1 An Act concerning persons voluntarily excluded from gambling
2 facilities.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 99D.7, Code 2007, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 22A. To require licensees to establish a
1 4 process by which a person who has been voluntarily excluded
1 5 for life from a racetrack enclosure and all other licensed
1 6 facilities under this chapter and chapter 99F may, after
1 7 having been excluded for at least five years, apply to revoke
1 8 that exclusion. A person shall not have their exclusion
1 9 revoked unless the application to revoke contains the written
1 10 consent of the person's spouse, if applicable. The process
1 11 established shall include a procedure that will allow any
1 12 person that has revoked their exclusion to request that the
1 13 lifetime exclusion be reinstated. A person that has
1 14 reinstated a lifetime exclusion shall not be permitted to
1 15 revoke that reinstated exclusion. The state and any licensee
1 16 under this chapter or chapter 99F shall not be liable to any
1 17 person for any claim which may arise from this process.
1 18 Sec. 2. Section 99F.4, Code Supplement 2007, is amended by
1 19 adding the following new subsection:
1 20 NEW SUBSECTION. 22A. To require licensees to establish a

1 22 for life from an excursion gambling boat and all other
1 23 licensed facilities under this chapter and chapter 99D may,
1 24 after having been excluded for at least five years, apply to
1 25 revoke that exclusion. A person shall not have their
1 26 exclusion revoked unless the application to revoke contains
1 27 the written consent of the person's spouse, if applicable.
1 28 The process established shall include a procedure that will
1 29 allow any person that has revoked their exclusion to request
1 30 that the lifetime exclusion be reinstated. A person that has
1 31 reinstated a lifetime exclusion shall not be permitted to
1 32 revoke that reinstated exclusion. The state and any licensee
