  1 An Act relating to child abuse reporting and registry
  2    requirements.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 232.69, subsection 1, paragraph b, Code
  1  2 2005, is amended by adding the following new subparagraph:
  1  3    NEW SUBPARAGRAPH.  (13)  An employee or operator of a
  1  4 provider of services to children funded under a federally
  1  5 approved medical assistance home and community=based services
  1  6 waiver.
  1  7    Sec. 2.  Section 232.71D, subsection 3, paragraph i, Code
  1  8 2005, is amended by striking the paragraph.
  1  9    Sec. 3.  Section 235A.15, subsection 2, paragraph b,
  1 10 subparagraph (9), Code 2005, is amended by striking the
  1 11 subparagraph.
  1 12    Sec. 4.  Section 235A.15, subsection 2, paragraph c, Code
  1 13 2005, is amended by adding the following new subparagraphs:
  1 14    NEW SUBPARAGRAPH.  (12)  To an area education agency or
  1 15 other person responsible for providing early intervention
  1 16 services to children that is funded under part C of the
  1 17 federal Individuals with Disabilities Education Act.
  1 18    NEW SUBPARAGRAPH.  (13)  To a federal, state, or local
  1 19 governmental unit, or agent of the unit, that has a need for
  1 20 the information in order to carry out its responsibilities
  1 21 under law to protect children from abuse and neglect.
  1 22    Sec. 5.  Section 235A.15, subsection 2, paragraph e, Code
  1 23 2005, is amended by adding the following new subparagraph:
  1 24    NEW SUBPARAGRAPH.  (18)  To a person or agency responsible
  1 25 for the care or supervision of a child named in a report as an
  1 26 alleged victim of abuse or a person named in a report as
  1 27 having allegedly abused a child, if the juvenile court or
  1 28 department deems access to report data and disposition data by
  1 29 the person or agency to be necessary.
  1 30    Sec. 6.  Section 235A.15, subsection 3, paragraphs b and c,
  1 31 Code 2005, are amended to read as follows:
  1 32    b.  Persons involved in an assessment of child abuse
  1 33 identified in subsection 2, paragraph "b", subparagraphs (2),
  1 34 (3), (4), (6), and (7), and (9).
  1 35    c.  Others identified in subsection 2, paragraph "e",
  2  1 subparagraphs (2), (3), and (6), and (18).
  2  2    Sec. 7.  Section 235A.15, subsection 4, paragraph c, Code
  2  3 2005, is amended to read as follows:
  2  4    c.  Others identified in subsection 2, paragraph "e",
  2  5 subparagraph subparagraphs (2) and (18).
  2  6    Sec. 8.  Section 235A.19, subsection 2, paragraph b, Code
  2  7 2005, is amended by adding the following new subparagraph:
  2  8    NEW SUBPARAGRAPH.  (9)  For others identified in section
  2  9 235A.15, subsection 2, paragraph "d", subparagraph (7), and
  2 10 paragraph "e", subparagraphs (9) and (16).
