  1 An Act relating to the council on human services and the state
  2    child care advisory council.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 217.2, Code 2009, is amended to read as
  1  2 follows:
  1  3    217.2  COUNCIL ON HUMAN SERVICES.
  1  4    1.  a.  There is created within the department of human
  1  5 services a council on human services which shall act in a
  1  6 policy=making policymaking and advisory capacity on matters
  1  7 within the jurisdiction of the department.  The council shall
  1  8 consist of seven voting members appointed by the governor
  1  9 subject to confirmation by the senate.  Appointments shall be
  1 10 made on the basis of interest in public affairs, good
  1 11 judgment, and knowledge and ability in the field of human
  1 12 services.  Appointments shall be made to provide a diversity
  1 13 of interest and point of view in the membership and without
  1 14 regard to religious opinions or affiliations.  Members The
  1 15 voting members of the council shall serve for six=year
  1 16 staggered terms.
  1 17    b.  Each term of a voting member shall commence and end as
  1 18 provided by section 69.19.
  1 19    c.  All voting members of the council shall be electors of
  1 20 the state of Iowa.  No more than four members shall belong to
  1 21 the same political party and no more than two members shall,
  1 22 at the time of appointment, reside in the same congressional
  1 23 district.  At least one member of the council shall be a
  1 24 member of a county board of supervisors at the time of
  1 25 appointment to the council.  At least one of the members shall
  1 26 also be a member of the state child care advisory council
  1 27 selected from nominees submitted by the advisory council.
  1 28 Vacancies occurring during a term of office shall be filled in
  1 29 the same manner as the original appointment for the balance of
  1 30 the unexpired term subject to confirmation by the senate.
  1 31    2.  In addition to the voting members described in
  1 32 subsection 1, the membership of the council shall include four
  1 33 legislators as ex officio, nonvoting members.  The four
  1 34 legislators shall be appointed one each by the majority leader
  1 35 of the senate, the minority leader of the senate, the speaker
  2  1 of the house of representatives, and the minority leader of
  2  2 the house of representatives for terms as provided in section
  2  3 69.16B.
  2  4    Sec. 2.  Section 237A.21, subsections 1 and 2, Code 2009,
  2  5 are amended to read as follows:
  2  6    1.  a.  A state child care advisory council is established
  2  7 consisting of not more than thirty=five voting members from
  2  8 urban and rural areas across the state.  The membership shall
  2  9 include, but is not limited to, all of the following persons
  2 10 or representatives with an interest in child care:  a licensed
  2 11 center provider, a registered child development home provider
  2 12 from a county with a population of less than twenty=two
  2 13 thousand, an unregistered a family, friend, and neighbor child
  2 14 care home provider, a parent of a child in child care, staff
  2 15 members of appropriate governmental agencies, and other
  2 16 members as deemed necessary by the director governor.  The
  2 17 voting members are eligible for reimbursement of their actual
  2 18 and necessary expenses while engaged in performance of their
  2 19 official duties.
  2 20    b.  For the purposes of this subsection, "family, friend,
  2 21 and neighbor child care" means child care, usually provided
  2 22 without cost and on a voluntary basis, by a family member, a
  2 23 friend, or a neighbor whose reason for providing that care is
  2 24 a strong existing personal relationship with a parent,
  2 25 guardian, or custodian and the parent's, guardian's, or
  2 26 custodian's child or children.
  2 27    2.  Members Except as otherwise provided, the voting
  2 28 members shall be appointed by the director governor from a
  2 29 list of names submitted by a nominating committee to consist
  2 30 of one member of the state council established pursuant to
  2 31 this section, one member of the department's child care staff,
  2 32 three consumers of child care, and one member of a
  2 33 professional child care organization.  Two names shall be
  2 34 submitted for each appointment.  Members The voting members
  2 35 shall be appointed for terms of three years but no member
  3  1 shall be appointed to more than two consecutive terms.  The
  3  2 state council shall develop its own operational policies which
  3  3 are subject to departmental approval.
  3  4    Sec. 3.  Section 237A.21, subsection 3, unnumbered
  3  5 paragraph 1, Code 2009, is amended to read as follows:
  3  6    The voting membership of the council shall be appointed in
  3  7 a manner so as to provide equitable representation of persons
  3  8 with an interest in child care and shall include all of the
  3  9 following:
  3 10    Sec. 4.  Section 237A.21, subsection 3, paragraph m, Code
  3 11 2009, is amended by striking the paragraph.
  3 12    Sec. 5.  Section 237A.21, subsection 3, Code 2009, is
  3 13 amended by adding the following new paragraphs:
  3 14    NEW PARAGRAPH.  n.  One person who is a business owner or
  3 15 executive officer.  Notwithstanding subsection 2, the nominees
  3 16 under this paragraph shall be submitted by the Iowa chamber of
  3 17 commerce executives.
  3 18    NEW PARAGRAPH.  o.  One designee of the community
  3 19 empowerment office of the department of management.
  3 20    NEW PARAGRAPH.  p.  One person who is a member of the Iowa
  3 21 afterschool alliance.
  3 22    NEW PARAGRAPH.  q.  One person who is part of a local
  3 23 program implementing the statewide preschool program for
  3 24 four=year=old children under chapter 256C.
  3 25    NEW PARAGRAPH.  r.  One person who represents the early
  3 26 childhood Iowa council created in section 135.173.
  3 27    Sec. 6.  Section 237A.21, Code 2009, is amended by adding
  3 28 the following new subsection:
  3 29    NEW SUBSECTION.  4.  In addition to the voting members, the
  3 30 membership shall include four legislators as ex officio,
  3 31 nonvoting members.  The four legislators shall be appointed
  3 32 one each by the majority leader of the senate, the minority
  3 33 leader of the senate, the speaker of the house of
  3 34 representatives, and the minority leader of the house of
  3 35 representatives for terms as provided in section 69.16B.
  4  1    Sec. 7.  Section 237A.22, Code 2009, is amended to read as
  4  2 follows:
  4  3    237A.22  DUTIES OF STATE CHILD CARE ADVISORY COUNCIL AND
  4  4 DEPARTMENT.
  4  5    1.  The state child care advisory council shall advise and
  4  6 make recommendations to the department, governor, and general
  4  7 assembly concerning child care.  In fulfilling this
  4  8 responsibility the advisory council shall do all of the
  4  9 following:
  4 10    1.  a.  Consult with the department and make
  4 11 recommendations to the department concerning policy issues
  4 12 relating to child care.
  4 13    2.  b.  Advise the department concerning services relating
  4 14 to child care, including but not limited to any of the
  4 15 following:
  4 16    a.  (1)  Resource and referral services.
  4 17    b.  (2)  Provider training.
  4 18    c.  (3)  Quality improvement.
  4 19    d.  (4)  Public=private partnerships.
  4 20    e.  (5)  Standards review and development.
  4 21    (6)  The federal child care and development block grant,
  4 22 state funding, grants, and other funding sources for child
  4 23 care.
  4 24    3.  c.  Assist the department in developing an
  4 25 implementation plan to provide seamless service to recipients
  4 26 of public assistance, which includes child care services.  For
  4 27 the purposes of this subsection, "seamless service" means
  4 28 coordination, where possible, of the federal and state
  4 29 requirements which apply to child care.
  4 30    4.  d.  Advise and provide technical services to the
  4 31 director of the department of education or the director's
  4 32 designee, upon request, relating to prekindergarten,
  4 33 kindergarten, and before and after school programming and
  4 34 facilities.
  4 35    e.  Make recommendations concerning child care expansion
  5  1 programs that meet the needs of children attending a core
  5  2 education program by providing child care before and after the
  5  3 core program hours and during times when the core program does
  5  4 not operate.
  5  5    f.  Make recommendations for improving collaborations
  5  6 between the child care programs involving the department and
  5  7 programs supporting the education and development of young
  5  8 children including but not limited to the federal head start
  5  9 program, the statewide preschool program for four=year=old
  5 10 children and the early childhood, at=risk, and other early
  5 11 education programs administered by the department of
  5 12 education.
  5 13    g.  Make recommendations for eliminating duplication and
  5 14 otherwise improving the eligibility determination processes
  5 15 used for the state child care assistance program and other
  5 16 programs supporting low=income families, including but not
  5 17 limited to the federal head start, early head start, and even
  5 18 start programs, the early childhood, at=risk, and preschool
  5 19 programs administered by the department of education, the
  5 20 family and self=sufficiency grant program, and the family
  5 21 investment program.
  5 22    h.  Make recommendations as to the most effective and
  5 23 efficient means of managing the state and federal funding
  5 24 available for the state child care assistance program.
  5 25    i.  Review departmental program data concerning child care
  5 26 as deemed to be necessary by the advisory council, although
  5 27 the department shall not provide personally identifiable data
  5 28 or information.
  5 29    j.  Advise and assist the early childhood Iowa council in
  5 30 developing the strategic plan required pursuant to section
  5 31 135.173.
  5 32    2.  The department shall provide information to the
  5 33 advisory council semiannually on all of the following:
  5 34    a.  Federal, state, local, and private revenues and
  5 35 expenditures for child care, including but not limited to
  6  1 updates on the current and future status of the revenues and
  6  2 expenditures.
  6  3    b.  Financial information and data relating to regulation
  6  4 of child care by the department and the usage of the state
  6  5 child care assistance program.
  6  6    c.  Utilization and availability data relating to child
  6  7 care regulation, quantity, and quality from consumer and
  6  8 provider perspectives.
  6  9    d.  Statistical and demographic data regarding child care
  6 10 providers and the families utilizing child care.
  6 11    e.  Statistical data regarding the processing time for
  6 12 issuing notices of decision to state child care assistance
  6 13 applicants and for issuing payments to child care providers.
  6 14    3.  The advisory council shall coordinate with the early
  6 15 childhood Iowa council in reporting annually to the governor
  6 16 and general assembly in December concerning the status of
  6 17 child care in the state, providing findings, and making
  6 18 recommendations.  The annual report may be personally
  6 19 presented to the general assembly's standing committees on
  6 20 human resources by a representative of the advisory council.
