iowa
  9 20 infrastructure fund to the following departments and agencies
  9 21 for the fiscal year beginning July 1, 2010, and ending June
  9 22 30, 2011, the following amounts, or so much thereof as is
  9 23 necessary, to be used for the purposes designated:
  9 24    1.  DEPARTMENT OF ADMINISTRATIVE SERVICES
  9 25    For projects related to major repairs and major maintenance
  9 26 for state buildings and facilities under the purview of the
  9 27 department:
  9 28 .................................................. $ 10,000,000
  9 29    Of the amount appropriated in this subsection, up to
  9 30 $1,000,000 may be used for demolition purposes.
  9 31    2.  DEPARTMENT OF CORRECTIONS
  9 32    For expansion, including land acquisition, of the
  9 33 community=based corrections facility at Des Moines:
  9 34 .................................................. $  5,000,000
  9 35    The appropriation in this subsection is contingent upon
 10  1 relocation of the sex offender treatment program from the
 10  2 community=based corrections facility at Des Moines to the
 10  3 property in northeast Des Moines identified by the fifth
 10  4 judicial district in the facility and site study final report
 10  5 submitted December 12, 2008.
 10  6    3.  DEPARTMENT OF ECONOMIC DEVELOPMENT
 10  7    For costs associated with the renovation and expansion of
 10  8 phase II of a zoo project located in a city with a population
 10  9 of between one hundred ninety thousand and two hundred
 10 10 thousand as determined by the 2000 certified federal census:
 10 11 .................................................. $    500,000
 10 12    4.  STATE BOARD OF REGENTS
 10 13    For phase II of the construction and renovation of the
 10 14 veterinary medical facilities at Iowa state university of
 10 15 science and technology, specifically the renovation and
 10 16 modernization of the area formerly occupied by the large
 10 17 animal area of the teaching hospital for expanded clinical
 10 18 services in a small animal hospital:
 10 19 .................................................. $ 13,000,000
 10 20    5.  IOWA STATE FAIR
 10 21    For infrastructure improvements to the Iowa state
 10 22 fairgrounds including but not limited to the construction of
 10 23 an agricultural exhibition center on the Iowa state
 10 24 fairgrounds:
 10 25 .................................................. $  2,500,000
 10 26    6.  DEPARTMENT OF TRANSPORTATION
 10 27    a.  For deposit into the railroad revolving loan and grant
 10 28 fund created in section 327H.20A, notwithstanding section
 10 29 8.57, subsection 6, paragraph "c":
 10 30 .................................................. $  2,000,000
 10 31    b.  For a discretionary grant program to assist
 10 32 local governments to rebuild and repair local roads,
 10 33 notwithstanding section 8.57, subsection 6, paragraph

 11  1    The department shall allocate the amount appropriated in
 11  2 this lettered paragraph as follows:  50 percent shall be

 11 19 necessary, to be used for the purposes designated:
 11 20    For deposit into the railroad revolving loan and grant fund
 11 21 created in section 327H.20A, notwithstanding section 8.57,
 11 22 subsection 6, paragraph "c":
 11 23 .................................................. $  2,000,000
 11 24    Sec. 4.  REVERSION.  For purposes of section 8.33, unless
 11 25 specifically provided otherwise, unencumbered or unobligated
 11 26 moneys made from an appropriation in this division of this Act
 11 27 shall not revert but shall remain available for expenditure
 11 28 for the purposes designated until the close of the fiscal year
 11 29 that ends three years after the end of the fiscal year for
 11 30 which the appropriation was made.  However, if the project or
 11 31 projects for which such appropriation was made are completed
 11 32 in an earlier fiscal year, unencumbered or unobligated moneys
 11 33 shall revert at the close of that same fiscal year.
 11 34                           DIVISION II
 11 35            REBUILD IOWA INFRASTRUCTURE FUND == GROW
 12  1                        IOWA VALUES FUND
 12  2    Notwithstanding the amount of the standing appropriation
 12  3 from the rebuild Iowa infrastructure fund as provided in
 12  4 section 15G.110, subsection 2, there is appropriated from the
 12  5 rebuild Iowa infrastructure fund to the department of economic
 12  6 development for deposit into the grow Iowa values fund, in
 12  7 lieu of the appropriation made in section 15G.110, subsection
 12  8 2, for the fiscal year beginning July 1, 2009, and ending June
 12  9 30, 2010, the following amount, notwithstanding section 8.57,
 12 10 subsection 6, paragraph "c":
 12 11 .................................................. $ 45,000,000
 12 12    Sec. 5.  2009 Iowa Acts, House File 817, section 2, if
 12 13 enacted is amended to read as follows:
 12 14    SEC. 2.  GROW IOWA VALUES FUND APPROPRIATION == TRANSFER.
 12 15    1.  In lieu of any standing appropriation in section
 12 16 15G.111 from the grow Iowa values fund to the department of
 12 17 economic development, for the fiscal year beginning July 1,
 12 18 2009, there is appropriated from the grow Iowa values fund to
 12 19 the department of economic development for purposes of
 12 20 administering financial assistance programs:
 12 21 .................................................. $ 31,000,000
 12 22    Of the amount allocated for departmental purposes in
 12 23 section 15G.111, subsection 4, if enacted by 2009 Iowa Acts,
 12 24 Senate File 344, section 2, the department of economic
 12 25 development shall allocate one million dollars for transfer to
 12 26 the general fund of the state for purposes of funding the
 12 27 increased amount of tax credits authorized in this Act.  The
 12 28 amount remaining after allocating the one million dollars for
 12 29 transfer shall be allocated for departmental purposes as
 12 30 described in section 15G.111, subsection 4, if enacted by 2009
 12 31 Iowa Acts, Senate File 344, section 2.
 12 32    2.  For the fiscal year beginning July 1, 2009, and ending
 12 33 June 30, 2010, the one million dollars allocated for transfer
 12 34 pursuant to subsection 1 is transferred from the grow Iowa
 12 35 values fund to the general fund of the state only if a tax
 13  1 credit is awarded pursuant to section 15.335, as amended by
 13  2 this Act.  If one or more tax credits are not awarded, the
 13  3 department may reallocate the one million dollars for
 13  4 departmental purposes.
 13  5    Sec. 6.  REDUCTION OF THE GROW IOWA VALUES FUND
 13  6 APPROPRIATION TO THE DEPARTMENT OF ECONOMIC DEVELOPMENT.  In
 13  7 lieu of the fifty million dollars appropriated for the fiscal
 13  8 year beginning July 1, 2009, and ending June 30, 2010, from
 13  9 the grow Iowa values fund to the department of economic
 13 10 development pursuant to section 15G.111, subsection 3, if
 13 11 enacted by 2009 Iowa Acts, Senate File 344, section 2, there
 13 12 is appropriated from the grow Iowa values fund to the
 13 13 department of economic development for the fiscal year
 13 14 beginning July 1, 2009, and ending June 30, 2010, forty=five
 13 15 million dollars for purposes of making expenditures pursuant
 13 16 to chapter 15G.
 13 17    Sec. 7.  GROW IOWA VALUES FUND ALLOCATIONS.  In lieu of the
 13 18 amounts allocated pursuant to section 15G.111, subsections 4
 13 19 through 10, if enacted by 2009 Iowa Acts, Senate File 344,
 13 20 section 2, for the fiscal year beginning July 1, 2009, and
 13 21 ending June 30, 2010, of the forty=five million dollars
 13 22 appropriated to the department of economic development
 13 23 pursuant to this division of this Act, the department shall
 13 24 allocate the following amounts for the following purposes as
 13 25 described in section 15G.111, subsections 4 through 10, if
 13 26 enacted by 2009 Iowa Acts, Senate File 344, section 2:
 13 27    1.  For departmental purposes, twenty=eight million eight
 13 28 hundred thousand dollars.  Of the moneys allocated pursuant to
 13 29 this subsection and in lieu of the two million dollars
 13 30 allocated for deposit in the renewable fuel infrastructure
 13 31 fund under section 15G.111, subsection 4, paragraph "h", if
 13 32 enacted by 2009 Iowa Acts, Senate File 344, section 2, the
 13 33 department shall allocate one million eight hundred thousand
 13 34 dollars for deposit in the renewable fuel infrastructure fund.
 13 35    2.  For the state board of regents institutions, four
 14  1 million five hundred thousand dollars.
 14  2    3.  For state parks, nine hundred thousand dollars.
 14  3    4.  For deposit in the Iowa cultural trust fund, nine
 14  4 hundred thousand dollars.
 14  5    5.  For community colleges, six million three hundred
 14  6 thousand dollars.
 14  7    6.  For regional financial assistance, nine hundred
 14  8 thousand dollars.  Of the moneys allocated pursuant to this
 14  9 subsection and in lieu of the three hundred fifty thousand
 14 10 dollars transferred under section 15G.111, subsection 9,
 14 11 paragraph "a", if enacted by 2009 Iowa Acts, Senate File 344,
 14 12 section 2, the department shall transfer three hundred fifteen
 14 13 thousand dollars to Iowa state university of science and
 14 14 technology, for purposes of providing financial assistance to
 14 15 establish small business development centers.
 14 16    7.  For commercialization services, two million seven
 14 17 hundred thousand dollars.
 14 18    Sec. 8.  CONDITIONAL GROW IOWA VALUES FUND APPROPRIATIONS.
 14 19 If 2009 Iowa Acts, Senate File 344 is not enacted, for the
 14 20 fiscal year beginning July 1, 2009 and ending June 30, 2009,
 14 21 the following amounts are appropriated from the grow Iowa
 14 22 values fund in lieu of the amounts appropriated under section
 14 23 15G.111:
 14 24    1.  To the department of economic development for
 14 25 departmental purposes as described in section 15G.111,
 14 26 subsection 1, twenty=eight million eight hundred thousand
 14 27 dollars.
 14 28    2.  To the department of economic development for financial
 14 29 assistance to the state board of regents institutions pursuant
 14 30 to section 15G.111, subsection 2, four million five hundred
 14 31 thousand dollars.
 14 32    3.  To the department of economic development for financial
 14 33 assistance to state parks pursuant to section 15G.111,
 14 34 subsection 3, nine hundred thousand dollars.
 14 35    4.  To the treasurer of state for deposit in the Iowa
 15  1 cultural trust fund pursuant to section 15G.111, subsection 4,
 15  2 nine hundred thousand dollars.
 15  3    5.  To the department of economic development for deposit
 15  4 in the workforce training and economic development funds of
 15  5 the community colleges pursuant to section 15G.111, subsection
 15  6 5, six million three hundred thousand dollars.
 15  7    6.  To the department of economic development for providing
 15  8 economic development region financial assistance pursuant to
 15  9 section 15G.111, subsection 6, nine hundred thousand dollars.
 15 10 Of the moneys appropriated pursuant to this subsection and in
 15 11 lieu of the three hundred fifty thousand dollars transferred
 15 12 under section 15G.111, subsection 6, paragraph "b", the
 15 13 department shall transfer three hundred fifteen thousand
 15 14 dollars to Iowa state university of science and technology,
 15 15 for purposes of providing financial assistance to establish
 15 16 small business development centers.
 15 17    7.  To the department of economic development for providing
 15 18 commercialization services pursuant to section 15G.111,
 15 19 subsection 7, two million seven hundred thousand dollars.

 15 23    Sec. 9.  There is appropriated from the technology
 15 24 reinvestment fund created in section 8.57C to the following

 15 27 much thereof as is necessary, to be used for the purposes
 15 28 designated:

 16 11 in this lettered paragraph for an etranscript data system

 16 15    For costs associated with the justice enterprise data
 16 16 warehouse:

 16 32 pursuant to section 8D.13 for the replacement of equipment and
 16 33 for operations and maintenance costs of the network.

 17  1 entered into by the treasurer of state in accordance with
 17  2 section 12.28 for the replacement of equipment for the
 17  3 network.  For purposes of this lettered paragraph, the
 17  4 treasurer of state is not subject to the maximum principal
 17  5 limitation contained in section 12.28, subsection 6.
 17  6 Repayment of any amounts financed shall be made from receipts
 17  7 associated with fees charged for use of the network.

 17 20 this section to support the statewide improvement of the free
 17 21 and confidential 211 hotline available twenty=four hours a
 17 22 day, seven days a week, that provides information or refers
 17 23 callers to appropriate private or government entities that
 17 24 provide assistance relating to families, housing, food,
 17 25 health, legal advice, child and senior services, or volunteer
 17 26 opportunities.
 17 27    9.  DEPARTMENT OF PUBLIC SAFETY
 17 28    For continuation of payments on the lease=purchase of the
 17 29 automated fingerprint identification system:
 17 30 .................................................. $    350,000
 17 31    Sec. 10.  REVERSION.  For purposes of section 8.33, unless
 17 32 specifically provided otherwise, unencumbered or unobligated
 17 33 moneys made from an appropriation in this division of this Act
 17 34 shall not revert but shall remain available for expenditure
 17 35 for the purposes designated until the close of the fiscal year
 18  1 that ends three years after the end of the fiscal year for
 18  2 which the appropriation was made.  However, if the project or
 18  3 projects for which such appropriation was made are completed
 18  4 in an earlier fiscal year, unencumbered or unobligated moneys
 18  5 shall revert at the close of that same fiscal year.
 18  6                           DIVISION IV
 18  7               TAX=EXEMPT BOND PROCEEDS RESTRICTED
 18  8                      CAPITAL FUNDS ACCOUNT
 18  9    Sec. 11.  There is appropriated from the tax=exempt bond
 18 10 proceeds restricted capital funds account of the tobacco
 18 11 settlement trust fund to the department of administrative
 18 12 services for the fiscal year beginning July 1, 2009, and
 18 13 ending June 30, 2010, the following amount, or so much thereof
 18 14 as is necessary, to be used for the purposes designated:
 18 15    For projects related to major repairs and major maintenance
 18 16 for state buildings and facilities under the purview of the
 18 17 department:
 18 18 .................................................. $    195,484
 18 19    Sec. 12.  TAX=EXEMPT STATUS == USE OF APPROPRIATIONS.
 18 20 Payment of moneys from the appropriations in this division of
 18 21 this Act shall be made in a manner that does not adversely
 18 22 affect the tax=exempt status of any outstanding bonds issued
 18 23 by the tobacco settlement authority.
 18 24                           DIVISION V
 18 25                            TRANSFERS
 18 26    Sec. 13.  ENDOWMENT FOR IOWA'S HEALTH RESTRICTED CAPITALS
 18 27 FUND AND TAX=EXEMPT BOND PROCEEDS RESTRICTED CAPITALS FUND ==
 18 28 TRANSFERS.  Notwithstanding any provision of law to the
 18 29 contrary, the unencumbered or unobligated balances of the
 18 30 endowment for Iowa's health restricted capitals fund at the
 18 31 close of the fiscal year beginning July 1, 2009, and the
 18 32 tax=exempt bond proceeds restricted capitals fund at the close
 18 33 of the fiscal year beginning July 1, 2009, or the close of any
 18 34 succeeding fiscal year, shall be transferred to the department
 18 35 of administrative services for projects related to major
 19  1 repairs and major maintenance for state buildings and
 19  2 facilities under the purview of the department.  Upon receipt
 19  3 of a transfer, the department of administrative services shall
 19  4 report to the legislative services agency and to the
 19  5 department of management the amount transferred in conjunction
 19  6 with the department's report filed pursuant to section 8.57,
 19  7 subsection 6, paragraph "h".
 19  8                           DIVISION VI
 19  9                        IOWA FLOOD CENTER
 19 10    Sec. 14.  NEW SECTION.  466C.1  IOWA FLOOD CENTER.
 19 11    1.  The state board of regents shall establish and maintain
 19 12 in Iowa City as a part of the state university of Iowa an Iowa
 19 13 flood center.  In conducting the activities of this chapter,
 19 14 the center shall work cooperatively with the department of
 19 15 natural resources, the department of agriculture and land
 19 16 stewardship, the water resources coordinating council, and
 19 17 other state and federal agencies.
 19 18    2.  The Iowa flood center shall have all of the following
 19 19 purposes:
 19 20    a.  To develop hydrologic models for physically based flood
 19 21 frequency estimation and real=time forecasting of floods,
 19 22 including hydraulic models of flood plain inundation mapping.
 19 23    b.  To establish community=based programs to improve flood
 19 24 monitoring and prediction along Iowa's major waterways and to
 19 25 support ongoing flood research.
 19 26    c.  To share resources and expertise of the Iowa flood
 19 27 center.
 19 28    d.  To assist in the development of a workforce in the
 19 29 state knowledgeable regarding flood research, prediction, and
 19 30 mitigation strategies.
 19 31                          DIVISION VII
 19 32                 CHANGES TO PRIOR APPROPRIATIONS
 19 33    Sec. 15.  2005 Iowa Acts, chapter 178, section 9, is
 19 34 amended to read as follows:
 19 35    SEC. 9.  REVERSION.
 20  1    1.  Notwithstanding Except as provided in subsection 2 and
 20  2 notwithstanding section 8.33, moneys appropriated from the
 20  3 rebuild Iowa infrastructure fund in this division of this Act,
 20  4 except for the moneys appropriated in section 1, subsection 2,
 20  5 paragraph "a", for maintenance costs of the department of
 20  6 corrections and subsection 5, paragraph "d", for the
 20  7 vocational rehabilitation division of the department of
 20  8 education, shall not revert at the close of the fiscal year
 20  9 for which they were appropriated but shall remain available
 20 10 for the purposes designated until the close of the fiscal year
 20 11 that begins July 1, 2008, or until the project for which the
 20 12 appropriation was made is completed, whichever is earlier.
 20 13 This section does not apply to the sections in this division
 20 14 of this Act that were previously enacted and are amended in
 20 15 this division of this Act.
 20 16    2.  Notwithstanding section 8.33, moneys appropriated in
 20 17 section 3, subsection 1, paragraph "h" of this division of
 20 18 this Act shall not revert at the close of the fiscal year for
 20 19 which they were appropriated but shall remain available for
 20 20 the purpose designated until the close of the fiscal year that
 20 21 begins July 1, 2009, or until the project for which the
 20 22 appropriation was made is completed, whichever is earlier.
 20 23    Sec. 16.  2007 Iowa Acts, chapter 219, section 7,
 20 24 subsection 1, is amended to read as follows:
 20 25    1.  For costs associated with the construction and
 20 26 establishment of the Iowa institute for biomedical discovery
 20 27 at the state university of Iowa:

 20 35 appropriated in this section shall not revert at the close of
 21  1 the fiscal year for which they are appropriated but shall
 21  2 remain available for the purposes designated until the close
 21  3 of the fiscal year that begins July 1, 2009.  The full=time
 21  4 equivalent position authorized in this section shall continue
 21  5 to be authorized until the close of the fiscal year that
 21  6 begins July 1, 2009.
 21  7    Sec. 18.  2008 Iowa Acts, chapter 1178, section 19, is
 21  8 amended to read as follows:
 21  9    SEC. 19.  WATER TRAILS AND LOW HEAD DAM PUBLIC HAZARD
 21 10 STATEWIDE PLAN == APPROPRIATION.  There is appropriated from
 21 11 any interest or earnings on moneys in the federal economic
 21 12 stimulus and jobs holding fund to the department of natural
 21 13 resources for the fiscal year beginning July 1, 2008, and
 21 14 ending June 30, 2009, the following amount, or so much thereof
 21 15 as is necessary, to be used for the purposes designated:
 21 16    For the establishment and administration of a water trails
 21 17 and low head dam public hazard statewide plan, including
 21 18 salaries, support, maintenance, and miscellaneous purposes:
 21 19 .................................................. $    250,000
 21 20    Notwithstanding section 8.33, moneys appropriated in this
 21 21 section shall not revert at the close of the fiscal year for
 21 22 which they are appropriated but shall remain available for the
 21 23 purposes designated until the close of the fiscal year that
 21 24 begins July 1, 2009.
 21 25    Sec. 19.  2008 Iowa Acts, chapter 1179, section 1,
 21 26 subsection 1, paragraph e, is amended to read as follows:
 21 27    e.  For the state's share of support in conjunction with
 21 28 the city of Des Moines and local area businesses to provide a
 21 29 free shuttle service to the citizens of Iowa visiting the
 21 30 capitol complex that includes transportation between the
 21 31 capitol complex and the downtown Des Moines area,
 21 32 notwithstanding section 8.57, subsection 6, paragraph "c":

 23  2 for the use of Mercy capitol hospital, once acquired by the
 23  3 state, with any state agency or other governmental entity or
 23  4 political subdivision, as deemed appropriate by the
 23  5 department.
 23  6    Sec. 21.  2008 Iowa Acts, chapter 1179, section 1,
 23  7 subsection 13, paragraph c, is amended to read as follows:
 23  8    c.  For the construction of a depot and platform to
 23  9 accommodate the future Amtrak service from Dubuque to Chicago,
 23 10 notwithstanding section 8.57, subsection 6, paragraph "c":

 23 12    Sec. 22.  2008 Iowa Acts, chapter 1179, section 1,
 23 13 subsection 14, paragraph a, is amended to read as follows:

 23 16 which belong to the association of Iowa fairs:

 23 25 amended to read as follows:
 23 26    SEC. 6.  DEPARTMENT OF CORRECTIONS.  There is appropriated
 23 27 from the rebuild Iowa infrastructure fund to the department of
 23 28 corrections for the designated fiscal years the following
 23 29 amounts, or so much thereof as is necessary, to be used for
 23 30 the purposes designated:
 23 31    For expansion of the Iowa correctional facility for women
 23 32 at Mitchellville:
 23 33 FY 2010=2011 2011=2012............................ $ 11,700,000
 23 34 FY 2011=2012 2012=2013............................ $  8,779,000
 23 35    Notwithstanding section 8.33, moneys appropriated in this
 24  1 section for the fiscal year beginning July 1, 2010 2011, and
 24  2 ending June 30, 2011 2012, shall not revert at the close of
 24  3 the fiscal year for which they are appropriated but shall
 24  4 remain available for the purpose designated until the close of
 24  5 the fiscal year that begins July 1, 2013 2014, or until the
 24  6 project for which the appropriation was made is completed,
 24  7 whichever is earlier.
 24  8    Notwithstanding section 8.33, moneys appropriated in this
 24  9 section for the fiscal year beginning July 1, 2011 2012, and
 24 10 ending June 30, 2012 2013, shall not revert at the close of
 24 11 the fiscal year for which they are appropriated but shall
 24 12 remain available for the purpose designated until the close of
 24 13 the fiscal year that begins July 1, 2014 2015, or until the
 24 14 project for which the appropriation was made is completed,
 24 15 whichever is earlier.
 24 16    Sec. 24.  2008 Iowa Acts, chapter 1179, section 15,
 24 17 subsection 4, paragraph b, is amended to read as follows:
 24 18    b.  To the public broadcasting division for the purchase
 24 19 and installation of generators at transmitter sites:
 24 20 .................................................. $  1,602,437
 24 21    Of the amount appropriated in this lettered paragraph, up
 24 22 to $210,477 may be used for operational costs of the division
 24 23 for FY 2008=2009 and up to $1,000,000 may be used for
 24 24 operational costs of the division for FY 2009=2010,
 24 25 notwithstanding section 8.57C, subsection 2.
 24 26    Sec. 25.  2008 Iowa Acts, chapter 1186, section 20,
 24 27 subsection 2, is amended to read as follows:
 24 28    2.  Notwithstanding any provision of law to the contrary,
 24 29 the unencumbered or unobligated balances of the healthy Iowans
 24 30 tobacco trust at the close of available prior to the close of
 24 31 the fiscal year beginning July 1, 2008, or the endowment for
 24 32 Iowa's health account at the close available prior to the
 24 33 close of the fiscal year beginning July 1, 2008, or the close
 24 34 of any succeeding fiscal year shall be transferred to the
 24 35 general fund of the state.
 25  1    Sec. 26.  2009 Iowa Acts, Senate File 344, section 9,
 25  2 subsection 3, if enacted, is amended by striking the
 25  3 subsection and inserting in lieu thereof the following:
 25  4    3.  Effective July 1, 2009, all funds remaining in the
 25  5 accelerated career education account of the physical
 25  6 infrastructure assistance fund created in section 15E.175
 25  7 shall be transferred to the accelerated career education fund
 25  8 established in section 260G.6, subsection 1, as amended by
 25  9 this Act.
 25 10    Sec. 27.  EFFECTIVE AND RETROACTIVE APPLICABILITY DATES.
 25 11    1.  Except as provided in subsection 2, this division of
 25 12 this Act, being deemed of immediate importance, takes effect
 25 13 upon enactment.
 25 14    2.  The sections of this division of this Act, amending
 25 15 2008 Iowa Acts, chapter 1179, section 1, subsection 13,
 25 16 paragraph "c"; section 1, subsection 14, paragraph "a"; and
 25 17 section 15, subsection 4, paragraph "b", apply retroactively
 25 18 to July 1, 2008.
 25 19                          DIVISION VIII
 25 20                              CODE
 25 21                        AND MISCELLANEOUS
 25 22                             CHANGES
 25 23    Sec. 28.  Section 8.57, subsection 6, Code 2009, is amended
 25 24 by adding the following new paragraph:
 25 25    NEW PARAGRAPH.  i.  Annually, on or before December 31 of
 25 26 each year, a recipient of moneys from the rebuild Iowa
 25 27 infrastructure fund for any purpose shall report to the state
 25 28 agency to which the moneys are appropriated the status of all
 25 29 projects completed or in progress.  The report shall include a
 25 30 description of the project, the progress of work completed,
 25 31 the total estimated cost of the project, a list of all revenue
 25 32 sources being used to fund the project, the amount of funds
 25 33 expended, the amount of funds obligated, and the date the
 25 34 project was completed or an estimated completion date of the
 25 35 project, where applicable.
 26  1    Sec. 29.  Section 8.57C, subsection 3, paragraph b, Code
 26  2 2009, is amended to read as follows:
 26  3    b.  There is appropriated from the rebuild Iowa
 26  4 infrastructure fund for each the fiscal year of the fiscal
 26  5 period beginning July 1, 2008, and ending June 30, 2010 2009,
 26  6 the sum of seventeen million five hundred thousand dollars,
 26  7 and for the fiscal year beginning July 1, 2009, and ending
 26  8 June 30, 2010, the sum of fourteen million five hundred
 26  9 twenty=five thousand dollars to the technology reinvestment
 26 10 fund, notwithstanding section 8.57, subsection 6, paragraph
 26 11 "c".
 26 12    Sec. 30.  Section 12E.12, subsection 1, paragraph b,
 26 13 subparagraph (2), subparagraph division (b), Code 2007, as
 26 14 amended by 2008 Iowa Acts, chapter 1186, section 16, is
 26 15 amended to read as follows:
 26 16    (b)  For each fiscal year beginning July 1, 2009, the
 26 17 moneys deposited in the endowment for Iowa's health account of
 26 18 the tobacco settlement trust fund are transferred to the
 26 19 general fund of the state rebuild Iowa infrastructure fund.
 26 20 The moneys transferred shall be used for the purposes
 26 21 specified in section 12E.3A.
 26 22    Sec. 31.  Section 15.329, subsection 7, Code 2009, is
 26 23 amended by striking the subsection.
 26 24    Sec. 32.  Section 15F.201, Code 2009, is amended by adding
 26 25 the following new subsection:
 26 26    NEW SUBSECTION.  3.  "River enhancement community
 26 27 attraction and tourism project" means a project that creates
 26 28 or enhances recreational opportunities and community
 26 29 attractions on and near lakes or rivers or river corridors
 26 30 within cities across the state under the purview of the
 26 31 program.
 26 32    Sec. 33.  NEW SECTION.  15F.206  RIVER ENHANCEMENT
 26 33 COMMUNITY ATTRACTION AND TOURISM PROJECTS == APPLICATION
 26 34 REVIEW.
 26 35    1.  Applications for assistance for river enhancement
 27  1 community attraction and tourism projects shall be submitted
 27  2 to the department.  For those applications that meet the
 27  3 eligibility criteria, the department shall provide a staff
 27  4 review analysis and evaluation to the vision Iowa program
 27  5 review committee referred to in section 15F.304, subsection 2,
 27  6 and the board.
 27  7    2.  When reviewing the applications, the vision Iowa
 27  8 program review committee and the department shall consider, at
 27  9 a minimum, all of the following:
 27 10    a.  Whether the wages, benefits, including health benefits,
 27 11 safety, and other attributes of the project would improve the
 27 12 quality of life or the quality of attraction or tourism
 27 13 employment in the community.
 27 14    b.  The extent to which such a project would generate
 27 15 additional recreational and cultural attractions or tourism
 27 16 opportunities.
 27 17    c.  The ability of the project to produce a long=term,
 27 18 tax=generating economic impact.
 27 19    d.  The location of the projects and geographic diversity
 27 20 of the applications.
 27 21    e.  The project is primarily a vertical infrastructure
 27 22 project with demonstrated substantial regional or statewide
 27 23 economic impact.  For purposes of the program, "vertical
 27 24 infrastructure" means land acquisition and construction, major
 27 25 renovation and major repair of buildings, all appurtenant
 27 26 structures, utilities, site development, and recreational
 27 27 trails and water trails.  "Vertical infrastructure" does not
 27 28 include routine, recurring maintenance, or operational
 27 29 expenses or leasing of a building, appurtenant structure, or
 27 30 utility without a lease=purchase agreement.
 27 31    f.  Whether the applicant has received financial assistance
 27 32 under the program for the same project.
 27 33    g.  The extent to which the project has taken the following
 27 34 planning principles into consideration:
 27 35    (1)  Efficient and effective use of land resources and
 28  1 existing infrastructure by encouraging development in areas
 28  2 with existing infrastructure or capacity to avoid costly
 28  3 duplication of services and costly use of land.
 28  4    (2)  Provision for a variety of transportation choices,
 28  5 including pedestrian traffic.
 28  6    (3)  Maintenance of a unique sense of place by respecting
 28  7 local cultural and natural environmental features.
 28  8    (4)  Conservation of open space and farmland and
 28  9 preservation of critical environmental areas.
 28 10    (5)  Promotion of the safety, livability, and
 28 11 revitalization of existing urban and rural communities.
 28 12    3.  Upon review of the recommendations of the review
 28 13 committee, the board shall approve, defer, or deny the
 28 14 applications.
 28 15    4.  Upon approval of an application for financial
 28 16 assistance under the program, the board shall notify the
 28 17 treasurer of state regarding the amount of moneys needed to
 28 18 satisfy the award of financial assistance and the terms of the
 28 19 award.  The treasurer of state shall notify the department
 28 20 anytime moneys are disbursed to a recipient of financial
 28 21 assistance under the program.
 28 22    Sec. 34.  Section 15F.304, subsection 2, Code 2009, is
 28 23 amended to read as follows:
 28 24    2.  A review committee composed of eight members of the
 28 25 board shall review vision Iowa program applications and river
 28 26 enhancement community attraction and tourism project
 28 27 applications submitted to the board and make recommendations
 28 28 regarding the applications to the board.  The review committee
 28 29 shall consist of members of the board listed in section
 28 30 15F.102, subsection 2, paragraphs "d" through "h".
 28 31    Sec. 35.  Section 15F.304, Code 2009, is amended by adding
 28 32 the following new subsection:
 28 33    NEW SUBSECTION.  5.  The review committee shall consider,
 28 34 review, and make recommendations regarding applications for
 28 35 assistance for river enhancement community attractions and
 29  1 tourism projects a provided in section 15F.206.
 29  2    Sec. 36.  Section 15G.111, subsection 4, paragraph a, Code
 29  3 2009, as amended by 2009 Iowa Acts, Senate File 344, section
 29  4 2, if enacted, is amended to read as follows:
 29  5    a.  For administrative costs, an amount not more than one
 29  6 and one=half percent six hundred thousand dollars of the
 29  7 moneys subject to allocation under this subsection.
 29  8    Sec. 37.  Section 135.63, subsection 2, paragraph l,
 29  9 unnumbered paragraph 1, Code 2009, is amended to read as
 29 10 follows:
 29 11    The replacement or modernization of any institutional
 29 12 health facility if the replacement or modernization does not
 29 13 add new health services or additional bed capacity for
 29 14 existing health services, notwithstanding any provision in
 29 15 this division to the contrary.  With respect to a nursing
 29 16 facility, "replacement" means establishing a new facility
 29 17 within the same county as the prior facility to be closed.
 29 18 With reference to a hospital, "replacement" means establishing
 29 19 a new hospital that demonstrates compliance with all of the
 29 20 following criteria through evidence submitted to the
 29 21 department:
 29 22    Sec. 38.  1989 Iowa Acts, chapter 131, section 63, is
 29 23 amended to read as follows:
 29 24    SEC. 63.  Sections 455G.6 and 455G.7 are repealed effective
 29 25 July 1, 2009 2010, except as such sections apply with respect
 29 26 to any outstanding bonds issued thereunder, or refinancing of
 29 27 such outstanding bonds.
 29 28    Sec. 39.  Sections 12.101 and 12.102, Code 2009, are
 29 29 repealed.
 29 30    Sec. 40.  EFFECTIVE DATE.  The section of this division of
 29 31 this Act amending section 12E.12 takes effect June 30, 2009.
