                                      A BILL FOR

  1 An Act allowing the director of the department of education to
  2    inform the regulatory boards of school districts, area
  3    education agencies, and community colleges when required
  4    report submissions are late and providing suspension of
  5    professional licenses in certain circumstances.

  1  1    Section 1.  Section 256.9, subsection 18, Code Supplement
  1  2 2007, is amended to read as follows:
  1  3    18.  a.  Prepare forms and procedures as necessary to be
  1  4 used by area education agency boards, district boards, school
  1  5 officials, principals, teachers, and other employees, and to
  1  6 insure uniformity, accuracy, and efficiency in keeping records
  1  7 in both pupil and cost accounting, the execution of contracts,
  1  8 and the submission of reports, and notify.
  1  9    b.  (1)  Notify the area education agency board, district
  1 10 board, or school authorities when a report has not been filed
  1 11 in the manner or on the dates prescribed by law or by rule
  1 12 that the school will not be accredited until the report has
  1 13 been properly filed.
  1 14    (2)  If a school district does not file a data or
  1 15 information report with the department on the date prescribed
  1 16 by law or rule, the department shall inform the school
  1 17 district of the overdue submission within fifteen days.  If a
  1 18 report is more than thirty days overdue, the department shall
  1 19 notify the school district board of directors and may inform
  1 20 the board of educational examiners of the school district's
  1 21 failure to comply with the reporting requirement.  The board
  1 22 of educational examiners is authorized to suspend the license
  1 23 of an administrator responsible for the school district's
  1 24 failure to comply with the reporting requirement.  A school
  1 25 district may apply to the department for an extension of a
  1 26 filing deadline.  For the purposes of this subparagraph,
  1 27 "administrator" means a superintendent or principal of a
  1 28 public school, or the authorities in charge at an accredited
  1 29 nonpublic school.
  1 30    Sec. 2.  Section 260C.5, subsection 5, Code 2007, is
  1 31 amended to read as follows:
  1 32    5.  a.  Administer, allocate, and disburse federal or state
  1 33 funds available to pay a portion of the operating costs of
  1 34 community colleges.
  1 35    b.  If a community college does not file a data or
  2  1 information report with the department on the date prescribed
  2  2 by law or rule, the department shall inform the community
  2  3 college of the overdue submission within fifteen days.  If a
  2  4 report is more than thirty days overdue, the department may
  2  5 notify the community college merged area board and the merged
  2  6 area board of directors of the community college's failure to
  2  7 comply with the reporting requirement.  A community college
  2  8 may apply to the department for an extension of a filing
  2  9 deadline.
  2 10    Sec. 3.  NEW SECTION.  273.14  REPORT DEADLINES ==
  2 11 PENALTIES.
  2 12    If an area education agency does not file a data or
  2 13 information report with the department on the date prescribed
  2 14 by law or rule, the department shall inform the area education
  2 15 agency of the overdue submission within fifteen days.  If the
  2 16 report is more than thirty days overdue, the department shall
  2 17 notify the area education agency board and may inform the
  2 18 board of educational examiners of the area education agency's
  2 19 failure to comply with the reporting requirement.  The board
  2 20 of educational examiners is authorized to suspend the license
  2 21 of an area education agency administrator responsible for the
  2 22 area education agency's failure to comply with the reporting
  2 23 requirement.  A school district may apply to the department
  2 24 for an extension of a filing deadline.  For the purposes of
  2 25 this section, "administrator" means a chief administrator,
  2 26 special education director, and other division administrators.
